Criminal Justice, Inc., John Rappaport Jan 2018

Criminal Justice, Inc., John Rappaport

Public Law and Legal Theory Working Papers

In the past decade, major retailers nationwide have begun to employ a private, for-profit system to settle criminal disputes, extracting payment from shoplifting suspects in exchange for a promise not to call the police. This Article examines what retailers’ decisions reveal about our public system of criminal justice and the concerns of the agents who run it, the victims who rely on it, and the suspects whose lives it alters. The private policing of commercial spaces is well known, as is private incarceration of convicted offenders. This Article is the first, however, to document how industry has penetrated new parts …

The Individual Determinants Of Support For Open Space Bond Referendums, Patrick Prendergast, Shanna Pearson-Merkowitz, Corey Lang Jan 2018

The Individual Determinants Of Support For Open Space Bond Referendums, Patrick Prendergast, Shanna Pearson-Merkowitz, Corey Lang

Political Science Faculty Publications

The ubiquitous use of ballot referendums in the public finance of land conservation means that conservation policy is often made at the individual voter level. However, studies to date have relied on either aggregate vote outcomes or surveys of residents of small geographic areas facing high growth. In this article, we utilize an original national survey to investigate a series of questions that pertain to individual opinion on open space preservation with a special focus on respondents’ perception of open space in their community. We find that most demographic variables that are determinants of open space and land use preferences …

The Social Dynamics Of Turbine Tourism And Recreation: Introducing A Mixed-Method Approach To The Study Of The First U.S. Offshore Wind Farm, Hollie Smith, Tiffany Smythe, Amelia Moore, David Bidwell, Jennifter Mccann

Marine Affairs Faculty Publications

Understanding the complex dynamics that influence energy transitions requires mixed methods and collaborations among researchers, resource managers, and communities. This essay details how an interdisciplinary team of researchers used a mixed-method approach to study the social dimensions of tourism and recreation as they relate to the first offshore wind farm in the United States, the Block Island Wind Farm. Although impacts to tourism from wind energy systems are widely cited as a concern by communities and policymakers, little work has sought to define what constitutes tourism and recreation impacts or provided empirical evidence of impacts from operating projects. Researchers adopted …

Organized Gaming And Its Effect On Collegiate Academics, Mark Cochran Jan 2018

Organized Gaming And Its Effect On Collegiate Academics, Mark Cochran

Honors Program Theses

With the emergence of gaming as an ever more popular pass time, and professional level eSports gaining steam, collegiate student organizations are beginning to reflect this change as well. This study of 166 college students from across the United States addresses the rise of gaming organizations and their subsequent effects of collegiate academics, namely grade point averages (GPA). The results suggest that participation in an organization dedicated to gaming results in a slightly lower GPA than those involved in other organizations, but still higher than average pointing towards factors of involvement still benefiting students. An important factor to note is …

This study aims to understand the information needs of Korean immigrant mothers in the United States for their high school children’s college preparation. A content analysis was conducted for the messages posted to a “motherhood” forum on the MissyUSA website. In total, 754 posts were analyzed in terms of a child’s grade, college preparation stage, type of post, and topic of post. The study found that there is a range of information needed at different stages in a child’s education. Many of the demonstrated information needs showed similarities to those of other immigrant groups, but there were also community-specific themes, …

Privileging Public Defense Research, Janet Moore, Ellen Yaroshefsky, Andrew Davies Jan 2018

Privileging Public Defense Research, Janet Moore, Ellen Yaroshefsky, Andrew Davies

Hofstra Law Faculty Scholarship

Empirical research on public defense is a new and rapidly growing field in which the quality of attorney-client communication is emerging as a top priority. For decades, law has lagged behind medicine and other professions in the empirical study of effective communication. The few studies of attorney-client communication focus mainly on civil cases. They also tend to rely on role-playing by non-lawyers or on post hoc inquiries about past experiences. Direct observation by researchers of real-time defendant-defender communication offers advantages over those approaches, but injecting researchers into the attorney-client dyad is in tension with legal and ethical precepts that protect …

Corporate Governance And Bankruptcy, Daniel J.H. Greenwood Jan 2018

Corporate Governance And Bankruptcy, Daniel J.H. Greenwood

Hofstra Law Faculty Scholarship

Ordinary corporate law invests enormous authority in corporate leaders, largely without accountability either to those they govern or to the judiciary, in defiance of much of what we know about effective governance procedure. Instead, we rely on the markets in which the corporation participates as the primary check on incumbent officials. Regardless of whether relying on markets is sufficient in the ordinary course, corporate insolvency is the markets' verdict that incumbent management has failed. Accordingly, in bankruptcy and insolvency more generally, the law ought to abandon its ordinary deference to the corporate powers that be and instead impose standard good …

All ETDs from UAB

ABSTRACT College health nurses (CHNs) play an essential role in student health services where they address a myriad of students’ health concerns. The purpose of this study was to gain an in-depth understanding of the CHNs’ perception of their role in nursing practice. The study focused on hearing nurses’ perspectives on what they considered their role to be in college health (CH) practice, and the challenges encountered in their role performance. This qualitative study utilized a phenomenological design to explore the lived experience of the CHN. The study comprised of 11 CHNs currently employed in five 4-year universities across a …

Evaluating Crime As A Negative Externality Of Hosting Mega-Events: Econometric Analysis Of The 2012 London Summer Olympics, Nicholas Le Jan 2018

Evaluating Crime As A Negative Externality Of Hosting Mega-Events: Econometric Analysis Of The 2012 London Summer Olympics, Nicholas Le

Economics Faculty Working Papers Series

Analysis of the benefits and the drawbacks of hosting large-scale sporting events like the Olympics or World Cup frequently ignore the effects of crime due to its relatively small economic impact in comparison to employment and consumption effects. Literature has frequently tied sporting events and tourism to crime, in addition to observing proximity effects on crime during sporting events. This research seeks to confirm both by implementing a difference-in-difference regression that can show whether crime increased during the Olympics, in particular in London boroughs which hosted venues for the Games. Ultimately, the research concludes that crime in London as a …

The Contributions Of Spiritual Formation Questions To Redeeming The Shadow Side Of Pastoral Identity, Natalie Hendrickson Jan 2018

The Contributions Of Spiritual Formation Questions To Redeeming The Shadow Side Of Pastoral Identity, Natalie Hendrickson

All Electronic Theses and Dissertations

There is a well-documented problem of shadow side issues, hidden sin or dysfunction, derailing many pastoral leaders and devastating families, congregations, and whole communities. In response to this problem, this Doctor of Ministry thesis project sought to explore the contributions of spiritual formation questions to redeeming the shadow side of pastoral identity. This researcher explored biblical questions and focused on the questions of Jesus in the Gospels to identify an efficacious spiritual formation approach to using questions in redemptive work. In addition, this researcher conducted more than a year of fieldwork with pastoral participants utilizing mixed-method data analysis. Quantitative data …

The Psychology Of Morality, Diane Sunar Jan 2018

The Psychology Of Morality, Diane Sunar

Online Readings in Psychology and Culture

Five questions regarding the nature of the moral sense, the origin of conscience, the development of morality, variability in the moral sense, and the relation of morality to behavior are examined from the point of view of four theoretical approaches (psychoanalytic theory, social learning theory, cognitive-developmental theory, and evolutionary psychology). In addition, some concepts and findings from outside the four approaches are also touched upon. The moral sense is shown to be complex, comprising cognitions, feelings, and behaviors. The theoretical approaches disagree regarding the issues of whether conscience directly reflects social teaching, or is constructed by the developing individual. They …

The Effects Of Using Expressive Intervention In Group Counseling On Acculturative Stress And Depressive Symptoms Among Korean Immigrant Women In South And Central Texas :A N Experimental Study, Sun-Kyung Chung

Dissertations

This study evaluated the relationship between acculturative stress and depressive symptoms in Korean immigrant women and evaluated the use of expressive group counseling interventions for these women's acculturative stress and depressive symptoms. Participants were randomly assigned to the intervention or control group. The intervention group received a total of four sessions of expressive group counseling interventions while the control group was asked to color pictures at home. Pearson correlations found statically significant relationships between acculturative stress and depressive symptoms in Korean immigrant women. The results of a one-way analysis of covariance (ANCOVA) indicated no statistically significant difference in the effect …

International Lobbying Law, Melissa J. Durkee Jan 2018

International Lobbying Law, Melissa J. Durkee

Articles

An idiosyncratic array of international rules allows “consultants” to gain special access to international officials and lawmakers. Historically, many of these consultants were public-interest associations like Amnesty International. For this reason, the access rules have been celebrated as a way to democratize international organizations, enhancing their legitimacy and that of the rules they produce. But a focus on the classic public-law virtues of democracy and legitimacy produces a theory at odds with the facts: Many of these international consultants are now industry and trade associations like the World Coal Association, whose principal purpose is to lobby for their corporate clients. …

Age-0 Walleye Growth Rates Following Spiny Water Flea Bythotrephes Longimanus Invasion, Joseph Amundson Jan 2018

Age-0 Walleye Growth Rates Following Spiny Water Flea Bythotrephes Longimanus Invasion, Joseph Amundson

Journal of Earth and Life Science

Within Voyageurs National Park, spiny water flea Bythotrephes longimanus has reduced Lake Kabetogama and Rainy Lake native zooplankton biomass during summer peak by 40-60%. Subsequently, planktivorous age-0 Yellow Perch Perca flavescens growth has decreased. A possible trophic cascade may influence predatory fish growth rates like that of age-0 Walleye Sander vitreus. Using seine net and electrofishing data, age-0 Walleye growth rates were modeled as a linear function of growing degree days (GDD) and the slope was compared between pre- and post-spiny water flea establishment. Nearby Lake Vermilion, assumed to have been unaffected by spiny water flea until 2015 and …

Back To The Garden: American Longing In John Updike’S Couples, Sue Norton Jan 2018

Back To The Garden: American Longing In John Updike’S Couples, Sue Norton

Books/Book Chapters

Published in 1968, John Updike’s Couples appeared in print only one year before the Woodstock Music and Art Fair of 1969, a quintessential moment in the lifespan of ‘the me generation.’ Though the novel’s action is set in the years 1962 and 1963, it met readers at a point in American social history when hippie culture and its various manifestos, such as ‘if it feels good, do it’ and ‘love the one you’re with,’ were affecting the national mind-set. The idea of ‘finding oneself’ gained traction even in bourgeois society, as it too began to countenance personal and sexual permissiveness. …

The Implications Of Social Skills On The Formation Of Relationships Between Indonesian Muslims And Japanese, Sachiko Nakano, Tomoko Tanaka Jan 2018

The Implications Of Social Skills On The Formation Of Relationships Between Indonesian Muslims And Japanese, Sachiko Nakano, Tomoko Tanaka

Papers from the International Association for Cross-Cultural Psychology Conferences

This study aims to investigate social skills adopted by Japanese people in Indonesia relevant to developing satisfactory interpersonal relationships with Indonesian Muslims. Twenty-seven Japanese people living in Indonesia were questioned on coping strategies used to overcome interpersonal difficulties (Nakano & Tanaka, 2016, July) and behaviors used to form satisfactory relationships. The results indicated that the subjects used two coping strategies: (1) cognitive, which involves understanding and tolerating cultural and religious characteristics or differences; and (2) behavioral, which involves accommodating one’s behavior to characteristics and differences, observation, and mimicry. It was also revealed that three specific skills are needed: …

Identifying Undergraduate Student's Motivation To Attend Tutoring For General Chemistry Courses, Alexis C. Hyacinthe

Honors Undergraduate Theses

General Chemistry II is a common chemistry course that is required for professional school such as, medical, dental, optometry schooling. Considering that it historically has a high drop, fail, withdrawal rate, it is surprising that less than 10% of students in chemistry II attend tutoring at the Student Academic Resource Center (SARC). In this tutoring center, sessions are led by students who have excelled previously in that specific course. The objective of this research is to investigate the relationship between student motivation and attendance in SARC peer tutoring sessions for chemistry II. More precisely, to better understand the connection between …

Communication & Theatre Arts Faculty Publications

The growth and prevalence of sport event ticket transactions on secondary ticket market platforms such as StubHub has led to the creation of a body of academic research studying this new phenomenon. Factors such as team performance and perceptions of fairness have been explored for their relationship with the price of secondary market tickets. This exploratory study introduces a new potential price determinant – social media activity – itself a popular online phenomenon that has inspired considerable academic research. This exploratory study of prices for eight National Football League games adds use of official team hashtags on Twitter to a …
