Remedies And The Government's Constitutionally Harmful Speech, Helen Norton

Although governments have engaged in expression from their inception, only recently have we begun to consider the ways in which the government’s speech sometimes threatens our constitutional rights. In my contribution to this symposium, I seek to show that although the search for constitutional remedies for the government’s harmful expression is challenging, it is far from futile. This search is also increasingly important at a time when the government’s expressive powers continue to grow—along with its willingness to use these powers for disturbing purposes and with troubling consequences.

This study addressed several outcomes, implications, and possible future directions for blended learning (BL) in higher education in a world where information communication technologies (ICTs) increasingly communicate with each other. In considering effectiveness, the authors contend that BL coalesces around access, success, and students’ perception of their learning environments. Success and withdrawal rates for face-to-face and online courses are compared to those for BL as they interact with minority status. Investigation of student perception about course excellence revealed the existence of robust if-then decision rules for determining how students evaluate their educational experiences. This qualitative dissertation investigated possible causes and cures for unclear scholarly writing. For this study, a stipulative definition of unclear scholarly writing, or “academese,” is that the language tends to be vague and verbose. The problem, according to the included literature, is that people who use or accept vague language have less academic, social, professional, and civic power. Academese, some say, can detach readers and that can accordingly diminish collective exchange. Because higher education is meant to share knowledge, promote agency, and prepare students to communicate powerfully within and beyond the university, this study researched the causes and cures of …

Hydnora Arabica (Aristolochiaceae), A New Species From The Arabian Peninsula And A Key To Hydnora, Jay F. Bolin, Darach Lupton, Lytton John Musselman

The plant parasite Hydnora arabica (Aristolochiaceae) is described from the Arabian Peninsula. This species was previously identified as Hydnora africana in Oman. It can be separated from other Hydnora taxa primarily by its terete rhizome, red to orange inner perianth tube color, and tepal lobe margins entirely covered with dense strigose setae. In Oman, Hydnora arabica is known to parasitize two leguminous trees: Acacia tortilis and the introduced Pithocellobium dulce, but may parasitize additional Fabaceae. At least eleven synonyms or subspecific varieties of H. abyssinica are described in the literature, all from east or southern Africa. These synonyms are …

This article provides a theoretical model that positions family leisure experiences as a mechanism for positive family outcomes and resilience in military families. The article integrates the Creation of Family Experiences (CFE) framework with literature on military families, family leisure, and structured experiences. The CFE framework is a conceptual model that provides a lens for examining the context of family activities in order to better identify benefits for human development and family relations. India has one of the highest rates of cervical cancer morbidity and mortality globally. Despite this, there are no national or state-wide screening efforts for cervical cancer and its prevention in India. In an effort to understand the magnitude of cervical cancer in Bangalore, India, this research draws upon data collected in hospital contexts over a month-long period to explore the ways in which physician attitudes contribute to understandings of cervical cancer and its prevention in the growing urban context of Bangalore.

In this dissertation, I explore ‘green’ urban development and urban agriculture projects from the perspective of residents of an African American majority neighborhood in Kansas City—who reside in an area referred to as a ‘blighted food desert’ by local policy makers. In Kansas City, extensive city government support exists for urban agricultural projects, which are touted not just as a solution to poverty associated issues such food insecurity and obesity, but also as a remedy for ‘blight,’ violence and crime, and vacant urban land. Over the last four decades, farming families throughout North America experienced significant transitions due, in part, to the implementation of the North American Free Trade Agreement. This multi-sited dissertation investigates the ways in which a network of binational (Mexican-American) families organize their small- to mid-scale farming enterprises, engage in global networks as food producers, and contribute to rural economies in the southeastern U.S. and the Mexican Bajío. Since the 1990s, the population on the Honduran island of Roatán has grown from around 20,000 (mostly English-speaking Islanders) to roughly 100,000 residents (at least half of which are native Spanish-speaking Ladinos from the Honduran mainland) (Bay Islands Voice 2014b). This population growth has occurred alongside increasing forms of economic and environmental precarity that have fueled widespread instability on the island. While ethnic tensions between Ladinos and Islanders have existed since colonial times, conflict between the groups reached a crescendo in 2014 after the murder of a cruise ship employee in Roatán by a Ladino migrant. The contribution of the midfoot in landing mechanics is understudied. Therefore, the main purpose of this study was to quantify midtarsal joint kinematics and kinetics during a barefoot single-leg landing task. A secondary aim of this study was to explore the relationship between static foot posture and dynamic midfoot function. In a cross-sectional study design, 48 females (age = 20.4 ± 1.8 yr, height = 1.6 ± 0.06 m, weight = 57.3 ± 5.5 kg, BMI = 21.6 ± 1.7 kg·m^-1) performed drop landings from a height of 0.4 m onto split force platforms. The controversy surrounding the Dakota Access Pipeline (“DAPL”) has put the peaceful plains of North Dakota in the national and international spotlight, drawing thousands of people to the confluence of the Missouri and Cannonball Rivers outside of Standing Rock Sioux Reservation for prayer and peaceful protest in defense of the Sioux Tribes’ treaties, lands, cultural property, and waters. Spanning over 7 months, including the harsh North Dakota winter, the gathering was visited by indigenous leaders and communities from around the world and represents arguably the largest gathering of indigenous peoples in the United States in more than 100 years.

The present research shows that managers communicate negative feedback ineffectively because they suffer from transparency illusions that cause them to overestimate how accurately employees perceive their feedback. We propose that these illusions emerge because managers are insufficiently motivated to engage in effortful thinking, which reduces the accuracy with which they communicate negative feedback to employees. Six studies (N = 1883) using actual performance appraisals within an organization and role plays with MBA students, undergraduates, and online participants show that transparency illusions are stronger when feedback is negative (Studies 1–2), that they are not driven by employee bias (Study 3), and …

CEO transgressions are a common storyline in today's business press. Such incidents result in the need to repair trust for both the CEO and the organisation that the CEO leads. We found no instrument developed for this purpose. Objectives: to construct, develop and validate a non-technical skills assessment scale in nursing. Method: methodological research. Based on the literature review and experience of researchers on non-technical skills in healthcare and the knowledge of the principles of crisis resource management, a list of 63 items with a five-point Likert scale was constructed. In The Dignity of Commerce, Nathan Oman sets out an ambitious market theory of contract, which he argues is a superior normative foundation for contract law than either the moralist or economic justifications that currently dominate contract theory. In doing so, he sets out a robust defense of commerce and the market-place as contributing to human flourishing that is a refreshing and welcome contribution in an era of market alarmism. This Article explores the lack of formal guidelines governing the First Lady by first considering the history of the role and how the three branches of government have typically dealt with the role. Attention is also given to the possible intersection with the anti-nepotism statute when and if the First Lady acts as an advisor to the President. This Article then goes on to suggest that this lack of formality has allowed gender norms to govern the role. Synthesis And Biological Activities Of Halogenated Chalcone-Based Pyra, Dinh Phuoc Nguyen

Twenty new 1,3,5-trisubstituted pyrazoline derivatives have been synthesized from chalcones and acylhydrazides in two steps. In the first step, chalcones were prepared by treatment of various acetophenones with different substituted benzaldehydes by Claisen-Schmidt condensation. In the second step, pyrazoline derivatives were synthesized by conducting the reaction of chalcones with acylhydrazides in acetonitrile at 67 °C in the presence of triazabicyclodecene as a catalyst. The synthesized compounds were identified by 1H, 13C NMR and HRMS spectral data and were evaluated for their antibacterial, anticancer and tyrosinase inhibitory activities. In antibacterial and tyrosinase inhibitory activities, most of pyrazoline derivatives showed inactive properties. …
