Increasing Access To Medications For Opioid Use Disorder For All Justice-Associated Populations, Edgar Rodriguez
Doctor of Nursing Practice Final Manuscripts
The purpose of this paper is to support a federal mandate requiring universal access to medication of opioid use disorder for all the justice-involved populations. The policy proposal aims to standardize evidence-based treatment across correctional systems, improve treatment initiation during incarceration, strengthen continuity of care after release, reduce overdose mortality, and address disparities in access for racial and economic groups and rural communities. This policy paper calls for the increase of access to medications of opioid use disorder across the United States for all justice-involved population. This article reviews an evaluative case study of implementation of a six-session virtual book club on connection, attachment, and Black joy in women who identify as Black and African American. Participants included six women and one group leader, all but one of whom were currently enrolled in a higher education setting. Members read selected chapters from two books--What my mother and I don’t talk about: Fifteen writers break the silence (Filgate, 2019), and You are your best thing: Vulnerability, shame resilience, and the Black experience (Burke & Brown, 2021). In late 2008, an Irish businessman was successful in legally preventing sexual assault claims from being brought against him. In explaining why one “victim” should be discredited, the court cited a threat she made against the businessman to make allegations of a sexual nature against him if he did not pay her a sum of money. The Disconnect Of Moral Accountability: Freedom, Equality, And The Limits Of Punishment, Celine Shiah Choi

This thesis examines the justificatory foundations of moral accountability as a social practice and the profound disconnect between our ordinary intuitions about justice, the moral attitudes we hold toward one another, and the governing institutional practices of punishment. Drawing on Stephen Darwall's second-person standpoint and P.F. Strawson's account of reactive attitudes, the paper argues that legitimate accountability presupposes two necessary conditions, freedom and equality, understood as the shared capacity of rational agents to recognize moral demands and stand in reciprocal normative relation with one another. Both conditions, however, prove deeply fragile in practice: legal institutions invoke the language of rational …

Before City of Boerne v. Flores, the Supreme Court construed Section Five of the Fourteenth Amendment as an expansive grant of authority, affording Congress broad power to enact legislation enforcing its own interpretations of the Constitution. Under this regime, Congress enacted landmark civil rights statutes such as the Americans with Disabilities Act and the Violence Against Women Act. In 1997, however, City of Boerne v. Flores sharply curtailed Congress’s power under Section Five—announcing (for the first time) that legislation contravening the Court’s prior pronouncements on the meaning of the Fourteenth Amendment impermissibly intruded on the Supreme Court’s role as …

Since its enactment in 1970, the Racketeer Influenced and Corrupt Organizations Act (RICO) has been the target of—and survived—many constitutional challenges. While RICO passes constitutional muster as enacted, federal prosecution that uses state acquittals as predicate acts under RICO is barred by the Double Jeopardy Clause. Justice Neil Gorsuch’s dissent in the recent Supreme Court case Denezpi v. United States sets the foundation for an assimilation exception to the same-sovereign element of the Double Jeopardy Clause analysis. The narrow Bartkus exception to dual sovereignty is a weak shield against the modern innovation of compound-complex offenses. Defining an assimilation exception to …

Deferred prosecution agreements (DPAs) have been used with increasing frequency, particularly in corporate criminal prosecutions, over the past two decades. By allowing prosecutors to offer a path for rehabilitation without requiring a defendant to enter a guilty plea, DPAs present a valuable tool for progressive prosecutors to use in a broader movement for criminal justice reform.
However, data on how prosecutors use DPAs––how often they offer them and who they offer them to––has long been lacking. Drawing on a recent national experiment studying state and local prosecutors, this Article aims to supplement the existing data to help answer these questions, …

Sexual Touching While Sleeping: Occurrence, Context, Responses, And Perceptions Of Sexual Assault Among Undergraduates, Michelle Drouin, Tara Cornelius

Sexual consent is central to cases of sexual assault and rape. Logically, sleeping persons cannot consent; yet there has been scant research examining the experience of sexual touching while sleeping. The current research is the first known to specifically examine sexual touching with a sleeping partner, with a goal of understanding the contextual features surrounding, responses to, and perceptions of the legality and acceptability of these behaviors. Undergraduate participants from two universities (N = 724) completed several measures assessing their experience of sexual touching while sleeping, the context, sexual precedence, responses, and their perceptions of such touching. The displacement of cultural artifacts through conflict, colonization, and illicit trafficking has created profound gaps in humanity's shared heritage. This paper examines the systemic barriers to cultural property restitution and proposes a structured dispute resolution framework as the primary remedy. Drawing on the social, nonmarket, and economic values of cultural heritage, the study establishes why repatriation extends beyond legal formality into questions of identity, sovereignty, and collective memory. A review of existing international instruments, including the 1954 Hague Convention, the 1970 UNESCO Convention, and the ICPRCP, reveals persistent enforcement gaps and jurisdictional inconsistencies that impede meaningful restitution. The Impact Of Mnar Attrition On Estimation Of Latent Growth Curve Models With Binary Observed Variables, Jason T. Newsom, Brian T. Keller, Mallory R. Kroeck, Nicholas A. Smith

A Monte Carlo simulation was used to evaluate the performance of latent growth curve (LGC) modelswith binary observed variables when the attrition pattern was missing not at random (MNAR) for fivetime points. Parameter and standard error biases for three estimation methods were compared:weighted least squares with mean and variance adjustment (WLSMV), categorical robust marginal max-imum likelihood (categorical MLR), and Bayes. The results indicated that robust diagonal weightedleast squares paired with multiple imputation (MI) performed best when values were missing at ran-dom. When data were missing not at random, Bayesian estimates performed best.

Stronger Together Program: Justice For Latino Youth Involved In The Juvenile Justice System, Leyla Feize, Marisa Ugalde, John M. Gonzalez, Tamer Oraby

Adolescents are vulnerable to delinquent behaviors during their period of cognitive and emotional development. Latino adolescents are often more vulnerable to delinquency behaviors and are over-involved in the juvenile system. Ten Latino youths and 15 parents/guardians participated in a culturally adapted Functional Family Therapy (FFT) intervention program. The behavioral change of the youths was measured using pre- and post-test scores on the Sorensen Self-Esteem test questionnaire and the Low Self-Control Measure. The parents/guardians’ behavioral change was measured using pre- and post-test scores from the Family Interpersonal Relationship Questionnaire. The results indicated that the youths’ self-esteem increased. The change in self-control …
