Characterizing And Quantifying Regulatory Changes In Cancer, Lizhong Ding
Characterizing And Quantifying Regulatory Changes In Cancer, Lizhong Ding
All-Inclusive List of Electronic Theses and Dissertations
This study is to characterize and quantify regulatory changes in the cancer regulatory network, which includes factors such as alternative splicing (AS) and miRNA-mRNA interaction. To achieve this goal, we compare, develop, and evaluate tools to identify AS splicing junction. We also develop pipelines to characterize, cluster, and visualize miRNA-mRNA pairs in tumor tissues compared to normal tissues. With the tools or pipelines, researchers can characterize and quantify molecular level changes in the tumorous tissues compared to normal tissues in different cancer types. This study provides new hallmarks of cancer types, potential diagnostic biomarkers, and therapeutic targets in cancer and …

0855: Carlos Bozzoli Architectural Guides Drafts, Marshall University Special Collections
Guides to Manuscript Collections
This collection consists of various editions of architectural guides to buildings and homes in Cabell County, WV, with special attention paid to the Marshall University Campus. These guides offer walking or driving tours of the areas, and are divided by sections in Huntington and by city/area (Barboursville, Milton, Guyandotte & Greenbottom). The guides are intended to acquaint visitors to the area with its architectural history and to inspire those who live in the area to more fully appreciate their surroundings. These are all rough, uncompleted drafts of the guides, and edits and corrections can be found on many pages. Digital …
Digitizing Brandenburg: Common Law Drift Toward A Causal Theory Of Imminence, J. Remy Green
Digitizing Brandenburg: Common Law Drift Toward A Causal Theory Of Imminence, J. Remy Green
Faculty Scholarship
The Supreme Court’s Brandenburg v. Ohio test provides an exception to the First Amendment’s broad guarantee of freedom of speech. Where speech is (1) directed to inciting or producing imminent lawless action, and (2) is likely to incite or produce such action, the First Amendment withdraws its promise of protection. Thus, where the “imminence” of lawless action cannot be shown, free speech cannot be restricted. Since Brandenburg, Courts have applied a test for imminence that turns on proximity in space and in time — that is, the test evaluates how spatiotemporally imminent lawless activity is. In this Article, I argue …

Antibacterial resistance is a great concern and requires global action. A critical question is whether enough new antibacterial drugs are being discovered and developed. A review of the clinical antibacterial drug pipeline was recently published, but comprehensive information about the global preclinical pipeline is unavailable. This Review focuses on discovery and preclinical development projects and has found, as of 1 May 2019, 407 antibacterial projects from 314 institutions. The focus is on Gram-negative pathogens, particularly bacteria on the WHO priority bacteria list. The preclinical pipeline is characterized by high levels of diversity and interesting scientific concepts, with 135 projects on …
A Common-Sense Defense Of Janus: Forthcoming Changes In The Public Sector, Maria O'Brien
A Common-Sense Defense Of Janus: Forthcoming Changes In The Public Sector, Maria O'Brien
Faculty Scholarship
Many scholars and others have, for some time now, been calling attention to the alarming growth in post-employment and other benefits for unionized employees in the public sector. 17 A fairly well-understood phenomenon is thought to explain the inability of state and local governments to resist outsized demands from their public unions. As 18 Is and others 19 have argued, the central problem with public sector unions is that they find it easy to capture their employers (taxpayers) in ways that private sector unions cannot. The role played by often eager and feckless elected officials in this process has also …

Background
The CTN-0067 CHOICES trial tests implementation of extended-release naltrexone (XR-NTX) versus treatment-as-usual (TAU) for opioid use disorders (OUD) in HIV clinics to improve HIV viral suppression. The study team investigated recruitment strategies to elucidate the barriers and facilitators to recruitment and enrollment in the study.
Main text
Methods: Semi-structured, in-depth, digitally recorded interviews were completed with study recruitment-related staff and medical providers (n = 26) from six participating HIV clinics in the fall of 2018. Interviews probed 1) factors that might prevent prospective participants from engaging in study recruitment and enrollment procedures and 2) strategies used by study …

Importance It is uncertain to what extent established cardiovascular risk factors are associated with venous thromboembolism (VTE).
Objective To estimate the associations of major cardiovascular risk factors with VTE, ie, deep vein thrombosis and pulmonary embolism.
Design, Setting, and Participants This study included individual participant data mostly from essentially population-based cohort studies from the Emerging Risk Factors Collaboration (ERFC; 731 728 participants; 75 cohorts; years of baseline surveys, February 1960 to June 2008; latest date of follow-up, December 2015) and the UK Biobank (421 537 participants; years of baseline surveys, March 2006 to September 2010; latest date of follow-up, February …
Becoming A Better Therapist: Eight Lessons From Running, Kelsey Hyde
Becoming A Better Therapist: Eight Lessons From Running, Kelsey Hyde
Graduate School of Professional Psychology: Doctoral Papers and Masters Projects
This paper seeks to identify lessons that can be taken from the sport of running to serve as a map for learning skills needed to become a better therapist. The practice of running mirrors the practice of learning therapy skills. This paper takes the lens of how to practice to become a better runner and applies it as a new approach to skill development for therapists. Additionally, this paper incorporates self-reflection and disclosure as I myself identify as a female runner and therapist. I will use personal examples to highlight the ways that lessons from running have served as a …
A Behavior Analytic Translation Of Erving Goffman's Frame Analysis, Tim Chi
A Behavior Analytic Translation Of Erving Goffman's Frame Analysis, Tim Chi
Graduate School of Professional Psychology: Doctoral Papers and Masters Projects
The sociologist Erving Goffman's 1974 work, "Frame Analysis," is an attempt to account for how people construct and organize meaning in their experiences. The central principle in this approach is that of the frame: An abstractive concept that refers to the totality of environmental events and stimuli exerting some influence on how people behave in a particular setting and time, with respect to the expectations, roles, and norms to be observed.
Though Frame Analysis was developed within the discipline of sociology, it converges in apparently useful ways with the work of clinical psychology, both in its content and epistemology. Goffman's …
Adverse Childhood Experiences, Neuroadaptation, And Resilience: Does Trauma Focused Cognitive Behavioral Therapy Go Far Enough?, Tracie Abbott
Adverse Childhood Experiences, Neuroadaptation, And Resilience: Does Trauma Focused Cognitive Behavioral Therapy Go Far Enough?, Tracie Abbott
Graduate School of Professional Psychology: Doctoral Papers and Masters Projects
Adverse childhood experiences (ACEs) pose a significant public health risk. Current literature suggests ACEs have the potential to significantly disrupt sensitive periods of neurodevelopment. These neuroadaptations can result in social, emotional, and cognitive impairments that place a child at a significantly greater risk for adopting health risk behaviors and lifestyle factors that lead to the major causes of disease, disability, social problems, and early death in adults. Mental health clinicians have a unique opportunity to intervene by working with families to alter the trajectories of the child’s health risk behaviors and lifestyle factors. Trauma Focused Cognitive Behavioral Therapy (TF-CBT), a …

Revisionist History? Responding To Gun Violence Under Historical Limitations, Michael Ulrich
Revisionist History? Responding To Gun Violence Under Historical Limitations, Michael Ulrich

In the D.C. Circuit case Heller v. District of Columbia (Heller II), Judge Kavanaugh wrote that “Heller and McDonald leave little doubt that courts are to assess gun bans and regulations based on text, history, and tradition, not by a balancing test such as strict or intermediate scrutiny.” Now Justice Kavanaugh, will he find support on the highest court for what was then a dissenting view? Chief Justice Roberts, during oral arguments for Heller I, asked “Isn’t it enough to…look at the various regulations that were available at the time…and determine how these—how this restriction and the scope of this …

Digital Platforms And Antitrust Law, Keith N. Hylton

This Article is about "big data" and antitrust law. Big data, for my purposes, refers to digital platforms that enable the discovery and sharing of information by consumers, and the harvesting and analysis of consumer data by the platform. The obvious example of such a platform is Google. The big platforms owe their market dominance not to anticompetitive conduct, but to economies of scale. This Article discusses three types of anticompetitive conduct associated with digital platforms: kill zone expropriation, acquisition of nascent rivals, and denial of access to data. There is nothing so unusual about digital platforms that would require …
Using The Anglo-American Respondeat Superior Principle To Assign Responsibility For Worker Statutory Benefits And Protections, Michael C. Harper
Using The Anglo-American Respondeat Superior Principle To Assign Responsibility For Worker Statutory Benefits And Protections, Michael C. Harper
Faculty Scholarship
When viewed flexibly, not to find doctrinal rules, but rather to find insight from judges' collective judgment on social values, the common law may have particular value for modern policy makers. For instance, a common law insight could set policy makers in both the United States (U.S.) and the United Kingdom (U.K.) on a promising path for defining when workers are to be protected and benefitted by employment statutes. That insight reflects the underlying rationale for the common law that made relevant the initial distinction between employees and independent contractors - the common law of vicarious liability through respondeat superior. …

Unity And Diversity In International Law, William W. Park

The primordial Greek sea-god Proteus could alter his shape at will, notwithstanding that his divine substance remained the same. Reinventing himself by adapting to new circumstances, Proteus still stayed unchanged in essence.
Unlike the sea-god’s protean nature, the substance of international law may well undergo alterations when examined through the telescope of legal culture, or with predispositions of divergent educational backgrounds. For the thoughtful reader, scholarly speculation on such variations will be triggered by reading Is International Law International?. In that book, Professor Anthea Roberts explores a variety of elements in the teaching and practice of international law, viewed …
Rising Confusion About "Arising Under" Jurisdiction In Patent Cases, Paul Gugliuzza
Rising Confusion About "Arising Under" Jurisdiction In Patent Cases, Paul Gugliuzza
Faculty Scholarship
By statute, all cases “arising under” patent law must be heard exclusively by the federal courts (not state courts) and, on appeal, by the Federal Circuit (not the twelve regional circuits). But not all cases involving patents “arise under” patent law. As recently as 2013, the Supreme Court ruled that the mere need to apply patent law in, for example, a malpractice case involving a patent lawyer, is insufficient to trigger exclusive jurisdiction. Rather, the Court held, for a case that does not involve claims of patent infringement to arise under patent law, the patent issue must be “important . …

In the aftermath of the 2016 election, the shortcomings of existing sanctuary protections came sharply into focus.1 Historically, cities enacted sanctuary protections to extricate their law enforcement agencies from activities related to federal immigration enforcement. In sanctuary cities, local government agencies are typically restricted from sharing information with federal immigration authorities or from cooperating in apprehending individuals targeted for removal. 2 After the White House issued an Executive Order (EO) in late January 2017, many immigrant rights advocates recognized that external facing policies that proscribed direct cooperation would not suffice. 3 The EO announced that Immigration and Customs Enforcement …

Us Military Medical Ethics In The War On Terror, George J. Annas, Sondra S. Crosby
Faculty Scholarship
Military medical ethics has been challenged by the post-11 September 2001 ‘War on Terror’. Two recurrent questions are whether military physicians are officers first or physicians first, and whether military physicians need a separate code of ethics. In this article, we focus on how the War on Terror has affected the way we have addressed these questions since 2001. Two examples frame this discussion: the use of military physicians to force-feed hunger strikers held in Guantanamo Bay prison camp, and the uncertain fate of the Department of Defense’s report on ‘Ethical Guidelines and Practices for US Military …

Children and youth routinely have easy, unsupervised access to the internet through smartphones and tablets. This connectivity increases the danger that adults will sexually exploit them. Adult chat rooms, which may require nothing more than a child checking a box indicating that they are over the age of 18, are a common site for such exploitation. In most cases, this behaviour only comes to light when either a parent becomes aware of the activity, or when an in-person sexual offence against a child is detected and the online communications are discovered in the course of the investigation.
A Partial Simulation Study Of Phantom Effects In Multilevel Analysis Of School Effects: The Case Of School Socioeconomic Composition, Hao Zhou
Theses and Dissertations--Education Sciences
Socioeconomic status (SES) affects students’ academic achievement at different levels of an educational system. However, misspecified Hierarchical Linear Model (HLM) may bias school SES estimation. In this study, a partial simulation study was conducted to examine how misspecified HLM model bias school and student SES estimation.
The result of this study can be summarized by four important points. First, based on partial simulation procedure, phantom effects of school SES and student SES are real. Second, characteristics of phantom effects are generalized. The stronger the correlation between prior science achievement measure and present science achievement measure, the greater the decrease in …

Assessing The Model Fit Of Multidimensional Item Response Theory Models With Polytomous Responses Using Limited-Information Statistics, Caihong Rosina Li
Theses and Dissertations--Education Sciences
Under item response theory, three types of limited information goodness-of-fit test statistics – M2, Mord, and C2 – have been proposed to assess model-data fit when data are sparse. However, the evaluation of the performance of these GOF statistics under multidimensional item response theory (MIRT) models with polytomous data is limited. The current study showed that M2 and C2 were well-calibrated under true model conditions and were powerful under misspecified model conditions. Mord were not well-calibrated when the number of response categories was more than three. RMSEA2 and RMSEAC2 are …

The Effect Of Increased Physical Activity On Academic Performance, Lauren Michelle Willis
Theses and Dissertations--Education Sciences
Increased levels of obesity, particularly among American youth, have consistently been cause for concern over the last few decades. Additionally, the amount of time youth spend being active throughout the day has consistently decreased. Physical activity levels among school-aged children in America are effected by any number of reasons, but this study points to the possibility of time spent being physically active during the school day having the greatest effect on a student’s overall level of physical activity. Increased pressures from different entities on local schools to improve student performance on standardized test scores have contributed to a decline in …

A Leadership Perspective On Family Engagement: Qualitative Content Analysis Of Secondary Data, Stephanie Anderson
Theses and Dissertations--Education Sciences
The purpose of the study was to explore the leadership actions and activities that contributed to the implementation of a schoolwide family engagement initiative in a school. A qualitative content analysis of secondary data design was used to investigate the intentional actions and activities of a school leadership team during the implementation of a family engagement initiative within an elementary school. The Coherence Framework (Fullan & Quinn, 2016) provided a lens for which to investigate schoolwide change across drivers and sub-drivers.
The findings of this study describe intentional leadership actions and activities when communicating with families, conducting formal assessments, and …

Endowments Of Higher Education Institutions And Individual Income Tax Policy: Wealth Erosion From A Loss In Charitable Contributions, Jennifer W. Siebenthaler
Theses and Dissertations--Educational Policy Studies and Evaluation
The most significant tax overhaul bill in over thirty years was enacted in 2017 and expected to have wide-ranging effects. The Tax Cuts and Jobs Act includes numerous policies that directly and indirectly impact the higher education sector and the effect to endowments was not addressed in the public debate leading up to enactment. Unlike expendable gifts, a reduction in endowment contributions has a cumulative effect because a gift to an endowment can benefit all subsequent years. Each year following a contribution, investment income earned on the original gift is available for spending and benefits escalate over time in amount, …

The Stakeholder Gap Lens: Teacher And Parental Perceptions Of The Achievement Gap In Kentucky's Public Schools, Heather Renee Brown Chapman
Theses and Dissertations--Science, Technology, Engineering, and Mathematics (STEM) Education
The research around the achievement gap is extensive. However, regardless that the term “achievement gap” is so widely used in academia today, there is often confusion surrounding what the achievement gap is. This study seeks to answer three research questions: (1) To what extent does an achievement gap exist among different subgroups of students in Kentucky’s K-12 public schools? (2) How do the perceptions of parents and teachers interact with decision-making? (3) How do the ideas of parents and teachers regarding closing the achievement gap compare?
This research examines perceptions of the existence of an achievement gap in Kentucky’s public …

A Quasi-Experimental Study Of Middle Level Student Engineering Understanding Pre-And Post-Treatment, Emily Driessen
Theses and Dissertations--Science, Technology, Engineering, and Mathematics (STEM) Education
This qualitative quasi-experimental study analyzed middle-level students’ understanding of engineering before and after instruction. Students from four teachers were examined. Before and after instruction, all students completed the Draw an Engineer Test (DAET) and the Views of Nature of Engineering (VNOE) survey. Additionally, sixteen students (eight girls and eight boys) from each group (Treatment and Comparison) were interviewed before and after instruction. Findings revealed that after instruction (1) many students viewed engineers as makers/builders/workers (just as they did pre-instruction), however, the percentage of students who listed engineers as inventors, designers, and creators increased; (2) fewer students from both groups noted …

The ultimate goal of statistics education is to create a statistically literate society in which people can appropriately use statistical thinking. Although the need to improve the teaching of introductory statistics courses is not a new one, with increased demand on these courses, there has been constant effort to seek out better ways of teaching these courses. The University of Kentucky (UK) began a reform of its general education program in November 2005. Thinking and reasoning are the central themes of this well-designed general education curriculum.
The main goal of this dissertation is to fill in some gaps in the …

Leadership Development In Physical Therapy: Moving Toward A Community Of Transformative Practitioners, Kerry Cronin Mallini
Theses and Dissertations--Educational Leadership Studies
Physical therapy as an emerging profession is committed to establishing its identity and solidifying its role as a leader in health care. With expertise in human movement, wellness, and disease prevention, physical therapists possess invaluable knowledge and skill to influence public health and enhance patient recovery without increasing cost. Physical therapists have the opportunity to transform the delivery of public health services to meet current and future needs. A major challenge, however, is a dearth of leadership development in preparation programs. Because most physical therapists have not received formal education or explicit training in leadership, a problem of practice exists. …
