Capacity Building, Environmental Justice, And Brownfield Redevelopment: A Case Study Of Harvest Hope Park, Tampa Bay, Fl, Gabrielle R. Lehigh
Capacity Building, Environmental Justice, And Brownfield Redevelopment: A Case Study Of Harvest Hope Park, Tampa Bay, Fl, Gabrielle R. Lehigh
USF Tampa Graduate Theses and Dissertations
Harvest Hope Park is a brownfield redevelopment project for the University Area Community Development Corporation (University Area CDC), a nonprofit organization dedicated to the sustainable redevelopment of north Tampa neighborhoods. While the project is still in progress, the University Area CDC has noted a lack of community engagement by local residents. The neighborhood, sometimes referred to as “suitcase city” because of the presumed transient nature of the population, has been plagued with poverty, blight, decay, high crime rates, and a lack of basic resources for decades (32 percent of the population in this area lives below the 2016 national poverty …

The Right To Counsel But Not The Presence Of Counsel: A Survey Of State Criminal Procedures For Pre-Trial Release, John P. Gross
The Right To Counsel But Not The Presence Of Counsel: A Survey Of State Criminal Procedures For Pre-Trial Release, John P. Gross
Florida Law Review
There is a widely-held belief that the state provides counsel to indigent criminal defendants at their initial appearance in state court. However, the majority of states do not provide counsel to indigent defendants at their initial appearance when a judicial officer determines conditions of pretrial release. State criminal procedure codes fail to provide the same procedural protections that defendants have in federal court. Indeed, states systems are characterized by predictive determinations regarding guilt, an overemphasis on the potential dangerousness of defendants, a lack of adequate pretrial services, and continued reliance on financial securities.
The U.S. Supreme Court has done little …

Policing, Technology, And Doctrinal Assists, Bennett Capers
Florida Law Review
Sounding the alarm about technology, policing, and privacy has become an almost daily occurrence. We are told that the government’s use of technology as a surveillance tool is an “insidious assault on our freedom.” That it is “nearly impossible to live today without generating thousands of records about what we watch, read, buy and do—and the government has access to them.” The message is clear. Big Brother is watching. And we should be afraid.
But the police use of technology, or what this Article terms “techno-policing,” does not have to be dystopian. This Article challenges conventional thinking and offers an …
Contextualizing The Free Exercise Of Religion, Adam Lamparello
Contextualizing The Free Exercise Of Religion, Adam Lamparello
Florida Law Review
The level of protection afforded to an individual’s First Amendment right to freely exercise religion should depend upon the context within which it is exercised. Put differently, an individual’s right to religious liberty should be balanced against other individuals’ right to equal protection of the law, and the broader societal interest in protecting individuals from invidious discrimination. This Article proposes a multifactor test that fully protects the right to freely exercise one’s religion while simultaneously safeguarding equal protection and antidiscrimination guarantees. Specifically, the level of protection afforded to a free exercise claim should depend, among other things, on whether it …

Unlikely Pioneers: Creative Climate Policymaking In Smaller U.S. Cities, George C. Homsy
Unlikely Pioneers: Creative Climate Policymaking In Smaller U.S. Cities, George C. Homsy
Public Administration Faculty Scholarship
With the U.S. federal government stepping away from climate change, a number of cities have indicated that they will continue efforts to reduce greenhouse gas emissions. Broad statistical analysis and case studies of larger and often progressive cities have provided some insight into what drives local governments to act on climate change mitigation. However, the vast majority of U.S. municipalities, most of them small, do nothing. Understanding what might drive smaller, poorer, and less progressive places is important if local governments are expected to take the lead on this global commons issue. In this exploratory study, I examine a group …

The Boko Haram Insurgency And Its Impact On Border Security, Trade And Economic Collaboration Between Nigeria And Cameroon: An Exploratory Study, Viviane E. Foyou, Peter Ngwafu, Maribel Santoyo, Andrea Ortiz
African Social Science Review
This article examines how sporadic conflicts between bordering states can be used by emerging terrorist groups to advance nebulous religious and political agendas and threaten regional security in various regions of the world. For example, the unconventional activities of ruthless insurgent groups in Africa (such as the Islamic State of the Maghrib, Boko Haram, and Al Shabaab) often thrive on conflicts and instability between bordering states, driven by religious, political or economic motives, to acquire power, territory, and control over innocent populations. Notorious for the violence and mayhem that these groups have imposed on villages and towns along the Northern …

Epidemiology Faculty Publications
BACKGROUND: Illicit drug use (DU) and hazardous drinking (HD) among marginalized populations may be associated with greater barriers to care.
METHODS: We used baseline data on the participants of the Seek, Test, Treat, and Retain data harmonization initiative. DU includes use of any illicit drugs within the past 6 months. HD was defined as scores ≥8 for men and ≥ 7 for women on Alcohol Use Disorders Identification Test within the past 12 months. Social support scores were assigned by summing scores from individual questions related to social support. Two outcomes for multivariable regression models and mediation analysis were perceived …

Equity Culture And Decent Work: The Case Of Amazon (2017), Marcy Murninghan
New England Journal of Public Policy
Every year, publicly traded companies hold annual meetings at which management presents a summary of the year’s accomplishments and shareholders vote on a slate of ballot issues, referred to as “proxy resolutions,” that are placed there by either management or shareholders. As in public life, in theory this form of corporate governance relies on a division of authority and checks and balances among shareholders, the board of directors, and company management. In theory, shareholders function much like registered voters, boards serve as their elected representatives, and management operates much like the executive branch to carry out the mandates accorded to …
Testimonial Statements, Reliability, And The Sole Or Decisive Evidence Rule: A Comparative Look At The Right Of Confrontation In The United States, Canada, And Europe, Deborah Paruch
Catholic University Law Review
Criminal trials in the United States are meant to ascertain the truth. But other societal values, such as fairness to the parties and public confidence in the integrity of the process, are at stake as well. Among the cornerstone rights to protect a defendant’s right to a fair trial is the right to confrontation. The right to confrontation enables a criminal defendant to exclude hearsay evidence from a trial when the defendant did not have an opportunity to cross-examine the witness. This right has undergone substantial changes and revisions over the last decade, both in the United States and abroad. …
Five Steps To A Better U: Improving The Crime-Fighting Visa, Jason A. Cade, Meghan L. Flanagan
Five Steps To A Better U: Improving The Crime-Fighting Visa, Jason A. Cade, Meghan L. Flanagan
Richmond Public Interest Law Review
Congress created the U nonimmigrant status to assist noncitizen vic- tims of serious crime and to encourage them to assist law enforce- ment in the investigation of that crime. Despite these laudable goals, the process has been flawed since the outset. U visas were capped at 10,000 per year, eventually precipitating a multi-year backlog that diminishes the incentive to report crime for persons who fear depor- tation. Of particular importance, the willingness of law enforcement officers to provide a certification of helpfulness—a mandatory com- ponent of an application for U status—varies tremendously across agencies. Eligibility for U status is thus …

Undimmed By Human Tears: American Cities, Philanthropy, And The Civic Ideal (1992), Marcy Murninghan
New England Journal of Public Policy
Commissioned by the Council on Foundations in 1992 at a time when urban concerns had fallen off the national agenda, this article contains summary recommendations of an investigation into the response of grantmakers and urban policy experts after the deadly violence that occurred in Los Angeles that spring. An April 29 state-court acquittal of police officers accused of using excessive force against Rodney King had sparked two days of burning and looting throughout South Central Los Angeles, an area hard-hit by job loss and plant closings that over the previous twenty years had become demographically and economically transformed. Once an …

Hydrophilic Polymer Embolism: Implications For Manufacturing, Regulation, And Postmarket Surveillance Of Coated Intravascular Medical Devices, Rashi I. Mehta, Rupal I. Mehta
Clinical and Translational Science Institute
Hydrophilic polymers are ubiquitously applied as surface coatings on catheters and intravascular medical technologies. Recent clinical literature has heightened awareness on the complication of hydrophilic polymer embolism (HPE), the phenomenon wherein polymer coating layers separate from catheter and device surfaces, and may be affiliated with a range of unanticipated adverse reactions. Significant system barriers have limited and delayed reporting on this iatrogenic complication, the full effects of which remain under-recognized by healthcare providers and manufacturers of various branded devices. In 2015, the United States Food and Drug Administration acknowledged rising clinical concerns and stated that the agency would work with …

If what happens overseas affects what happens here in North America, then the United States needs to have a voice and influence in overseas affairs. The Navy and the Marine Corps have served as the sources of that instrumentality on a day-to-day basis. How? How will they do so in the already emerging future?

Women's Summit Presented by Bryant University
It has been quite a year since our last Women’s Summit – one filled with accomplishments, changes, and challenges.
In the Fortune 500 annual list of top CEOs, women claimed 32 spots – a record number that included the first Latina. The reality, however, is that they make up just 6.2 percent of those listed, and U.S. women earn 20 percent less than men, on average.
The painful experiences that many people encounter in their careers became public through revelations about misconduct that surfaced in entertainment, business, sports, the news media, and in politics. These events – which continue to …
