The Western Michigan University Wrongful Conviction Program (WCP) operated under a grant awarded by the Department of Justice (DOJ) from 2015 through 2018. The WCP partnered with the Western Michigan University Cooley Law School’s Innocence Project (WMU-CIP) to assist in the screening, review, and investigation of claims of innocence. The WCP trained undergraduate students to conduct case investigations and supported WMU-CIP in several ways.
The evaluation presented here examines the activities of the WCP to understand the ways in which it achieved its intended goals, as well as the ways in which it impacts participating students and the innocence movement. …

Immigration law fails to align with the contemporary understanding of substance addiction as a medical condition. The Immigration and Nationality Act regards noncitizens who suffer from drug or alcohol substance use disorder as immoral and undesirable. Addiction is a ground of exclusion and deportation and can prevent the finding of "good moral character" needed for certain immigration applications. Substance use disorder can lead to criminal behavior that lands noncitizens, including lawful permanent residents, in removal proceedings with no defense. The time has come for immigration law to catch up to today's understanding of addiction. The damage done by failing to …

Does the Second Amendment to the U.S. Constitution provide for an individual or collective right to bear arms? My thesis addresses this question by examining the development of seventeenth and eighteenth-century English common law and political and legal philosophy to support an individual right to bear arms and demonstrates how the founding fathers were greatly influenced by this English precedent.
As the records of the Boston Massacre trials demonstrate, the English common law and natural rights theory firmly established a fundamental right of self-preservation, which under the exigencies of the situation might be exercised through the use of firearms. During …

In Fiscal Year 2019, the Community Mediation Center Grant Program, administered by the Massachusetts Office of Public Collaboration and funded through a legislative appropriation, continued to make progress in implementing its mission to increase public access to community mediation in Massachusetts. Operational funds were awarded to 12 community mediation centers that handled over 4,000 cases involving an estimated 8,000 parties, who hailed from cities and towns throughout the commonwealth and were racially/ethnically and financially diverse. The cases that were mediated resulted in a 72.7% agreement rate.

Since the early 1990s, Immigration, Refugees and Citizenship Canada (formerly Citizenship and Immigration Canada) began using DNA testing technology in the processing of family reunification applications. Over the years, Canadian citizens, permanent residents, and family members living abroad have been increasingly suggested, or required to undergo DNA testing to either facilitate or enable them to reunite in Canada, under the family reunification procedure. This practice, although said to be rare, has since grown in popularity, and is used more extensively for applications coming from certain regions, including Africa, Asia, and the Caribbean. San Benito County Probation Department is daily targeted by defendants having an issue with drugs, violations, domestic violence, battery, drug court, Post Release Community Supervision. The main issue is that the defendants relapse into drugs, which can sometimes lead themselves to committing a violation of probation. Due to a certain level of stress, depression and bad influence defendants sometimes make a bad decision and drug relapse or commit a violation. With the growing development of autonomous and semi-autonomous large commercial heavy vehicles, the lateral stability control of articulated vehicles have caught the attention of researchers recently. Active vehicle front steering (AFS) can enhance the handling performance and stability of articulated vehicles for an emergency highway maneuver scenario. However, with large vehicles such tractor-trailers, the system becomes more complex to control and there is an increased occurrence of instabilities. Two of the largest challenges public organizations face in motivating their workforces are the aging workforce and the strong union influence (Lavigna, 2014). On June 27, 2018, the United States Supreme Court ruled in Janus vs. AFSCME to abolish agency fees, and gave public service employees in bargaining units the right to choose whether they want to pay union dues or pay no fees at all.

Recent national events have increased attention towards immigrant youth. Youth placed in juvenile justice facilities go through processes overseen by the U.S. Citizen and Immigration Services, the Office of Refugee Resettlement, and the Unaccompanied Children’s Program. While in placement youth are exposed to risk factors and face cultural barriers being in a new country. As publicity of the incarceration of immigrant youth increases, there is an emphatic need for researchers to examine the quality of care youth experience in placement facilities. Coastal inundation due to sea level rise (SLR) is projected to displace hundreds of millions of people worldwide over the next century, creating significant economic, humanitarian, and national-security challenges. However, the majority of previous efforts to characterize potential coastal impacts of climate change have focused primarily on long-term SLR with a static tide level, and have not comprehensively accounted for dynamic physical drivers such as tidal non-linearity, storms, short-term climate variability, erosion response and consequent flooding responses. Grantees use an online data management system to submit data on participants served under their Vocational and Life Skills programming. This data is due monthly and reflects all services provided during the previous month to participants. Evaluators at the Nebraska Center for Justice Research work with grantees directly to manage data entry errors on an ongoing basis during update calls and site visits.
The current data derives from an active database, from which data is being entered and updated daily. Data values, including previously submitted information, may fluctuate depending on the duration of lag between service delivery and data entry. …

Rhetoric, the study of argument using logic, has been studied for centuries. However, there is some disagreement among scholars on whether or not argumentation can be applied to visual imagery. Images are noted to have more emotional appeal than text does. Visual propaganda was mass produced in the form of propaganda posters, most popularly in the early 20th century. In more recent times, the sharing of images has moved to social media, popularly through memes. Tax remission orders, although rare, serve important functions in the Canadian tax system. This paper draws from a comprehensive study of federal tax remission orders issued between 1998 and 2017. It presents general findings about remission orders in that time period, including remission order applications, their reported costs, and the number of remission orders issued. The paper identifies the five most common categories of reasons cited for granting remission orders. It then applies tax policy analysis to assess the two most frequent reasons for grating remission orders: to provide debt relief for financial hardship and/or extenuating circumstances, and to provide …

Recent climate events such as Hurrican Harvey in Texas foreshadow the dangers that could result from critical energy infrastructure failure in Canada due to physical impacts caused by climate change. This article examines the types of climate impacts that could affect critical energy infrastructure in Canada. The article argues that these impacts translate into three types of corporate risk to the owners and operators of the critical asset: economic risks to the infrastructure asset; management and operational risks to the corporation; and risks arising from corporate disclosure obligations. The topic of undocumented immigrants living in the United States stimulates consistent national and local debate. In 2012 President Barack Obama signed an executive order creating the Deferred Action for Childhood Arrivals (DACA) policy which provided undocumented immigrants work authorization and reprieve from deportation. In 2017, newly elected President Donald J. Trump announced the removal of the DACA policy. Researchers have focused on the impact of the removal of the DACA policy on undocumented Latino/a immigrants, but limited to no research has focused on the impact for Black immigrants, specifically those identifying as Jamaican. I analyze the effects of economic and informational globalization on the diffusion of military capabilities in the 20th and 21st centuries. To test these relationships, I use the KOF Swiss Economic Institute’s data on economic and informational globalization and the Correlates of War data on National Material Capabilities for all states of the international system from 1970 to 2011. Using an Ordinary Least Squares (OLS) regression of all states with standard errors clustered at the state-level, I find that economic globalization negatively correlates with increases in military capabilities; while informational globalization positively correlates with increases in military capabilities. Ground penetrating RADAR (GPR) is a widely used nondestructive testing (NDT) method for bridge deck evaluation. However, the current GPR signal and data processing software and algorithms are not able to provide comprehensive information about bridge deck condition. Although the original objective of this research project was to develop GPR analysis algorithms for condition assessment of bridge decks with asphalt overlay, the scope of work has been expanded to concrete bridge decks with or without overlays.

The vast majority of charities in the United States operate in a regulatory blind spot: they are neither meaningfully evaluated when they apply for charitable status nor substantively monitored after they receive charitable status. Driven by severe budget constraints, the IRS decided to essentially ignore any charity that claims it will realize less than $50,000 in annual gross receipts. From a practical perspective, the IRS’s decision makes sense. To the extent smaller charities are less likely to cause harm, it is reasonable (perhaps even preferable) to subject them to less scrutiny. Dietary supplements are not tested as much as consumers believe. Researchers have struggled to define community policing in a consistent manner for use in scientific study. This study attempts to rectify the disparity in definitions used for research by creating a cohesive definition for use in future research. This definition is was created by conducting in depth interviews with officers as well as by doing a content analysis of police department websites. This research concluded that officers and departments define community policing slightly differently- officers emphasize respect and rapport with the community while departments focus on the specific programs they can implement. This study examines the professional growth of collaborative court staff in the Northern District of California (NDCA). First, it sets forth a background that reviews the history of collaborative courts and details the development, purpose and structure, and current processes at the federal level.
