Improve Organizational Commitment By Leading Like A Therapist, Anna A. Gibson Jan 2018

Improve Organizational Commitment By Leading Like A Therapist, Anna A. Gibson

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

The 21st-century workplace underemphasizes the importance of relational leadership, at the expense of the bottom line. Although there is a plethora of both popular and academic literature on the importance of good leadership in the workplace, relational leadership techniques have been misunderstood and underutilized. Dynamic psychology theories that emphasize the importance of relationships—such as self psychology—can be used to produce organizational results.

Therapeutic Alliance Through Person-Centered Therapy: An Influential Factor In Long-Term Utilization Of Mental Health Services Among Asians In The United States, Lahela Ashlee Rice Jorgenson

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

While the Asian population in the United States is growing vastly and there is an abundance of literature regarding barriers to utilization of psychological services for this population, there remains minimal research on positive or facilitative factors for those who do utilize services and do not prematurely terminate treatment. The purpose of this study was to explore possible factors that promote clients' utilization and commitment to mental health services, as reported by Asian clinicians working with an Asian American population. This study was performed through a descriptive qualitative approach consisting of semi-structured interviews with four clinicians providing mental health services …

Cultural Adaptation To Suicide Prevention Interventions On College Campuses, Leisha Marie Chiles Jan 2018

Cultural Adaptation To Suicide Prevention Interventions On College Campuses, Leisha Marie Chiles

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

Suicide is the second leading cause of death for adolescents and young adults ages 15 to 34. Given that college students are within that age range, it is believed they are at a similar risk. As college campuses try to address the suicide risk among their diverse student body, many have developed a public health approach, including the use of gatekeeper trainings. Many of these population-based interventions take a one-size fits all approach to suicide prevention, but with an increasingly diverse student population represented on college campuses this type of approach may fall short and fail to meet the cultural …

How To Build A Better Bar Exam, Eileen Kaufman, Andrea Anne Curcio, Carol L. Chomsky Jan 2018

How To Build A Better Bar Exam, Eileen Kaufman, Andrea Anne Curcio, Carol L. Chomsky

Scholarly Works

As a licensing exam, the purpose of the bar exam is consumer protection–-ensuring that new lawyers have the minimum competencies required to practice law effectively. As critics point out, however, the exam, and particularly the multiple-choice question portion of the exam, has significant flaws because it assesses legal knowledge and analysis in an artificial and unrealistic context, and the closed-book format rewards the ability to memorize thousands of legal rules, a skill unrelated to law practice.

This essay discusses how to improve the exam by changing its multiple-choice content and format. We use two law licensing exams to illustrate how …

Fashioning An Effective Negotiation Style: Choosing Between Good Practices, Tactics, And Tricks, Harold I. Abramson Jan 2018

Fashioning An Effective Negotiation Style: Choosing Between Good Practices, Tactics, And Tricks, Harold I. Abramson

Scholarly Works

This article addresses two long standing issues in negotiations. First, what choices should we make to be effective? This article offers a schema for classifying the choices into one of three categories and in so doing, classifies choices based on likely benefits and degree of risk when fashioning an effective negotiation style. The second question is how to distinguish between negotiation style, the subject of this article, and our natural conflict style. By highlighting the distinction between how we want to negotiate (negotiation style) and how we naturally negotiate (conflict style), this article offers a way to become the negotiator …

Pre-Service K-8 Teachers’ Professional Noticing And Strategy Evaluation Skills: An Exploratory Study, Vecihi S. Zambak, Marta T. Magiera Jan 2018

Pre-Service K-8 Teachers’ Professional Noticing And Strategy Evaluation Skills: An Exploratory Study, Vecihi S. Zambak, Marta T. Magiera

Mathematical and Statistical Science Faculty Research and Publications

This study sheds light on three teaching competencies: Pre-service teachers’ (PSTs’) professional noticing of student mathematical reasoning and strategies, their ability to assess the validity of student reasoning and strategies, and to select student strategy for class discussion. Our results reveal that PSTs with strong awareness of mathematically significant aspects of student reasoning and strategies (focused noticing) were better positioned to assess the validity of student reasoning and strategies. PSTs with higher strategy evaluation skills were more likely to choose the strategy to engage class in justification or to advance students’ conceptual understanding compared to PSTs with low strategy evaluation …

Will The Jury System Survive The Peña-Rodriguez Exception To Rule 606(B)?: The Court’S Response To Racial Discrimination By A Juror Leaves The Future Of The American Jury Trial System In Jeopardy, Taurus Myhand

Scholarly Works

The enforcement of no-impeachment rules has been a long-standing tradition in the United States preventing jurors from offering testimony as to impeach their own verdict. In March 2017, the Supreme Court changed course from centuries of jurisprudence and superseded the Federal Rules of Evidence with a new exception to Rule 606(b) in the Court’s decision in Peña-Rodriguez v. Colorado. The Court’s effort to “root out” racial bias in the justice system resulted in the debunking of the legislative authority granted to the Congress while creating an exception that does little, if anything, toward eliminating racial bias during jury deliberations. Background: With the publication of DSM 5 alternative model for personality disorders it is critical to assess the components of the model against evidence-based models such as the five factor model and the DSM-IV-TR categorical model. This study explored the relative clinical utility of these models in screening for borderline personality disorder (BPD).

Methods: Receiver operator characteristics and diagnostic efficiency statistics were calculated for three personality measures to ascertain the relative diagnostic efficiency of each measure. A total of 1653 adult inpatients at a specialist psychiatric hospital completed SCID-II interviews. Sample 1 (n=653) completed the SCID-II interviews, SCID-II Questionnaire (SCID-II-PQ) …

Formative Projects, Formative Influences: Of Martha Albertson Fineman And Feminist, Liberal, And Vulnerable Subjects, Linda C. Mcclain Jan 2018

Formative Projects, Formative Influences: Of Martha Albertson Fineman And Feminist, Liberal, And Vulnerable Subjects, Linda C. Mcclain

Faculty Scholarship

This essay, contributed to a symposium on the work of Professor Martha Albertson Fineman, argues that Fineman is a truly generative and transformative scholar, spurring people to think in new ways about key terms like “dependency,” “autonomy,” and “vulnerability” and about basic institutions such as the family and the state. It also recounts Fineman’s role in creating spaces for the generation of scholarship by others. The essay traces critical shifts in Fineman’s scholarly concerns, such as from a theory of dependency to vulnerability theory and from a gender lens to a skepticism about a focus on identities and discrimination. In …

Excavating Race-Based Disadvantage Among Class-Privileged People Of Color, Khiara Bridges Jan 2018

Excavating Race-Based Disadvantage Among Class-Privileged People Of Color, Khiara Bridges

Faculty Scholarship

The aim of this article is to begin to theorize the fraught space within which class-privileged racial minorities exist — the disadvantage within their privilege. The article posits that the invisibility of the racial subordination of wealthier people of color (that is, their marginalization on account of their race) is fertile soil for the germination of post-racialism — the sense that we, as a nation, have overcome our racial problems. The dramatic visibility of the minority poor’s suffering, combined with the relative invisibility of the suffering of those minorities who are not poor, breeds the belief that class is now …

The Continuing Duty In Reality: A Preliminary Empirical Look, David M. Siegel, Tigran W. Eldred Jan 2018

The Continuing Duty In Reality: A Preliminary Empirical Look, David M. Siegel, Tigran W. Eldred

Faculty Scholarship

The continuing duty of criminal defense counsel to their former clients, even when those former clients bring post-conviction actions alleging ineffective assistance of counsel, has existed as a national practice standard in capital cases since at least 1987. In addition to its inclusion in the ABA’s Guidelines for the Appointment and Performance of Counsel in Death Penalty Cases since 1989, duties to former clients exist in state ethics rules as well as the ABA Model Rules of Professional Conduct. The duty has been further operationalized in non-capital litigation through a 2010 ABA formal ethics opinion concerning disclosures by trial counsel …

Adr And Access To Justice: Current Perspectives, Ellen E. Deason, Michael Z. Green, Donna Shestowsky, Rory Van Loo, Ellen Waldman

Faculty Scholarship

Access to justice is a broad topic, and we cannot cover everything. You will notice a few major omissions. Most notably, we are not going to emphasize consumer pre-dispute arbitration agreements. This is not because they are not important, but because much has been written and said on this topic, and it could easily swallow the whole discussion. Also, we are probably not going to say very much about restorative justice, and I am sure you will notice some other holes. We invite you to raise missing issues in your comments.

Let me start with a few opening remarks. We …

Saving Face: Unfolding The Screen Of Chinese Privacy Law, Tiffany Li, Jill Bronfman, Zhou Zhou Jan 2018

Saving Face: Unfolding The Screen Of Chinese Privacy Law, Tiffany Li, Jill Bronfman, Zhou Zhou

Faculty Scholarship

Privacy is often a subjective value, taking on meaning from specific social, historical, and cultural contexts. Western privacy scholars have so far generally limited academic study to focus on Western ideals of privacy. However, privacy – or some notion of it – can be found in almost every culture and every nation, including the growing economic powerhouse that is the People’s Republic of China. Focusing on China as a case study of non-Western privacy norms is important today, given the rapid rise of the Chinese economy and its corresponding impact on worldwide cultural norms and law. Simply put, it is …

Eyes Wide Open: What Social Science Can Tell Us About The Supreme Court's Use Of Social Science, Jonathan Feingold, Evelyn Carter Jan 2018

Eyes Wide Open: What Social Science Can Tell Us About The Supreme Court's Use Of Social Science, Jonathan Feingold, Evelyn Carter

Faculty Scholarship

In McCleskey v. Kemp, the Supreme Court rendered statistical evidence of racial disparities doctrinally irrelevant to a criminal defendant’s equal protection claim. Fifteen years later in Grutter v. Bollinger, Chief Justice Rehnquist—part of the McCleskey majority—invoked admissions data to support his conclusion that the University of Michigan Law School had unconstitutionally discriminated against White applicants. This facially inconsistent treatment of statistical data invites the following inquiry: Why do judges (including Supreme Court Justices) rely on social science in some cases, yet reject it in others? We suggest that one answer lies at the intersection of Critical Race Theory and empirical …

What Explains Observed Reluctance To Trade? A Comprehensive Literature Review, Kathryn Zeiler Jan 2018

What Explains Observed Reluctance To Trade? A Comprehensive Literature Review, Kathryn Zeiler

Faculty Scholarship

Valuation gaps and exchange asymmetries are among the most widely studied phenomena in the field of behavioral economics. The purpose of this chapter is to present the current state of the social science literature related to observed reluctance to trade. Numerous theories have been proposed and only a few might be safe to rule out based on the evidence to date. The chapter begins by describing the standard model of preferences, which generally assumes that valuation is independent of ownership status, and then catalogs early findings that seem to suggest that ownership status influences valuation. Early research tested various potential …

The Extended Evolutionary Synthesis Facilitates Evolutionary Models Of Culture Change, Cameron M. Smith, Liane Gabora, William Gardner-O’Kearney

Anthropology Faculty Publications and Presentations

The Extended Evolutionary Synthesis (EES) is beginning to fulfill the whole promise of Darwinian insight through its extension of evolutionary understanding from the biological domain to include cultural information evolution. Several decades of important foundation-laying work took a social Darwinist approach and exhibited ecologically-deterministic elements. This is not the case for more recent developments to the evolutionary study of culture, which emphasize non-Darwinian processes such as self-organization, potentiality, and epigenetic change.

Two Cognitive Transitions Underlying The Capacity For Cultural Evolution, Liane Gabora, Cameron M. Smith Jan 2018

Two Cognitive Transitions Underlying The Capacity For Cultural Evolution, Liane Gabora, Cameron M. Smith

Anthropology Faculty Publications and Presentations

This paper proposes that the distinctively human capacity for cumulative, adaptive, open-ended cultural evolution came about through two temporally-distinct cognitive transitions. First, the origin of Homo-specific culture over two MYA was made possible by the onset of a finer-grained associative memory that allowed episodes to be encoded in greater detail. This in turn meant more overlap amongst the distributed representations of these episodes, such that they could more readily evoke one another through self-triggered recall (STR). STR enabled representational redescription, the chaining of thoughts and actions, and the capacity for a stream of thought. Second, fully cognitive modernity following the …

Devalued Liberty And Undue Deference: The Tort Of False Imprisonment And The Law Of Solitary Confinement, Efrat Arbel

All Faculty Publications

Despite numerous calls for reform and restraint, solitary confinement continues to be both misused and overused in Canadian prisons. This paper charts a path through which to address such misuse, but analyzing solitary confinement through the tort of false imprisonment. This analysis is new: while some scholars have examined how other branches of tort law can address harms caused by solitary confinement, none have examined the application of this tort. I argue that the tort of false imprisonment provides segregated prisoners with an effective means through which to seek compensation for individual harm. As an intentional tort that is actionable …

In this Introduction to the collection, we lay out what these papers offer to the field of gambling research and beyond. To begin, we identify the scholarly approaches to gambling upon which we wish to build (Part I). Then, we specify three contributions we seek to make through our socio-legal endeavors. First, this collection seeks to foreground the diverse, vernacular forms and places of play that are sometimes overlooked in gambling scholarship (Part II). Second, the papers take a distinctive pluralist approach that recognizes the multi-layered character of gambling regulation (Part III). Third, and finally, the interdisciplinary and methodologically diverse …

Uncovering The Lost Knowledge Of The Imagination In Films, Seda, Daniel A. Jan 2018

Uncovering The Lost Knowledge Of The Imagination In Films, Seda, Daniel A.

Journal of Conscious Evolution

Films have forever changed the way in which humans perceive reality and have provided significant opportunities to spread knowledge in ways that are both entertaining and deceptive. Uncovering the lost knowledge of the imagination shifts an individual’s perceptions of a shared experience and exposes film’s persuasive power to penetrate the psyche. This paper explores the constitutions of reality and how humans are able to tap into other realms of consciousness through mediums of creative expression. Topics such as the origins of life, the hidden knowledge of secret societies, and the burgeoning full disclosure movement for truth are discussed as a …

Predictors Of Arterial Stiffness In Law Enforcement Officers, Jason Michael Keeler Jan 2018

Predictors Of Arterial Stiffness In Law Enforcement Officers, Jason Michael Keeler

Theses and Dissertations--Kinesiology and Health Promotion

The prevalence of cardiovascular disease (CVD) among law enforcement officers (LEOs) is slightly higher than the general population. Furthermore, the prevalence of CVD doubles among LEOs following retirement compared to the general population. The measure of arterial stiffness serves as an independent risk factor that has prognostic value for future incidence of CVD. However, there is limited research on lifestyle, occupational, and demographic factors that may be associated with increased arterial stiffness in LEOs. Therefore, the purpose of this investigation was to compare the level of arterial stiffness among LEOs versus the general population and to identify lifestyle, occupational, and …

The Effect Of Sleep Quantity And Quality On Direct Current Potential In Collegiate American Football Players, Erik D. Korem Jan 2018

The Effect Of Sleep Quantity And Quality On Direct Current Potential In Collegiate American Football Players, Erik D. Korem

Theses and Dissertations--Kinesiology and Health Promotion

Direct current (DC) potential is an objective measure of the functional state of the human organism. It is a sensitive and accurate indicator of short- and long-term adaptations to stress, adaptive capacities, and it is an important marker of athlete readiness. Sleep is posited to be the most efficacious strategy for improving recovery to enhance sport performance, and adequate sleep is considered vital to normal psycho-physiological function. Thus, optimal sleep may enhance the functional state, in turn enhancing an athlete’s adaptability to training stress. However, little is known about the relationship between sleep and DC potential. Therefore, the purpose of …
