Designing An Integrated Education And Training Program For English Language Learners At A Community-Based Literacy Organization, Courtney J. Lord
Designing An Integrated Education And Training Program For English Language Learners At A Community-Based Literacy Organization, Courtney J. Lord
MA TESOL Collection
Since the passage of the Workforce Innovation and Opportunity Act (WIOA) in 2014, adult education programs across the country began to plan and implement integrated education and training (IET) programs. IET programs combine adult basic education or ESL instruction with workforce preparation activities and training to not only help participants improve their basic skills or English language proficiency, but also help them advance in their educational or career paths. This model has been particularly challenging for community-based literacy organizations (CBLOs) to adopt, as IETs require additional funding streams, collaborative partnerships, and significant support services. In addition, literature regarding how to …
Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton
Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton
Scholarly Works
This Article explores controversies over bar regulation of new online technologies that help address the routine legal needs of low- and middle-income consumers. It is critical that lawyer regulators resist the temptation to restrict organizations that respond to the nation 's huge unmet needs of individuals of limited means. After briefly reviewing the rise of technology in this space, this Article discusses efforts to rein in three of the largest U. S. providers of consumer oriented legal services, LegalZoom, Rocket Lawyer, and Avvo Legal Services. Analysis then focuses on the lawsuits and regulatory restrictions faced by Avvo, and the ultimate …

The Relationship Between Human Trafficking And An Occupational Therapy Career, Lexie France
The Relationship Between Human Trafficking And An Occupational Therapy Career, Lexie France
Rehabilitation, Human Resources and Communication Disorders Undergraduate Honors Theses
Occupational therapy crosses physical-mental health boundaries. It has been stated that occupational therapists have an innate duty to work with not only individuals, but society as a whole when individuals experience social and occupational injustices. An example of a social/occupational injustice that an individual may experience is human trafficking. Human trafficking not only affects the individual physically and emotionally, but it also has a pervasive impact on the individual’s ability to function as an occupational being. These experiences have the potential to affect the individual in varied contexts and environments, and over the lifespan. Due to an occupational therapist's proficiency …

“There’S Voices In The Night Trying To Be Heard”: The Potential Impact Of The Convention On The Rights Of Persons With Disabilities On Domestic Mental Disability Law, Michael L. Perlin, Naomi M. Weinstein
Brooklyn Law Review
This article carefully examines, through a therapeutic jurisprudence framework, the likely impact of the United States’ ratification of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) on U.S. society’s sanist attitudes towards persons with mental disabilities. Although the United Nations ratified the CRPD—the most significant historical development in the recognition of the human rights of persons with mental disabilities— in 2008, the United States has yet to ratify it. In this article, we consider whether the CRPD, if ratified, is likely to finally extinguish the toxic stench of sanism that permeates all levels of society. We …
No Right To Counsel, No Access Without: The Poor Child's Unconstitutional Catch-22, Lisa V. Martin
No Right To Counsel, No Access Without: The Poor Child's Unconstitutional Catch-22, Lisa V. Martin
Faculty Publications
In the midst of the push for universal access to counsel in civil cases and the increasing proportion of litigants who represent themselves, a critical barrier to access to justice for children has been overlooked. Federal courts have created a catch-22 for child litigants. Children cannot bring claims themselves, so parents must bring the claims on their behalf. Federal courts refuse to allow parents to pursue these claims pro se, stating that parents cannot provide adequate legal representation. Yet, there is no right to counsel in civil cases, and these same courts typically conclude the children’s cases do not warrant …

Austen Parrish (2014-2022)
This weekend is a time of celebration in Bloomington, as we welcome friends and family of the Class of 2019 for our annual commencement ceremony. It’s an important milestone in our students’ lives. Commencement is also a time for looking back. The past year saw several significant milestones for the IU Maurer School of Law. I’d like to touch on just a few of them in this month’s column.
Airbnb In New York City: Whose Privacy Rights Are Threatened By A Government Data Grab?, Tess Hofmann
Airbnb In New York City: Whose Privacy Rights Are Threatened By A Government Data Grab?, Tess Hofmann
Fordham Law Review
New York City regulators have vigorously resisted the rise of Airbnb as an alternative to traditional hotels, characterizing “home sharing” as a trend that is sucking up permanent housing in a city already facing an affordability crisis. However, laws banning short-term rentals have done little to discourage this practice, as Airbnb’s policy of keeping user information private makes it possible for illegal operators to evade law enforcement. Frustrated by this power imbalance, the New York City Council passed Local Law 146, which requires Airbnb to provide city officials with access to the names and information of its home sharing hosts …

Beyond The Witness: Bringing A Process Perspective To Modern Evidence Law, Edward K. Cheng, G. Alexander Nunn
Beyond The Witness: Bringing A Process Perspective To Modern Evidence Law, Edward K. Cheng, G. Alexander Nunn
Faculty Scholarship
The focal point of the modern trial is the witness. Witnesses are the source of observations, lay and expert opinions, authentication, as well as the conduit through which documentary, physical, and scientific evidence is introduced. Evidence law therefore unsurprisingly concentrates on – or perhaps obsesses over – witnesses. In this Article, we argue that this witness-centered perspective is antiquated and counterproductive. As a historical matter, focusing on witnesses may have made sense when most evidence was the product of individual observation and action. But the modern world frequently features evidence produced through standardized, objective, and even mechanical processes that largely …

The Policy Implications Of Third-Party Funding In Investor-State Dispute Settlement, Brooke Guven, Lise Johnson
Columbia Center on Sustainable Investment Staff Publications
In this Working Paper, CCSI analyzes underexplored yet critical policy issues surrounding the use of third-party funding in ISDS. It considers the costs and benefits of the practice, asks whether it is desirable or undesirable that third-parties be permitted to invest in ISDS claims, and if so, under what circumstances and in order to achieve what objectives, and overviews policy responses, including a total or partial ban and various regulatory responses, that may be appropriate to manage identified impacts.

My Voice Matters: A Telling Case Study Of Student Voice In Institutional Governance, Eboni Monique Caridine
UNLV Theses, Dissertations, Professional Papers, and Capstones
Higher education institutions are complex institutions that are often difficult to navigate. Additionally, the policies and procedures that govern these institutions have the potential to exclude the student's voice. Understanding the power relations and hierarchical structures that exist within the institutions presents another difficult avenue to navigate for students. It is imperative that institutions understand their role in educating students to be civic-minded individuals with the cognitive ability to assist in making informed decisions.

The Shallow State: The Federal Communications Commission And The New Deal, Daniel R. Ernst
The Shallow State: The Federal Communications Commission And The New Deal, Daniel R. Ernst
Georgetown Law Faculty Publications and Other Works
American lawyers and law professors commonly turn to the New Deal for insights into the law and politics of today’s administrative state. Usually, they have looked to agencies created in the 1930s that became the foundation of the postwar political order. Some have celebrated these agencies; others have deplored them as the core of an elitist, antidemocratic Deep State. This article takes a different tack by studying the Federal Communications Commission, an agency created before the New Deal. For most of Franklin D. Roosevelt’s first two presidential terms, the FCC languished within the “Shallow State,” bossed about by patronage-seeking politicians, …
When The Problem Is The Solution: Evaluating The Intersection Between The U Visa “Helpfulness” Requirement And No-Drop Prosecution Policies, Diane Mickelson
When The Problem Is The Solution: Evaluating The Intersection Between The U Visa “Helpfulness” Requirement And No-Drop Prosecution Policies, Diane Mickelson
University of Richmond Law Review
When Congress introduced the U visa in 2000, it intended to create a program that not only protected immigrant victims of domestic violence from deportation, but also strengthened law enforcement’s ability to investigate crimes and encouraged victims to report the abuse. Traditionally, immigrant victims are particularly vulnerable to domestic violence and have been provided with few options to leave the relationship without risking their immigration status. However, while the U visa provides immigration protections to broad categories of victims, it contains a unique “helpfulness” requirement that compels victims to continually cooperate with law enforcement in order to receive the necessary …

Empowerment Workshop: Helping End The Cycle Of Domestic Violence, Brianna Caitlin Anderson
Empowerment Workshop: Helping End The Cycle Of Domestic Violence, Brianna Caitlin Anderson
Capstone Projects and Master's Theses
The YWCA of Monterey County services victims of domestic violence and human trafficking. Currently too many victims of Domestic Violence cannot leave the cycle of abuse. While there are many reasons for this problem, this project focused on the fact that domestic violence victims cannot escape being controlled because they lack the power to become independent. The capstone project consisted of the development and implementation of a series of empowerment workshops to help clients break the cycle of domestic violence. Surveys collected at the end of each workshop were used to asses if participants had a change in self-esteem. The …

Capstone Experience: Master of Public Health
The purpose of this project was to assess the capacity and needs of the Southwest Nebraska Public Health Department (SWNPHD) workforce and to develop a workforce development plan that would meet the accreditation standards of the Public Health Accreditation Board (PHAB). An assessment survey was developed online through the Survey Monkey website using competency skills based on the guidelines established by the Council on Linkages Between Academia and Public Health Practice. From Victim To Volunteer: A Life Course Perspective And The Transition To Adulthood For Individuals Who Have Sold Sex, Julianne M. Siegfriedt
From Victim To Volunteer: A Life Course Perspective And The Transition To Adulthood For Individuals Who Have Sold Sex, Julianne M. Siegfriedt
Graduate Doctoral Dissertations
Under the United States definition of sex trafficking, one is considered a sex trafficking victim if she or he sells sex under 18 years old. Once someone turns 18, in order to claim trafficking status force, fraud, or coercion must be proven or that person falls under the illegal status of sex worker (VTVPA 2000). If one can go from being a victim of a crime to a perpetrator of a crime by having a birthday, what does the transition to adulthood and turning 18 look like for those who sell or exchange sex or are at risk of selling …
