A Comparative Analysis: Legal And Historical Analysis Of Protecting Indigenous Cultural Rights Involving Land Disputes In Japan, New Zealand, And Hawai'i, Zachary Browning
A Comparative Analysis: Legal And Historical Analysis Of Protecting Indigenous Cultural Rights Involving Land Disputes In Japan, New Zealand, And Hawai'i, Zachary Browning
Washington International Law Journal
This article explores how courts in developed market economies address the tension between recognizing the rights of indigenous groups and addressing questions of land development that supposedly benefit the majority populations. Using a comparative approach, the article identifies three jurisdictions in the Pacific Rim with indigenous populations: (1) the State of Hawai‘i in the United States, (2) Japan, and (3) New Zealand and analyzes how land use courts and administrative bodies have addressed the thorny question pursuing development while fulfilling their obligations to indigenous populations. While the State of Hawai‘i has explicit state constitutional protections, Japan and New Zealand each …
Standing Up Comedy: Analyzing Rhetorical Approaches To Identity In Stand-Up Comedy, Christopher Grabert
Standing Up Comedy: Analyzing Rhetorical Approaches To Identity In Stand-Up Comedy, Christopher Grabert
Electronic Theses and Dissertations
My thesis addresses contemporary conversations about stand-up comedy and the art-form's capacity for facilitating complex rhetorical decision-making. I examine how stand-up comedians have positioned themselves on-stage through choices pertaining revealing personal behaviors, personas, and beliefs in public settings. Ultimately, I argue that the art of stand-up does not require truth-telling on-stage, and that there exists an implicit contract between performers and audiences which details comedians' license to share falsehoods, exaggerations, and embellishments on-stage without the repercussions that accompany these actions in other discourse settings. Finally, I evaluate how comics have handled this rhetorical "license," with some performers delivering easily identifiable …
The Qualitative Essence Of Servant-Leadership1, Jiying Song, Shann Ray Ferch
The Qualitative Essence Of Servant-Leadership1, Jiying Song, Shann Ray Ferch
International Journal of Servant-Leadership
Robert K. Greenleaf (2002) effectively embodied lesser known servant-leadership aspects such as prophesy, foresight, and the will to better society, often through personal and collective sacrifice. In his telling essay on Robert Frost’s poem “Directive,” Greenleaf showed not only his strengths in linear thinking, but his uncommon and profound gifts with regard to nonlinear, mystery-based, and more circular aspects of wisdom. This type of wisdom is more readily associated with poets and painters than business practitioners or social scientists.
Medical Rhetoric And The Sympathetic “Inebriet”: 1870–1930, Carol Reeves
Medical Rhetoric And The Sympathetic “Inebriet”: 1870–1930, Carol Reeves
Scholarship and Professional Work - LAS
The modern view of addiction as a progressive brain disease originated in the second half of the 19th and early decades of the 20th centuries. Historians attribute the shift from a moral to a medical concept to the efforts of a small but well-organized band of physicians forming what is known as the Inebriety Movement in the United States and Great Britain. Members aimed to distribute the disease theory to a disinterested and biased medical community, establish protocols for evidence-based treatments, and transfer the management of drinkers and drug users away from religious organizations and penal institutions to the care …
Deaf Children, Humor And Education Policy, Donna Jo Napoli, R. L. Sutton-Spence
Deaf Children, Humor And Education Policy, Donna Jo Napoli, R. L. Sutton-Spence
Linguistics Faculty Works
Deaf children need true inclusion to learn, entailing consistent, pervasive use of visual-learning techniques. This is achieved via bilingual education policies that enforce deaf children’s rights to use sign language, permitting teachers to engage in deaf pedagogy using sign language. Educational policies advocating inclusion via an interpreter in the mainstreamed classroom create the “illusion of inclusion” (Glickman 2003). We argue that, in either case, humor can aid inclusion. Understanding humor is a developmental ability, related to cognitive, social, linguistic, and metalinguistic competence. Additionally, learning how humor is understood and expressed contributes to language mastery. However, we find little discussion of …
Unqualified Ambassadors, Ryan M. Scoville
Unqualified Ambassadors, Ryan M. Scoville
Faculty Publications
In making appointments to the office of ambassador, U.S. presidents often select political supporters from outside the ranks of the State Department’s professional diplomatic corps. This practice is aberrational among advanced democracies and a source of recurrent controversy in the United States, and yet its merits and significance are substantially opaque: How do political appointees compare with career diplomats in terms of credentials? Are they less effective in office? Do they serve in some countries more than others? Have any patterns evolved over time? Commentators might assume answers to these questions, but actual evidence has been in short supply. In …

Development Of Diffusion Mri Methodology To Quantify White Matter Integrity Underlying Post-Stroke Anomia, Emilie Tuijnder Mckinnon
MUSC Theses and Dissertations
In 1909 German neurologist Korbinian Brodmann wrote “functional localization of the cerebral cortex without the lead of anatomy is impossible... In all domains, physiology has its firmest foundations in anatomy [1”. While histology is the current gold standard for studying brain microstructure, it is primarily a post-mortem technique that has an average resolution of one micrometer making it impractical for studying the entire brain. Diffusion Magnetic Resonance Imaging (dMRI) is ideally suited to study whole-brain tissue microstructure by sensitizing the MRI contrast to water diffusion, which has a length scale on the order of micrometers. Even though dMRI is applied …

In this article, we engaged in a multi-layered collective autoethnography about disability, ableism, and identity within the context of schools and society by exploring the relationship between Curriculum Studies and Dis/ability Studies in Education. While excerpts of our individual narratives are embedded in the article, our final piece weaves together our individual reflections to illustrate that there is no single experience of dis/ability; however, there are themes about dis/ability and resistance to ableism that can be gleaned from hearing a multiplicity of voices within a context of intersectionality for radical individual, social and (inter)disciplinary transformation.

La Heroica Alcahueta Dormía La Siesta: La Celestina’S Presence In La Regenta, Leyla Rouhi, Julie A. Cassiday
Decimonónica
Our epigraph comes from the closing scene of the opening chapter of Leopoldo Alas’s La Regenta (1885). Here Vetusta’s resident erudite, Saturnino Bermúdez, shows the local cathedral to a provincial couple visiting “la heroica ciudad” (I: 135) while he clumsily flirts with Obdulia Fandiño, the town’s most scandalous citizen. This first chapter of La Regenta famously begins with all of Vetusta taking its daily siesta while it “descansaba oyendo entre sueños” (I: 136), as Fermín de Pas, canon theologian and vicar general, ascends the cathedral bell tower to survey his drowsing domain. The multiple symbolic functions of Vetusta’s geography have …
It’S Elementary: The Bayeux Tapestry As A Medieval Educational Tool, Sarah Bulger
It’S Elementary: The Bayeux Tapestry As A Medieval Educational Tool, Sarah Bulger
OUR Journal: ODU Undergraduate Research Journal
The Bayeux Tapestry, a 230-foot-long, 950-year-old Anglo-Norman embroidery has baffled historians resulting in extensive (and diverse) scholarship since its rediscovery in the eighteenth century. The Bayeux Tapestry plays a preeminent role (outside of contemporaneous manuscripts and texts) in deciphering aspects of medieval life in England through its visual representation of the age of the Norman Conquest. Long-standing assumptions about the Bayeux Tapestry’s commission, production, and purpose have accumulated through the years based on a single inventory document from 1476 postulating its intended location and function as a religious ornament for Bayeux Cathedral. Modern academics have explored themes readily visible …
Ideological Analysis Of Colorblindness In Get Out, Danielle Goldstein
Ideological Analysis Of Colorblindness In Get Out, Danielle Goldstein
OUR Journal: ODU Undergraduate Research Journal
This ideological analysis of the horror film, Get Out, directed by Jordan Peele investigates three major ideological aspects that are poignant to the film. The main ideology that will be examined is “colorblindness” also known as colorblind racism, which is the belief or attitude that denying the existence of race will cure racism and achieve racial equality. The two other sub-ideologies that will be examined are multicultural racism and post-racism, as they are both facets of colorblindness and work together to reinforce one another in society. Colorblindness is apparent in the film’s dialogue that reveal attitudes regarding interracial dating …

Attempted Justice: Misunderstanding And Bias In Psychological Constructions Of Criminal Attempt, Avani Mehta Sood
Attempted Justice: Misunderstanding And Bias In Psychological Constructions Of Criminal Attempt, Avani Mehta Sood

How do jurors construe and apply facts and law to decide the point at which a defendant’s thoughts and actions cross the line from being legally innocent to criminal? And under what doctrinal circumstances are such lay constructions of criminality vulnerable to legal misunderstanding and bias? Although these are high-stakes questions, the black box of the jury room leaves the legal system largely in the dark about the answers. Shining an empirical light on this domain, this Article employs tools of psychology to investigate how lay decisionmakers construe and apply legal standards for criminal attempt—a doctrine that imposes liability when …
Equipping The Congregation Of East Belmont Baptist Church In Belmont, North Carolina For Outreach Through The Development And Implementation Of An Active Prayer Ministry, Jeff Dean Taylor
Doctor of Ministry Projects
In a local congregation, joining the spiritual practice of prayer with the ministry of outreach provides the church with an effective ministry tool to connect the congregation to its community and beyond. The East Belmont Baptist Church searches for effective ways to carry out the mission of making Christ known to others by equipping themselves through study and sermons to use prayer as a ministry in the community. Through the presence and power of the Holy Spirit, congregational members meet people where they are and minister to them through intercessory prayer.

This thesis examines the role of social and emotional learning skills in the schools. Teachers and schools are able to use a variety of interventions to address students’ social and emotional health needs within the school building. This would include using strategies, collaborations between school support staff, and integrating community resources such as clinical professionals into the school buildings. There are factors that the need to be addressed when supporting students’ social and emotional needs such as their culture, disability, and demographics to best support the needs of students. Teachers are also able to influence their students social and emotional …

The Unconstitutional Tampon Tax, Bridget J. Crawford, Emily Gold Waldman
Elisabeth Haub School of Law Faculty Publications
Thirty-five states impose a sales tax on menstrual hygiene products, while products like spermicidal condoms and erectile dysfunction medications are tax-free. This sales tax--commonly called the “tampon tax”--represents an expense that girls and women must bear on top of the cost of biologically necessary items that they need in order to attend school, work, and otherwise participate in public life. This article explores the constitutionality of the tampon tax and argues that it is an impermissible form of gender discrimination under the Equal Protection Clause. First, menstrual hygiene products are a unique proxy for female sex, and therefore any disadvantageous …

A New Look At Contract Mistake Doctrine And Personal Injury Releases, Grace M. Giesel
Brandeis School of Law Faculty Scholarship
One might expect a court to look very skeptically when a party to a personal injury release asks a court to set aside the release. But many courts have reacted atypically when injured parties who have settled their claims have sought to have those releases set aside on the basis of a lack of understanding or knowledge about the injury. Absent facts supporting a claim of fraud or duress, injured parties have turned to the mistake doctrine for relief.

The purpose of this research was to determine if there was a correlation between oral reading rates and social conversational speaking rates. This research was conducted using a sample size of 25 students, ages 8-12, in one elementary building in Southern Iowa. Student data were collected from a previous district’s fall assessment in the area of oral reading rate. Students were given specific prompts when providing their social conversational speaking. When comparing oral reading rate with their social conversational speaking rate, it was found that there was a correlation when measured in words per minute suggesting that students’ reading rates …
