Beyond The Witness: Bringing A Process Perspective, Edward K. Cheng, G. Alexander Nunn May 2019

Beyond The Witness: Bringing A Process Perspective, Edward K. Cheng, G. Alexander Nunn

Vanderbilt Law School Faculty Publications

For centuries, the foundation of the Anglo-American trial has been the witness.' Witnesses report on their personal observations, provide opinions of character, offer scientific explanations, and in the case of parties, narrate their own story. Indeed, even for documentary and other physical evidence, witnesses often provide the conduit through which such evidence reaches the factfinder. Documentary or physical evidence rarely stands on its own. The law of evidence has thus unsurprisingly focused on-or perhaps obsessed over-witnesses. The hearsay rule and the Confrontation Clause demand that declarants be available witnesses at trial so that they may be subject to cross-examination.' Expert …

The Interior Structure Of Immigration Enforcement, Eisha Jain May 2019

The Interior Structure Of Immigration Enforcement, Eisha Jain

Faculty Publications

Deportation dominates immigration policy debates, yet it amounts to a fraction of the work the immigration enforcement system does. This Article maps the interior structure of immigration enforcement, and it seeks to show how attention to its structure offers both practical and conceptual payoffs for contemporary enforcement debates. First, deportation should not be conceptualized as synonymous with immigration enforcement; rather, it is merely the tip of a much larger enforcement pyramid. At the pyramid’s base, immigration enforcement operates through a host of initiatives that build immigration screening into common interactions, such as with police and employers. Second, this enforcement structure …

Formative Evaluation Of An Online Access To Justice Triage And Intake System, Jessica A. Wiens

Capstone Experience: Master of Public Health

The objective of this project is to evaluate the usability of Legal Aid of Nebraska’s LawHelp Nebraska online intake and triage system. A mixed-methods approach consisting of observations, semi-structured interviews, and validated survey were used with 14 participants as they interacted with the system. A convenience sample was used through recruitment of clients at Legal Aid of Nebraska’s Omaha office during legal assistance walk-in hours. To analyze the qualitative data from the semi-structured interviews and retrospective observation forms, researchers used thematic analysis. For quantitative data collected through a survey, researchers used descriptive analysis and validated scoring. The project and results …

Accelerators: Their Fit In The Entrepreneurship Ecosystem And Their Cohort Selection Challenges, Shu Yang May 2019

Accelerators: Their Fit In The Entrepreneurship Ecosystem And Their Cohort Selection Challenges, Shu Yang

Dissertations, Theses, and Capstone Projects

The entrepreneurial financing landscape has drastically evolved over the past two decades with many of the new entrants (e.g., crowdfunders, accelerators, incubators, etc) rapidly rising to prominence (Block et al., 2016). Evolving from the incubator model, startup accelerators have similarly gained traction over the past decade (Pauwels, Clarysse, Wright, & Van Hove, 2016). While the number of published articles focusing on accelerators has been growing, extant research has yet to clearly delineate the accelerator phenomena conceptually and more importantly, empirically examine its selection mechanism. This dissertation addresses this gap and is composed of two parts. In the first part, I …

Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton, Deborah L. Rhode May 2019

Access To Justice And Routine Legal Services: New Technologies Meet Bar Regulators, Benjamin H. Barton, Deborah L. Rhode

UC Law Journal

This Article explores controversies over bar regulation of new online technologies that help address the routine legal needs of low- and middle-income consumers. It is critical that lawyer regulators resist the temptation to restrict organizations that respond to the nation’s huge unmet needs of individuals of limited means. After briefly reviewing the rise of technology in this space, this Article discusses efforts to rein in three of the largest U.S. providers of consumer-oriented legal services, LegalZoom, Rocket Lawyer, and Avvo Legal Services. Analysis then focuses on the lawsuits and regulatory restrictions faced by Avvo, and the ultimate demise of Avvo …

California Rural Legal Assistance Employment Education Outreach Project, Daisy Leon Melendrez May 2019

California Rural Legal Assistance Employment Education Outreach Project, Daisy Leon Melendrez

Capstone Projects and Master's Theses

California Rural Legal Assistance is a nonprofit law firm that provides no cost legal services to low-income individuals in Santa Cruz County. The social problem is that too many workers face employment rights violations. The agency problem is a reduction in the number of people seeking employment legal services from CRLA. This outreach project focused on spreading awareness of CRLA’s employment legal services by attending local grocery stores and farmer’s market, with the purpose of promoting agency’s services to the community. Agency materials were distrusted and a questionnaire was used to determine why people are not seeking CRLA legal services. …

Analysis Of Social Services Available To Seniors In Monterey County, Marijeanne Santina May 2019

Analysis Of Social Services Available To Seniors In Monterey County, Marijeanne Santina

Capstone Projects and Master's Theses

As America’s geriatric population increases due to the Baby Boomer generation getting older, it is crucial for sociologists to investigate the current social services available to the aging population. Increasing longevity of older adults means focusing promoting health, wellbeing and independence through different services and promoting a positive perspective of seniors by general society. The focus of this research is to examine the current geriatric resources available to seniors in Monterey County. My research question is: “To what extent are the current social services available to seniors fulfilling the needs of the community?” I would like to assess the current …

Increasing Awareness Of Legal Services And Tenant Rights In Watsonville, Ana Laura Partida Lopez May 2019

Increasing Awareness Of Legal Services And Tenant Rights In Watsonville, Ana Laura Partida Lopez

Capstone Projects and Master's Theses

California Rural Legal Assistance is a non-profit that works with marginalized communities such as people who are of low income, farm workers, and those with disabilities, school children, seniors, and those are a part of the LGBT community. Marginalized people most often get taken advantage of and are afraid to ask for help. The housing crisis in the Santa Cruz County has led many to endure harsh living conditions despite this; CRLA has a stagnant rate of people going into the office for consultations. The outreach project was about conducting a survey in the community to find out how aware …

Evaluating The Impact Of Training Employees To Identify Victims Of Human Trafficking, Emily Roman May 2019

Evaluating The Impact Of Training Employees To Identify Victims Of Human Trafficking, Emily Roman

Electronic Theses and Dissertations

Human trafficking is a global epidemic that steals the freedoms away from those who have been oppressed by it. Providing victims with resources begins with identifying them. Unfortunately, identifying victims is not an easy task. Trafficked victims are controlled and protected by their traffickers, and recipients may not even realize that they are victims of human trafficking. Also, the vague nature of trafficking makes it difficult for service providers, such as those in law enforcement, healthcare, and social services, to identify victims readily. Furthermore, research efforts imply a general lack of training provided for employees to know how to identify …

What gaps exist in the justice system that result in a need for services provided by community economic development attorneys? What is the evidence that those gaps actually exist? How do we know that community economic development practitioners fill those gaps, and in what way? These are merely a few of the questions addressed in this collection. At the Association of American Law Schools (AALS) annual meeting in San Diego in January 2018, legal scholars gathered to discuss this evolution as part of the discussion group, “Community Economic Development Is Access to Justice.” The goal of the discussion group was …

Education And The Art Viewing Experience: The Evolution Of Learning In Museums And Corporate Art Collections, Piper Hutson Apr 2019

Education And The Art Viewing Experience: The Evolution Of Learning In Museums And Corporate Art Collections, Piper Hutson

Dissertations

By investigating the history of corporate art collections and the evolution of educational frameworks in museums, this case study questions the differences between exhibition formats to illuminate possible areas of improvement. Museums were initially formed to display collections donated by wealthy or royal families and constructed around the ‘Curator’s Gallery’ format. This exhibition type focused on the aesthetic arrangement of objects based on the established art historical canon hierarchy and were accompanied by minimal ‘tombstone’ labels with little, if any, didactic information. Science museums emerged in the middle of the 19th century and were among the first informal learning institutions …

How Artificial Intelligence Will Affect Law Firms?, Cody O'Brien

Academic Festival

This paper aims to give a fundamental understanding of how artificial intelligence will affect the legal industry. The overall purpose of the study is to explore a wide range of topics that ultimately show how AI can be the most effective in the workforce. Currently, AI has many setbacks in terms of its logical-decision making, meaning, when AI is used in our legal system, there is always legal precedence that should never be overlooked. They Still Just Don’T Get It: The Lessons Of The #Metoo Movement Through The Lens Of Supreme Court Nominations, Maryann Grover Apr 2019

They Still Just Don’T Get It: The Lessons Of The #Metoo Movement Through The Lens Of Supreme Court Nominations, Maryann Grover

Richmond Public Interest Law Review

Many have hailed the #MeToo Movement as a turning point in the way this country discusses sexual assault and sexual harassment, but when looking at the #MeToo Movement through the lens of Supreme Court nominations, it is unclear whether the impact of the Movement will be as farreaching as some imagine. The hearing of Anita Hill, which came before the #MeToo Movement, and the hearing of Dr. Christine Blasey Ford, which came after the #MeToo Movement, perhaps demonstrate that the #MeToo Movement has reached its limit culturally and now institutional change must be the focus in order for the goals …
