The Case Against Qualified Immunity, Joanna C. Schwartz
The Case Against Qualified Immunity, Joanna C. Schwartz
Notre Dame Law Review
If the Court did find an appropriate case to reconsider qualified immunity, and took seriously available evidence about qualified immunity’s historical precedents and current operation, the Court could not justify the continued existence of the doctrine in its current form. Ample evidence undermines the purported common-law foundations for qualified immunity. Research examining contemporary civil rights litigation against state and local law enforcement shows that qualified immunity also fails to achieve its intended policy aims. Qualified immunity does not shield individual officers from financial liability. It almost never shields government officials from costs and burdens associated with discovery and trial in …

Taking "Great Care": Defining Victims Of Hate Speech Targeting Religious Minorities, Whittney Barth
Taking "Great Care": Defining Victims Of Hate Speech Targeting Religious Minorities, Whittney Barth
Chicago Journal of International Law
This Comment explores the intersection of race and religion in cases brought before the Human Rights Committee alleging violations of Article 20(2) of the International Covenant on Civil and Political Rights. This article proposes a positive requirement for states parties to prohibit hate speech. Specifically, the following analysis considers Committee determinations of standing in cases brought by Muslims living in Europe who sought to challenge a state party's response to discriminatory remarks made by public figures. This Comment argues that these determinations, which appear to implicitly endorse a lower threshold for group standing when both race and religion are under …
Perceptions Of Missouri School Superintendents And School Resource Officers Regarding Preparedness For Multi-Hazard Events, Jennifer Renae Wheeler Lofton
Perceptions Of Missouri School Superintendents And School Resource Officers Regarding Preparedness For Multi-Hazard Events, Jennifer Renae Wheeler Lofton
Dissertations
The purpose of this study was to garner the perceptions of superintendents and school resource officers in regard to district preparedness for multi-hazard events. Nationwide, schools are facing dramatic changes in the area of safety and security due to natural disasters, and more commonly, manmade hazards (Schaffhauser, 2013). Routinely, school personnel do not have the mindset, nor are they equipped, to respond to a major crisis (Trump, 2012). Recent mass murders and natural disasters in the United States have prompted districts to reach beyond the walls of their schools and into local communities for support (Gereluk, Donlevy, & Thompson, 2015). …
Cleaning Up Our Toxic Coasts: A Precaution And Human Health-Based Approach To Coastal Adaptation, Robin Kundis Craig
Cleaning Up Our Toxic Coasts: A Precaution And Human Health-Based Approach To Coastal Adaptation, Robin Kundis Craig
Utah Law Faculty Scholarship
Hurricanes in the United States in 2005, 2012, and 2017 have all revealed an insidious problem for coastal climate change adaptation: toxic contamination in the coastal zone. As sea levels rise and violent coastal storms become increasingly frequent, this legacy of toxic pollution threatens immediate emergency response, longer term human health, and coastal ecosystems’ capacity to adapt to changing coastal conditions.
Focusing on Hurricane Harvey’s 2017 devastation of Houston, Texas, as its primary example, this Article first discusses the toxic legacy still present in many coastal environments. It then examines the existing laws available to clean up the coastal zone—CERCLA, …
Why Don’T We Have A Peace Memorial? The Vietnam War And The Distorted Memory Of Dissent, Christian G. Appy
Why Don’T We Have A Peace Memorial? The Vietnam War And The Distorted Memory Of Dissent, Christian G. Appy
Center for the Study of Ethics in Society Papers
First paragraph:
Exactly a year before he was murdered, Martin Luther King Jr., gave one of the greatest speeches of his life, a piercing critique of the war in Vietnam. Two thousand people jammed into New York’s Riverside Church on April 4,1967, to hear King shred the historical, political, and moral claims U.S. leaders had invoked since the end of World War II to justify their counter-revolutionary foreign policy. The United States had not supported Vietnamese independence and democracy, King argued, but had repeatedly opposed it; the United States had not defended the people of South Vietnam from external Communist …
Evaluation Of Fiber Reinforced Polymer (Frp) Strengthening For Deteriorated Bridge Bent Caps, Yazan Almomani
Evaluation Of Fiber Reinforced Polymer (Frp) Strengthening For Deteriorated Bridge Bent Caps, Yazan Almomani
Civil Engineering Dissertations - Archive
Deterioration of aging highway bridges has been a serious concern in the U. S. A. Almost 39% percent of all bridges in the country have passed their 50-year design life, and approximately 9% of these bridges are structurally deficient due to concrete deterioration and truck weight increases on highways. Compared to superstructures, the deterioration of bridge substructures and associated repair/strengthening/evaluation has received much less attention in previous studies. A reinforced concrete bridge built in 1940 and located in Dallas, Texas, exhibited moderate to severe corrosion related concrete deterioration in the bent caps. Eight such bent caps were selected herein for …

Deploying The Secret Police: The Use Of Algorithms In The Criminal Justice System, Jessica Gabel Cino
Deploying The Secret Police: The Use Of Algorithms In The Criminal Justice System, Jessica Gabel Cino
Georgia State University Law Review
Algorithms saturate our lives today; from curated song lists to recommending “friends” and news feeds, they factor into some of the most human aspects of decision-making, tapping into preferences based on an ever-growing amount of data. Regardless of whether the algorithm pertains to routing you around traffic jams or finding your next dinner, there is little regulation and even less transparency regarding just how these algorithms work. Paralleling this societal adoption, the criminal justice system now employs algorithms in some of the most important aspects of investigation and decision-making.
The lack of oversight is abundantly apparent in the criminal justice …
A Discouraging Omen: A Critical Evaluation Of The Approved Uniform Language For Testimony And Reports For The Forensic Latent Print Discipline, Simon A. Cole
Georgia State University Law Review
The theme of the 2018 Georgia State University Law Review symposium is the Future of Forensic Science Reform. In this Article, I will assess the prospects for reform through a critical evaluation of a document published in February 2018 by the United States Department of Justice (DOJ), the Approved Uniform Language for Testimony and Reports for the Forensic Latent Print Discipline (ULTR).
I argue that this document provides reason to be concerned about the prospects of forensic science reform. In Part I, I discuss the background of the ULTR. In Part II, I undertake a critical evaluation of the ULTR. …
Three Transformative Ideals To Build A Better Crime Lab, Nicole B. Cásarez, Sandra G. Thompson
Three Transformative Ideals To Build A Better Crime Lab, Nicole B. Cásarez, Sandra G. Thompson
Georgia State University Law Review
This Article proposes that policy makers should consider establishing their jurisdiction’s crime laboratories as government corporations independent of law enforcement as a means of improving their quality and efficiency. Simply building new buildings or seeking accreditation will not solve the endemic problems that crime laboratories have faced. Rather, we propose that crime laboratories be restructured with a new organizational framework comparable to the Houston Forensic Science Center's (HFSC) status as a local government corporation (LGC), which has proven to be conducive to creating a new institutional culture.
From our experience with the HFSC, we also believe that crime laboratories are …

A Forgotten Founder: The Life And Legacy Of Christopher Gadsden, Kelcey M. Eldridge
All Theses
This study examines the life and legacy of Christopher Gadsden. Specifically, it explores Gadsden's understanding of individual and colonial rights, proper channels of protest, and early republicanism. It is through the discussion of these topics that this thesis highlights the importance of studying the individual reaction to the American Revolution and independence. Additionally, this study highlights the fact that many of the terms we use to describe these Revolutionary figures, such as radical or conservative, are not adequate — each individual experienced many changes in their life that led to their support of independence. Furthermore, this study opens the door …
Smart Sentencing Guidelines: The Effect Of Marginal Policy Changes On Recidivism, Sarah M. Estelle, David C. Phillips
Smart Sentencing Guidelines: The Effect Of Marginal Policy Changes On Recidivism, Sarah M. Estelle, David C. Phillips
Faculty Publications
Public appeals regarding criminal justice have shifted somewhat from “tough on crime” to “smart justice” that is more lenient when tradeoffs merit it. Among other considerations, smart sentencing policy depends on how sentence severity affects recidivism. Using administrative data on two common non-violent felonies committed by adults in Michigan, we measure the effect of sentences on offenders' future criminal activity. Discontinuities in the legislative guidelines that constrain sentences chosen by Michigan judges provide exogenous variation in sentence severity. Harsher sentences generated by sentencing guidelines significantly reduce recidivism by felony shoplifters but not repeat drunk drivers. Recidivism falls most for young, …

The Integration Of Creative And Expressive Arts In A Young Adult Problem-Solving Court, Ricky J. Pope
Dissertations
Interaction with the criminal justice system exacts substantial costs on human potential, and alternative practices are emerging to address this social issue. This research explores the integration of creative and expressive arts in a young adult problem-solving court. The Young Adult Diversion Court (YADC) was created to help young adults 17- 20 years of age complete requirements for probation. Successful completion of the program provides participants the opportunity for the initial criminal charge to be dismissed and made non-public on the criminal record. This qualitative study is informed by interpretive interactionism and narrative inquiry to provide a method to understand …

9-1-1 Leadership: Perceptions Of Evidence-Based Quality Improvement, Steven C. Sharpe
Education Doctoral
The quality of 9-1-1 services can mean the difference between life and death. In 2015, national 9-1-1 organizations created a minimum standard for Public Safety Answering Point (PSAP) comprehensive quality improvement programs, yet there is no mandate for PSAPs to adopt such standards. This study focuses on quality improvement perceptions among New York State (NYS) wireless PSAP leaders from an evidence-based management theory framework. The study addresses the primary research question: How do NYS wireless PSAP leaders support effective implementation of quality care? Using directed content analysis out-transcripts from focus group sessions with NYS wireless PSAP leaders, the following themes …
The Public Service Loan Forgiveness Program: The Need For Better Employment Eligibility Regulations, Gregory Crespi
The Public Service Loan Forgiveness Program: The Need For Better Employment Eligibility Regulations, Gregory Crespi
Buffalo Law Review
A few people have now applied for and obtained tax-exempt debt forgiveness of their federal student Direct Loans under the Public Service Loan Forgiveness (PSLF) program after satisfying the requirements of 10 years of post-October 1, 2007 employment in a “public service job.” While only a relatively small number of people have received debt forgiveness to date, I estimate that as the number of persons eligible ramps up sharply in 2018 and thereafter eventually 200,000 people a year or more will obtain debt forgiveness under the PSLF program, at a total cost to the Treasury of $12 billion per year …
Secure Device And Knowledge Discovery In Internet Of Things, Shahab Taregh Tayeb
Secure Device And Knowledge Discovery In Internet Of Things, Shahab Taregh Tayeb
UNLV Theses, Dissertations, Professional Papers, and Capstones
With the ever-growing adoption of Internet of Things (IoT), there is continued development and deployment of new nodes with various capabilities and services. Such heterogeneity introduces complexity and a significant need for neighbor service discovery frameworks. Because the types of services available are orders of magnitude more than pre-IoT era, researchers need new techniques to accurately discover not only the topologies and adjacencies but also the capability of other nodes and neighbors. Device discovery is usually the first task to be performed, immediately after deployment, as it enables communications, scheduling, and channel estimation. The existing discovery mechanisms do not consider …

Developing An Implementation Plan For Program Success: Sjsu Campus Community Emergency Response Team (C-Cert), Waynette Fernandez Santos
Master's Projects
San Jose State University would benefit from the implementation of the Campus Community Emergency Response Team (C-CERT), a program that many higher education institutions use to train community members in disaster preparedness. With a C-CERT program, trained people are empowered to know how to conduct themselves during an emergency, and learn how to keep themselves, their friends and colleagues safe. This research surveyed and interviewed emergency management professionals in other higher education institutions to determine best practices for C-CERT implementation. The goal of this research was to analyze other higher education institutions’ C-CERT success, identify what characteristics make their C-CERT …

A Framework For Assessing Sustainability Impacts Of Truck Routing Strategies, Haluk Laman
A Framework For Assessing Sustainability Impacts Of Truck Routing Strategies, Haluk Laman
Electronic Theses and Dissertations
The impact of freight on our transportation system is further accentuated by the fact that trucks consume greater roadway capacity and therefore cause more significant problems including traffic congestion, delay, crashes, air pollution, fuel consumption, and pavement damage. Assessing the actual effects of truck traffic is a growing need to support the ability to safely and efficiently move goods and people in areas where roadway expansion is not the best option. On one hand, trucks need to efficiently serve commerce and industry, while at the same time their activities need not contribute to a decline in the quality or public …
Delinquency Predictors: Offending To Commitment, Kaitlyn M. Pederson
Delinquency Predictors: Offending To Commitment, Kaitlyn M. Pederson
Boise State University Theses and Dissertations
The United States processes millions of adolescents through the juvenile court system annually. Throughout these hearings and upon adjudication, it is ultimately up to a judge to decide the juvenile’s disposition. Although research on juvenile delinquency has identified a variety of factors linked to youth offending, research is limited in terms of variables predicting a juvenile’s dispositional outcome. The current study examined number of predictive variables for youth offending to determine if they also influence a juvenile being committed to state custody in Idaho. This analysis consists of pre-screen evaluations obtained by the Idaho Department of Juvenile Corrections. The factors …
Failure-To-Rescue Simulations As A Risk Management Strategy For Registered Nurses, Trena K. Seago
Failure-To-Rescue Simulations As A Risk Management Strategy For Registered Nurses, Trena K. Seago
Graduate Theses, Dissertations, and Capstones
In the hospital setting, prevention of failure-to-rescue (FTR) events is an important aspect of patient safety. The use of patient simulation as a strategy to educate nurses on the prevention of these events offers two modes of learning: 1) experiential learning through simulation and 2) reflection through debriefing. The act of practicing to recognize a deteriorating patient through experiential learning and reflection may help increase nurses’ self-efficacy in recognizing a similar situation in their future practice. This quasi-experimental, one-group, pretest-posttest pilot study investigated the use of patient simulation among registered nurses (RNs) in the hospital setting as an anticipatory educational …
Environmental Conditions In San Martin Lake: Effects Of Eutrophication In An Estuary Associated With The Laguna Madre, Wendy L. Rogers
Environmental Conditions In San Martin Lake: Effects Of Eutrophication In An Estuary Associated With The Laguna Madre, Wendy L. Rogers
Theses and Dissertations
San Martin Lake is a shallow water Estuary in the lower Laguna Madre off the Port of Brownsville Shipping channel. It is influenced both by incoming tides and waste water runoff both from local farms and the Brownsville water treatment plants. The resulting mixture of eutrophic water and incoming sea water creates the perfect mix for a potential algal bloom. This study looks at the nutrient levels and environmental conditions in the main basin of the estuary to establish baseline levels and to observe the rate of nutrient clearing being accomplished in this environment. As sport recreation in the area …

Interprofessional Relationships In Rural Offender Re-Entry And Management: Mental Health Treatment Providers And Community Supervision Professionals, Michael Lasher
Electronic Theses and Dissertations
The current prevailing approach to managing offenders in the community involves community supervision professionals such as probation and parole officers partnering with other community professionals, such as psychologists, social workers, and other mental health providers to address offenders’ needs. Each type of professional draws from a unique field with goals, values, and theoretical orientations, which do not necessarily overlap. These relationships are rarely studied, and previous examinations are limited. The current study aims to address this deficit in the empirical literature. Drawing on data obtained from qualitative interviews, four aims were examined. First, using thematic analysis, interview data are analyzed …
Sanctuary Cities And The Trump Administration: The Practical Limits Of Federal Power, Joshua W. Dansby
Sanctuary Cities And The Trump Administration: The Practical Limits Of Federal Power, Joshua W. Dansby
The Scholar: St. Mary's Law Review on Race and Social Justice
On January 25, 2017, President Donald J. Trump signed an executive order with the supposed purpose of enhancing public safety of the interior of the United States. Part of the Administration’s plan includes threatening “sanctuary jurisdictions,” also known as “sanctuary cities,” with the loss of federal funds for failing to comply with federal law, specifically 8 U.S.C. § 1373.
There are several problems with this plan: (1) there is no solid definition for what makes a city a “sanctuary;” (2) if we accept the Administration’s allusion that a sanctuary jurisdiction is one that “willfully” refuses to comply with 8 U.S.C. …
