Utah State University Residence Life Behind Closed Doors New Ra 2018, Mo Rhoades

USU Student Folklore Fieldwork

So I think behind closed doors are really important. Because, I don’t know, it helped me a lot in becoming an RA. Because I’ve had a few situation that were brought up in the BCDs that I wouldn’t dreally have known how to handle otherwise. So I think they really helped me there just because I had that training to just apply it in, like, in the moment and I didn’t have to stop and be like, ‘Oh let me text my boss and figure out how to do this, because I don’t know how to do it.’ I just …

“Assault Weapon” Myths, E. Gregory Wallace Oct 2018

“Assault Weapon” Myths, E. Gregory Wallace

Southern Illinois University Law Journal

Four federal circuit courts have rejected Second Amendment challenges to “assault weapon” bans. The main target of these bans is the civilian AR-15, the most popular rifle in America. Most recently, the en banc Fourth Circuit in Kolbe v. Hogan took the unprecedented step of declaring that the AR-15 is not a protected firearm under the Second Amendment because it is functionally equivalent to the military M16. These courts have based their decisions upholding bans on the AR-15 and other “assault weapons” on certain factual claims about how these firearms operate.

This Article critically examines these factual claims. It identifies …

Getting Blood From Stones: Results And Policy Implications Of An Empirical Investigation Of Child Support Practice In St. Joseph County, Indiana Paternity Actions, Margaret F. Brinig, Marsha Garrison Oct 2018

Getting Blood From Stones: Results And Policy Implications Of An Empirical Investigation Of Child Support Practice In St. Joseph County, Indiana Paternity Actions, Margaret F. Brinig, Marsha Garrison

Journal Articles

Today, there is consensus that the current system of calculating and enforcing support obligations does not work well for disadvantaged families, most of which are nonmarital. Nonmarital children are less likely to have support orders established than marital children, and they are much less likely to experience full payment.

In this paper, we report data on parenting time, child support calculation, and enforcement actions in a population of nonmarital children for whom paternity actions were brought, in 2008 or 2010, in St. Joseph County, Indiana. The computerized, court-based record system we utilized to collect data gave us access to information …

Understanding The Dynamics Of The Student Code Of Conduct: Recommendations To Reduce Student Conduct Violations At Southern Illinois University Carbondale., Savannah Krieg

Research Papers

This paper aims to understand the dynamics of the Student Code of Conduct as it is being implemented at Southern Illinois University Carbondale (SIUC). Utilizing my reflections on my observations as a staff member under the Vice Chancellor of Student Affairs for five years, I outline some things that have and have not worked. Guided by the criminological theories, such as, Restorative Justice, Social Bond, and Social Learning, and Self Authorship this paper recommends four solutions. First, all incoming students should be mandated to complete a service learning project in the Carbondale community. Second, Student Rights and Responsibilities should increase …

Research Reports & White Papers

In 2016 according to the U.S. Department of Justice, 856,130 youth were arrested and 45,567 juveniles were held in 1,772 residential juvenile facilities across the country. Detained and confined youth share many characteristics: most are from poor communities and lack access to quality health care. Mental illness and sexually transmitted infections are prevalent. Compared to their non-confined counterparts, incarcerated youth also experience higher rates of substance abuse and homelessness, are educationally behind their peers, are disproportionately identified as needing special education services, and are more likely to have had traumatic experiences (including sexual and emotional abuse) and injuries including traumatic …

Urban Decolonization, Norrinda Brown Hayat Oct 2018

Urban Decolonization, Norrinda Brown Hayat

Michigan Journal of Race and Law

National fair housing legislation opened up higher opportunity neighborhoods to multitudes of middle-class African Americans. In actuality, the FHA offered much less to the millions of poor, Black residents in inner cities than it did to the Black middle class. Partly in response to the FHA’s inability to provide quality housing for low-income blacks, Congress has pursued various mobility strategies designed to facilitate the integration of low-income Blacks into high-opportunity neighborhoods as a resolution to the persistent dilemma of the ghetto. These efforts, too, have had limited success. Now, just over fifty years after the passage of the Fair Housing …

Introduction: This study estimated the U.S. lifetime per-victim cost and economic burden of intimate partner violence.

Methods: Data from previous studies were combined with 2012 U.S. National Intimate Partner and Sexual Violence Survey data in a mathematical model. Intimate partner violence was defined as contact sexual violence, physical violence, or stalking victimization with related impact (e.g., missed work days). Costs included attributable impaired health, lost productivity, and criminal justice costs from the societal perspective. Mean age at first victimization was assessed as 25 years. Future costs were discounted by 3%. The main outcome measures were the mean per-victim (female and …

Divine Justice And The Library Of Babel: Or, Was Al Capone Really Punished For Tax Evasion?, Gabriel Mendlow Oct 2018

Divine Justice And The Library Of Babel: Or, Was Al Capone Really Punished For Tax Evasion?, Gabriel Mendlow

Articles

A criminal defendant enjoys an array of legal rights. These include the right not to be punished for an offense unless charged, tried, and proved guilty beyond a reasonable doubt; the right not to be punished disproportionately; and the right not to be punished for the same offense more than once. I contend that the design of our criminal legal system imperils these rights in ways few observers appreciate. Because criminal codes describe misconduct imprecisely and prohibit more misconduct than any legislature actually aspires to punish, prosecutors decide which violations of the code merit punishment, and judges decide how much …

Immigration Blame, David S. Rubenstein Oct 2018

Immigration Blame, David S. Rubenstein

Fordham Law Review

This Article provides the first comprehensive study of blame in the U.S. immigration system. Beyond blaming migrants, we blame politicians, bureaucrats, and judges. Meanwhile, these players routinely blame each other, all while trying to avoid being blamed. As modeled here, these dynamics of “immigration blame” have catalyzing effects on the politics, policies, and structures of immigration law. Yoking key insights from a range of social sciences, this Article offers unique perspectives on the operation and design choices of the immigration system. Moreover, through a blame lens, the terms of debate over amnesty, immigration enforcement, the travel ban, sanctuary cities, and …

Too Ill To Be Killed: Mental And Physical Competency To Be Executed Pursuant To The Death Penalty, Linda A. Malone Oct 2018

Too Ill To Be Killed: Mental And Physical Competency To Be Executed Pursuant To The Death Penalty, Linda A. Malone

Faculty Publications

Mentally ill individuals are being housed in prisons and jails throughout the country. Due to decreased funding and overpopulation of correctional facilities, individuals with pre-existing illnesses, as well as others who develop illnesses, are in severe need of mental health services and punished for their ailments through the use of solitary confinement, long prison sentences, and lack of care. The stress created by such conditions is amplified for mentally ill prisoners who are awaiting execution or the dismissal of their death row sentences. These individuals must show that they are competent to stand trial, exhibit the mental state required for …

Forensic Science Course Student Efficacy, Task Value, And Sense Of Community: Comparing Traditional And Virtual Classroom Designs, Jennifer Lynn Hall-Rivera

Doctoral Dissertations and Projects

Student enrollment in undergraduate online education continues in an increasing trend toward the creation of new virtual degree programs. Academia and university faculty have observed comparable learning outcomes in both traditional and online classrooms, but minimal research exists discussing student perspectives of science-based coursework in these two learning environments. A specific discipline within scientific programs which continues to demand student interest is Forensic Science degree programs. Forensic Science coursework requires tangible application of content learning in addition to confidence in task completion. Forensic Science also necessitates a sense of connectedness amongst a team of individuals, as peer collaboration and discovery …

Delineating Victims From Perpetrators: Prosecuting Self-Produced Child Pornography In Youth Criminal Justice Systems, Bryce Westlake Oct 2018

Delineating Victims From Perpetrators: Prosecuting Self-Produced Child Pornography In Youth Criminal Justice Systems, Bryce Westlake

Faculty Publications

Video recording technology advancements and accessibility has been paralleled by a growth in self-produced child pornography (SPCP). Although social and judicial attention has been given to instances of teenage sexting, Internet-based forms of SPCP, such as webcam/website sex tourism, have almost been ignored. While some of the proposed legislation reform has referenced video-based SPCP, the majority has focused on SPCP distributed through cellular phones; excluding that which is manifested online or through entrepreneurial efforts. The purpose of this article is to introduce non-sexting SPCP, using the case study of Justin Berry (in the United States), and to propose a broad …

Never Again! Surviving Liberalized Prostitution In Germany, Sandra Norak, Ingeborg Kraus Oct 2018

Never Again! Surviving Liberalized Prostitution In Germany, Sandra Norak, Ingeborg Kraus

Dignity: A Journal of Analysis of Exploitation and Violence

This article, co-authored by a six-year survivor of the sex trade industry in Germany (Sandra Norak) and a psychologist and trauma therapist (Ingeborg Kraus), provides perspectives on the difficulty of withstanding the coercion of traffickers and the difficulties of exiting prostitution in a country in which prostitution has been legalized, normalized and made “a job like any other.” This normalization persuades survivors to believe their traffickers that it is a legitimate occupation and encourages them to endure the violence. Liberalization also has prevented the development of needed trauma services to those seeking to exit the sex trade industry.

(S)Expectations Abroad: Male Traveler Interactions With Southeast Asian Economies, Elliot J. Glotfelty, Glenn M. Miles

Dignity: A Journal of Analysis of Exploitation and Violence

Interacting with locals is a highlight of the tourism experience; however, these interactions may be accompanied by unsolicited propositions for the traveler to participate in the sex industry. Through the lens of Thailand’s largely visible sex industry, this work addresses issues of tourism and travel intertwined with the sex industry in greater Southeast Asia. Governments, a variety of businesses and individuals benefiting financially from a burgeoning sex tourism industry encourage persistence of a viable local sex trade. Although subtleties exist between human trafficking, the sex industry, and sex tourism, each can be intertwined. This article provides an overview of the …
