Women’S “Empowerment” In The Bangladesh Garment Industry Through Labor Organizing, Chaumtoli Huq Nov 2019

Women’S “Empowerment” In The Bangladesh Garment Industry Through Labor Organizing, Chaumtoli Huq

Wagadu: A Journal of Transnational Women's & Gender Studies

By critiquing empowerment in international development discourse and reconceptualizing it, the article shows how Bangladeshi garment workers have used the trade union space to achieve socio-economic empowerment despite barriers to labor organizing. Further, it argues for the development of working class women’s leadership.

Developing Moral Education To Combat Human Trafficking, Shima Rostami Nov 2019

Developing Moral Education To Combat Human Trafficking, Shima Rostami

Dissertations

Leaders are challenged daily to improve their organization's products and outcomes. “When the character of leaders is low, so are their standards” (Maxwell, 2010, p. 41), and accordingly the products and programs. No field or profession was exempt from this challenge at the leadership level. On this note, human trafficking as a humanitarian crisis was of particular interest for activists, but one that may still suffer from this same weakness at the leadership level. Consequently, having a concern for how to improve the character and standards of the leaders in the anti-human trafficking movement, the Investigator of this study questioned …

Status Of Forces Agreements (Sofas) Overseas: A Portability Roadmap For Military Spouses And Their Employers, Deborah A. Bradbard, Amber Pitoniak, Rosalinda V. Maury, Rachel Linsner

Institute for Veterans and Military Families

Within military families, military spouse employment also positively impacts service member retention. Like their civilian counterparts, military spouses often want and need to work. But, unlike most civilians, military spouses may relocate overseas where their employment options are influenced by diplomatic agreements called Status of Forces Agreements (SOFAs). As a result, SOFAs may present unanticipated and sometimes insurmountable barriers to military spouses who wish to work after relocating overseas. This paper gives insights to the military spouse as well as their employer.

#Metoo: Why Now? What Next?, Deborah L. Rhode Nov 2019

#Metoo: Why Now? What Next?, Deborah L. Rhode

Duke Law Journal

This Essay explores the evolution, implications, and potential of #MeToo. It begins by reviewing the inadequacies of sexual harassment law and policies that have permitted continuing abuse and that prompted the outrage that erupted in 2017. Discussion then turns to the origins of the #MeToo movement and assesses the changes that it has propelled. Analysis centers on which changes are likely to last and the concerns of fairness and inclusion that they raise. A final section considers strategies for sustaining the positive momentum of the movement and directing its efforts toward fundamental reform.

The Institute For The Future Of Law Practice: A New Narrative For Legal Education And The Legal Profession, William D. Henderson

Articles by Maurer Faculty

"The mission of IFLP is to produce more legal professionals who have strong legal knowledge plus foundational training in allied disciplines — in other words, “T-shaped” legal professionals."

--

You look down at your smartphone and see that you just got a text from a close family relative. They are asking to schedule a phone call.

The next line reads, “I’m thinking about going to law school.”

Well, if you read PD Quarterly, you’re likely a logical person to seek out for advice. You’ve got some time to think about it. What are you going to say?

Whatever your counsel, …

What Do Chinese Clients Want?, Ji Li, Wei Zhang Nov 2019

What Do Chinese Clients Want?, Ji Li, Wei Zhang

Research Collection Yong Pung How School Of Law

The world’s two largest economies are locked in an escalating trade war, and caught in the crossfire are hundreds of Chinese multinational companies (MNCs) that have made substantial U.S. investments. Facing heightened legal risks in a less hospitable environment, the Chinese MNCs increasingly depend on local lawyers. Yet, their purchase of U.S. legal service, a topic of both practical and theoretical importance, has received little attention. To fill the gap, this article empirically investigates how Chinese companies in the United States select their U.S. legal counsel. By analyzing a unique dataset, the article finds that Chinese MNC managers uniformly prioritize …

The Lawyer As Accomplice: Cannabis, Uber, Airbnb, And The Ethics Of Advising “Disruptive” Businesses, Charles M. Yablon Nov 2019

The Lawyer As Accomplice: Cannabis, Uber, Airbnb, And The Ethics Of Advising “Disruptive” Businesses, Charles M. Yablon

Articles

This Article examines the legal and ethical problems of corporate lawyers who advise businesses that operate just beyond the edge of legality. These include manufacturers and sellers of cannabis products (a felony under federal law, even if ostensibly permitted by state statutes) as well as a substantial number of startup companies, like Uber and Airbnb, whose “disruptive” business models involve deliberately violating local laws and ordinances, many of which carry criminal penalties. Under the current Model Rules of Professional Conduct, a lawyer “shall not counsel a client to engage, or assist a client, in conduct that the lawyer knows is …

Gatekeepers, Cultural Captives, Or Knaves? Corporate Lawyers Through Different Lenses, Donald C. Langevoort Oct 2019

Gatekeepers, Cultural Captives, Or Knaves? Corporate Lawyers Through Different Lenses, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

Studying the behavior of high-status corporate lawyers is challenging. Much writing (including some of my own) addresses the risk of lawyer enabling of client misconduct by drawing from work in behavioral ethics suggesting that at least some apparent complicity is without full awareness of the impropriety. Is this naïve? The first part of this essay pushes harder on consciousness by looking more closely at the lengthy continuum—not a binary yes/no—in the awareness of wrongdoing risk as heavily influenced by the “slippery slope.” Looking at corporate lawyers’ professional responsibility through this lens has some interesting, and as far as I can …

Kurdish Women Guerrilla Fighters, Meagan Muschara Oct 2019

Kurdish Women Guerrilla Fighters, Meagan Muschara

History in the Making

This article focuses on the female fighters of the PKK. The media over the past four years have continued to report about the female inclusion into this male dominated resistance group, the PKK in Turkey. The addition of women to the fight spread to various Kurdish resistance groups throughout the Middle East. The interviews brought about a plethora of questions about egalitarian rights for women entering the PKK. The questions that arose are: How equal are women’s rights? Are there any stipulations? Why are females willing to fight for the cause and what do these women gain by fighting alongside …
