The Habeas Corpus Protection Of Joseph Smith From Missouri Arrest Requisitions, A Keith Thompson
The Habeas Corpus Protection Of Joseph Smith From Missouri Arrest Requisitions, A Keith Thompson
Law Papers and Journal Articles
This is the first of two articles discussing Missouri’s requisitions to extradite Joseph Smith to face criminal charges and the Prophet’s recourse to English habeas corpus practice to defend himself. In this article, the author presents research rejecting the suggestion that the habeas corpus powers of the Nauvoo City Council were irregular and explains why the idea that the Nauvoo Municipal Court lacked jurisdiction to consider interstate habeas corpus matters is anachronistic. In the second article, the author analyzes the conduct of Missouri Governor Thomas Reynolds in relation to the requisitions for Joseph Smith’s extradition. Even by the standards of …

Countering The Norm, (Re)Authoring Our Lives: The Promise Counterstorytelling Holds As A Research Methodology With Lgbtq Youth And Beyond, M. Alex Wagaman, Rae Caballero Obejero, James S. Gregory
Social Work Publications
Counterstorytelling, a methodology that is rooted in critical race theory, is undergirded by principles that are beneficial to understanding the experiences of lesbian, gay, bisexual, transgender, and queer-identified (LGBTQ) young people from an intersectional perspective. Counterstorytelling holds promise as a method that creates opportunities for individual transformation and resistance to dominant narratives among young people facing systemic oppression. This article outlines the design and implementation of a counterstorytelling study with LGBTQ youth and reflects on the value and associated challenges of counterstorytelling as a participatory research method.

Assessing Instructed Feigner's Response To The Gudjonsson Suggestibility Scale, Stephen Scott Grabner
Assessing Instructed Feigner's Response To The Gudjonsson Suggestibility Scale, Stephen Scott Grabner
Theses and Dissertations
Research has suggested that the interrogative suggestibility levels play an important role in the elicitation of a false confession within a police interrogation. The Gudjonsson Suggestibility Scale (GSS-1) is currently the only validated assessment tool that measures interrogative suggestibility levels, and it is frequently used in forensic evaluations to help support or refute false confession claims. While it is imperative that the GSS-1 readily differentiate between those who are genuinely suggestible and those who are feigning higher suggestibility levels, past researchers have raised concerns regarding the layperson’s ability to feign higher suggestibility levels as measured by the GSS-1. This paper …

Sequencing Peace And Justice In Syria, Milena Sterio
ILSA Journal of International & Comparative Law
Since 2011, the conflict in Syria has caused the death of hundreds of thousands of individuals and the displacement of millions. Efforts to refer the Syrian situation to the International Criminal Court (ICC) have consistently failed despite well-documented reports about the commission of serious crimes in Syria, including the use of chemical weapons against civilians, torture, the use of child soldiers, and crimes of sexual violence.

Challenges And Motivations Experienced By 1st Generation Latina/O Students In Higher Education, Ereisa G. Morales
2018 Symposium
As of 2014, Latinx have accounted for more than half of the United States population. Additionally, the number of Latinx students pursuing higher education is increasing across the country, yet these students have also shown to be the highest in not completing their degrees. Currently, there is much research on the challenges that Latinx first-generation students face in pursuing higher education but limited on the motivation to pursue and stay in college. This work explores what keeps Latinx driven to continue their education despite the challenges experienced. Factors such as college knowledge and adjustment to college will be addressed in …

Multiracial Malaise: Multiracial As A Legal Racial Category, Taunya L. Banks
Multiracial Malaise: Multiracial As A Legal Racial Category, Taunya L. Banks
Faculty Scholarship
One byproduct of increased interracial marriages post Loving is a growing number of multiracial children. This cohort of multiracials tends to overshadow older and larger generations of multiracial people whose genealogical mixture is more distant. Some interracial couples, their multiracial children and others support a multiracial category on the U.S. Census. Proponents argued that multiracial individuals experience a unique type of discrimination that warrants treating them as a separate racial category. This article concedes that multiracial individuals should enjoy the freedom to self-identify as they wish, and like others, be protected by anti-discrimination law. It concludes, however, that current arguments …
The Impact Of Traumatic Symptomology And Social Support On The Effective Management Of Death Anxiety, Emily Pauline Courtney
The Impact Of Traumatic Symptomology And Social Support On The Effective Management Of Death Anxiety, Emily Pauline Courtney
ETD Archive
Terror management theory (TMT) posits that people function effectively in the world, in part, by relying on social anxiety-buffer systems to protect against death awareness; however, a new extension called anxiety buffer disruption theory (ABDT), posits that traumatic experiences can overwhelm those buffers, leaving people vulnerable to death anxiety and at increased risk for post-traumatic stress disorder (PTSD) symptoms. To test these hypotheses, participants with low and high posttraumatic stress symptoms were identified and recruited using a general population pre-screen, prompted to engage in a relationship threat priming task (vs. control topic), and then asked to complete a standard measure …

Oral History As Inquiry: Using Digital Oral History Collections To Teach School Desegregation, Yonghee Suh, Brian J. Daugherity
History Publications
A body of literature in both history and history education indicates that when it comes to contemporary historical issues, oral history is one of the essential sources to investigate the past, particularly as a source for “history from below,” experiences of those who were undocumented or ill-recorded. Most of all, with new digital technologies, oral histories are more accessible than ever to those who are interested in using them in their research and teaching. This article uses the topic of school desegregation as a case study to highlight the value of oral histories as a historical methodology for studying the …

The amount of time young people spend with media has grown to where it’s even more than a full-time work week . . . When children are spending this much time doing anything, we need to understand how it’s affecting them for good and bad. (Henry J. Kaiser Foundation, 2010, p. 2).

Fear-Based Provocation, Michal Buchhandler-Raphael
Fear-Based Provocation, Michal Buchhandler-Raphael
Scholarly Articles
This Article offers three major contributions to challenge existing view of provocation: first, it considers psychological research that found that fear, similarly to anger, may also significantly interfere with individuals’ decision making processes by disturbing rational judgment, therefore sometimes leading to lethal aggression. Second, drawing on this research, this Article argues that provocation doctrine should be reconstructed to also include a fear-based prong. Third, recognizing fear-based provocation calls for rejecting the loss of control paradigm that currently dominates judges’ and jurors’ perception of the defense. In its place, this Article advocates focusing on the fearful defendant’s fear of violence threatened …

Structuring Relief For Sex Offenders From Registration And Notification Requirements: Learning From Foreign Jurisdictions And From The Model Penal Code: Sentencing, Nora V. Demleitner
Scholarly Articles
This paper first discusses the scope of sex offender registration and notification under federal and state laws, and contrasts U.S. laws with those in other countries. Part III turns to the prevailing rationales for these laws and tests their empirical validity. It highlights the negative effect of registries and notification on criminal investigations, and the cost they impose on public coffers, public safety, and those labeled sex offenders. Part IV discusses a set of proposals to turn registries, which may serve a limited legitimate function, into more effective law enforcement tools while restricting public notification. This section outlines ex ante …

Epilogue: Homecoming Kings, Queens, Jesters, And Nobodies, Mark A. Drumbl
Scholarly Articles
This epilogue unpacks the return of convicted war criminals as homecomings, with all the attendant rites, rituals, and expectations. Knotting together the various papers in this edited collection, this paper examines how the international community constructs an ideal homecoming and, in turn, how such a construction may simply be fanciful.
Book Review, Jamie Rowen, Searching For Truth In The Transitional Justice Movement (2017) & Leonie Steinl, Child Soldiers As Agents Of War And Peace: A Restorative Transitional Justice Approach To Accountability For Crimes Under International Law (2017), Mark A. Drumbl
Scholarly Articles
Why do truth commissions emerge following some conflicts but not others? Jamie Rowen tackles this question in Searching for Truth in the Transitional Justice Movement. Rowen approaches this topic through a detailed study of three jurisdictions: the former Yugoslavia, Colombia, and the United States. Although truth commissions did progress in Colombia, they stalled in both the former Yugoslavia in the wake of the Balkan Wars as well as in the United States in regard to the conduct of US officials after the events on 11 September 2001. Rowen unpacks what happened and what failed to happen — and why …
