Military Sexual Assault: A Comparative Case Study Of Sexual Assault Policies In The United States, Israel, And Norway, Sarah Cummings

Master’s Theses and Projects

Military Sexual Trauma (MST), or the sexual assault or harassment of individuals serving in the military by others who are also serving, has recently been recognized as a significant problem in the United States, especially for women service members. Despite its recognized prevalence, current policies across military branches in the United States have not created transparent provisions for service members to receive preventative trainings and adequate sanctions for offenders. Also, reporting methods in the U.S. military are not at a level that is reflective of a transparent MSA policy. With the use of current Israeli and Norwegian military sexual assault …

Illegal Gambling And Its Operation Via The Darknet And Bitcoin: An Application Of Routine Activity Theory, Sinyong Choi

Master’s Theses and Projects

For many years the Darknet and Bitcoins have been widely utilized by people who wish to anonymously perform illegal activities in cyberspace. Having already been restricted in many countries, the gambling websites utilizing Bitcoin payments and the Darknet allow online users to freely engage in illegal gambling activities with the absence of a formal capable guardian. Although it is an urgent priority that law enforcement find a solution to the pressing issue, there are a few empirical studies focusing on such illegal gambling website. Due to the scarcity of studies in this area, the current study attempts to examine the …

Tv Policy Dynamics: Examining Effects Of Advertising On Arrests In Cities, Johnathan B. Norton

Master’s Theses and Projects

Through the work done by Shaw & McKay (1942), Bursik (1989), Messner & Sampson (1991), and Sampson & Wilson (1995), social disorganization and focus on inner-city crime became a major point of interest for researchers. The idea of social disorganization looks at the weakening of social institutions, both formal and informal, that eventually lead to crime and the study of crime patterns in urban areas. This framework has been used to study crime and pinpoint areas where decisions from governmental officials and local communities have eroded the collective efficacy of neighborhoods, leading to crime. In 2003, the FCC made changes …

Powerpoint: Critical Engagement: Colin Kaepernick, Mason Sargent, Tate Henrikson, Sean N. Bennington, Justin M. Porter, Nicolete D. Moyo

Womanist Ethics

Critical Engagement is the use of practical strategies and pedagogical methods [that] challenge dominant intellectual legacies, theological resources, and ideologies that undermine the goals of Womanist ethics, namely, the empowerment of black women. It is a concept created by Floyd Thomas, in whose writings, it is one of the five Womanist tenants. We decided to base Colin Kaepernick’s ‘take a knee’ movement as an example of Critical Engagement. Using this perspective, we examined the various aspects of the movement and analyzed the effects on American culture and society through a Womanist lens.

Innovative Justice: Federal Reentry Drug Courts – How Should We Measure Success?, Timothy D. Degiusti Jan 2018

Innovative Justice: Federal Reentry Drug Courts – How Should We Measure Success?, Timothy D. Degiusti

Duke Law Master of Judicial Studies Theses

In response to the drug abuse and addiction epidemic in the United States, innovative ways of dealing with non-violent drug offenders within the criminal justice system began to emerge in the late 1980s. Special court dockets – commonly referred to as drug courts – were developed featuring an interdisciplinary team of criminal justice and mental health professionals, led by a presiding judge. Drug courts and other problem-solving courts have proliferated within the state court system, numbering 3,057 by the end of 2014. The use of such courts is expanding among the states, but the federal courts have been slow to …

Clinical and Translational Science Institute

There is growing recognition that home visitation programs serving at-risk families may be an appropriate mechanism for detecting and reducing intimate partner violence (IPV). More research is needed about how home visitors assess and respond to IPV, especially in rural and underserved areas with unique social and geographic challenges. This study describes the qualitative, needs assessment phase of a larger mixed-methods evaluation of IPV assessment, referral processes, and safety planning with clients within a statewide home visitation program. Three focus groups were conducted with home visitors (n = 16) in West Virginia’s Home Visitation Program in May 2015. Home visitors …

Method Overtness, Forensic Autopsy, And The Evidentiary Suicide Note: A Multilevel National Violent Death Reporting System Analysis, Ian R. H. Rockett, Eric D. Caine, Steven Stack, Hilary S. Connery, Kurt B. Nolte, Christa L. Lilly, Ted R. Miller, Lewis S. Nelson, Sandra L. Putnam, Paul S. Nestadt, Haomiao Jia

Faculty & Staff Scholarship

Objective

Higher prevalence of suicide notes could signify more conservatism in accounting and greater proneness to undercounting of suicide by method. We tested two hypotheses: (1) an evidentiary suicide note is more likely to accompany suicides by drug-intoxication and by other poisoning, as less violent and less forensically overt methods, than suicides by firearm and hanging/suffocation; and (2) performance of a forensic autopsy attenuates any observed association between overtness of method and the reported presence of a note.

Methods

This multilevel (individual/county), multivariable analysis employed a generalized linear mixed model (GLMM). Representing the 17 states participating in the United States …

This thesis first examines the science of opioids and the history of how the opioid addiction epidemic began and grew, and details the differences in policy responses across the New England States. Abstract

A review of this literature allowed the writers and authors to express how crimes have decreased and prisons have increased with African Americans, Hispanics, low-socioeconomic families, and students with special disabilities. Zero tolerance policies are being used in today’s school systems that lead to an increase in school arrests. This paper is designed to study the research that shows how a particular population of students are being forced out of school’s systems and into the juvenile criminal justice system which then filters them into federal prisons.

Keywords: teacher professional, discipline policies, school, prison, pipeline, incarceration, juvenile, criminal justice

Biosocial Criminology Versus The Constitution, Karen E. Balter Jan 2018

Biosocial Criminology Versus The Constitution, Karen E. Balter

Regis University Student Publications (comprehensive collection)

The continually emerging field of biosocial criminology provides a basis for productively merging biology with sociological reasonings for criminal behavior. Mainstream research in criminology focuses on environmental factors as the sole reason individuals exhibit antisocial behavior patterns and may ultimately commit crimes. Criminological research has travelled in this direction for decades. The current climate within this community subscribes heavily to the notion that biology has very little to do with why people behave the way they do, and if it did, government control would be the norm. The nature of biocriminology opens a door through which constitutional issues may enter. …

The Office Of The Prosecutor: Seeking Justice Or Serving Global Imperialism?, Shannon Fyfe Jan 2018

The Office Of The Prosecutor: Seeking Justice Or Serving Global Imperialism?, Shannon Fyfe

Scholarly Articles

The international criminal courts and tribunals, especially the ICC, have been strongly criticized for their susceptibility to political influence. Some have argued that the ICC has a distinctly Western bias and is participating in a new kind of imperialism in Africa. Others argue that history and the complicity of the West should disqualify the international community from demanding the prosecution of individuals participating in conflicts resulting directly from colonialism. Many have focused on the nature of the creation of the judicial bodies and the inherent political nature of judicial decisions regarding whom to prosecute. In this article, I offer a …
