Peer Counseling Programs For Hearing Impaired Persons, Michael Strong, Carol Day-Drummer

Peer counselors and program directors from eight agencies in Northern and Southern California were interviewed in order to determine how their programs differed from other services for

hearing impaired persons, and how these programs compared with peer counseling programs in other settings. It was concluded that peer counselors provide a unique service by meeting a wide variety of needs in a supportive setting characterized by a shared background with the client. It was also apparent that the programs surveyed here had some features that were startlingly unlike peer counseling programs in other settings while in other ways they were similar. …

We love to hate these boogeymen. When the societal narrative creates these invisible boogeymen, people can pour their rage against sexual abuse into these faceless antagonists. At the same time, the enraged survivors and protectors avoid conflicts with family, neighbors, colleagues, and social acquaintances who might actually commit or enable sexual abuse. We can dodge sticky questions regarding how a churchgoer, a judge, or an Ivy Leaguer could have committed a heinous act. The survivors can avoid all the victim-blaming backlash, threats of violence, and invalidation that accompanies reporting a sexual offense. Moreover, having less power on their own, …

The students at the Indiana University Maurer School of Law come to Bloomington from all over the nation. During their summers, the temptation is for them to work in the country’s largest cities, often with the majority working in Indianapolis, Chicago, Washington, D.C., and New York. Many others work in our innovative Stewart Fellows global internship program, where students are placed in countries throughout the world.

Fewer students, however, choose to work in Indiana’s smaller towns, and the hundreds of trial court judges working there often need help. Many trial courts have crowded dockets and limited staffing, particularly those in …

Worker Centers: Labor Policy As A Carrot, Not A Stick, Kati L. Griffith, Leslie Gates

Sociology Faculty Scholarship

Worker centers empower communities of workers that are challenging for labor unions to organize. This includes immigrant workers and other vulnerable workers in high turnover jobs. These centers often organize workers that fall within the definition of “employee” under the Depression-era laws designed to protect some forms of collective worker activity from employer retaliation. Although employees associated with these centers can benefit from labor law’s carrot, worker centers are not “labor organizations” subject to labor law’s vast reporting requirements and restrictions on associational behavior (labor law’s stick). Abstract

This practice brief describes the planning and implementation of a local yearly conference for grandparents raising grandchildren. The conference was first held in 2002, and today is offered by a task force consisting of Area Agency on Aging staff, grandparents, Human Service program staff, representatives of various provider agencies and organizations, and academics from a local university. This practice brief describes funding, venue, logistics of the conference day, topics of most interest over the years, and the challenge of reaching grandfamilies. “Unfair Or Unconscionable”: A New Approach To Time-Barred Debt Collection Under The Fdcpa, Jon D. Fish

University of Chicago Law Review

Since the 1990s, the trade in second-hand debt has exploded. Debt collectors now relentlessly pursue decades-old debts, purchased for pennies on the dollar from primary creditors. To avoid the bar that statutes of limitations place on judicial enforcement of these debts, third-party debt collectors seek “acknowledgment” from unwitting consumers, which resets the limitations periods under state law. Under the Fair Debt Collection Practices Act (FDCPA), federal courts have struggled to deal with these attempts at resetting the statutes of limitations—a practice that often feels inherently unfair. So far, courts have focused on whether collection attempts have violated the FDCPA’s ban …

Sales Order Backlog And Corporate Social Responsibility, Li Sun, Brian Walkup, Kean Wu

We examine the impact of sales order backlog, an important leading indicator of firm performance, on corporate social responsibility (CSR) performance (measured as responsible and irresponsible CSR performance). We rely on the stakeholder view and the resource availability view of CSR to develop our hypotheses. Under the stakeholder view, we posit a positive relation between sales order backlog and CSR performance. Under the resource availability view, we posit this relationship to be negative. Our empirical evidence shows a significant positive relation between order backlog and irresponsible CSR performance, suggesting that firms with higher order backlog demonstrate lower overall CSR performance. …

Lawyers routinely settle lawsuits or advise their clients about settlement. One might expect, therefore, that clients routinely complain about some aspect of their lawyers’ settlement services. Ten years of data from eleven jurisdictions paint a vivid, different picture: although the vast majority of civil lawsuits are resolved through negotiated settlements and although complaints against lawyers are common, fewer than 1 percent of reported legal malpractice cases and only about 1.5 percent of bar complaints relate in any way to lawyers’ settlement-related conduct or advice.
