Objective

A paucity of corroborative psychological and psychiatric evidence may be inhibiting detec- tion of drug intoxication suicides in the United States. We evaluated the relative importance of suicide notes and psychiatric history in the classification of suicide by drug intoxication versus firearm (gunshot wound) plus hanging/suffocation—the other two major, but overtly violent methods.

Methods

This observational multilevel (individual/county), multivariable study employed a general- ized linear mixed model (GLMM) to analyze pooled suicides and undetermined intent deaths, as possible suicides, among the population aged 15 years and older in the 17 states participating in the National Violent Death Reporting System …

The Juvenile Record Myth, Joy Radice Jan 2018

The Juvenile Record Myth, Joy Radice

Scholarly Works

The proliferation of adult criminal records and their harmful impact on people with convictions has received growing attention from scholars, the media, and legislators from both sides of the political aisle. Much less attention has been given to the far-reaching impact of juvenile delinquency records, partly because many people believe that juvenile records are not public, especially after a juvenile turns eighteen. That common notion is a myth.

This Article addresses that myth and adds to both the juvenile justice and collateral consequences literature in four ways. First, The Juvenile Record Myth illuminates the variety of ways states treat juvenile …

The Biology Of Inequality, Lucille A. Jewel Jan 2018

The Biology Of Inequality, Lucille A. Jewel

Scholarly Works

We have known for quite some time that disadvantaged individuals suffer from poorer health outcomes and lower life spans than the advantaged. The disadvantaged do not perform as well on educational tests than their wealthier peers. In some situations, racial discrimination intersects with poverty to worsen these outcomes for minorities. With the notion that poverty becomes implanted in an individual’s genes and brain, science helps explain how these disparate lifespans and variations in cognitive outcomes come to be. This Article collectively refers to these scientific theories as embodied inequality. Embodied inequality explains why it is so difficult for individuals to …

A Review And Conceptual Model Of Factors Correlated With Postmortem Root Band Formation, Joseph Donfack, Hilda S. Castillo Jan 2018

A Review And Conceptual Model Of Factors Correlated With Postmortem Root Band Formation, Joseph Donfack, Hilda S. Castillo

United States Department of Justice: Publications

It is generally accepted within the forensic trace evidence community that a postmortem root band (PMRB) can appear in the root of hairs attached to remains during decomposition. Presently, the specific sequences of events and/or exact molecular signals that lead to the formation of a PMRB are not well understood. The published literature addressing the abiotic and biotic factors that correlate with the formation of PMRBs is reviewed and a conceptual model for the formation of PMRBs is proposed.

Science‐Based Interviewing: Information Elicitation, Susan E. Brandon, Simon Wells, Colton Seale Jan 2018

Science‐Based Interviewing: Information Elicitation, Susan E. Brandon, Simon Wells, Colton Seale

United States Department of Justice: Publications

This article describes an ethical and effective science‐based model of interviewing. An initial planning phase assists the investigative team in separating facts from inferences, decreases the likelihood of errors based on cognitive biases, and prompts careful preparation of the environment. The interview begins with an explanation of why the subject is being questioned. The interviewer then metaphorically hands the interview over to the subject, making him the talker and the interviewer the listener. The interviewer engages in active listening, soliciting as much information from the subject as possible by deploying tactics that enhance memory based on science, including elements of …

Criminal Thinking, Psychiatric Symptoms, And Recovery Attitudes Among Community Mental Health Patients, Nicole R. Bartholomew, Robert D. Morgan, Sean M. Mitchell, Stephanie A. Van Horn Jan 2018

Criminal Thinking, Psychiatric Symptoms, And Recovery Attitudes Among Community Mental Health Patients, Nicole R. Bartholomew, Robert D. Morgan, Sean M. Mitchell, Stephanie A. Van Horn

United States Department of Justice: Publications

Research suggests it is important to consider criminogenic needs among individuals with severe mental illness. This study aimed to determine the severity of criminal thinking in community-based clinical samples, understand the association between criminal thinking and psychiatric and criminal justice outcomes, and compare these associations between consumers enrolled in Assertive Community Treatment (ACT) and Forensic Assertive Community Treatment (FACT) programs. Participants (N = 234) were male and female consumers enrolled in ACT and FACT programs in five states. Results revealed no significant differences in criminal thinking when comparing participants by program type or history of criminal justice involvement. There …

Conflict Resolution Studies Faculty Book and Book Chapters

Colleges and universities in the United States have long recognized the necessity of dispute resolution for the many different stakeholders who come together to live and work in the relatively confined campus community. Traditionally, student, faculty, and staff disputes were handled by offices of student affairs, human resource departments and legal affairs, or other administrative units. On the student side, administrators or student judges presided over disputes among students, infractions over code of conduct, or other policies, and resolved with either a dismissal of the issue or with imposed sanctions. On the employee side, formal investigation resulted in dismissal of …

Faculty Articles and Other Publications

I was invited to deliver the September 2017 Dean's Lecture, on which this essay is based, in March of 2017, shortly after the inauguration of Donald J. Trump as the 45th president of the United States. I had originally planned to present on one of my longstanding research areas, the intersections of contract law and critical race theory, but as the spring wore on, I began to feel an urgency about using my expertise to comment more directly on the increasingly overt but trenchant race, gender, sex, and class inequalities and conflicts that have plagued our nation for centuries.

Yet, …

Constitutionally Different: A Child’S Right To Substantive Due Process, Tiffani N. Darden Jan 2018

Constitutionally Different: A Child’S Right To Substantive Due Process, Tiffani N. Darden

Loyola University Chicago Law Journal

Kent v. United States required trial courts to conduct an individualized assessment before transferring a juvenile defendant to criminal jurisdiction. Several decades later, in Miller v. Alabama, the Supreme Court prohibited imposing life without parole sentences upon youth offenders without first conducting an individualized assessment. The latter holding also pronounced that juveniles are constitutionally different from adults, finding support in social science, developmental psychology and neuroscience advancements. This same body of adolescent behavioral research casts fundamental fairness concerns on a transferred youth’s ability to effectively participate in other parts of the justice process when removed to criminal court. Whereas …
