Regulating The “Too Big To Jail” Financial Institutions, Jerry W. Markham Jan 2018

Regulating The “Too Big To Jail” Financial Institutions, Jerry W. Markham

Brooklyn Law Review

This article addresses the “too big to jail” regulatory model in which large banks pay hundreds of billions of dollars to settle multiple and duplicative regulatory charges brought by a horde of state, federal, and even foreign regulators. The banks pay those massive settlements in order to keep their banking charters and to obtain immunity from prosecution for senior executives. In turn, regulators benefit from the headlines these fines generate. Much criticism has been directed at these settlements because the banks are allowed to continue business as usual and no senior executives are jailed. Other critics contend that these settlements …

Loving Lessons: White Supremacy, Loving V. Virginia, And Disproportionality In The Child Welfare System, Leah A. Hill Jan 2018

Loving Lessons: White Supremacy, Loving V. Virginia, And Disproportionality In The Child Welfare System, Leah A. Hill

Fordham Law Review

Part I of this Article introduces a brief discussion of the history of antimiscegenation laws and, specifically, their prevalence in the Commonwealth of Virginia during the 1950s. Next, Part II sets forth a short commentary about the Lovings’ triumph over antimiscegenation. Part III then details the Lovings’ judicial hurdles against the state, which argued that its antimiscegenation laws were enacted, in part, to prevent child abuse and thus served legitimate state interests. Part IV argues that the remnants of the white supremacist ideology at the center of Loving appear in our modern child welfare system, which has long been plagued …

National Security, Islamophobia, And Religious Freedom In The U.S., Rosemary Hancock Jan 2018

National Security, Islamophobia, And Religious Freedom In The U.S., Rosemary Hancock

Arts Papers and Journal Articles

A central argument in Hurd’s (2015) Beyond Religious Freedom is that the religious freedom policy framework pursued by the United States not only entrenches lines of division between religious faiths, but also is constructive of those very divisions. Where foreign and domestic policies purport to promote tolerance and respectful pluralism in the name of religious freedom, Hurd (2015, 41) contends they instead create ‘new forms of social friction defined by religious difference.’ Utilizing Hurd’s (2015) categories of Official, Governed, and Lived religion I examine Islamophobia and the racialization of Muslims in the United States and demonstrate how over-identification with religious …

Where Should My Child Go To School? Parent And Child Considerations In Binational Families, Edmund T. Hamann, Víctor Zúñiga, Juan Sánchez García Jan 2018

Where Should My Child Go To School? Parent And Child Considerations In Binational Families, Edmund T. Hamann, Víctor Zúñiga, Juan Sánchez García

Department of Teaching, Learning, and Teacher Education: Faculty Publications

Using examples encountered from our multi-year study of students encountered in Mexican schools with prior experience in US schools, we look at transnationally-tied families’ decision-making regarding where to send their children to school and ask whether parents should ‘parent from afar’. We don’t pose that as a question about ideals— what would be best if parents had economic security and unambiguous legal residential status— but rather as a more pragmatic one. Given some parents’ and children’s limited agency in real- world circumstances, what is their best path forward?

Mimosa 2017/2018, Jacksonville State University Jan 2018

Mimosa 2017/2018, Jacksonville State University

JSU Yearbooks

The JSU Yearbook Collection spans the years from 1926 to the present. The publication began in 1926 as the Teacola (some volumes spelled "Teacoala") and continued under this title through 1933. The yearbook appears to have ceased printing after that year; the student newspaper took the name Teacola (later changed to the Collegian and finally the Chanticleer) and began publication in 1934. The yearbook started up again in 1947 under the name Mimosa. The Library holds all volume years that were printed: 1926-1933, 1947-1950, 1952-present.

Cyber Security And Risk Society: Estonian Discourse On Cyber Risk And Security Strategy, Lauren Kook Jan 2018

Cyber Security And Risk Society: Estonian Discourse On Cyber Risk And Security Strategy, Lauren Kook

Copyright, Fair Use, Scholarly Communication, etc.

The main aim of this thesis is to call for a new analysis of cyber security which departs from the traditional security theory. I argue that the cyber domain is inherently different in nature, in that it is lacking in traditional boundaries and is reflexive in nature. Policy-makers are aware of these characteristics, and in turn this awareness changes the way that national cyber security strategy is handled and understood. These changes cannot be adequately understood through traditional understanding of security, as they often are, without missing significant details. Rather, examining these changes through the lens of Ulrich Beck’s risk …

Trust-Based Rating Prediction And Malicious Profile Detection In Online Social Recommender Systems, Anahita Davoudi Jan 2018

Trust-Based Rating Prediction And Malicious Profile Detection In Online Social Recommender Systems, Anahita Davoudi

Electronic Theses and Dissertations

Online social networks and recommender systems have become an effective channel for influencing millions of users by facilitating exchange and spread of information. This dissertation addresses multiple challenges that are faced by online social recommender systems such as: i) finding the extent of information spread; ii) predicting the rating of a product; and iii) detecting malicious profiles. Most of the research in this area do not capture the social interactions and rely on empirical or statistical approaches without considering the temporal aspects. We capture the temporal spread of information using a probabilistic model and use non-linear differential equations to model …

Serving Up Allergy Labeling: Mitigating Food Allergen Risks In Restaurants, Marie C. Boyd Jan 2018

Serving Up Allergy Labeling: Mitigating Food Allergen Risks In Restaurants, Marie C. Boyd

Faculty Publications

Allergens in restaurant food cause many allergic reactions and deaths. Yet no federal, state, or local law adequately protects people from these harms. Although federal law requires the labeling of “major food allergens” in packaged food, there are no allergen labeling requirements for restaurant-type food. In addition, existing food safety requirements for restaurants are inadequate to prevent allergen cross contact.

The existing legal scholarship on food allergens in restaurants is limited. Much of the legal scholarship on labeling in restaurants focuses on menu labeling — the provision of calorie and other nutrition information to combat obesity. The requirements of Section …

Integrative Biology Faculty and Staff Publications

Helping faculty develop high-quality instruction that positively affects student learning can be complicated by time limitations, a lack of resources, and inexperience using student data to make iterative improvements. We describe a community of 16 faculty from five institutions who overcame these challenges and collaboratively designed, taught, iteratively revised, and published an instructional unit about the potential effect of mutations on DNA replication, transcription, and translation. The unit was taught to more than 2000 students in 18 courses, and student performance improved from preassessment to postassessment in every classroom. This increase occurred even though faculty varied in their instructional practices …

La Ciudad De Las Letradas: Reescribiendo Santo Domingo En La Narrativa Femenina Urbana Dominicana Del Nuevo Milenio, Lucía M. Montás Jan 2018

La Ciudad De Las Letradas: Reescribiendo Santo Domingo En La Narrativa Femenina Urbana Dominicana Del Nuevo Milenio, Lucía M. Montás

Theses and Dissertations--Hispanic Studies

In the last few decades, Dominican female writers have contributed significantly to the literary representation of the city of Santo Domingo and urban life. This dissertation studies how these female writers produce a cultural paradigm for criticizing the urban crisis in the Dominican Republic that at times is at odds with much narrative written by men and with key concepts in Urban Theory that are taken for granted. The authors I study, Ángela Hernández, Emilia Pereyra, Emelda Ramos, Aurora Arias and Rita Indiana Hernández, understand the city and redefine the urban model by expressing their dissatisfaction in the civilizing and …

Finding Moments Of Meaning In Undergraduate Education: How The Scholarship Of Teaching And Learning Can Help, Jeffrey L. Bernstein Jan 2018

Finding Moments Of Meaning In Undergraduate Education: How The Scholarship Of Teaching And Learning Can Help, Jeffrey L. Bernstein

International Journal for the Scholarship of Teaching & Learning

I argue for the value of high-impact educational practices as tools to minimize the commoditization of higher education. As a vehicle for doing so, I discuss a travel course to Washington, D.C. that I have led. This course is a significant and meaningful learning experience for the students who participate. In reflecting upon the value of this course, I suggest that scholars of teaching and learning have a particular responsibility to resist the increasing commoditization of higher education. Instead, we must think about embedding significant and transformative elements into the curriculum. Scholars of teaching and learning must help to demonstrate, …

Observing And Deterring Social Cheating On College Exams, Richard J. Fendler, Michael C. Yates, Jonathan M. Godbey Jan 2018

Observing And Deterring Social Cheating On College Exams, Richard J. Fendler, Michael C. Yates, Jonathan M. Godbey

International Journal for the Scholarship of Teaching & Learning

This research introduces a unique multiple choice exam design to observe and measure the degree to which students copy answers from their peers. Using data collected from the exam, an empirical experiment is conducted to determine whether random seat assignment deters cheating relative to a control group of students allowed to choose their seats. Empirical results demonstrate a significant decline in measured cheating within the assigned seating sample. This study contributes to the literature by providing a measurement of actual cheating frequency among students, as opposed to relying on reported cheating in anonymous surveys, and by demonstrating that an easily …

Challenges To Disciplinary Knowing And Identity: Experiences Of Scholars In A Sotl Development Program, Janice E. Miller-Young Dr, Michelle Yeo, Karen Manarin

International Journal for the Scholarship of Teaching & Learning

Faculty members from five years of an annual Scholarship of Teaching and Learning (SoTL) development program were invited to participate in a study about the impact of SoTL on their teaching, scholarship, and career trajectory. During semi-structured interviews, many expressed feeling discomfort during their journey into SoTL. A qualitative analysis using the constant comparison method showed that this discomfort was sometimes due to contrasts between SoTL and their discipline’s epistemology, as well as challenges to their identity as a teacher, researcher, and a colleague. We conclude with suggestions for how faculty development and multidisciplinary SoTL communities of practice can be …

Death In Life And Life In Death: Forms And Fates Of The Human, Connor Graham, Alfred Montoya Jan 2018

Death In Life And Life In Death: Forms And Fates Of The Human, Connor Graham, Alfred Montoya

Sociology & Anthropology Faculty Research

This chapter traces the origins, meanings and characteristics of “the human” in recent time – its forms. The chapter contends that, instead of being immutable, “the human” has taken different forms, been ascribed different meanings, and exhibited different characteristics over time. Our approach to “the human” contributes to this volume on digital existence, which confronts existential questions centered on being and technology, with historical and anthropological awareness. We aim to show, through Foucault’s (1971 ) insistence upon the forms of subjectivity as opposed to its substance, how understandings of “the human” are subject to change and transformation. Exploring these diverse …

Machine-Learning-Based Quantitative Estimation Of Soil Organic Carbon Content By Vis/Nir Spectroscopy, Jianli Ding, Aixia Yang, Jingzhe Wang, Vasit Sagan, Danlin Yu Jan 2018

Machine-Learning-Based Quantitative Estimation Of Soil Organic Carbon Content By Vis/Nir Spectroscopy, Jianli Ding, Aixia Yang, Jingzhe Wang, Vasit Sagan, Danlin Yu

Department of Earth and Environmental Studies Faculty Scholarship and Creative Works

Soil organic carbon (SOC) is an important soil property that has profound impact on soil quality and plant growth. With 140 soil samples collected from Ebinur Lake Wetland National Nature Reserve, Xinjiang Uyghur Autonomous Region of China, this research evaluated the feasibility of visible/near infrared (VIS/NIR) spectroscopy data (350-2,500 nm) and simulated EO-1 Hyperion data to estimate SOC in arid wetland regions. Three machine learning algorithms including Ant Colony Optimization-interval Partial Least Squares (ACO-iPLS), Recursive Feature Elimination-Support Vector Machine (RF-SVM), and Random Forest (RF) were employed to select spectral features and further estimate SOC. Results indicated that the feature wavelengths …

Analysis Of The Racial And Ethnic Representation Of Adult Male Inmates In Large Jail Isolation Units In The United States, Lance E. Bohn, Stephen A. Morreale

Walden Faculty and Staff Publications

Black males are overrepresented in US large jails, and this overrepresentation may extend into their isolations units, or DHUs. While overrepresentation in prison populations has been explored and well documented in academic literature. Far less is known about overrepresentation in jail populations where prisoners serve far less time, and in some cases, may not yet be convicted of crimes. The study analyzed the classification of adult male prisoners to DHU within large jails. This central research question of the study primarily focused on exploring the causes and prevalence of overrepresentation in DHUs in jails based on race or ethnicity. The …

Staging Uncle Tom's Cabin In Tehran, Debra J. Rosenthal Jan 2018

Staging Uncle Tom's Cabin In Tehran, Debra J. Rosenthal

2018 Faculty Bibliography

As Harriet Beecher Stowe’s novel Uncle Tom’s Cabin traveled around the world, it was molded by the imaginations and needs of international audiences. For over 150 years it has been coopted for a dazzling array of causes far from what its author envisioned. This book tells thirteen variants of Uncle Tom’s journey, explicating the novel’s significance for Canadian abolitionists and the Liberian political elite that constituted the runaway characters’ landing points; nineteenth-century French theatergoers; liberal Cuban, Romanian, and Spanish intellectuals and social reformers; Dutch colonizers and Filipino nationalists in Southeast Asia; Eastern European Cold War communists; Muslim readers and …
