Cultivating Empathy: Lessons From An Interdisciplinary Service-Learning Course, Megan Jacobs, Marygold Walsh-Dilley Apr 2018

Cultivating Empathy: Lessons From An Interdisciplinary Service-Learning Course, Megan Jacobs, Marygold Walsh-Dilley

Journal of the National Collegiate Honors Council Online Archive

In “Thinking Critically, Acting Justly,” Naomi Yavneh Klos suggests that the key questions for honors education and social justice are first “how to engage our highest-ability and most motivated students in questions of justice” and second “how honors can be a place of access, equity, and excellence in higher education.” These goals are both important and complementary; achieving the latter helps achieve the former. Honors education creates a fruitful space for inclusion where the knowledge and experience of diverse students develop skills oriented toward justice for the whole community. Making honors a place of access and equity prompts deeper engagement …

Combating Corruption With African Restorative Justice Tradition: Suggested Steps For Nigeria, Peter Genger Apr 2018

Combating Corruption With African Restorative Justice Tradition: Suggested Steps For Nigeria, Peter Genger

African Journal of Criminology and Justice Studies

Corruption has continued to plague countries across the world, especially those in Africa. Local and international communities have all congregated around the conviction that Western bureaucratic mechanisms can destroy and deter corruption. The heavy criticisms against them indicates failure coming from inherent contradictions and lack of political and moral will to keep corruption practices and actors at bay. African restorative justice is articulated as a viable mechanism for controlling corruption and should not be taken as a second fiddle to Western mechanisms, but suis generis a strategy with great potentials. By using African restorative justice mechanism, Nigeria will not only …

Batson's Appellate Appeal And Trial Tribulations, Jonathan Abel Apr 2018

Batson's Appellate Appeal And Trial Tribulations, Jonathan Abel

Faculty Scholarship

Batson v. Kentucky is widely regarded as a failure. In the thirtyplus years since it was decided by the Supreme Court, the doctrine has been subjected to unrelenting criticism for its inability to stop the discriminatoy use of peremptory challenges. The scholarly literature is nearly unanimous: Batson is broken. But this Article approaches Batson from a different perspective, focusing on Batson's appellate virtues rather than its trial shortcomings. This change in focus reveals a number of ways in which the Batson doctrine provides opportunities on appeal that do not exist at trial. In short, this Article argues that appellate Batson …

Judge, Jury, And Executioner: Roger Goodell And The Power To Punish, Ursula Petersen Apr 2018

Judge, Jury, And Executioner: Roger Goodell And The Power To Punish, Ursula Petersen

Loyola of Los Angeles Entertainment Law Review

This Note examines the unbridled disciplinary powers granted to NFL Commissioner Roger Goodell. These powers, granted by the NFL’s Collective Bargaining Agreement, allow Goodell to indiscriminately punish NFL players for violent, off-field behavior. The increased media coverage of domestic violence and sexual assault—perpetrated by NFL players—has damaged the NFL’s public persona and resulted in loss of sponsorship. In response, Goodell has pledged to deter violent behavior and punish player indiscretions by crafting and implementing harsher Personal Conduct Policies.

This Note explores the history of NFL disciplinary policies and the legal challenges to Goodell’s disciplinary powers. Additionally, this Note looks at …

Educate To Liberate: Exploring Educator Narratives To Examine The Mis-Education Of Black Students, Adwoa Nefertari Nkenge Apr 2018

Educate To Liberate: Exploring Educator Narratives To Examine The Mis-Education Of Black Students, Adwoa Nefertari Nkenge

CUP Ed.D. Dissertations

It is not known why the chronic mis-education of Black students has neither been adequately investigated nor treated as the most significant, widespread phenomenon of twenty-first century pedagogy. To attempt to understand this quandary, it was urgent to ask: How do Black educators understand the education of Black students? Are they able to incorporate the tensions and varied experiences they have had as students into their professional repertoire? This study described how Black educators’ unique cultural perspectives might enable increased insight into the problem of mis-education. Critical race theory framed this study with an emphasis on narrative inquiry and transformative …

Activism As A Source Of Strength For Black College Students At Predominately White Institutions, Caroline M. Reid

Honors Theses

Racism is deeply ingrained in American society, and white supremacy and the oppression of people of color has greatly contributed to the establishment of the very institutions that continue to perpetuate its existence today. Racism manifests itself in a variety of ways, and its most constant and daily appearance is in instances of microaggressions. These experiences contribute to feelings of invisibility, frustration, and anger, an experience known as racism-related stress, which research has shown to severely and negatively impact mental health. In order to combat the insidious effects of racism, Black Americans have utilized coping mechanisms for generations. This resiliency …

The State Of American Juvenile Justice, Merril Sobie Apr 2018

The State Of American Juvenile Justice, Merril Sobie

Elisabeth Haub School of Law Faculty Publications

This article will summarize the major twenty-first century state legislative and case law developments. It will also briefly note the expansion of state and local initiatives limiting the prosecution of youthful offenders, such as diversion and restorative justice programs.

The state of American juvenile justice has improved significantly in the past several years. However, the reforms are best viewed as a work in progress. Much has been accomplished, but much remains to be accomplished. Crucially, after a generation of “tough on kids” measures, we are on the road toward a true “justice” system for children.

Beyond The Movement: State Action In Addressing Campus Sexual Violence, Amijo Wadena Apr 2018

Beyond The Movement: State Action In Addressing Campus Sexual Violence, Amijo Wadena

Political Science Theses and Capstones

The "Me Too" movement, started by actress Alyssa Milano, has helped shine a light on the prevalence of sexual harassment and sexual violence throughout the country. While it has helped the public understand the magnitude of the issue, it has only started the conversation about sexual violence. And while the focus has mostly been on Hollywood, there has been one area that is being overlooked; sexual violence on College and University campuses. With Secretary DeVos' repeal of Obama era policies, the current administration is being a lot less transparent when it comes to sexual violence, in general. With policy-making responsibility …

Cold Careers And Occupational Hazards: The Occupational Preferences Of Canadian Serial Killers, Christina E. Ledezma Apr 2018

Cold Careers And Occupational Hazards: The Occupational Preferences Of Canadian Serial Killers, Christina E. Ledezma

Masters Theses

Serial killing is a dark and complex phenomenon. As researchers have begun to recognize that serial killing exists and interacts within a broad modern context, how these factors affect its occurrence has received more attention. This includes serial killers’ occupational preferences and the influence that occupations have on their offending. However, studies on serial killers’ occupational preferences have been limited to the United States and the United Kingdom. This thesis sought to classify the occupational preferences of 36 Canadian serial killers and subsequently analyze how these occupations may have influenced their offending, both instrumentally and psychologically. According to Canada’s 2016 …

Intergenerational Incarceration And Inmate Adjustment, Sarah C. Light Apr 2018

Intergenerational Incarceration And Inmate Adjustment, Sarah C. Light

Masters Theses

Current research has found the impact of incarceration to be far reaching. Families, especially children, often experience the most strain and disadvantage as a result of a parent’s incarceration. This effect can carry into the adult years and influence economic, educational, and behavioral health outcomes. The present study investigates the effect of having a parent or stepparent incarcerated on behavioral and psychological inmate adjustment to the prison environment. Using secondary data from a national data sample of 14,499 inmates, behavioral and psychological adjustment to the prison environment was measured. Results showed no significant effect of second generation prison status on …

Disregarding Statutory Safeguards: The Supreme Court Of Missouri's Failure To Recognize Manifest Injustice In Predatory Sexual Offender Determinations, Lauren Vincent Apr 2018

Disregarding Statutory Safeguards: The Supreme Court Of Missouri's Failure To Recognize Manifest Injustice In Predatory Sexual Offender Determinations, Lauren Vincent

Missouri Law Review

This Note scrutinizes the way in which the Supreme Court of Missouri resolved the issue of whether the predatory sexual offender statute, section 566.125.5(3), is constitutional when applied to currently charged acts in light of the procedural mandates for sentence enhancement provided in section 558.021.2. This Note argues the Supreme Court of Missouri erred in its interpretation of the statutory language provided in section 566.125.5(3) and in its application of Alleyne precedent. This Note further argues the Supreme Court of Missouri failed to recognize the manifest injustice that resulted when the trial court disregarded the statutory timing requirements that should …

The Prison To Homelessness Pipeline: Criminal Record Checks, Race, And Disparate Impact, Valerie Schneider Apr 2018

The Prison To Homelessness Pipeline: Criminal Record Checks, Race, And Disparate Impact, Valerie Schneider

Indiana Law Journal

Study after study has shown that securing housing upon release from prison is critical to reducing the likelihood of recidivism,1 yet those with criminal records— a population that disproportionately consists of racial minorities—are routinely denied access to housing, even if their offense was minor and was shown to have no bearing on whether the applicant would be likely to be a successful renter. In April of 2016, the Office of General Counsel for the United States Department of Housing and Urban Development (HUD) issued much anticipated guidance dealing directly with the racially disparate impact of barring those with criminal records …
