The Right To Appeal In Comparative Perspective, Dražan Djukić
The Right To Appeal In Comparative Perspective, Dražan Djukić
The Journal of Appellate Practice and Process
Appellate procedures regarding the most serious crimes under domestic law are, in general, conducted differently in common law and civil law systems. This article reviews the differences concerning the primary facets of such proceedings, namely prosecutorial rights of appeal, access to appellate review, the scope of appellate review, the admission of additional evidence, appellate decisionmaking powers, and the functions of appellate review. It then explains that these differences result from dissimilar decisionmaking processes, degrees of adherence to the search for the truth, and sources of law.

Open The Jail Cell Doors, Hal: A Guarded Embrace Of Pretrial Risk Assessment Instruments, Glen J. Dalakian Ii
Open The Jail Cell Doors, Hal: A Guarded Embrace Of Pretrial Risk Assessment Instruments, Glen J. Dalakian Ii
Fordham Law Review
In recent years, criminal justice reformers have focused their attention on pretrial detention as a uniquely solvable contributor to the horrors of modern mass incarceration. While reform of bail practices can take many forms, one of the most pioneering and controversial techniques is the adoption of actuarial models to inform pretrial decision-making. These models are designed to supplement or replace the unpredictable and discriminatory status quo of judicial discretion at arraignment. This Note argues that policymakers should experiment with risk assessment instruments as a component of their bail reform efforts, but only if appropriate safeguards are in place. Concerns for …

If You Would Not Criminalize Poverty, Do Not Medicalize It, William M. Sage, Jennifer E. Laurin
If You Would Not Criminalize Poverty, Do Not Medicalize It, William M. Sage, Jennifer E. Laurin
Faculty Scholarship
American society tends to medicalize or criminalize social problems. Criminal justice reformers have made arguments for a positive role in the relief of poverty that are similar to those aired in healthcare today. The consequences of criminalizing poverty caution against its continued medicalization.
Centering Women In Prisoners' Rights Litigation, Amber Baylor
Centering Women In Prisoners' Rights Litigation, Amber Baylor
Faculty Scholarship
This Article consciously employs both a dignity rights-based framing and methodology. Dignity rights are those rights that are based on the Kantian assertion of “inalienable human worth.”29 This framework for defining rights spans across a number of disciplines, including medicine and human rights law.30 Disciplinary sanctions like solitary confinement or forced medication might be described as anathema to human dignity because of their degrading effect on an individual’s emotional and social well-being.
This Article relies on first-person oral histories where possible. Bioethics scholar Claire Hooker argues that including narratives in work on dignity rights “is both a moral and an …

How The Misunderstanding That Heroin Addiction Is A Choice And The Stigma Surrounding Medication-Assisted Treatment Leads To More Overdose Deaths, Margaret M. Drew

Heroin is an opioid that commonly appears as white or brown powder. Eventually a person can become physically dependent on heroin, meaning the body begins to expect the drug. A sudden withdrawal from the drug can cause intense symptoms such as vomiting, muscle pain, and cravings, often leading to relapse (Shannon, p. 172). Although the initial decision to try heroin may be up to the addict, due to the dependence one develops when using heroin, addiction eventually morphs into an involuntary compulsion. There are many factors out of an individual’s control that influence their likelihood of trying heroin and becoming …
The New Gospel Of Wealth: On Social Impact Bonds And The Privatization Of Public Good, Etienne C. Toussaint
The New Gospel Of Wealth: On Social Impact Bonds And The Privatization Of Public Good, Etienne C. Toussaint
Faculty Publications
Since Andrew Carnegie penned his famous Gospel of Wealth in 1889, corporate philanthropists have championed considerable public good around the world, investing in a wide range of social programs addressing a diversity of public issues, from poverty to healthcare to criminal justice. Nevertheless, the problem of “the Rich and the Poor,” as termed by Andrew Carnegie in his famous essay, remains unsolved. Socially conscious investors have recently called for America to reimagine a new “gospel of wealth”, one that not only grapples with the what of social injustice, but also explores the how and the why of systemic social and …

The Constitutionality Of Classification: Indigenous Overrepresentation And Security Policy In Canadian Federal Penitentiaries, D'Arcy Leitch
The Constitutionality Of Classification: Indigenous Overrepresentation And Security Policy In Canadian Federal Penitentiaries, D'Arcy Leitch
Dalhousie Law Journal
This article examines one component of the Correctional Service of Canada's (CSC) risk classification scheme. The CSC uses the Custody Rating Scale (CRS), a 12-item actuarial instrument, to measure risk and to provide security classification recommendations. Empirical data shows that while CRS recommendations may have some predictive validity, certain of the 12 items the CRS includes do not, particularly for Indigenous prisoners. This article makes the case that the inclusion ofsuch items in the CRS violates prisoner's rights under section 7 of the Charter by depriving them of liberty in a manner that is arbitrary and overbroad. Habeas corpus is …

Visibly (Un)Just: The Optics Of Grand Jury Secrecy And Police Violence, Nicole Smith Futrell
Visibly (Un)Just: The Optics Of Grand Jury Secrecy And Police Violence, Nicole Smith Futrell
Dickinson Law Review (2017-Present)
Police violence has become more visible to the public through racial justice activism and social justice advocates’ use of technology. Yet, the heightened visibility of policing has had limited impact on transparency and accountability in the legal process, particularly when a grand jury is empaneled to determine whether to issue an indictment in a case of police violence. When a grand jury decides not to indict, the requirement of grand jury secrecy prevents public disclosure of the testimony, witnesses, and evidence presented to the grand jury. Grand jury secrecy leaves those who have seen and experienced the act of police …

Counter-Revolutionary: Liberalism, Capital Punishment, And The Next Step Forward, Jason G. Tiplitz

Capital punishment is anathema to liberal notions of human rights and civil liberties. It is time to finally cast it aside as an anachronistic vestige of bygone times. The death penalty is fundamentally incompatible with a truly liberal state.

Protecting Women's Rights? Prospects Under The Un Human Rights Treaty System: A Case Study On India 2005-2017, Deepali
LLM Theses
The establishment of the United Nations Treaty System was the fundamental step for the protection and enforcement of women’s rights. The system is designed to monitor the human rights standards in countries that have ratified the treaties, called state parties. However, the system is facing several challenges that have compromised its effective working for the protection and enforcement of women’s rights. The thesis seeks to explain the challenges to the effective working of the system, that is, why the system does not work as designed in protecting women’s rights against three specific issues: domestic violence, sexual trafficking, and reproductive rights. …

What Are The Parental Beliefs On The Relationship Between Poverty And Low-Grade Achievement?, Selamawit Ayalkebet
School of Education and Leadership Student Capstone Projects
This project addresses the question: What are the parental beliefs on the relationship between poverty and low-grade achievement? It documented a well-written essay of the correlation between poverty and low-grade achievement. For my Literature Review chapter, I used sources that researchers conducted on studies related to my research question and I talked about how to understand low-grade achievement with the following lens: socioeconomics status of children and their families, socio-cultural status, family background and how these concepts are connected to low-grade achievement and what schools and teachers can do to best help students who come from lower socioeconomic backgrounds to …
Restorative Justice In Education Practices As Interventions That Support Teachers In Creating A Better Climate And Culture In Their Classrooms, Erin Tande
School of Education and Leadership Student Capstone Projects
Behavior management in schools is constantly changing. School-wide and classroom behavior processes are striving to find and create ways to reduce negative or unwelcomed behavior while increasing the school’s climate and culture. Schools committed to following Restorative Justice practices have reported stronger school community, reduced suspensions, and increased problem-solving skills during conflicts. This capstone uses a combination of research, assessment, testimonials, and pilot school studies to help answer the research question, What restorative justice in education interventions can be used to support teachers in creating better climate and culture in their classrooms? The research concludes Restorative Justice in Education practices …

From State Policy To School Practices: Accessibility And Implementation Of Teen Dating Violence Awareness Education, Heidi Adams Rueda, Peter R. Fawson
From State Policy To School Practices: Accessibility And Implementation Of Teen Dating Violence Awareness Education, Heidi Adams Rueda, Peter R. Fawson
Social Work Faculty Publications
Currently, 22 states legally require or urge schools to include teen dating violence (TDV) awareness education; yet, little research has examined how school districts are interpreting and implementing these policies. In a state that mandates such education for parents and children, and within a large urban city serving primary Hispanic youth, the present article assessed the types of TDV awareness education being provided in public schools, including the accessibility of this information. Specifically, we contacted independent school districts (ISDs; N= 10, serving over 15,000 youth) directly to assess whether and which TDV education programs were being implemented. We also assessed …

Post-Accountability Accountability, Nicole Stelle Garnett
Post-Accountability Accountability, Nicole Stelle Garnett
University of Michigan Journal of Law Reform
Over the past few decades, parental choice has exploded in the United States. Yet, despite early proponents’ hopes that parental choice would eliminate the need to regulate school quality—since parents’ choices would serve an accountability function—demands to use the law to hold chosen schools accountable for their academic performance are central features of education-reform debates today. This is an opportune time to consider the issue of academic accountability and parental choice. Parental choice has gained a firm foothold in the American educational landscape. As it continues to expand, debates about accountability for chosen schools will only intensify. The questions of …
