The New Law Of The Child, Anne C. Dailey, Laura A. Rosenbury
The New Law Of The Child, Anne C. Dailey, Laura A. Rosenbury
UF Law Faculty Publications
This Article sets forth a new paradigm for describing, understanding, and shaping children’s relationship to law. The existing legal regime, which we term the “authorities framework,” focuses too narrowly on state and parental control over children, reducing children’s interests to those of dependency and the attainment of autonomy. In place of this limited focus, we envision a “new law of the child” that promotes a broader range of children’s present and future interests, including children’s interests in parental relationships and nonparental relationships with children and other adults; exposure to new ideas; expressions of identity; personal integrity and privacy; and participation …

Criminal Justice
Capital punishment has always remained a controversial topic in society, and lately has proved to be a contributing source to the political divide in our country. Moreover, our great nation was founded on the ideals of individualism and a distaste for large government and its overwhelming powers. As a result, our founding fathers established a society in which the people rule and the individual's needs are valued higher than the rest. This paper will cover the flaws in capital punishment, and how, although it may serve a certain purpose, its potential for failure is too considerable to remain a U.S. …

Who We Are And How We Vote: Individual Difference Factors In Politics, Abby Joens-Witherow 18
Who We Are And How We Vote: Individual Difference Factors In Politics, Abby Joens-Witherow 18
Honor Scholar Theses
The current research focuses on the relationships between individual differences and political preferences, particularly conservatism as measured by the Social and Economic Conservatism Scale (Everett, 2013). I conducted a survey using the crowdsourcing platform Mechanical Turk that assessed individuals in terms of demographics, the Big Five Aspect Scales, Moral Foundations, Social Dominance Orientation, Right Wing Authoritarianism, and opinions about the 2016 presidential candidates (Hillary Clinton & Donald Trump). Through hierarchical multiple regression, I was able to find correlations among openness to experience (-) and conscientiousness (+) with conservatism in terms of the Big Five. I found that binding moral foundations …
Evaluating The Effectiveness Of U.S. Anti-Slavery Legislation Through The Lens Of Supply Chain Management, Alexander Marion Mingus
Evaluating The Effectiveness Of U.S. Anti-Slavery Legislation Through The Lens Of Supply Chain Management, Alexander Marion Mingus
Honors Theses
Whether knowingly or unknowingly, business supply chains are often tainted with slavery and forced labor practices. In an effort to address this reality, the California Transparency in Supply Chains Act of 2010 (CTSCA) requires companies in California to publish a statement disclosing companies’ efforts to prevent this potential abuse. This study evaluates the effectiveness of the California legislation by observing media trends and collecting expert interviews and data from business leaders, academics, and legislators. The data reveals both strengths and weaknesses in the California bill, which informs future attempts to create antislavery legislation addressing corporate supply chain abuses. The CTSCA …
Conflicting Approaches To Addressing Ex-Offender Unemployment: The Work Opportunity Tax Credit And Ban The Box, Katherine English
Conflicting Approaches To Addressing Ex-Offender Unemployment: The Work Opportunity Tax Credit And Ban The Box, Katherine English
Indiana Law Journal
Each year, roughly 700,000 prisoners are released from their six-by-eight-foot cells and back into society. Sadly, though, many of these ex-prisoners are not truly free. Upon returning to society, they often encounter several challenges that prevent them from resuming a normal, reintegrated lifestyle. For many, the difficulties associated with reentry prove to be too much, and within a short three years of their release, two-thirds of ex-offenders are rearrested, reconvicted, and thrown back into the familiar six-by-eight-foot cell. Recidivism might appear to be entirely the exoffenders’ fault, but ex-offenders are not solely responsible for these recidivism rates or the solution …

Jails Are Not Treatment Centers, Michael Henning, Rachel Mattick, Cali Turbes
Master of Social Work Student Policy Advocacy Briefs
Currently, in Minnesota alone, there are more individuals with severe mental illness being incarcerated than hospitalized. Blue Earth County's Yellow Line Project (YLP) reported that 83.7% of individuals screened positive for mental illness prior to being booked into jail . Not only does incarcerating individuals with mental illness fill our jails, it prolongs mental illness and time spent away from treatment. Jail diversion programs divert individuals with mental health disorders from the criminal justice system and into appropriate treatment when applicable. For those individuals ineligible for diversion from the criminal justice system, care coordination would be ideal to assist in …
(Bi)Sexuality And Victim Blame: How Observer Sexuality Affects Attributions Of Blame In A Case Of Acquaintance Sexual Assault With A Heterosexual Female Victim, Olivia Mann
Honors Thesis
This study examined the ways in which members of the heterosexual and queer communities assign blame in cases of sexual assault. Heterosexual, bisexual, and homosexual participants were recruited from Amazon mTurk. After reading a vignette depicting a sexual assault, participants completed a survey measuring variables like victim blame, empathy for and similarity to the victim and perpetrator, and rape myth acceptance (RMA). There appears to be a gender/sexuality interaction at play wherein males of all sexualities are significantly less victim-friendly than females of all sexualities and wherein there are significant differences between males of different sexualities. Significant differences were found …

Trust In The Jury System As A Predictor Of Juror/Jury Decisions, Kimberly S. Dellapaolera, Bailey A. Barnes, Brian H. Bornstein
UCARE: Research Products
To determine whether jurors’ attitudes are correlated with their verdicts and judgments at trial, the present experiments examined the relationship between individuals’ trust in the jury system, other legal attitudes, and their verdict judgments, at both the individual (juror) and group (jury) level. We used a binary logistic regression model to examine the factors—jury instructions and individual difference measures—that contribute to a juror’s verdict. The results indicate that jurors with higher PJAQ and JUST scores had a higher likelihood of voting guilty on a homicide trial involving a mercy killing. It was also found that the majority of juries in …
Connecting The Church Beyond Prison Ministry: Transitioning The Discipled Prisoner Into A Discipleship Community, Joyce Weathers
Connecting The Church Beyond Prison Ministry: Transitioning The Discipled Prisoner Into A Discipleship Community, Joyce Weathers
Doctoral Dissertations and Projects
The prison population in the United States surpasses all other countries on a per capita basis. The number of released inmates, who return to prison (recidivism) is staggering. In-prison Christian discipleship programs have successfully transitioned parolees into the free world, but little research has been done to confirm a standard practice for the transition process. Theories abound from clergy and laity alike; yet apathy and fear remain persistent deterrents. The church is confronted with a biblical mandate to assist the incarcerated (Matt. 25:36) and to make disciples (Matt. 28:19). By addressing the current concerns of church and prison ministry leaders, …

Path2 Services Court: A Process Evaluation, Octavio Jimenez
Master's Projects
In 2014, the Santa Clara County Superior Court received a Substance Abuse and Mental Health Services Administration (SAMHSA) grant to improve the efficacy of the Juvenile Treatment Court (JTC) and Court for the Individualized Treatment of Adolescents (CITA) programs by streamlining the referral, screening, and court hearing processes. Receipt of the grant allowed the Superior Court to integrate JTC and CITA to establish the Progress Achieved Through Hope and Holistic Services (PATH2 Services) Court.
This research analyzed whether the Santa Clara County Superior Court successfully integrated the JTC and CITA programs when it established PATH2 Services. In addition it determined …

The Santa Clara County Reentry Resource Center: Reentry Service Linkage And The One-Stop Shop Model, Rose Redlich
Master's Projects
AB 109 has resulted in a significantly greater need for reentry programs and services across California. Many county law enforcement officials now view reentry programs and services as a promising approach for keeping recidivism rates low.
Santa Clara County has recognized the value of well-coordinated, quick, and efficient reentry service delivery. In response to AB 109, the Office of the Sheriff and Department of Correction partnered with the Probation Department, Office of the County Executive, Behavioral Health Services Department, Custody Health Department, Ambulatory Care, and the Social Services Agency to establish the Santa Clara County Reentry Resource Center (SCCRC) in …

The Just Response To Crime: To Harm Or To Heal?, Matthew M. Silberstein
Philosophy Department Student Scholarship
In the realm of criminal justice, Western society has primarily relied on retributive justice system. A retributive system uses punishment as the standard response to crime. In recent years, some have formulated a different criminal justice system, that of restorative justice. Rather than punishment, restorative justice proponents argue that justice is achieved in the aftermath of crime by healing the trauma incurred by crime. The aim of this project is to articulate the value of restorative justice and evaluate its prospects.
The Normalization Of Prostitution In Switzerland: The Origin Of Policies, Corinne Isler, Marjut Jyrkinen
The Normalization Of Prostitution In Switzerland: The Origin Of Policies, Corinne Isler, Marjut Jyrkinen
Dignity: A Journal of Analysis of Exploitation and Violence
In this article, we examine how socio-political actors frame prostitution and problems attached to the phenomenon and what types of policies they suggest. The sex trade in Switzerland has been tolerated since 1942, and prostitution is protected under the economic freedom guaranteed by the Swiss constitution. Any critique of prostitution is viewed as counterproductive, claimed to be rooted in old-fashioned ideas about sexuality and thought to worsen the situation for women who sell sex. The role of sex buyers is largely obscured, and the presumed right to buy sex remains unquestioned.

Gatekeeping Decriminalization Of Prostitution: The Ubiquitous Influence Of The New Zealand Prostitutes' Collective, Janice G. Raymond
Dignity: A Journal of Analysis of Exploitation and Violence
This article explores the activities of The New Zealand Prostitutes' Collective (NZPC) in promoting decriminalization of prostitution and its role in gatekeeping this legislation. The NZPC has loomed large in the government’s evaluations of the decriminalization legislation known as the Prostitution Reform Act (PRA). It has collected information, partnered on the research team appointed by the Ministry of Justice to conduct the research, and ultimately secured seats as evaluators on the Prostitution Law Review Committee (PLRC) charged with assessing the research and making recommendations. Much of its outsized influence on the research and conclusions of this report is demonstrated in …
