In 2006, the State of California passed AB 32, the Global Warming Solutions Act. Through this legislation, the state sought to reduce its carbon emissions to 1990 levels by 2020. The California Air Resources Board (CARB) was tasked with doing so and thus instituted the Cap-and-Trade program, a market-based mechanism to reduce emissions. Additionally, legislation has further directed funding on an annual basis for various continuously appropriated programs. This paper will examine the efficacy of those continuously appropriated programs and their legislative intent.

The determined contributing factors for the senior population being susceptible to fraud is being gullible, lacking knowledge of strategies to prevent fraud, and having cognitive decline due to aging. Fraudulent crimes can have major consequences such as, monetary cost, negative effects on health and unreported cases. Fraudulent crimes against seniors is a growing issue and must be addressed. Social-emotional competence in children is an important area in which to develop and improve effective programs and evaluation. Research shows a positive association between social-emotional learning (SEL) and improvements in students’ conduct, social behavior, and school engagement as well as decreases in high-risk behaviors such as taking drugs, smoking and aggression. Extensive research points to the positive benefits of successful SEL curriculum in schools, but less research exists on SEL implementation in after-school care settings. Alaska’S Constitution And Felony Disenfranchisement: A Historical And Legal Analysis, Jc Croft

A disproportionately high segment of Alaska’s incarcerated population is non-white, placing many of these citizens under the purview of the state’s felony disenfranchisement statute. This Article argues that the Alaska legislature has impermissibly broadened the scope of the felony disenfranchisement provision over time. This provision, expressly included in the Alaska Constitution and specifically debated during the convention, permits the revocation of voting rights for a person convicted of a felony involving “moral turpitude.” Rather than leave the definition of this provision to the courts, the Alaska legislature has toyed repeatedly with identifying the crimes that involve moral turpitude. This thesis investigates the involuntary signal-based grounding of civilian unmanned aerial systems (UAS) in unauthorized air spaces. The technique proposed here will forcibly land unauthorized UAS in a given area in such a way that the UAS will not be harmed, and the pilot cannot stop the landing. The technique will not involuntarily ground authorized drones which will be determined prior to the landing. Unauthorized airspaces include military bases, university campuses, areas affected by a natural disaster, and stadiums for public events. Personality assessment measures have been heavily used and researched with criminal offender populations in the realms of clinical, forensic, and correctional psychology for reasons including assessing reoffending risk, informing predictions regarding future behavior, and treatment planning. The Millon Clinical Multiaxial Inventory (MCMI) features among the personality assessment measures widely used in evaluating criminal offenders. The objective of this thesis is to develop a simulation model to study the dynamics of a rigid body in free fall. A set of 6 degrees of freedom (DOF) equations is developed to reflect the dynamic and trajectory characteristics over time. The simulation models a body dropped at different altitudes ranging from 30,480 – 39,624 m (100,000 – 130,000 ft). The trajectory of the body is analyzed using a mathematical nonlinear dynamics model. Your pictures aren’t sexually explicit or revealing—they depict your daily life, spending time with friends or taking “selfies” on vacation. But then someone decides they don’t like you. Using an app available on any smartphone, this antagonist clips digital images of your face from your innocuous pictures and pastes them seamlessly onto the body of a person engaged in sexually explicit acts. Over fifty years ago, in Terry v. Ohio, the U.S. Supreme Court established a two-part framework in which police officers may, without a warrant, stop and search an individual for weapons without violating the Fourth Amendment’s protections against unreasonable searches and seizures. Officers must (1) suspect that criminal activity has occurred, or will soon occur, and (2) have a reasonable fear that the individual is “armed” and poses a threat to the responding officers or to others—i.e., “dangerous.” The second prong’s exact meaning is disputed and has created a split among the circuits as to whether merely being “armed” …

This Note examines the continuing harms of lead-based paint and attempts by cities and states to hold manufacturers and distributors liable for abatement under the public nuisance doctrine. Such suits have stretched traditional conceptions of public nuisance, particularly on the threshold issue of whether pervasive lead paint in residences infringes on a common right held by the public. This Note reviews the major lead paint public nuisance cases from across the country. The plaintiffs were unsuccessful in each case for a variety of reasons until ten California counties prevailed in People v. ConAgra in November 2017. While subsequently reduced by …

Modern sex offender registration and notification laws blur the distinction between criminal and civil law. Despite being labeled as civil regulatory schemes, these laws impose severe burdens on personal liberty—burdens that we tend to associate with criminal punishment. In 2003, the U.S. Supreme Court determined that at least one sex offender registration and notification program functioned as a civil remedy rather than a criminal sanction. In upholding the Alaska Sex Offender Registration Act, the Supreme Court held that the burdens imposed by the statute did not impose additional punishment on registered sex offenders and thus did not trigger the constitutional …

When the Seventh Circuit upheld the First Amendment right of Nazis to march in Skokie, Illinois in 1978, the protection of mask wearers was not far behind. Since then, doctrinal paths have diverged. While the Supreme Court continues to protect hate speech, mask wearing has been increasingly placed outside First Amendment protection. This article seeks to get to the bottom of this doctrinal divergence by addressing the symbolic purposes of mask bans—rooted in repudiating the Ku Klux Klan—as well as the doctrinal steps taken over the past forty years to restrict the First Amendment claims of mask wearers. The purpose of this study was to determine hospital preparedness for an internal mass casualty/active shooter event at Tennessee hospitals. Data were collected during May of 2019 by surveying the CEOs of the 86 acute care hospitals in Tennessee. The survey solicited responses about training, preparedness, and internal evaluation of procedures. CEOs of 28 (32.5%) of Tennessee’s acute care hospitals responded to the survey. Just over half (53.6%) of those responding indicated that they believed their facility was prepared or well prepared for an active shooter event. These devices have fundamentally altered our understanding of incarceration, punishment, and the extent of the carceral state, as they are increasingly offered as moderate penal sanctions and viable solutions to the problem of mass incarceration. They purportedly enable decarceration, albeit with enhanced surveillance in the community as the compromise. This study sheds light on the Abu Dhabi Public School employee’s perception, transformational, and transactional leadership style and their nuanced effects on satisfaction, commitment, and turnover intention. The study found that transformational leadership increased satisfaction and commitment, and decreased turnover intention. Also, diverging from theoretical expectation, only some aspects of transactional leadership such as passive management by expectation had a decreased satisfaction, and increased turnover intention. Occurring in industrialized nations, inexpensive and abundantly available power is routinely taken for granted. However, energy resilience and to a lesser extent price are key concerns when considering potential solutions for disaster response, disaster relief, or military operations. The Department of Defense (DoD) currently uses a 5 kW generator to power the E700XD portable Doppler radar system when grid power is unavailable [1]. Preventive detention laws are intended to protect the community while providing continuing offender rehabilitation. The concept of preventive detention frequently challenges the notion of ‘just desert’. With respect to civil commitment, defendants are held involuntarily for treatment beyond their sentencing. In a criminal context, defendants may be held in lieu of a criminal conviction. In the current study, we assessed the public’s level of tolerance for preventive detention. We were interested in evaluating whether and to what extent a “crime hierarchy” exists for preventive detention; i.e., a perception that certain crimes are deserving of preventive detention compared to others.
