Evaluating The Legality Of Age-Based Criteria In Health Care: From Nondiscrimination And Discretion To Distributive Justice, Govind Persad Jan 2018

Evaluating The Legality Of Age-Based Criteria In Health Care: From Nondiscrimination And Discretion To Distributive Justice, Govind Persad

Publications

Recent disputes over whether older people should pay more for health insurance, or receive lower priority for transplantable organs, highlight broader disagreements regarding the legality of using age-based criteria in health care. These debates will likely intensify given the changing age structure of the American population and the turmoil surrounding the financing of American health care. This Article provides a comprehensive examination of the legality and normative desirability of age-based criteria. In the Article, I defend a distributive justice approach to age-based criteria. Rather than viewing age as a personal characteristic akin to race or religion, the distributive justice approach …

Paying Patients: Legal And Ethical Dimensions, Govind Persad Jan 2018

Paying Patients: Legal And Ethical Dimensions, Govind Persad

Publications

This Article explores the implications for medical care of a debate that is more familiar in the law and ethics of human subjects research: whether people should be paid to receive or decline medical interventions, or to reach certain health objectives. It examines the legal and ethical issues such payments raise, and considers various actors who might make such payments, including governments, employers, insurers, care providers, and private parties. It argues for two interrelated conclusions: first, that these payments should not be subject to blanket normative condemnation, and, second, that payments made in different settings and contexts frequently share underlying …

Data Economy - Need To Safeguard The Economy By Implementing Strong Data Protection Laws, Suresh Chandra Pandey, Saurabh Pandey Jan 2018

Data Economy - Need To Safeguard The Economy By Implementing Strong Data Protection Laws, Suresh Chandra Pandey, Saurabh Pandey

National Law School Journal

Data Economy is an evolving market and, collaborated with considerable advances in technology, is resulting in the generation of even more data. The never-ending quest of humanity to change the way it leads its life and the need to reform itself with the modern standards has invariably led to the creation and growth of the data economy. It has potential to change every sphere of our life and, if properly regulated, can have effects of huge magnitude if it is looked upon from the perspective of the European Union where data economy has resulted in generating growth in the economy …

The Role Of International Law In State Building: Exploring The Nexus Between Conflict Resolution And Law, Prof (Dr.) Rakesh Kumar Singh, Dr. Bhanu Pratap Jan 2018

The Role Of International Law In State Building: Exploring The Nexus Between Conflict Resolution And Law, Prof (Dr.) Rakesh Kumar Singh, Dr. Bhanu Pratap

National Law School Journal

One of the least explored areas of International Law is the emerging trend of 'State Building’. International Law has entered its 'post-ontological' state, where the debate about its existence and legality is moot. International Law is facing certain knotty problems since the advent of globalization. International law controlled the jus ad bellum regime in a Westphalian context. As a result, The Charter of the United Nations only settled disputes which arose between states. In other words, the focus of the Charter was interstate disputes. The last decade of 20th century and the early 21st century heralded the era of Civil …

An Iterated Local Search Algorithm For The Team Orienteering Problem With Variable Profits, Aldy Gunawan, Kien Ming Ng, Graham Kendall, Junhan Lai Jan 2018

An Iterated Local Search Algorithm For The Team Orienteering Problem With Variable Profits, Aldy Gunawan, Kien Ming Ng, Graham Kendall, Junhan Lai

Research Collection School Of Computing and Information Systems

The orienteering problem (OP) is a routing problem that has numerous applications in various domains such as logistics and tourism. The objective is to determine a subset of vertices to visit for a vehicle so that the total collected score is maximized and a given time budget is not exceeded. The extensive application of the OP has led to many different variants, including the team orienteering problem (TOP) and the team orienteering problem with time windows. The TOP extends the OP by considering multiple vehicles. In this article, the team orienteering problem with variable profits (TOPVP) is studied. The main …

Efficient And Privacy-Preserving Outsourced Calculation Of Rational Numbers, Ximeng Liu, Kim-Kwang Raymond Choo, Robert H. Deng, Rongxing Lu, Jian Weng Jan 2018

Efficient And Privacy-Preserving Outsourced Calculation Of Rational Numbers, Ximeng Liu, Kim-Kwang Raymond Choo, Robert H. Deng, Rongxing Lu, Jian Weng

Research Collection School Of Computing and Information Systems

In this paper, we propose a framework for efficient and privacy-preserving outsourced calculation of rational numbers, which we refer to as POCR. Using POCR, a user can securely outsource the storing and processing of rational numbers to a cloud server without compromising the security of the (original) data and the computed results. We present the system architecture of POCR and the associated toolkits required in the privacy preserving calculation of integers and rational numbers to ensure that commonly used outsourced operations can be handled on-the-fly. We then prove that the proposed POCR achieves the goal of secure integer and rational …

The Role Of Culture In Creative Cognition, Angela K. Y. Leung, Brandon Koh Jan 2018

The Role Of Culture In Creative Cognition, Angela K. Y. Leung, Brandon Koh

Research Collection School of Social Sciences

In this chapter, we propose the complementary model of culture and creativity (CMCC) to account for three pairs of contrasting forces that characterize the manners in which individuals manage their cultural experiences and that produce impacts on creative pursuits. We theorize three bidimensional psychological processes that explain the effects of culture on creativity: (a) stereotyping versus destabilizing cultural norms, (b) fixating on one cultural mindset versus alternating between cultural frames, and (c) distancing from versus integrating cultures. We contend that a broader and diversifying cultural experience offers an impetus to break down cultural confines, to oscillate between a variety of …

Bilingualism Positively Predicts Mathematical Competence: Evidence From Two Large-Scale Studies, Andree Hartanto, Hwajin Yang, Sujin Yang Jan 2018

Bilingualism Positively Predicts Mathematical Competence: Evidence From Two Large-Scale Studies, Andree Hartanto, Hwajin Yang, Sujin Yang

Research Collection School of Social Sciences

Although little is known about the link between bilingualism and mathematical achievement in children, the established link between executive functions (EFs) and mathematical achievement suggests that bilingualism—which has been shown to affect EFs—may positively predict math skills. Drawing on two large-scale datasets collected in the US—the Multi-State Study of Pre-Kindergarten and the State-Wide Early Education Programs (Study 1) and the Early Childhood Longitudinal Study (Study 2)—we examined the relation between bilingualism and mathematical achievement among preschoolers, kindergarteners, and first-grade students (ages 4–7), while controlling for key covariates of (a) demographic variables, such as age, gender, race/ethnicity, and socioeconomic status; and …

Libertarian Paternalism Is Hard Paternalism, Shane Ryan Jan 2018

Libertarian Paternalism Is Hard Paternalism, Shane Ryan

Research Collection School of Social Sciences

I argue that libertarian paternalism is in fact paternalism, or hard paternalism, rather than a form of soft paternalism. I do so on the basis of an analysis of the paternalist act according to which the paternalist act needn’t violate the will of the agent who is the target of that act and the paternalist actor need only suspect that her action may improve the welfare of that target. The paper considers and rejects interpretations of libertarian paternalism as soft paternalism. I then provide an outline as to how libertarian paternalism may be reformed in light of the finding that …

Messing With Liberty, Chandran Kukathas Jan 2018

Messing With Liberty, Chandran Kukathas

Research Collection School of Social Sciences

Dan Klein asks: "If the signification [liberty] has no resemblance to others not messing with one's stuff, well, what is it?" In the history of the use of the term among philosophers and other writers, "liberty" has been held to mean many things: conceptions of liberty abound. For Locke it meant above all not being enslaved. For many republicans, past and present, it meant having a certain status: that of a free man, with certain rights and duties as a citizen—including political rights. For contemporary republicans, like Philip Pettit, it means not being dominated by others (which, in his account, …

Competency Analytics Tool: Analyzing Curriculum Using Course Competencies, Swapna Gottipati, Venky Shankararaman Jan 2018

Competency Analytics Tool: Analyzing Curriculum Using Course Competencies, Swapna Gottipati, Venky Shankararaman

Research Collection School Of Computing and Information Systems

The applications of learning outcomes and competency frameworks have brought better clarity to engineering programs in many universities. Several frameworks have been proposed to integrate outcomes and competencies into course design, delivery and assessment. However, in many cases, competencies are course-specific and their overall impact on the curriculum design is unknown. Such impact analysis is important for analyzing, discovering gaps and improving the curriculum design. Unfortunately, manual analysis is a painstaking process due to large amounts of competencies across the curriculum. In this paper, we propose an automated method to analyze the competencies and discover their impact on the overall …

Lack Of Dream-Capital Among Korean Youths: Rationally Chosen Or Culturally Forbidden?, Seokho Kim, Hongjung Kim, Sangkyu Lee, Eunji Kim, Ohjae Gowen Jan 2018

Lack Of Dream-Capital Among Korean Youths: Rationally Chosen Or Culturally Forbidden?, Seokho Kim, Hongjung Kim, Sangkyu Lee, Eunji Kim, Ohjae Gowen

Research Collection School of Social Sciences

This paper attempts to provide empirical evidence in understanding the ways that contemporary youth pursue their dreams in Korea. This paper examines the rational aspect of "dreaming" or "non-dreaming" by employing two concepts: dream-capital and penetration. In this paper, dream-capital is conceptualized as a seed that facilitates the accumulation of other capitals. It is the total capacity to dream and is composed of four dimensions: imagination, hope, optimism and resilience. Penetration is defined as the "cognitive judgment about the (un)realizability of dream." It refers to the discrepancy that exists between judgment about the capacity, condition and qualification required to fulfill …

User-Friendly Deniable Storage For Mobile Devices, Bing Chang, Yao Cheng, Bo Chen, Fengwei Zhang, Wen-Tao Zhu, Yanju Liu, Zhan Wang Jan 2018

User-Friendly Deniable Storage For Mobile Devices, Bing Chang, Yao Cheng, Bo Chen, Fengwei Zhang, Wen-Tao Zhu, Yanju Liu, Zhan Wang

Research Collection School Of Computing and Information Systems

Mobile devices are prevalently used to process sensitive data, but traditional encryption may not work when an adversary is able to coerce the device owners to disclose the encryption keys. Plausibly Deniable Encryption (PDE) is thus designed to protect sensitive data against this powerful adversary. In this paper, we present MobiPluto, a user-friendly PDE scheme for denying the existence of sensitive data stored on mobile devices. A salient difference between MobiPluto and the existing PDE systems is that any block-based file systems can be deployed on top of it. To further improve usability and deniability of MobiPluto, we introduce a …

Pricing For A Last-Mile Transportation System, Yiwei Chen, Hai Wang Jan 2018

Pricing For A Last-Mile Transportation System, Yiwei Chen, Hai Wang

Research Collection School Of Computing and Information Systems

The Last-Mile Problem refers to the provision of travel service from the nearest public transportation node to a home or other destination. Last-Mile Transportation System (LMTS), which has recently emerged, provide on-demand shared transportation. We consider an LMTS with multiple passenger types—adults, senior citizens, children, and students. The LMTS designer determines the price for the passengers, last-mile service vehicle capacity, and service fleet size (number of vehicles) for each last-mile region to maximize the social welfare generated by the LMTS. The level of last-mile service (in terms of passenger waiting time) is approximated by using a batch arrival, batch service, …

Real-World Large-Scale Iot Systems For Community Eldercare: A Comparative Study On System Dependability, Hwee-Pink Tan, Austin Zhang Jan 2018

Real-World Large-Scale Iot Systems For Community Eldercare: A Comparative Study On System Dependability, Hwee-Pink Tan, Austin Zhang

Research Collection School Of Computing and Information Systems

The paradigm of aging-in-place — where the elderly live and age in their own homes, independently and safely, with care provided by the community — is compelling, especially in societies that face both shortages in institutionalized eldercare resources, and rapidly-aging populations. Internet-of-Things (IoT) technologies, particularly in-home monitoring solutions, are commercially available, and can be a fundamental enabler of smart community eldercare, if they are dependable. In this paper, we present our findings on system performance of solutions from two vendors, which we have deployed at scale for technology-enabled community care. In particular, we highlight the importance of quantifying actual system …

Well-Being Concepts And Components, William Tov Jan 2018

Well-Being Concepts And Components, William Tov

Research Collection School of Social Sciences

Well-being is a broad, multifaceted construct. This chapter reviews different ways of defining and measuring well-being and the implications this has for understanding the correlates and causes of well-being. Hedonic well-being (HWB), eudaimonic well-being (EWB), and other conceptions of well-being are discussed. Specific components and aspects of HWB are elaborated on. These include the distinction between affective and cognitive well-being. Major aspects of affective well-being include valence, frequency versus intensity, arousal, and interpersonal engagement. Major aspects of cognitive well-being include life satisfaction, life evaluation, and domain satisfaction. Processes underlying the structure of cognitive well-being are discussed including top-down versus bottom-up …

Logos And Dao Revisited: A Non-Metaphysical Interpretation, Steven Burik Jan 2018

Logos And Dao Revisited: A Non-Metaphysical Interpretation, Steven Burik

Research Collection School of Social Sciences

Why another article on logos and dao ? Is it not the case that enough scholars have looked into the similarities between the term logos and the notion of dao? Although it may seem so, I will argue that when another perspective is employed, logos and dao might fruitfully be compared on a different level from the one used by most of these comparisons. In this essay I will argue first that in many instances the approach of some of the scholars who have compared logos and dao has been one-sided and has mostly consisted in a comparison of these …
