Striking The Right Balance: Hate Speech Laws In Japan, The United States, And Canada, Craig Martin Jan 2018

Striking The Right Balance: Hate Speech Laws In Japan, The United States, And Canada, Craig Martin

UC Law Constitutional Quarterly

This Article engages in a comparative examination of three different approaches to finding the right balance between legal limits on hate speech and the right to freedom of expression. The Japanese and American systems have struggled to find both a sufficiently important purpose to justify hate speech laws, or an appropriate limiting principle to narrow their scope. Neither system views hate speech laws as implicating equal protection rights, and so the balance is heavily in favor of freedom of speech. The American doctrine views hate speech laws as justifiable only if they can come within other ill-fitting categories of lesser-protected …

While illicit fentanyl and analogs are increasingly responsible for overdose-related deaths, prescription misuse is a significant risk factor for progression to illicit substance use. Methods: Survey data from a pilot medication safety campaign utilizing medication disposal pouches were evaluated by descriptive analysis and qualitative analysis. Survey findings were compared to data of all unintentional overdose-related deaths in Montgomery County from January to October, 2017. Secondary analysis of death data was performed …

Vicarious Retribution In U.S. Public Support For War Against Iraq, Peter Liberman, Linda J. Skitka Jan 2018

Vicarious Retribution In U.S. Public Support For War Against Iraq, Peter Liberman, Linda J. Skitka

Publications and Research

U.S. public anger and desires to avenge the 11 September 2001 terror attacks were redirected toward Iraq partly because of its identity as an Arab and Muslim state. Online panel survey data reveal that citizens who were relatively angry about the terror attacks were more belligerent toward Iraq, and that this effect was strongest among those who perceived Arabs and Muslims in monolithic terms. Angry desires to avenge 9/11 were more persistent for those who saw Arabs and Muslims in that light, and their effects on war support were partially mediated by worsened feelings about Arabs and Muslims in general. …

Costa Rica currently has a booming eco-tourism industry important to the Costa Rican economy. The environment in Costa Rica is not only …

Social Media Usage And Romantic Development: Testing Attachment Anxiety And Avoidance As Moderators, Molly D. Moeller Jan 2018

Social Media Usage And Romantic Development: Testing Attachment Anxiety And Avoidance As Moderators, Molly D. Moeller

Undergraduate Research Journal

Social media use is linked with the development and maintenance of romantic relationships, exhibiting both positive and negative effects on relationship quality depending on the social media behavior. However, many of these studies focus on a singular social media platform rather than multiple social media platforms. Also, studies on Facebook have linked anxious attachment to more surveillance and Facebook-induced jealousy (Marshall, Benjanyan, Di Castro, & Lee, 2013). Thus, the impact of social media behaviors for relationship quality may depend on attachment behaviors. Therefore, the goal of the current study is to examine how attachment avoidance and attachment anxiety predict relationship …

Teacher And Student Demographic Variables Which Predict Teacher Referral Of Males For Special Education Evaluation, Sandra Harris, Sandra Harris Jan 2018

Teacher And Student Demographic Variables Which Predict Teacher Referral Of Males For Special Education Evaluation, Sandra Harris, Sandra Harris

Walden Faculty and Staff Publications

Past research has shown that African American/Black males are referred for special education evaluation at disproportionately higher rates compared to males of other racial/ethnic groups. Special education placement for African American/Black /Black males has been linked to adverse outcomes such as lower teacher expectations, low academic performance, and increased likelihood of dropping out of school. This study addressed the question of whether student and teacher demographic variables predicted how likely a teacher would refer male students for special education evaluation and whether there were significant differences in teacher ratings of severity of behavior based on race/ethnicity of male students. Principles …

Conceptual Framework For A Curriculum In Social Change, Iris M. Yob

Walden Faculty and Staff Publications

Colleges, universities, and many high schools are expressing their mission in terms of creating social change or contributing to the common good. Such a mission suggests that if they are going to graduate students who will fulfill this mission, they will need to consider how they will best prepare students to do this. The conceptual framework for a curriculum in social change in this article offers a holistic approach, taking into account what a student should know, be able to do, and what values and attitudes should be nurtured. To that end, the article identifies three competencies in the knowledge …

The Influence Of Religion And Spirituality On Hiv Prevention Among Black And Latino Men Who Have Sex With Men, New York City, Kathryn Drumhiller, Jose Nanín, Zaneta Gaul, Madeline Y. Sutton

Publications and Research

The influence of religion and spirituality (R/S) on HIV prevention has been understudied, especially for Black and/or Latino men who have sex with men (BLMSM), who bear a disproportionate burden of HIV, and who are part of racial/ethnic communities with high engagement in R/S. The specific aim of this study was to explore perspectives about R/S among BLMSM to inform HIV prevention strategies and reduce HIV-related health disparities. Data from 105 qualitative interviews with BLMSM were analyzed; 58 (55%) stated that R/S had no personal influence on HIV prevention. For those reporting any R/S influence, main themes were: (1) R/S …

Elvis Has Left The Library: Identifying Forged Annotations In A Book Of Mormon, Keith A. Erekson Jan 2018

Elvis Has Left The Library: Identifying Forged Annotations In A Book Of Mormon, Keith A. Erekson

BYU Studies

For nearly three decades, the ghost of Elvis Presley has hung over the historical collections of The Church of Jesus Christ of Latter-day Saints. In 1989, a copy of the Book of Mormon was donated that contained marginal annotations purportedly by the “King of Rock and Roll.” Word of the acquisition spread quickly by fireside speakers, classroom teachers, and newspaper columnists. Requests to see and touch the book came repeatedly, so much so that by 2002 the book’s binding had cracked and a digital copy was made for visitors who came each week for a peek. In 2007, an independent …

Overcoming Roadblocks To Reaching Settlement In Family Law Cases, John M. Lande Jan 2018

Overcoming Roadblocks To Reaching Settlement In Family Law Cases, John M. Lande

Faculty Publications

In “litigation as usual,” settlement often comes only after adversarial posturing, the original conflict escalates, the relationships deteriorate, the process takes too long and costs too much, and nobody is really happy with the resolution. This article describes roadblocks to negotiation and ways to overcome them to reach good settlements in family law cases.

Truth In A Post-Truth Society: How Sticky Defaults, Status Quo Bias, And The Sovereign Prerogative Influence The Perceived Legitimacy Of International Arbitration, S. I. Strong Jan 2018

Truth In A Post-Truth Society: How Sticky Defaults, Status Quo Bias, And The Sovereign Prerogative Influence The Perceived Legitimacy Of International Arbitration, S. I. Strong

Faculty Publications

Through empirical and theoretical studies conducted by political scientists, philosophers, psychologists, and economists, this Article demonstrates how three phenomena - sticky defaults, status quo bias, and the sovereign prerogative-work in parallel to create enduring, but demonstrably incorrect, perceptions about the legitimacy of international arbitration. Interdisciplinary research also provides a potential solution in the form of a heuristic known as the Reversal Test, which acts as an objective diagnostic tool to identify the influence of unconscious cognitive distortions such as the status quo bias. Through this analysis, this Article not only addresses one of the core paradoxes in international dispute resolution, …

Globalisation And The Muslim Ummah: Issues, Challenges, And The Ways Out, Rashid Ating Jan 2018

Globalisation And The Muslim Ummah: Issues, Challenges, And The Ways Out, Rashid Ating

Research Publications (2016 to 2020)

Globalisation is a phenomenon and a process that is aspiring to transform the entire world into a single political and economic system through the rapid movement of goods and people across the planet in the most rapid speed ever witnessed in the history of mankind. This paper is a theoretical and conceptual research which investigates the dilemmas of the Muslim ummah in the era of globalisation. The problem is the way the global forces are threatening to obliterate all cultures and civilisations in favour for non-conforming Western political and economic arrangements. The research uses a qualitative method of data collection …

Feminist Judging Matters: How Feminist Theory And Methods Affect The Process Of Judgment, Linda L. Berger, Bridget J. Crawford, Kathryn M. Stanchi Jan 2018

Feminist Judging Matters: How Feminist Theory And Methods Affect The Process Of Judgment, Linda L. Berger, Bridget J. Crawford, Kathryn M. Stanchi

Scholarly Works

Professor Linda Berger rejoins her Feminist Judgments: Rewritten Opinions of the United States Supreme Court coauthors in this essay presenting feminism as the foundation for a developing form of rich, complex, and practical legal scholarship-the lens and the means through which we may approach and resolve many legal problems. First, this essay explores the intellectual foundations of feminist legal theory and situates the United States and international feminist judgments projects within that scholarly tradition. It next considers how the feminist judgments projects move beyond traditional academic scholarship to bridge the gap between the real-world practice of law and feminist theory. …

A Genealogy Of Programmatic Stop And Frisk: A Discourse-To-Practice-Circuit, Frank Rudy Cooper Jan 2018

A Genealogy Of Programmatic Stop And Frisk: A Discourse-To-Practice-Circuit, Frank Rudy Cooper

Scholarly Works

President Trump has called for increased use of the recently predominant policing methodology known as programmatic stop and frisk. This Article contributes to the field by identifying, defining, and discussing five key components of the practice: (1) administratively dictated (2) pervasive Terry v. Ohio stops and frisks (3) aimed at crime prevention by means of (4) data-enhanced profiles of suspects that (5) target young racial minority men. Whereas some scholars see programmatic stop and frisk as solely the product of individual police officer bias, this Article argues for understanding how we arrived at specific police practices by analyzing three levels …

A Wesleyan Missiological Perspective On Holiness Across Cultures, Marcus W. Dean Jan 2018

A Wesleyan Missiological Perspective On Holiness Across Cultures, Marcus W. Dean

The Asbury Journal

Missiology has focused on various aspects of contextualization and the importance of salvation, but has not dealt extensively with the biblical concept of holiness. From a Wesleyan perspective this paper looks at holiness from the lens of contextualization. A biblical support of contextualization is presented. Then the cultural factors of values—the dynamics of shame, guilt, and fear are explored— and purity are examined as starting points to contextualize the holiness message. While holiness is ultimately about ethical life and relationships, the message must be built upon culturally understandable concepts.

Methodism In An Orthodox Context: History, Theology, And (Sadly) Politics, Mark R. Elliott Jan 2018

Methodism In An Orthodox Context: History, Theology, And (Sadly) Politics, Mark R. Elliott

The Asbury Journal

The history of Methodism and Eastern Orthodoxy goes back to the early days of Wesley and his interest in the teachings of the Greek Church Fathers. The relationship between Methodists and the Orthodox Church has gone through positive and negative periods, but the growth of the Soviet Union and the challenge of Communism placed new challenges on both groups. The emergence of the Russian Orthodox Church and its reaction to growing Protestant missions has led to new problems, although the ongoing hope is that commonalities in our theology will overcome some of the challenges of current political realities. This paper …

The Paradoxical Experiences Of Young Hispanic College Students: Academic Success In The Face Of Age-Related Stigma, Marilyn Garcia Jan 2018

The Paradoxical Experiences Of Young Hispanic College Students: Academic Success In The Face Of Age-Related Stigma, Marilyn Garcia

Open Access Theses & Dissertations

There has been growth in programs such as the Early College High School Initiative in order to address the inequalities that racial/ethnic minorities, such as Hispanics, face when it comes to pursuing a higher education. As a result, there has been an increase of nontraditionally aged students (i.e., young students under 18) in higher education. Despite likely increases in young students attending universities, little is known about the young students' academic performance and the challenges they face while attending college; this Thesis addresses that limitation through two studies using institutional and interview data from one university. The first study used …

An Economic Framework Of Collective Action During The Korean War, Nicole C. Ruiz Jan 2018

An Economic Framework Of Collective Action During The Korean War, Nicole C. Ruiz

Open Access Theses & Dissertations

Collective action, the coordinated effort between multiple actors, continues to play a role in the international community. In an increasingly complex operational environment, understanding the dynamics of these coordinated efforts is necessary for intelligence analysts. This research seeks to address the question: How can economic methodology be used to understand collective action during the Korean War for future use in intelligence analysis? The Korean War consisted of two different collective action groups going against each other militarily and ultimately diplomatically, which is why it is a suitable case study for understanding the nature of collective action. The research provides an …
