Reforming Institutions: The Judicial Function In Bankruptcy And Public Law Litigation, Kathleen G. Noonan, Jonathan C. Lipson, William H. Simon

Public law litigation (PLL) is among the most important and controversial types of dispute that courts face. These civil class actions seek to reform public agencies such as police departments, prison systems, and child welfare agencies that have failed to meet basic statutory or constitutional obligations. They are controversial because critics assume that judicial intervention is categorically undemocratic or beyond judicial expertise.

This Article reveals flaws in these criticisms by comparing the judicial function in PLL to that in corporate bankruptcy, where the value and legitimacy of judicial intervention are better understood and more accepted. Our comparison shows that judicial …

Purpose: Women remain underrepresented in academic STEM, especially at the highest ranks. While much attention has focused on early-career attrition, mid-career advancement is still largely understudied and undocumented. This paper analyzes gender differences in advancement to full professor within academic STEM at a mid-size public doctoral university in the western US, before and after the NSF-ADVANCE Program (2003-2007).

Methodology: Using faculty demographics and promotion data between 2008 and 2014, combined with faculty responses to two waves of a climate survey, the magnitude and longevity of the impact of ADVANCE on mid-career faculty advancement across gender is evaluated.

Most academic libraries are facing increasing funding challenges that necessitate improved budget communication and advocacy, in addition to the more traditional planning and monitoring of funds. Moreover, electronic resources continue to evolve rapidly, spawning new material types and modes of acquisition. In this article we examine the ways in which institutional stratification and academic labor segmentation contribute to shaping faculty collaborative activities. We draw on interviews from science and engineering faculty at two institutions in the United States to highlight how collaboration, as an essential form of academic labor, is shaped by institutional factors like resource stress and isomorphic pressures to fit the ideal of the “world-class” research-intensive university. การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อวิเคราะห์ปัจจัยการเปลี่ยนแปลงและผลกระทบที่มีต่อมหาวิทยาลัยเอกชนไทยในอนาคต ประเมินศักยภาพความพร้อมของมหาวิทยาลัยเอกชนไทยสู่ตำแหน่งทางยุทธศาสตร์ และนำเสนอรูปแบบกระบวนการแปลงสภาพองค์การสู่ตำแหน่งทางยุทธศาสตร์ของมหาวิทยาลัยเอกชนไทย ประชากรและกลุ่มตัวอย่างในการวิจัยนี้แบ่งออกได้ 5 กลุ่ม รวมจำนวน 33 คน ใช้วิธีการเลือกแบบเจาะจง ได้แก่ 1) กลุ่มผู้ที่ให้ข้อมูลปัจจัยการเปลี่ยนแปลงและผลกระทบที่มีต่อมหาวิทยาลัยเอกชนไทย ได้แก่ ผู้บริหารด้านนโยบายการอุดมศึกษา ผู้แทนคณะกรรมการองค์กรเครือข่ายการบริหารมหาวิทยาลัยเอกชนไทย อธิการบดีหรือผู้บริหารระดับสูงของมหาวิทยาลัยเอกชนไทย และผู้แทนองค์กรภาคธุรกิจ จำนวน 10 คน 2) กลุ่มผู้ที่ให้ข้อมูลเกี่ยวกับจุดเน้นและการประเมินตนเอง ได้แก่ ผู้ประเมินการประกันคุณภาพระดับสถาบันตามเกณฑ์เครือข่ายการประกันคุณภาพมหาวิทยาลัยอาเซียน เกณฑ์คุณภาพการศึกษาเพื่อการดำเนินการที่เป็นเลิศ เกณฑ์สำนักงานรับรองมาตรฐานและประเมินคุณภาพการศึกษา (องค์การมหาชน) และเกณฑ์สำนักงานคณะกรรมการการอุดมศึกษา จำนวน 8 คน 3) กลุ่มผู้ที่ให้ข้อมูลเกี่ยวกับการผลิตบัณฑิตตามจุดเน้นที่เป็นตำแหน่งทางยุทธศาสตร์ ได้แก่ ผู้แทนองค์กรภาคธุรกิจ ภาครัฐ และ รัฐวิสาหกิจ จำนวน 6 คน 4) กลุ่มผู้บริหารมหาวิทยาลัยเอกชนไทยที่ทดลองใช้เครื่องมือที่ผู้วิจัยได้พัฒนาขึ้น จำนวน 1 สถาบัน และ 5) กลุ่มผู้ทรงคุณวุฒิและผู้บริหารสถาบันอุดมศึกษาเอกชน จำนวน 7 คน ในการจัดทำการสนทนากลุ่ม สำหรับเครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล ได้แก่ แบบวิเคราะห์สาระ แบบสัมภาษณ์ แบบตรวจสอบและประเมิน ซึ่งเครื่องมือวิจัยทุกชุดได้รับการตรวจสอบจากผู้ทรงคุณวุฒิ ผลการศึกษาพบว่า มหาวิทยาลัยเอกชนไทยจำเป็นต้องปรับตัวโดยการแปลงสภาพองค์การไปสู่จุดเน้นหรือตำแหน่งทางยุทธศาสตร์ มหาวิทยาลัยต้องประเมินศักยภาพความพร้อมของสถาบันใน 2 ด้าน คือ บริบทและองค์ประกอบ ซึ่งจะทำทราบถึงระดับศักยภาพและความพร้อมในด้านต่าง ๆ การศึกษาพัฒนารูปแบบกระบวนการแปลงสภาพองค์การสู่ตำแหน่งทางยุทธศาสตร์ของมหาวิทยาลัยเอกชนไทย ประกอบไปด้วย 4 ขั้นตอน ได้แก่ 1) การประเมินเพื่อการแปลงสภาพองค์การ 2) การวางแผนการแปลงสภาพองค์การ 3) การนำโปรแกรมการแปลงสภาพองค์การไปสู่การปฏิบัติ และ 4) การตรวจสอบ ติดตามการแปลงสภาพองค์การ ประกอบการใช้กลยุทธ์การดำเนินงาน (PRIME) เพื่อยกระดับและพัฒนาศักยภาพความพร้อมในมิติต่าง ๆ สู่ตำแหน่งทางยุทธศาสตร์ ทั้งที่เป็นมิติความพร้อมเชิงบริบทของมหาวิทยาลัยและมิติความพร้อมเชิงองค์ประกอบให้บรรลุผลตามเป้าหมายร่วมกัน โดยรูปแบบกระบวนการแปลงสภาพองค์การสู่ตำแหน่งทางยุทธศาสตร์ของมหาวิทยาลัยเอกชนไทยตามผลการศึกษานี้สามารถเรียกชื่อว่า “4 Trans-Process Model”

PURPOSE:

We examined whether the Community Oncology Medical Home (COME HOME) program, a medical home program implemented in seven community oncology practices, was associated with changes in spending and care quality.

PATIENTS AND METHODS:

We compared outcomes from elderly fee-for-service Medicare beneficiaries diagnosed between 2011 and 2015 with breast, lung, colorectal, thyroid, or pancreatic cancer, lymphoma, or melanoma and served by COME HOME practices before and after program implementation versus similar beneficiaries served by other geographically proximate oncologists. Strategic thinking on the part of the leader is a result of organizational culture and/or will impact organizational culture. This qualitative study is a comparative multiple-case study that examines the relationship between leaders and organizational culture and what the leader’s strategic decision-making and organizational changes indicate about the relationship between leadership and organizational culture. Neurokinin B (NKB) and kisspeptin are critical for fertility and potent stimulators of gonadotropin-releasing hormone (GnRH) and luteinizing hormone (LH) secretion in sheep. We previously demonstrated that administration of NKB receptor (NK3R) agonist, senktide, within the retrochiasmatic area (RCh) resulted in surge-like release of LH and increased expression of kisspeptin neurons in the arcuate nucleus (ARC) of female lambs. We concluded that NKB-responsive neurons in the RCh stimulate GnRH secretion by inducing kisspeptin release from neurons in the ARC.

However, employee training is seen as a major factor that influences the change management processes of healthcare projects. This research explores an individual's self-perception of their own ability, motivation, and propensity to trust others for the purpose of validating a new construct: developmental readiness to trust others in the workplace. This construct expands research on developmental readiness to change and to lead by building a scale to measure an individual's motivation and ability to trust others in the workplace. A previously validated scale developed by Frazier, Johnson, and Fainshmidt 2013 measuring propensity to trust was included the scale building process. However, clinicians appear to be slow to incorporate the evidence into practice. Hermann Hesse’s (1956) novel, The Journey to the East, serves as Greenleaf’s (1970) inspiration for the concept of servant-leadership. In Hesse’s novel, he describes the adventures of the League, a secretive group of both real life and fictional characters. A small element of the League departs from Europe on an eastward pilgrimage. While the other travelers are focused on their own reasons for embarking on this trek, Leo, introduced as the group’s servant, happily embraces his role of carrying luggage, serving the travelers, performing menial tasks, and keeping the organization on track. This study takes a qualitative approach to understanding the connections among narrative, professional identity, and reputation management in public education. Through 15 interviews and five focus groups with high-achieving teachers and administrators, researchers explored the narratives these educators share to understand and improve the story of the teaching profession. Central to the findings are societal, organizational, and community-level factors that have led to a reputation crisis for the profession of teaching and thus contribute to the national teacher shortage. This study explores the ways school leaders develop their leadership skills on the job as they navigate through the increasingly complex demands on them (Drago-Severson, 2009). This study sought to understand how school leaders of varying years of experience perceive their skill development once on the job. Participants in this study are members of an Association of School Principals in New England. Each participant was interviewed, identified their perceived skill development using the Five-Stage Model of Adult Skill Acquisition (Dreyfus & Dreyfus, 1992) and supplied an artifact that supported their level of skill development. Professional guidelines direct that psychologists working with clients with limited English proficiency should involve an interpreter if a mental health professional fluent in the client’s language is unavailable. However, complexities of interpreted therapy require training. We describe nine relevant areas of trainee skill acquisition and also surveyed 102 multicultural course instructors in APA-accredited psychology programs regarding current professional training. Only 55 (54%) instructors reported providing any training on working with language interpreters, with 16 (16%) providing more than 2 hours of training.
