Of Loaded Weapons And Legal Alchemy, Great Cases And Bad (?) Law: Korematsu And Strict Scrutiny, 1944-2017, Scott Dewey

This article traces in detail how dicta in the wartime Japanese American internment cases of Korematsu v. United States and Hirabayashi v. United States was taken out of context and gradually transmuted, through a process of legal alchemy or "precedent laundering, " into holdings supporting the postwar strict scrutiny doctrine regarding equal protection under the Fifth and Fourteenth Amendments. The article addresses the complex, twisted prehistory ofKorematsu, which includes the troubled Japanese American immigrant experience leading up to the internment and the growing interwar geopolitical rivalry between Japan and the United States over domination of the Asia/Pacific region. Feasibility And Acceptability Of Hiv Self-Testing Among Men Who Have Sex With Men In Nigeria, Population Council

HIV and AIDS

HIV self-testing (HIVST) provides an alternative to facility-based HIV testing services, particularly for key populations such as men who have sex with men (MSM), who face barriers to testing due to stigma, discrimination, and criminalization. This brief reports on a study in Nigeria that demonstrates high acceptability for HIVST among MSM. Lessons learned from this study indicate that the scale-up of HIVST in Nigeria must include provision of adequate pre- and post-test counseling information, as well as the availability of helpline support to improve linkage to care for those who test positive. Future research should explore how HIV retesting can …

This article reports on a study focused on understanding the relationship between teachers’ emotional responses and the larger contextual factors that shape response practices. Drawing from response and emotion scholarship, this article proposes affective tensions as a way for understanding the tug and pull that teachers experience between what they feel they should do (mostly driven from a pedagogical perspective) and what they are expected to do (mostly driven by an institutional perspective) in a contextual moment. The Coal Combustion Residual (CCR) and Effluent Limitations Guidelines (ELGs) rules pose significant technical and economic challenges for ash management and for treatment and discharge of flue gas desulfurization (FGD) wastewater at coal-fired power plants. Beneficial use is always a priority for ash, but only about half is being reused on a national basis, and the rest is destined for disposal. The U.S. Environmental Protection Agency identified biological treatment as the baseline treatment technology for FGD wastewater in the ELGs. The reuse of treated wastewater effluent for municipal supply is not a new idea in Texas, having been contemplated for at least sixty years. However, its importance has grown in recent decades as traditional surface water sources have become fully subscribed. Reuse is recognized as a significant source of future supply for Texas in the 2017 Texas State Water Plan.1 The law related to reuse is, however, still very much a developing subject. Factors That Affect Help-Seeking: Examining Racial Differences Between Whites, Asians, And African Americans, Sierra P. Saykeo, Eva Lawrence

Modern Psychological Studies

The purpose of this study was to identify factors that impact intentions to seek mental health services as well as to explore how they may vary based on race. A total of 172 participants were asked to fill out questions that measured variables related to help-seeking. Results indicated that Asians had significantly higher levels of self-stigma, lower levels of benefits of self-disclosure, and lower intentions to seek help than both Whites and African Americans. Multiple regression analyses showed that self-stigma was a significant predictor of intentions for all three groups, while benefits of self-disclosure was only significant for Whites and …

The drive for animals to regulate their water content can have significant consequences for food webs in xeric ecosystems. But the importance of animal water balance (gains vs losses) for mesic food webs has not been explored. Impervious surfaces in cities absorb and re-radiate solar radiation, raising local temperatures. Higher temperatures lead to greater rates of organismal water loss. Thus, urbanization of mesic regions may lead to greater likelihood of desiccation, with consequences for food webs. An overwhelming majority of anthropogenic climate change studies have placed emphasis on biogeochemical agents, chiefly carbon dioxide emissions, which operate on a global scale. Fewer studies focus on biophysical factors such as land use/ land cover which operate on a regional or local scale. The impact from biophysical factors will continue to be reinforced with a growing human population and expanding resource demands. Of these factors, agricultural land use represents one of the largest, most extensive, and vital land use allocations.

Because social networks are an important aspect of the lived realities of those who participate in them, this study examined the way racial identity was signified, indicated, or displayed on social networks. A survey was distributed to 347 college students from a medium sized Midwestern university to assess ways in which participants depicted their racial identity on social media. The study looked at the use of photos, textual communication, concealment of racial identity, and interactions with race related content to assess how participants projected racial identity on social networks. The purpose of this research is to show how biracial people narrate their identities and how people in society influence biracial individuals' constructions of their self. This is significant because this research obtains perspectives from individuals who simultaneously occupy a privileged and underprivileged identity. In highlighting the experiences of biracial people and their constructions of the self, this research answered questions surrounding how they perform their identities in social situations and how they negotiate passing privileges granted to some based on visual perceptions and/or skin tone.

There is a societal stigma that villainizes or degrades anyone diagnosed or associated with any mental illness. While many different forms of media have attempted to destroy this stigma through psycho-centric narratives, I wanted to argue that musical theatre has the greatest potential as a live entertainment source to deconstruct and reduce the stigma surrounding mental illness. Google Scholar, PsyciNFO, and PubMed were searched using tenns related to resilience and HIV to identify peer-reviewed research articles. Of the 156 articles identified, only 49 were included in the current analyses. Articles were excluded when they did not include a measure of resilience and/or were not relevant to resilience in the context of HIV.
