Convicting With Reasonable Doubt: An Evidentiary Theory Of Criminal Law, Doron Teichman
Convicting With Reasonable Doubt: An Evidentiary Theory Of Criminal Law, Doron Teichman
Notre Dame Law Review
This Article presents an evidentiary theory of substantive criminal law according to which sanctions are distributed in proportion to the strength of the evidence mounted against the defendant. It highlights the potential advantages associated with grading penalties in proportion to the probability of wrongdoing and situates this claim within both consequentialist and deontological theories of punishment. Building on this analysis, the Article reviews the doctrinal tools used to achieve the goal of evidentiary grading of sanctions and shows that key factors in criminal law are geared towards dealing with evidentiary uncertainty. Finally, the Article explores the underlying logic of the …

Director's Editorials from Age in Action
The year 2018 is the Virginia Center on Aging's 40th anniversary. Our programs and activities have evolved over time but we have remained true to the charges given us in the Code of Virginia, essentially to conduct interdisciplinary studies, including training practitioners and offering educational opportunities for older adults, conducting research on and advancing knowledge about dementia, and serving as an information resource to those committed to the well-being of older adults. Our current operations feature four program areas: abuse in later life (domestic violence and elder abuse); dementia research; geriatrics and gerontology education; and lifelong learning.

You Can’T Save Dead People: The Emerging Battles Over Supervised Consumption Sites, James Satterberg
You Can’T Save Dead People: The Emerging Battles Over Supervised Consumption Sites, James Satterberg
Washington Law Review Online
The United States is experiencing a drug overdose epidemic of historic proportions. As fatal overdose rates continue to increase, some jurisdictions have sought evidence-based solutions to this public health issue. This Comment concerns one proposed remedy in particular: supervised consumption sites. In a supervised consumption site, drug users are encouraged to consume their own drugs at the facility. Facility staff give drug users clean equipment, teach safe injection techniques, and, most importantly, monitor drug users for symptoms of overdose. If a staff member witnesses an overdose, they act to prevent the overdose from becoming fatal. Research conducted on supervised consumption …

Smart police body cameras and smart glasses worn by law enforcement increasingly reflect state-of-the-art surveillance technology, such as the integration of live-streaming video with facial recognition and artificial intelligence tools, including automated analytics. This Article explores how these emerging cybersurveillance technologies risk the potential for bulk biometric metadata collection. Such collection is likely to fall outside the scope of the types of bulk metadata collection protections regulated by the USA FREEDOM Act of 2015. The USA FREEDOM Act was intended to bring the practice of bulk telephony metadata collection conducted by the National Security Agency (“NSA”) under tighter regulation. In …
Race And The Extra-Legal Punishment Of Professional Athletes, Samuel V. Bruton, Donald F. Sacco, Earl W. Spurgin, Kori N. Armstrong
Race And The Extra-Legal Punishment Of Professional Athletes, Samuel V. Bruton, Donald F. Sacco, Earl W. Spurgin, Kori N. Armstrong
2018 Faculty Bibliography
In recent years, major American sports teams and leagues have responded increasingly to players’ off-field, off-court wrongdoing by imposing extra-legal punishments (ELPs) on offending athletes. This paper focuses on an unexplored ethical concern raised by ELPs: teams’ and leagues’ economic incentive for racial bias in the imposed sanctions. In an experimental study, Black and White participants read a series of vignettes about fictional professional athletes who received ELPs for various off-field transgressions. Black participants evaluating punishments imposed on Black athletes found the ELPs inappropriate and overly punitive relative to punishments imposed on White or racially neutral athletes. Conversely, Whites assessing …

Why Courts Fail To Protect Privacy: Race, Age, Bias, And Technology, Bernard Chao, Catherine Durso, Ian Farrell, Christopher Robertson
Sturm College of Law: Faculty Scholarship
The Fourth Amendment protects against unreasonable “searches and seizures,” but in the digital age of stingray devices and IP tracking, what constitutes a search or seizure? The Supreme Court has held that the threshold question depends on and reflects the “reasonable expectations” of ordinary members of the public concerning their own privacy. For example, the police now exploit the “third party” doctrine to access data held by email and cell phone providers, without securing a warrant, on the Supreme Court’s intuition that the public has no expectation of privacy in that information. Is that assumption correct? If judges’ intuitions about …

Intimate Partner Violence & Men’S Professional Sports: Advancing The Ball, Chelsea Augelli, Tamara L. Kuennen
Sturm College of Law: Faculty Scholarship
This article examines how men'sprofessional sports leagues treat domestic violence committed by players. Over the past twenty years, but particularly over the last five, the public has criticized, and the media has shone a spotlight on, the big leagues' ignoring of the issue. Many call for parity between how the criminal justice system treats the issue of domestic violence and how the leagues should treat it, arguing for a zero-tolerance approach. This article applies lessons learned by feminist law and policy makers and legal scholars in the development of the larger justice system response to domestic violence to the nascent …
The Impact And Radical Queer Possibility Of Youth Participatory Action Research, Adrienne R. Carmack
The Impact And Radical Queer Possibility Of Youth Participatory Action Research, Adrienne R. Carmack
Senior Scholar Papers
In this paper, I review and analyze the year long implementation of a Participatory Action Research (PAR) project at a small-town alternative education program. PAR is a feminist research method, as well as a form of feminist education, in the way that it facilitates a critical-consciousness raising. PAR is queer in its emphasis on analyzing social and relational structures, as well as in the way that it subverts power dynamics within traditional, heteronormative research; it also is distinctly queer in its ability to imagine other ways of being while orienting itself toward social change. Finally, this paper offers a critical …

BACKGROUND: Transgender persons are highly victimized, marginalized, disproportionately experience incarceration, and have alarmingly increased rates of HIV infection compared to cis-gender persons. Few studies have examined the HIV care continuum outcomes among transgender women (TW), particularly TW who are involved with the criminal justice (CJ) system.
METHODS: To improve our understanding of HIV care continuum outcomes and risk behaviors among HIV-infected TW who are involved with the CJ system, we analyzed data from the National Institute on Drug Abuse-supported Seek, Test, Treat, Retain (STTR) Data Harmonization Initiative. Baseline data were pooled and analyzed from three U.S. STTR studies to examine …

The leading barometers of online learning such as the Online Report Card (available at https://onlinelearningconsortium.org/read/online-report-card-tracking-online-education-united-states-2015/) indicate that over one in four higher education students now take distance courses and the increase in online enrollments is outpacing overall higher education enrollments. Busy life schedules, tight budgets, established career paths, advances in technology and the desire to reach ever wider, more diverse student bodies are some of the factors driving the growth. Students have differing needs and preferences and some disciplines’ training requirements cannot be met through online learning. In our Conflict Resolution Studies Department at Nova Southeastern University, we have …

Adolescent Protective Factors Related To Resilience: Issues Of Academic Self-Efficacy, Parental Involvement, And Special Education Status, Bethdalie Cruz
Adolescent Protective Factors Related To Resilience: Issues Of Academic Self-Efficacy, Parental Involvement, And Special Education Status, Bethdalie Cruz
Electronic Theses and Dissertations
The predictive value of three constructs was examined in this study in order to explain adolescent self-reported protective factors associated with resilience while moderating for the effects of sex and race. The three constructs included Academic Self-efficacy, Maternal Parental Involvement, and Special Education Identification Status. Participants included 54 adolescents in diverse public middle and high schools, ages 11 to 18. Twenty of these participants were identified as receiving special education services while 34 did not. Results indicated that adolescent perceptions of Academic Self-efficacy significantly predicted protective factors associated with resilience while Special Education Identification Status and Maternal Parental Involvement did …
