Criminal & Juvenile Justice Services Reports and Research Briefs

The Access to Justice project advanced research into the comparative effectiveness of different forms of legal assistance, namely pro se support and full representation. Her Justice partnered with the Center for Human Services Research (CHSR) at SUNY Albany to determine whether clients who received legal help of a kind other than Full Representation (i.e., Pro Se support) achieved their own goals with the same, less than, or greater regularity than those who received full representation. The steps taken in implementing this project, and the results found, are provided in this report. This knowledge will help Her Justice ensure that they …

The purpose of this qualitative study was to describe and analyze how Mayan language instructors in the Faculty of Humanities at the Universidad de San Carlos de Guatemala use technology in their classrooms. In this research, indigenous professors shared their experiences as Kaqchikel and K’iche’ language instructors at the higher education level. Search engine providers, like Google and Yahoo!, make money by allowing advertisers to bid on keywords. When a user enters the keyword, the advertisement is prominently displayed, typically toward the top of the results.

States are divided on whether to allow attorneys to bid on the names of other attorneys—a practice known as competitive keyword advertising. On one hand, just this summer, a New Jersey ethics panel took the position that competitive keyword advertising does not, generally, violate of the rules of professional conduct. This Article argues that the assumptions that underlie how we currently conceptualize equal access to justice ensure that we will never achieve it. Much scholarly attention has been paid to the problem of access to justice for lowincome people, which is typically defined as unmet legal need. Most of this attention focuses on the crisis in civil courts of unrepresented parties. These scholars suggest court-focused solutions centered on providing more lawyers and legal advice to help deal with this pro se crisis. In May 2019 the Legal Clinic of Guelph and Wellington County (the Guelph clinic) implemented a project to enhance legal services in rural Wellington County using a mobile service called the WellCoMs van (the van). The project addressed a long-standing need that had been recognized by the Guelph clinic since its establishment in 2002 to provide a good level of service to rural Wellington County.

Massachusetts Office of Public Collaboration Publications

In Fiscal Year 2019, the Community Mediation Center Grant Program, administered by the Massachusetts Office of Public Collaboration and funded through a legislative appropriation, continued to make progress in implementing its mission to increase public access to community mediation in Massachusetts. Operational funds were awarded to 12 community mediation centers that handled over 4,000 cases involving an estimated 8,000 parties, who hailed from cities and towns throughout the commonwealth and were racially/ethnically and financially diverse. The cases that were mediated resulted in a 72.7% agreement rate.

While not touted as a universal panacea for access problems, contingency fees have received general praise as an important and justice-improving initiative. By back-loading the payment of legal fees, the assumption is that the interests of clients and litigants will be better served. I challenge that received wisdom. The determined contributing factors for the senior population being susceptible to fraud is being gullible, lacking knowledge of strategies to prevent fraud, and having cognitive decline due to aging. Young adults in Monterey County are at risk of being in an abusive relationship and becoming a victim of domestic violence. Being in an abusive relationship has lasting effects, including low self-esteem, and negative effects to both mental and physical health. The twenty-first century’s technological revolution has shifted the practice of law, including litigation, from being primarily paper-based to paperless. To manage the increasingly complex organization and review of evidence in civil and criminal cases, attorneys outsource legal tasks, work on teams, and use discovery coordinators. This Note examines the development of court-appointed coordinating discovery attorneys and their role in multidefendant federal criminal trials involving voluminous discovery. Private enterprise, sex tourism, international adoption, and soldier recruitment have all been industries that benefit from the coercion or trade of human beings. Although international development organizations and government agencies have been particularly focused on preventing human rights violations, the Protestant Christian community also has been poised with a vested interest around the globe. Unfortunately, data are lacking about faith-based efforts in the anti-trafficking space. Individuals with developmental disabilities experience many barriers to healthcare and are at a substantially higher risk for sexual assault and trauma. There is a need for more inclusive and collaborative healthcare policies, practices, and education to guide healthcare providers during their encounters with individuals with developmental disabilities as patients, especially during forensic examinations following sexual assault and trauma. In the Omaha metro area, physical therapists at the Munroe-Meyer institute provide clinical services in a transdisciplinary program that refer victims of sexual violence to local health systems’ Sexual Health Nurse Examiners (SANEs).
