This study aimed to assess sex differences in predictors for becoming a current exclusive electronic cigarette (e-cigarette) user, current exclusive smoker, or current dual user (concurrent smoking and e-cigarette use). This longitudinal study included 2399 females and 2177 males who had tried neither cigarettes nor e-cigarettes at baseline and attended 57 middle schools in the three largest cities in Mexico. We estimated multinomial logistic models stratified by sex. At follow-up, the prevalence of current exclusive e-cigarette use was 6.4% for males and 5.5% for females; current exclusive smoking was similar among males (3.6%) and females (3.5%); dual use was 2.4% …
Miracles And Home Births: The Importance Of Media Representations Of Birth, Molly Wiant Cummins
Miracles And Home Births: The Importance Of Media Representations Of Birth, Molly Wiant Cummins
Communication Faculty Publications - Archive
Since most women do not experience birth firsthand before giving birth themselves, many U.S. American birthing women draw knowledge from media representations for understanding what to expect during delivery. Most media representations of birth uphold a medical model, presenting many women with limited options for birth and reducing the agency available to women in their healthcare choices. Lack of choice and agency play into some of the issues surrounding the high rate of maternal mortality in the U.S., compared to other developed nations. This paper analyzes “The Miracle of Birth” scene from Crazy Ex-Girlfriend and Darci’s home birth on Jane …

Bismuth iodide Bi4I4 exhibits intricate crystal structures and topological insulating states that are highly susceptible to influence by environments, making its physical properties highly tunable by external conditions. In this work, we study the evolution of structural and electronic properties of Bi4I4 at high pressure using an advanced structure search method in conjunction with first-principles calculations. Our results indicate that the most stable ambient-pressure monoclinic α−Bi4I4 phase in C2/m symmetry transforms to a trigonal P31c structure (ɛ−Bi4I4) at 8.4 GPa, then to a tetragonal P4/mmm structure (ζ−Bi4I4) above 16.6 GPa. In contrast to the semiconducting nature of ambient-pressure Bi4I4, the …
The Oecd Multilateral Tax Instrument: A Model For Reforming The International Investment Regime?, Wolfgang Alschner
The Oecd Multilateral Tax Instrument: A Model For Reforming The International Investment Regime?, Wolfgang Alschner
Brooklyn Journal of International Law
The international tax and investment regimes display striking similarities. They are both based on thousands of bilateral treaties that follow similar principles but differ in fine print. They each facilitate the free flow of international capital by respectively disciplining fiscal and regulatory host state conduct. Finally, they share common historical foundations and have experienced similar periods of rapid diffusion and deep contestation. Yet, while the international tax regime recently accomplished a sweeping reform to solve a decades-old legitimacy crisis, the investment regime is still grappling with its own legitimacy crisis and reform. In 2018, the multilateral tax instrument (MLI) entered …
Coming To Terms With Wartime Collaboration: Post-Conflict Processes & Legal Challenges, Shane Darcy
Coming To Terms With Wartime Collaboration: Post-Conflict Processes & Legal Challenges, Shane Darcy
Brooklyn Journal of International Law
The phenomenon of collaboration during wartime is as old as war itself. During situations of armed conflict, civilians or combatants belonging to one party to the conflict frequently provide assistance to the opposing side in various ways, such as by disclosing valuable information, defecting and fighting for the enemy, engaging in propaganda, or providing administrative support to an occupying power. Such acts of collaboration have been punished harshly, with violent retribution often directed at alleged collaborators during armed conflict, while states and at times non-state actors have prosecuted and punished collaboration as treason or related offenses in times of war. …
How Much Do Expert Opinions Matter? An Empirical Investigation Of Selection Bias, Adversarial Bias, And Judicial Deference In Chinese Medical, Chunyan Ding
Brooklyn Journal of International Law
This article investigates the nature of the operation and the role of expert opinions in Chinese medical negligence litigation, drawing on content analysis of 3,619 medical negligence cases and an in-depth survey of judges with experience of adjudicating medical negligence cases. It offers three major findings: first, that both parties to medical negligence disputes show significant selection bias of medical opinions, as do courts when selecting court-appointed experts; second, expert opinions in medical negligence litigation demonstrate substantial adversarial bias; third, courts display very strong judicial deference to expert opinions in determining medical negligence liability. This article fills the methodological gap …
Reducing The Governance Gap For Corporate Complicity In International Crimes, Seunghyun Nam
Reducing The Governance Gap For Corporate Complicity In International Crimes, Seunghyun Nam
Brooklyn Journal of International Law
With increasing reports of corporations involved in serious human rights abuses that amount to international crimes, there are greater calls for states to hold these corporations accountable. Still, many obstacles and challenges remain when it comes to holding corporations accountable. Complex corporate structures, the extraterritorial dimension of the abuses, competition among states and businesses, lack of institutional capacity on the part of states, and lack of legal coordination among states collectively create an impunity gap. The case studies of the situation in Burma and the Democratic Republic of Congo involving foreign companies aim to illustrate this governance gap. With growing …

Sovereign Immunity For Russia's Rocket Engines? Enforcing The "Yukos" Award, Evan Drake
Brooklyn Journal of International Law
In 2003 Yukos Oil Company was once the largest oil company in Russia, and its oligarch CEO was Russia’s richest man. By 2007 Yukos had been dissolved, its CEO arrested, and its assets acquired by Russian state oil giants Rosneft and Gazprom. The fall of Yukos triggered what may be the largest arbitral dispute of all time. In 2014, the former shareholders of Yukos successfully won a $50 billion award against Russia for violations of the Energy Charter Treaty – by far the largest in history. Now the shareholders need to collect. This Note examines how Yukos could enforce its …
Third-Party Funding: The Road To Compatibility In International Arbitration, Vienna Messina
Third-Party Funding: The Road To Compatibility In International Arbitration, Vienna Messina
Brooklyn Journal of International Law
Third-party funding in global commerce and dispute resolution has gained considerable traction in the last few decades. The rise in complex international arbitration cases has encouraged a demand for third-party funding arrangements since the disputes involve large amounts of money in addition to high legal costs. This Note explores the implications of third-party funding on the practice of international arbitration, particularly with the expansion of arbitral institutions’ doctrinal rules to address the use of third-party funding. Much of the pre-existing research and literature highlights the issues that third-party funding poses in international arbitration proceedings, but fails to consider a broader, …

#Losingthethread: Recognizing Assembly Rights In The New Public Forum, Liz Grefrath
Brooklyn Law Review
The specter of banishment from the vibrant public forum of social media to the empty streets and deserted sidewalks is a matter of increasing political, social, and cultural importance. Today, nearly every government official maintains a social media presence on Facebook or Twitter, generally to promote initiatives, share ideological positions, engage constituents, and tangle with critics. Privacy controls and content moderation tools, however, offer government officials tantalizing opportunities to discretely and effectively muffle disapproval, stifle dissent, and shield themselves from criticism on their public social media pages through “blocking” features. Courts are just starting to grapple with the First Amendment …

Leonard Diepveen. Modernist Fraud: Hoax, Parody, Deception, Jayme Stayer
English: Faculty Publications and Other Works
Diepeveen has spent a considerable part of his career chasing after the tricky concept of intent, how authors or works signal it, and how interpretive communities respond to it. With his most recent book, he has brought a systematician’s rigour to the question of how modernism addresses, offends, or accounts for its various audiences. One of the most engaging elements of Modernist Fraud is how Diepeveen rescues authorial intention from the New Critical and Barthesian dustbins, revealing its centrality in the evaluation and understanding of art, in spite of its unpindownable nature. The paradox of intent is that its ‘evidentiary …

The Women Against Violence Experiment (W.A.V.E.): Social Journalism Solutions To Help Immigrant Women Protect Themselves Against Abuse, Isadora Varejao
Capstones
The Women Against Violence Experiment (W.A.V.E.) is the product of a yearlong investigation about information gaps in New York’s Latina immigrant community. I interviewed two Brazilian-American immigration attorneys serving the Brazilian community and several Brazilian women living in New York, including victims and survivors of domestic violence, and found that immigrant women have little or no knowledge about the different forms of abuse to which they are vulnerable. No matter who perpetrates the abuse -- a partner, a boss, a landlord -- women don’t know about the resources available to protect their rights, such as free services and U.S. legislation. …

Defining Art Aesthetically : A Revision Of Iseminger's New Aestheticism, Yeung Yu
Lingnan Theses (MPhil & PhD)
My thesis attempts to provide an aesthetic definition of art.
The thesis is divided into three parts. The first part is a summary of the different attempts in defining art in contemporary analytic philosophy, beginning with a discussion of Morris Weitz’s famous paper “The Role of Theory in Aesthetics”, in which he appealed to Wittgenstein’s “family resemblance” idea while rejecting traditional essential definitions. His attempt has led to the appearance of contemporary essential definitions, whereby art is defined through different relational properties. This is followed by a critically review on Weitz’s claims and those definitions.
The second part focuses on …

Indonesia And United States General System Of Preference (Us-Gsp): Eligibility Of Indonesia As A Beneficiary Country, Achmad Ismail
Global: Jurnal Politik Internasional
After 3 years, precisely in 2018, the United States reviewed Indonesia's eligibility in receiving US-General System of Preference (US-GSP) facilities. Interestingly, the results of the review have not yet been published. This happens for the United States assumes that Indonesia implements various trade and investment barriers that have a negative impact on the United States, one of which is due to the policy of limiting imports of horticultural products, the implementation of Gerbang Pembayaran Nasional (GPN) and so on. Then with the current conditions, how about the eligibility of Indonesia if it want to receive GSP facilities. This article argues …

Cells sensing infection produce Type I interferons (IFN-I) to stimulate Interferon Stimulated Genes (ISGs) that confer resistance to viruses. During lympho-hematogenous spread of the mouse pathogen ectromelia virus (ECTV), the adaptor STING and the transcription factor IRF7 are required for IFN-I and ISG induction and resistance to ECTV. However, it is unknown which cells sense ECTV and which pathogen recognition receptor (PRR) upstream of STING is required for IFN-I and ISG induction. We found that cyclic-GMP-AMP (cGAMP) synthase (cGAS), a DNA-sensing PRR, is required in bone marrow-derived (BMD) but not in other cells for IFN-I and ISG induction and for …

This Is My Neighborhood: An Exploration Of Culturally Relevant Agency To Support High School Latinx Students In An Urban Career Academy, Edward C. Fletcher Jr., Victor M. Hernandez-Gantes, Chrystal Smith
The Qualitative Report
The purpose of this study was to explore the perspectives and strategies internal and external stakeholders used to support students in a career academy serving a predominately Latinx community. Within this case study, the principal of the school was Latinx, grew up within the same community as the school, and therefore shared the same culture as his students. Thus, we wondered how effective the principal would be in overcoming the cultural, political, and social barriers of students in the predominately Latinx school. We found the school leaders had a heightened awareness of organizational, cultural, and political complexities because of their …
