Emergent Regulatory Systems And Their Challenges: The Case Of Combination Medical Products, George Horvath

Where regulatory systems overlap, courts and scholars often focus on the undesirable aspects of the overlap—the ways in which systems conflict. One such context involves the regulation of prescription drugs and medical devices by the FDA’s premarket evaluation processes and by state common-law tort and products liability actions. FDA regulation and state common law are often described as separate, conflicting regulatory systems. This Article challenges that description by proposing a model in which FDA premarket evaluation and state common law function as a single regulatory system.

Bridging The Gap Between Public Opinion Research And Consumer Marketing Research: Insights Into U.S. Shoppers Of Organic Foods, Marilena O. Vilceanu, Olivia Grasso, Kristine Johnson

The primary goal of this study embraces Hughner and team’s (2007) directive to focus new research on the growing segment of occasional consumers of organic and natural foods, rather than limit the search for consumer insights to the small, elitist groups of deeply committed consumers. Research questions address the demographics, attitudinal, and behavioral characteristics that identify organic foods as a premium product. Primary recommendations for marketing practitioners include focusing on higher income consumers, especially married individuals, who live in highly populated areas; creating a pleasant shopping experience; promoting non-food related organic items, and investing in brand presence and salience.

BACKGROUND: The use of immunodeficient mice transplanted with human hematopoietic stem cells is an accepted approach to study human-specific infectious diseases such as HIV-1 and to investigate multiple aspects of human immune system development. However, mouse and human are different in sialylation patterns of proteins due to evolutionary mutations of the CMP-N-acetylneuraminic acid hydroxylase (CMAH) gene that prevent formation of N-glycolylneuraminic acid from N-acetylneuraminic acid. How changes in the mouse glycoproteins' chemistry affect phenotype and function of transplanted human hematopoietic stem cells and mature human immune cells in the course of HIV-1 infection are not known.

The most significant tax overhaul bill in over thirty years was enacted in 2017 and expected to have wide-ranging effects. The Tax Cuts and Jobs Act includes numerous policies that directly and indirectly impact the higher education sector and the effect to endowments was not addressed in the public debate leading up to enactment. Unlike expendable gifts, a reduction in endowment contributions has a cumulative effect because a gift to an endowment can benefit all subsequent years. Each year following a contribution, investment income earned on the original gift is available for spending and benefits escalate over time in amount, …

Fens and bogs are unique wetlands that support a diversity of small mammals and many other rare species. One such species is the Northern Bog Lemming (Synaptomys borealis). This species is being considered for listing under the Endangered Species Act, so determining their presence is helpful for management. Northern bog lemmings are difficult to trap and when they are caught, experience high mortality rates. Since they are hard to capture and study, it is difficult to determine presence/absence of this species for management purposes. For small mammals subject to predation, individual longevity, or lifespan, is typically unknown. Snowshoe hares (Lepus americanus) are used as the focal species of this study to examine the assumption that small prey species do not typically live past one or two years of age. To test this assumption, we analyzed a 20-year capture-mark-recapture database to first index the lifespan of hares. We analyzed this database to determine which factors increased the odds of longevity in hares. Body condition and capture location were significant in increasing the odds of a hare being long lived, whereas sex of the …

Absent mistake or misrepresentation, most scholars assume that parties who agree to contract do so voluntarily. Scholars tend further to regard that choice as an important exercise in moral agency. Hanoch Dagan and Michael Heller are right to question the quality of our choices. Where the fundamental contours of the transaction are legally determined, parties have little opportunity to exercise autonomous choice over the terms on which they deal with others. This thesis examines the depiction of the Bodhi Tree, a common Buddhist symbol. Bodhi tree simply means tree of enlightenment and Buddha Shakyamuni reached enlightenment while in meditation beneath the particular tree species of ficus religiosa, or sacred fig. Plant secondary metabolites (PSMs) are compounds found in plant tissues designed to deter herbivores. Tannins, a type of PSM, can bind to proteins and reduce their availability to consumers. The detoxification limitation hypothesis suggests herbivores will prefer foods with lower amounts of PSMs and exhibit decreasing rates of feeding when PSM levels are high in order to stabilize the amount of PSMs ingested. Although this hypothesis has been supported by observations from other mammalian groups, it has not been tested in lemurs with regards to their consumption of tannins.

Age-related biochemical and biophysical changes to the structural properties of ocular lens membrane proteins and retinal pigment epithelium (RPE) cells are thought to play an underlying role in the etiology and progression of age-related cataract and macular degeneration. This dissertation work studies biophysical properties of biomimetic membranes to aid in further understanding of the role of aquaporin-0 in cataract pathogenesis and the biochemical composition of age-related pigmented granules, melanolipofuscin, and their implications in macular degeneration.

For too long, Oregon history has been captive to the mid-nineteenth-century’s rambling wagon trains. Settler stories of motivations, hardships, and achievements, preserved in diaries, letters, and memoirs, are compelling and deserving of the attention lavished on them. But more is necessary. Oregon’s Euro-Americans were intimately tied to national and international events that saw the rise of White, European colonial expansion into the colored word. Alongside that expansion was the development of a framework of domination, justified by claims of superiority and destiny, that conflated the ability to control with the right to do so.
