Cuyahoga County Bail Task Force: Report And Recommendations, Jonathan Witmer-Rich, Jay Milano, Carmen Naso, Mary Jane Trapp
Law Faculty Reports and Comments
Introduction:
All Cuyahoga County courts should transition from a bail system based on bond schedules, which vary widely from one court to the next, to a centralized, consistent, and comprehensive system of pretrial services initiated immediately after arrest. For most minor offenses, the presumption should be release on personal recognizance. Money bail should not be used to simply detain defendants. Rather than relying on bond schedules, courts should assess each defendant’s risk of non-appearance and danger to the community using a uniform risk assessment tool. If money bail is considered, courts should evaluate each defendant’s risk of non-appearance and ability …

US states are active in enacting immigration policies, which vary widely and have substantial impact on the lives of immigrants. Our understanding of what produces these divergent state laws remains limited. Qualitative research demonstrates the importance of a 2010 immigration compact, supported by a powerful religious organization, in shaping immigration policies in Utah, and the Utah Compact was held up as a model for other states. But is the experience of Utah applicable across other states? We test the effects of compacts and interest groups on immigration policy adoption across all 50 states between 2005 and 2013. Our findings suggest …

The Deweyan Approach To Learning Victim Advocacy: Seeing Beyond Stigmas And Facilitating Second Chances, Ashley Peake Wellman, Sherri Dioguardi
Qualitative Criminology (QC)
Fundamentally, criminal justice practitioners are public safety promoters, yet safety can be compromised if a divide exists between them and the communities they serve. The best way to train future criminal justice practitioners may be found in the progressive education proposed by John Dewey in the early 20th-century. Dewey’s experiential approach, specifically service-learning, has gained traction as an effective teaching tool for broadening perspectives, deepening understanding of diverse populations, and fostering higher order reasoning, all of which are critical characteristics for criminal justice professionals as well as for all American citizens. Undergraduate students participated in service-learning during a semester-long honors …

As the United States northern neighbor, Canada serves as a NATO ally and a strategic partner with Washington through the North American Aerospace Defense Command (NORAD). Canadian forces have fought honorably and bravely in concert with American forces in many wars. Canada's government, however, has been less consistent in promoting a credible vision of Canadian national security policy and geopolitical interests in its defense white papers. These documents have often contained idealistic rhetoric about adhering to a rules-based international order and defending freedom. In reality, Canadian governments of varying political parties have consistently failed to provide the sustained funding and …

Undocumented Students From Mexico And State Policy Variation Of Post-Secondary Education: Social And Economic Factors Affecting State Politics, Aki Hirotani
Open Access Theses
The Federal government is the primary level of government controlling immigration. Yet, the rapid growth of the immigrant population, documented and undocumented, in the United States and the Federal government’s inability to pass immigration reform has forced states and local governing bodies to pass their own immigration policies. Conflicting perspectives on the recent influx of immigrants have made immigration a controversial topic in the United States. Such divergent perspectives have also generated concerns regarding access to federally funded resources for undocumented immigrants, particularly higher education, defined as education beyond the secondary level, such as college or university. The goal of …

Consumers In Shock: How Federal Government Overregulation Led Mylan To Acquire A Monopoly Over Epinephrine Autoinjectors, Nicole O'Toole
Consumers In Shock: How Federal Government Overregulation Led Mylan To Acquire A Monopoly Over Epinephrine Autoinjectors, Nicole O'Toole
DePaul Business & Commercial Law Journal
The philosophy that federal government intervention increases costs and decreases options and values available to consumers can be analyzed across a plethora of markets. This Note will focus on the epinephrine autoinjector market, specifically looking at Mylan's epinephrine autoinjector known as the EpiPen. Today, the EpiPen is considered the “Kleenex” of epinephrine autoinjectors as it is estimated to control over ninety percent of the market share. From a Darwinist perspective it would appear that because the EpiPen controls most of the market, it must be the most superior product available to consumers. However, as this note will cover, this is …

Power And Prestige: Progressive Membership In Morristown, New Jersey, Erich Morgan Huhn
Power And Prestige: Progressive Membership In Morristown, New Jersey, Erich Morgan Huhn
Seton Hall University Dissertations and Theses (ETDs)
At the turn of the nineteenth century the social, political, and economic foundations of American society began to shift. Old families lost influence to the wealthy new “Robber Barons” while professionals lost prestige as their work increasingly became subsumed within a growing corporate structure. As a result, Progressive politics sought to shake up the system in an attempt to both help modernize archaic systems and reinforce old power structures.
In the case of the Civic Association of Morristown the members from old families and newcomers with professional backgrounds joined forces to secure power and prestige on what they saw as …

Limiting The National Right To Exclude, Katrina M. Wyman
Limiting The National Right To Exclude, Katrina M. Wyman
University of Miami Law Review
This essay argues that the robust right to exclude that nation states currently enjoy will be harder to justify in an era of climate change. Similar to landowners, nation states have virtual monopolies over portions of the earth. However, the right of landowners to control who enters their land is considerably more constrained than the right of nation states to control who enters their territory. Climate change will alter the areas of the earth suitable for human habitation and the broad right of nation states to exclude will be more difficult to justify in this new environment.
