How Strong Does The Evidence Against Kavanaugh Need To Be?, Katherine A. Shaw

Online Publications

The allegation made by Christine Blasey Ford — that at age 15 she was the victim of a sexual assault by a 17-year-old Brett Kavanaugh — has not only upended Judge Kavanaugh’s Supreme Court confirmation hearings, but has also left Americans wondering what standards should apply to an accusation like this.

Policing Against The State: United Nations Policing As Violative Of Sovereignty, Alexandra R. Harrington Sep 2018

Policing Against The State: United Nations Policing As Violative Of Sovereignty, Alexandra R. Harrington

San Diego International Law Journal

It is the author's contention that both parties to the policing arrangement-be they individuals, states, or organizations-give up portions of their sovereignty in the creation and maintenance of the police and policed relationship where the police are not serving the state which theoretically guards the policed. Part II of this Article provides a discussion of legal concepts of state sovereignty in international law. Part III examines the role of police in U.N. peacekeeping missions from the first peacekeeping mission entailing policing operations in the 1960s through present day operations. This examination reveals a pattern in the growth and development of …

The Meaning Of Wrongdoing - A Crime Of Disrespecting The Flag: Grounds For Preserving National Unity, Mohammed Saif-Alden Wattad Sep 2018

The Meaning Of Wrongdoing - A Crime Of Disrespecting The Flag: Grounds For Preserving National Unity, Mohammed Saif-Alden Wattad

San Diego International Law Journal

To conclude on this issue, the rights of others, as individuals and as a whole, are formulated as the social protected interest that criminal law seeks to protect through criminal means, and it is with these rights that criminal law theory should be concerned in the first level of scrutiny. However, in the second level of scrutiny, an additional set of rights are brought into play; these are the rights of the individual, namely the actor, to exercise their constitutional rights e.g., free speech, liberty, free exercise of religion. The second level of scrutiny requires balancing those rights with the …

Modularity In Cross-Border Insolvency, Andrew B. Dawson Sep 2018

Modularity In Cross-Border Insolvency, Andrew B. Dawson

Chicago-Kent Law Review

This Article proposes a framework for thinking about the design structure of the Model Law on Cross-Border Insolvency. The Model Law has been successful by many metrics; however, it has faced various implementation challenges. As leading scholar Professor Jay Westbrook has noted, thinking about these problems requires thinking about the Model Law as a system. To understand the system, it is necessary to understand its architecture, and I argue that this architecture is best understood as reflecting a modular design structure, i.e., one that divides complex systems into a hierarchical system of self-contained components. Modularity has provided insights into other …

Getting It Right: Title Ix's Role In Adjudicating Sexual Assault Claims, Meg Penrose Sep 2018

Getting It Right: Title Ix's Role In Adjudicating Sexual Assault Claims, Meg Penrose

Faculty Scholarship

Article Extract:

I want to start with a very important point: sexual assault is a crime. We have a serious issue in the United States with sexual assault and sexual harassment. We are seeing this play out right now, and I think the “Me Too” campaign has brought important attention to this issue. An issue that impacts not only our college residence halls, but, as we have seen, the halls of Congress. Serious people are not debating whether sexual assault and sexual harassment pose a societal problem. Rather, serious people are debating how to adequately address these issues without compromising …

Charter Damages: Private Law In The Unique Public Law Remedy, Peter Krikor Adourian Sep 2018

Charter Damages: Private Law In The Unique Public Law Remedy, Peter Krikor Adourian

LLM Theses

In 2010, the Supreme Court of Canadas decision in Vancouver (City) v Ward created a framework for a Charter damages claim. In two subsequent decisions, the Court deviated from Ward by relying extensively on private law principles to award public law damages. In doing so, the Court has created increasingly troubling results. I review the history of Charter damages and the Courts relevant Charter and private law damages jurisprudence, with a particular focus on factors like fault thresholds, immunities, and direct liability of government. I find that Ward provides an appropriate and just remedy in accordance with a purposive approach …

Qualitative Methods And Respectful Praxis: Researching With Youth, Susan Tilley, Leanne Taylor Sep 2018

Qualitative Methods And Respectful Praxis: Researching With Youth, Susan Tilley, Leanne Taylor

The Qualitative Report

In this article, we report on findings from a critical literature review of qualitative methods in youth-focused research. The articles reviewed cover an array of methods including those used traditionally in qualitative research and others more recently established. We identify methods that involve youth in general and youth marginalized and/or criminalized within institutional structures, more specifically. We explore the ethical implications of researching with youth, institutional and in situ, a theme that emerged in the literature reviewed. We highlight the tensions, challenges, and power issues arising in the context of research with youth. We close with arguments for methods that …

Revisiting A Classic: A Qualitative Analysis Of Differential Opportunity Theory And Its Utility In Explaining Residential Burglary, John A. Shjarback Sep 2018

Revisiting A Classic: A Qualitative Analysis Of Differential Opportunity Theory And Its Utility In Explaining Residential Burglary, John A. Shjarback

Qualitative Criminology (QC)

"Cloward and Ohlin’s (1960) differential opportunity theory made several significant contributions to criminology, including the emphasis on illegitimate means and the idea that social structure influences criminal opportunity. The problem, however, is that the field largely misinterpreted Cloward and Ohlin’s intent as a simple variation of strain theory instead of a critical refinement of the existing perspective. Generally, the theory has not received much scholarly attention in terms of testing of its key propositions. Using semi-structured personal interviews with 105 active residential burglars in St. Louis, Missouri during 1989- 1990, the current study uses qualitative measures to analyze differential opportunity …

Interviewing Cybercrime Offenders, Alice Hutchings, Thomas J. Holt Sep 2018

Interviewing Cybercrime Offenders, Alice Hutchings, Thomas J. Holt

Qualitative Criminology (QC)

"Research on cybercrime offending and victimization has increased dramatically over the past two decades, though qualitative scholarship on more technical offenses such as computer misuse has not kept pace with this broader trend. This research aims to identify potential best practices for researchers considering qualitative interviews as a method for researching computer misuse offenses, more commonly involving hacking techniques. The authors interviewed six experienced researchers who conducted qualitative examinations of active or incarcerated cybercriminals to understand their common experiences with recruitment, ways in which they interviewed research participants, ethical issues, and publishing their research. This analysis explores the difficulties associated …

The Life Course Of Female Homicide Offenders: The Context Of Turning Points, Alesa Liles Sep 2018

The Life Course Of Female Homicide Offenders: The Context Of Turning Points, Alesa Liles

Qualitative Criminology (QC)

"Although research on female offending has grown in the past few decades, the criminal justice system has remained inadequate in addressing the needs of women. Available research shows some experiences play a significant role in the lives of women that differ from men. To elaborate, this study sought to incorporate life course perspective and the individual’s perspective to show that context is fundamental to life course research. This study identified life events and turning points specific to female homicide offenders and validated the necessary incorporation of perception and attribution to future research with life course perspective."

Culture, Socialization, And Firearms Violence In The United States, Jennifer L. Lanterman, Sarah J. Blithe Sep 2018

Culture, Socialization, And Firearms Violence In The United States, Jennifer L. Lanterman, Sarah J. Blithe

Qualitative Criminology (QC)

"Firearm violence persists in the United States despite innumerable social, political, and economic changes throughout the 20th and early 21st centuries. Collaborative Event Ethnography was used at seven gun shows in three regions of the United States to explore childhood socialization into firearm culture via intergenerational communication of values and views regarding violence, safety, and the use of firearms. Children were observed at all gun shows engaged in activities ranging from standard play to potentially dangerous activity in an environment characterized by bias and controversy. The findings support social learning theory and provide some insight into the role of culture …

Preliminary Investigation Of Pharmaceutical Counterfeiters In The United States, Jay P. Kennedy, Ksenia Petlakh, Jeremy M. Wilson Sep 2018

Preliminary Investigation Of Pharmaceutical Counterfeiters In The United States, Jay P. Kennedy, Ksenia Petlakh, Jeremy M. Wilson

Qualitative Criminology (QC)

Pharmaceutical counterfeiting is one of the most pressing public health concerns in the United States and abroad, and recently an increasing amount of scholarly attention has been given to this issue. However, the extant literature lacks a systematic investigation of the specific roles undertaken within pharmaceutical counterfeiting schemes. We attempt to address this knowledge gap through an analysis of individuals convicted in federal court of counterfeiting offenses related to U.S.-based pharmaceutical counterfeiting incidents. From our investigation we identified six distinct roles that can classify an individual’s involvement in a pharmaceutical counterfeiting scheme: Key/Lead, Supporting, Sales/Distribution to Legitimate Others, Sales/Distribution to …

Battered Spouse Syndrome: A Comparative Regional Look At Domestic Abuse And Self-Defense In Criminal Courts, Katie Fair

Lincoln Memorial University Law Review Archive

This note will first discuss the general principles of domestic violence and Battered Spouse Syndrome, such as the cycle of abuse and concepts like learned helplessness and hypervigilance. Next, the note will compare and contrast several methods that states in the Southeast and Pacific West have used to allow evidence of Battered Spouse Syndrome and the evidence’s effect on the states’ rule of law. Finally, the note will detail why Battered Spouse Syndrome should be used in the criminal justice system and will discuss why the federal or state legislatures, or a combination of the two, should pass laws to …
