The Forgotten Fisa Court: Exploring The Inactivity Of The Atrc, Aram Gavoor, Timothy M. Belsan Jan 2019

The Forgotten Fisa Court: Exploring The Inactivity Of The Atrc, Aram Gavoor, Timothy M. Belsan

GW Law Faculty Publications & Other Works

The Alien Terrorist Removal Court (ATRC) was established in 1996 after immense political pressure from the Reagan, Bush, and Clinton Administrations and wide bipartisan support to serve as a forum to prosecute the most complex and difficult national security immigration removal cases while protecting vital classified information from public disclosure. Yet, after twenty-three years, this Article III court has not heard a single case.

This Article provides a fresh and critical inquiry into this veritable zombie court that has fallen from the public consciousness, yet still exists with a standing cadre of designated judges. It fills a significant gap in …

Ali Data Privacy: Overview And Black Letter Text, Daniel J. Solove, Paul M. Schwartz Jan 2019

Ali Data Privacy: Overview And Black Letter Text, Daniel J. Solove, Paul M. Schwartz

GW Law Faculty Publications & Other Works

In this Essay, the Reporters for the American Law Institute Principles of Law, Data Privacy provide an overview of the project as well as the text of its black letter. The Principles aim to provide a blueprint for policymakers to regulate privacy comprehensively and effectively.

The United States has long remained an outlier in privacy law. While numerous nations have enacted comprehensive privacy laws, the U.S. has clung stubbornly to a fragmented, inconsistent patchwork of laws. Moreover, there long has been a vast divide between the approaches of the U.S. and European Union (EU) to regulating privacy – a divide …

How Wto Dispute Settlement Succumbed To The Trump Administration, Steve Charnovitz

GW Law Faculty Publications & Other Works

The death of the WTO Appellate Body strikes a punishing blow to the WTO and stands as a signal accomplishment of the Trump Administration. Although the absence of an Appellate Body will not necessarily bring down the entire WTO dispute system, such an outcome may occur. This paper chronicles the key moments in the US government’s attack on WTO dispute settlement and the Appellate Body since 2016 by republishing the author's Blog posts over the past four years about the Appellate Body. One of the developments covered is the author’s efforts in 2017 to promote a rescue plan to stave …

The Lost History Of The Ilo’S Trade Sanctions, Steve Charnovitz Jan 2019

The Lost History Of The Ilo’S Trade Sanctions, Steve Charnovitz

GW Law Faculty Publications & Other Works

This essay about the International Labour Organization (ILO) presents the lost history of the ILO's trade sanctions. Although the ILO nowadays is characterized as a toothless international organization, in fact, as the one of the earliest specialized international agencies, the ILO was endowed in 1919 with a system for enforcement that included the possibility of trade sanctions against countries failing to comply with ratified ILO conventions. Even though the original provisions for ILO sanctions were always in plain view in the Treaty of Versailles, the literature on the ILO over the past few decades has largely overlooked the existence of …

Accessibility And Decay Of Web Citations In Computer Science Journals, Mohsen Jalali

Library Philosophy and Practice (e-journal)

The aim of this research is to scrutiny the accessibility and decay of web citations (URLs) used in refereed articles published by 27 Computer Science open access journals as indexed by Scopus. To do this, at first, we downloaded 1000 articles of Computer Science open access journals from 2009 to 2018. After acquiring articles, their web citations are extracted and analyzed from the accessibility and decay point of view. Moreover, for initially missed web citations complementary pathways such as using Google search engine are employed. Then, data collected are analyzed using descriptive statistical methods. Research findings indicated that 80.7% of …

Total Quality Management In Academic Perspective: An Overview, Sumaira Baba, Shabir Ahmed Ganie Jan 2019

Total Quality Management In Academic Perspective: An Overview, Sumaira Baba, Shabir Ahmed Ganie

Library Philosophy and Practice (e-journal)

Management is considered as the indispensable institution in the modern social organization marked by scientific thought and technological innovations. It (management) is essential in one or the other form, wherever human efforts are to be undertaken collectively to satisfy needs through some productive activity, occupation or profession. Even, without the leadership provided by management, the resources of production remain resources and never become production. Although Total Quality Management (TQM) was initially applied as a management philosophy in the industrialized sector. But due to its success, this idea increasingly being applied in the service sector, including libraries. In order to be …

Automatic Slide Generation For Scientific Papers, Athar Sefid, Jian Wu, Prasenjit Mitra, C. Lee Giles Jan 2019

Automatic Slide Generation For Scientific Papers, Athar Sefid, Jian Wu, Prasenjit Mitra, C. Lee Giles

Computer Science Faculty Publications

We describe our approach for automatically generating presentation slides for scientific papers using deep neural networks. Such slides can help authors have a starting point for their slide generation process. Extractive summarization techniques are applied to rank and select important sentences from the original document. Previous work identified important sentences based only on a limited number of features that were extracted from the position and structure of sentences in the paper. Our method extends previous work by (1) extracting a more comprehensive list of surface features, (2) considering semantic or meaning of the sentence, and (3) using context around the …

Drive-By Bridge Damage Identification Through Virtual Simulations, Chang Liu Jan 2019

Drive-By Bridge Damage Identification Through Virtual Simulations, Chang Liu

Civil and Environmental Engineering

With massive infrastructures built in US, timely condition assessment of these infrastructures becomes critical to daily traffic and economics. Due to high cost, long time consumption of direct condition assessment methods, such as closing traffic for sensor installation and monitoring, indirect bridge monitoring has become a promising method. However, the technology is in its initial stage and needs substantial refinement. In this research, virtual simulation approaches, both in 2D and 3D, are used to model the bridge and vehicle interaction through ABAQUS. Artificial Damages were embedded to the model according to different locations and different levels of intensities. With the …

Traffic Monitoring System Using In-Pavement Fiber Bragg Grating Sensors, Mu'ath Al-Tarawneh Jan 2019

Traffic Monitoring System Using In-Pavement Fiber Bragg Grating Sensors, Mu'ath Al-Tarawneh

Civil and Environmental Engineering

Recently, adding more lanes becomes less and less feasible, which is no longer an applicable solution for the traffic congestion problem due to the increment of vehicles. Using the existing infrastructure more efficiently with better traffic control and management is the realistic solution. An effective traffic management requires the use of monitoring technologies to extract traffic parameters that describe the characteristics of vehicles and their movement on the road. A three-dimension glass fiber-reinforced polymer packaged fiber Bragg grating sensor (3D GFRP-FBG) is introduced for the traffic monitoring system. The proposed sensor network was installed for validation at the Cold Weather …

"I'M Leavin' It (All) Up To You": Gundy And The (Sort-Of) Resurrection Of The Subdelegation Doctrine, Gary S. Lawson Jan 2019

"I'M Leavin' It (All) Up To You": Gundy And The (Sort-Of) Resurrection Of The Subdelegation Doctrine, Gary S. Lawson

Faculty Scholarship

In 2000, Cass Sunstein quipped that the conventional nondelegation doctrine, which holds that there are judicially enforceable constitutional limits on the extent to which Congress can confer discretion on other actors to determine the content of federal law, “has had one good year, and 211 bad ones (and counting).”1 The “one good year,” he said, was 1935, when the Court twice held unconstitutional certain provisions of the National Industrial Recovery Act that gave the president power to approve or create codes of conduct for essentially all American businesses, subject only to very vague, and often contradictory, statutory exhortations to pursue …

The Pathologies Of Digital Consent, Neil M. Richards, Woodrow Hartzog Jan 2019

The Pathologies Of Digital Consent, Neil M. Richards, Woodrow Hartzog

Faculty Scholarship

Consent permeates both our law and our lives — especially in the digital context. Consent is the foundation of the relationships we have with search engines, social networks, commercial web sites, and any one of the dozens of other digitally mediated businesses we interact with regularly. We are frequently asked to consent to terms of service, privacy notices, the use of cookies, and so many other commercial practices. Consent is important, but it’s possible to have too much of a good thing. As a number of scholars have documented, while consent models permeate the digital consumer landscape, the practical conditions …

The Inconsentability Of Facial Surveillance, Evan Selinger, Woodrow Hartzog Jan 2019

The Inconsentability Of Facial Surveillance, Evan Selinger, Woodrow Hartzog

Faculty Scholarship

Governments and companies often use consent to justify the use of facial recognition technologies for surveillance. Many proposals for regulating facial recognition technology incorporate consent rules as a way to protect those faces that are being tagged and tracked. But consent is a broken regulatory mechanism for facial surveillance. The individual risks of facial surveillance are impossibly opaque, and our collective autonomy and obscurity interests aren’t captured or served by individual decisions.

In this article, we argue that facial recognition technologies have a massive and likely fatal consent problem. We reconstruct some of Nancy Kim’s fundamental claims in Consentability: Consent …

Foreign Affairs Prosecutions, Steven Arrigg Koh Jan 2019

Foreign Affairs Prosecutions, Steven Arrigg Koh

Faculty Scholarship

Contemporary global crime and cross-border law enforcement cooperation have multiplied “foreign affairs prosecutions,” cases that encompass foreign apprehension, evidence gathering, and criminal conduct, as well as cases that implicate foreign nations’ criminal justice interests. Robert Mueller’s Russia investigation, the fugitive Edward Snowden, and the cross-border crimes of FIFA and El Chapo all exemplify such foreign affairs prosecutions. This Article argues that foreign affairs prosecutions represent a consequential shift in U.S. criminal law, offering the promise of closing global impunity gaps. At the same time, however, such cases risk defendant interests at home and U.S. foreign policy abroad. This Article calls …

Using Species Distribution Models And Connectivity Analyses To Predict Habitat Suitability For Three Bat Species, James Howard Cox Iii Jan 2019

Using Species Distribution Models And Connectivity Analyses To Predict Habitat Suitability For Three Bat Species, James Howard Cox Iii

All-Inclusive List of Electronic Theses and Dissertations

Forests are the most important and universally threatened habitats for bats. Habitat loss and fragmentation are leading causes of damage to forest ecosystem integrity. Critically, most bats need forests: over half of the 45 species of bats in North America use forests for roosting or foraging. Much research to date has been done to identify roosting and foraging patches of bats, but few have attempted to investigate how these patches are connected across a landscape. By understanding how to maintain connectivity across even fragmented landscapes, we may be able to mitigate the effects of forest habitat loss. In this thesis, …

Sources Of Black-White Differences In Mmpi-2-Rf Scores Among Traditionally Aged College Students, Yelena Gonzalez

All-Inclusive List of Electronic Theses and Dissertations

The Minnesota Multiphasic Personality Inventory (MMPI) is a widely used and extensively researched psychodiagnostic instrument that has received some attention regarding its use with racial and ethnic populations. Most of this attention has focused on scaled score differences observed between White and African American individuals, with conclusions ranging from questions about the instruments integrity and fairness in its use with diverse populations, to theories that these differences reflect individual and environmental disparities between groups. Despite a number of studies focusing on racial differences on the MMPI and its revised form, the MMPI-2, few studies have examined whether these differences exist …

The Effectiveness Of Brief Measures In Screening For Malingered Chronic Pain In A Primary Care Setting, Ande J. Seybert-Williams Jan 2019

The Effectiveness Of Brief Measures In Screening For Malingered Chronic Pain In A Primary Care Setting, Ande J. Seybert-Williams

All-Inclusive List of Electronic Theses and Dissertations

With the increased focus on the "Opiate Epidemic" and prescription drug practices, there has been increased conversation in regard to improving the way physicians assess and treat chronic pain. Little empirical research has been devoted to developing formal assessment techniques which address the unique challenge of assessing pain in a primary care setting. The current study explores the effectiveness of commonly used physical and mental health self-report measures in detecting malingered chronic pain and drug-seeking in a health care setting. Moreover, the study compared individuals with and without formal chronic pain diagnoses or a history of chronic pain treatment. Ninety-seven …

The Effects Of Race, Ethnicity, And Language On Competency To Stand Trial Evaluations, Gonzalez Melvin Pagan Jan 2019

The Effects Of Race, Ethnicity, And Language On Competency To Stand Trial Evaluations, Gonzalez Melvin Pagan

All-Inclusive List of Electronic Theses and Dissertations

Forensic evaluators receive training on multicultural assessment and most forensic assessment textbooks include guidelines addressing multicultural issues, but there is little research examining how race/ethnicity and linguistic differences may impact competency to stand trial evaluations. There is a need for research to better understand the needs of Hispanic individuals who are among the fastest growing populations in the United States. Prior studies suggest that clinicians may diagnose African American defendants and Hispanic individuals with a more severe diagnosis when compared to Caucasian individuals. When defendants communicate in their secondary language or require the use of an interpreter it may impact …

Hostile Takeover Regimes In Asia: A Comparative Approach, Umakanth Varottil, Wai Yee Wan

Research Collection Yong Pung How School Of Law

The market for corporate control is animportant corporate governance mechanism for the discipline of corporatemanagers. However, the process and substance of the regulation of hostiletakeovers differs remarkably among various jurisdictions. Existing andinfluential scholarship has focused on the differences in regulation between UnitedStates (US) and the United Kingdom (UK), with the explanations being founded ininterest group politics. Influential as it is, the question is whether thetheory can be extended outside of the US and the UK, particularly to theirlegal transplants in Asia? In the last few decades, many of the Asianjurisdictions have drawn heavily from the US and the UK when …

Staphylococcus aureus is commonly found as normal flora on human skin. As such, it is a frequent cause of skin and soft tissue infection that often spreads to deeper tissue. It has become an especially important microorganism in both clinical and community settings due to its propensity to acquire resistance to antibiotics as well as the invasive mechanisms it utilizes. Specifically, community-associated methicillin resistant Staphylococcus aureus (CA-MRSA) strains have developed resistance to beta-lactam antibiotics and, perhaps more importantly, many invasive pathogenic mechanisms. Thisdissertation explores novel virulence mechanisms of CA-MRSA infections through characterization of novel protein within the prevalent CA-MRSA strain, …
