Platform Law And The Brand Enterprise, Sonia K. Katyal, Leah Chan Grinvald Jan 2018

Platform Law And The Brand Enterprise, Sonia K. Katyal, Leah Chan Grinvald

Scholarly Works

The emergence of platforms has transformed the digital economy, reshaping and recasting online transactions within the service industry. This transformation, as many have argued, has created new and unimagined challenges for policymakers and regulators, as well as for traditional, offline companies. Most scholarship examining platforms discuss their impact on employment law or consumer protection. Yet trademark law, which is central to the success of the platform enterprise, has been mostly overlooked within these discussions. To address this gap, this article discusses the emergence of two central forms of platform entrepreneurship-the platform, or "macrobrand" and the platform service provider, or the …

Innovation Diffusion In The Legal Industry, William D. Henderson Jan 2018

Innovation Diffusion In The Legal Industry, William D. Henderson

Articles by Maurer Faculty

This article is adapted from a series of blog posts originally found in my recently-started blog entitled Legal Evolution. The foundational material set forth in this article (and in those blog posts) applies to the legal services market insights gained from disciplines other than law. This article begins by setting forth the well-established theory of an "innovation diffusion curve" and the research that has identified the factors that affect the rate of adoption of innovations. This article identifies why innovation in the legal services market is desirable and applies to the legal services field insights drawn from this research in …

Reaching And Teaching Millennials: Designing The Future Of Student Services, Kimberly Mattioli, Brian Detweiler, Mike Martinez Jr.

Articles by Maurer Faculty

Today’s students have come to expect library services that are quite different from their predecessors and law librarians must evolve to meet their needs. As law libraries in the United States face the realities of declining enrolment and decreasing budgets, it is imperative that we find new and creative ways to build positive relationships with our students while also preparing them for the realities of practicing law in an environment driven by rapid technological change. Three law librarians from the United States, Brian Detweiler, Kimberly Mattioli, and Mike Martinez, Jr., discuss their successes and failures in reaching out to their …

Is There “Hope For Every Addicted American”? The New U.S. War On Drugs, B Stone Jan 2018

Is There “Hope For Every Addicted American”? The New U.S. War On Drugs, B Stone

Publications and Research

The U.S. has been waging a War on Drugs for the last forty years. But in the mid-2010s, a series of reforms have rejected this militant approach. How did these policies manage to break through a gridlocked Congress? What is the nature of these reforms, and what are their political implications? Using critical discourse analysis, I demonstrate that a new policy framework of “addiction recovery” defines the political crises of the opioid epidemic, the failure of the War on Drugs, and mass incarceration in terms of disease, attributing Drug War injustices to prejudice against “addiction,” rather than a constellation of …

Acceptance And Commitment Therapy As An Intervention For Adolescent Chronic Pain Related To Pectus Excavatum: A Case Study, Hayley N. Roberts Jan 2018

Acceptance And Commitment Therapy As An Intervention For Adolescent Chronic Pain Related To Pectus Excavatum: A Case Study, Hayley N. Roberts

Graduate School of Professional Psychology: Doctoral Papers and Masters Projects

The most common chest wall deformity, Pectus Excavatum (PE), is a congenital deformity in which the sternum and adjoining chest wall cave inwards toward the spine (Lawson et al., 2003). While corrective surgical procedures have been shown to have positive effects on the physical and psychosocial well-being of patients with PE (Krasopoulos, Dusmet, Ladas, & Goldstraw, 2006), often surgical procedures, such as those done to correct PE, can result in what is known as Chronic Post-Surgical Pain (CPSP). CPSP has been shown to have great bearing on the patient’s overall well-being (Weinrib et al., 2017), meaning that while the corrective …

An Expanded View Of Translanguaging: Leveraging The Dynamic Interactions Between A Young Multilingual Writer And Machine Translation Software, Sara Vogel, Laura Ascenzi-Moreno, Ofelia García

Publications and Research

Two central forces re-shaping education in the 21st century in the United States are the increasingly diverse and rich multilingual practices of students, as well as our growing use of digital technologies to communicate and make meaning (Deumert, 2014; García, Bartlett & Kleifgen, 2007; Jewitt, 2008; New London Group, 1996). Even if much scholarship has focused on the trends of multilingualism and multimodalities as separate entities, there are many intersections. Digital tools like machine translation software are being used in schools by multilingual students, and their often-monolingual teachers. Frameworks for multilingual teaching and learning involving intentional use of machine translation …

Shanghai Is A Fast Paced City: An Exploration Into The Rapid Growth Of Queer And Trans Communities In Shanghai, China, Frances S. Hanna

University Honors Theses

In this undergraduate honors thesis, I utilize supplementary research, the theories presented by Michel Foucault, Eve Sedgwick, Jürger Habermas, and Roland Barthes in addition to my own personal experiences and observations through an autoethnographic lens to answer the question, “How do gender and sexual minority groups, such as queer and trans people, develop, maintain, and grow community spaces in Shanghai, China?” This work seeks to shine a light on the often underrepresented and unstudied topic of queer and trans communities in China, and how they continue to flourish despite pre-existing structures that deter them. Evoking Foucault’s imagery of a different …

Rhizomatic Mnemosyne: Warburg, Serres, And The Atlas Of Hermes, María Del Carmen Molina Barea Jan 2018

Rhizomatic Mnemosyne: Warburg, Serres, And The Atlas Of Hermes, María Del Carmen Molina Barea

Contemporary Aesthetics (Journal Archive)

This essay aims to examine Aby Warburg’s Mnemosyne Atlas according to two conceptual perspectives that seem deeply interwoven, Deleuze and Guattari’s notion of rhizome and Michel Serres’s metaphor on Hermes. Both theoretical approaches cast light on the epistemological implications of the Mnemosyne Atlas and explore its intriguing composition from an innovative point of view. Specifically, this paper excavates the disrupted nature of the Warburgian Atlas, paying particular attention to the schizophrenic proliferation of unexpected connections. In this scenario, it will be necessary to elucidate the terminological opposition between ‘atlas’ and ‘archive,’ as studied by Boris Groys, Foucault, and Derrida, …

Double- And Triple-Duty Caregiving Men: An Examination Of Subjective Stress And Perceived Schedule Control, Nicole Depasquale, Steven H. Zarit, Jacqueline Mogle, Phyllis Moen, Leslie B. Hammer, David M. Almeida Jan 2018

Double- And Triple-Duty Caregiving Men: An Examination Of Subjective Stress And Perceived Schedule Control, Nicole Depasquale, Steven H. Zarit, Jacqueline Mogle, Phyllis Moen, Leslie B. Hammer, David M. Almeida

Psychology Faculty Publications and Presentations

Based on the stress process model of family caregiving, this study examined subjective stress appraisals and perceived schedule control among men employed in the long-term care industry (workplace-only caregivers) who concurrently occupied unpaid family caregiving roles for children (double-duty child caregivers), older adults (double-duty elder caregivers), and both children and older adults (triple-duty caregivers). Survey responses from 123 men working in nursing home facilities in the United States were analyzed using multiple linear regression models. Results indicated that workplace-only and double- and triple-duty caregivers’ appraised primary stress similarly. However, several differences emerged with respect to secondary role strains, specifically work–family …

Quality Evaluation Of Coated Extra-Large Hulled Sunflower (Helianthus Annuus) Kernels For Precision Planting, Harjot Sidhu Jan 2018

Quality Evaluation Of Coated Extra-Large Hulled Sunflower (Helianthus Annuus) Kernels For Precision Planting, Harjot Sidhu

Agribusiness and Biosystems Engineering

Domestic and export demand for extra-large (XL) in-shell confectionary sunflower seeds (Helianthus Annuus) growing; however, a significant proportion of the hybrid seed for planting goes to the snack food market because the extra-large seed is not acceptable to farmers. The extra-large hybrid seed has poor emergence in the field and is not compatible with precision planters. Therefore, the option of coating the hulled sunflower kernels for improved germination and plantability is investigated in this dissertation. Twenty types of kernel coatings have been tested, through collaboration with five seed coating companies and development of our own in-house seed coating capabilities. Coated …

The Nonprofit Institute Newsletter

This month's topic is Opinion Research.

We recently sent out a survey about using data in nonprofit work. We received a lot of great feedback from many of you -- thank you! We are working hard to analyze the data from the survey to inform our decision making on our upcoming Nonprofit Data Lab project.

One of the many interesting things you had to tell us involved the challenge of learning about (and getting feedback from) people you aren’t currently reaching through your programs. So, we are devoting this month’s newsletter to a discussion of opinion research as one …

The Effects Of Injectable Trace Mineral Supplements In Donor Cows At The Initiation Of A Superovulation Protocol On Embryo Outcomes And Pregnancy Rates In Recipient Females, Felipe Silva Jan 2018

The Effects Of Injectable Trace Mineral Supplements In Donor Cows At The Initiation Of A Superovulation Protocol On Embryo Outcomes And Pregnancy Rates In Recipient Females, Felipe Silva

Animal Sciences

Concentrations of trace minerals within the body are known to impact reproductive processes. Thus, the current study analyzed the effects of using an injectable trace mineral supplement containing selenium, zinc, copper, and manganese during a superovulation protocol on embryo outcomes in donor beef cows and further effects on pregnancy rate in recipient females. We hypothesized that an injectable trace mineral (TM) supplement provided to cows fed to meet known nutrient requirements would increase TM status and influence superovulation, embryo characteristics, and enhance pregnancy rates. Our findings indicate that the injectable TM increased concentration of Se within the liver. However, superovulatory …

The Effects Of Maternal Diet On Passive Transfer Of Immunity To The Neonatal Beef Calf, And Calf Immune Response To Vaccination And Immunostimulants, James Joseph Gaspers Jan 2018

The Effects Of Maternal Diet On Passive Transfer Of Immunity To The Neonatal Beef Calf, And Calf Immune Response To Vaccination And Immunostimulants, James Joseph Gaspers

Animal Sciences

To investigate the effects of maternal diet on passive transfer of immunity to the neonatal beef calf, and calf immune response to vaccination and immunostimulants, three experiments (Exp.) were completed. Results from Exp. 1 indicated that there was no effect of supplemental starch to cows on colostrum production, offspring birth weight, incidence of dystocia, respiratory acidosis, and the passive transfer of immunity. Results from Exp. 2 indicated that both the needle – free injection devices (NFs) and needle and syringe (NS) initiate a haptoglobin (Hp) inflammatory response (P < 0.001). After injection bovine viral diarrhea virus (BVDV) type 2 antibody titers continually declined from d 0, 7, 28, and 115 across both NS and NF treatment groups (P < 0.001). After secondary booster vaccination on d 115, BVDV type 2 antibody titers significantly increased by d 143 (P < 0.001). The use of NFs will maintain a level of immunity that has been seen by the use of conventional NS vaccine administration methods. In Exp. 3, treatments containing a modified live vaccine (MLV) antigen initiated an Hp inflammatory response over time (P < 0.001). Interferon gamma was not significantly different across treatment over time (P = 0.39); however, there was a threefold increase in treatment three over time. Treatments containing a MLV BVDV antigen maintained BVDV type 2 antibodies over time (P <0.001). Feed intake and feeding behavior were unaffected by the use of the vaccine and/or immunostimulant.

Draining Us Dry: Scarcity Discourses In Contention Over Bottled Water Extraction, Daniel Jaffee, Robert A. Case Jan 2018

Draining Us Dry: Scarcity Discourses In Contention Over Bottled Water Extraction, Daniel Jaffee, Robert A. Case

Sociology Faculty Publications and Presentations

Water scarcity is a highly contested concept. The dominant narratives of water scarcity in policy debates have been criticised for prioritising purely quantitative metrics and eliding questions of inequality and power. While much scholarship on water scarcity examines contexts in the global South where potable water infrastructures do not reach most residents, this article examines conflict over commercial water extraction in a Northern setting where access to potable tap water is nearly universal, yet local water supplies are increasingly constrained. It addresses three main questions: (1) How are narratives or discourses of water scarcity mobilised by a range of actors …

The Contributions Of Parental, Academic, School, And Peer Factors To Differences By Socioeconomic Status In Adolescents’ Locus Of Control, Dara Shifrer Jan 2018

The Contributions Of Parental, Academic, School, And Peer Factors To Differences By Socioeconomic Status In Adolescents’ Locus Of Control, Dara Shifrer

Sociology Faculty Publications and Presentations

An internal locus of control may be particularly valuable for youth with low socioeconomic status (SES), yet the mechanisms that externalize their control remain unclear. This study uses data on 16,450 US 8th graders surveyed for the National Education Longitudinal Study in 1988 and 1990. Results indicate family income is more closely associated with adolescents’ locus of control than parents’ occupations and educational attainment, and that race does not independently affect adolescents’ locus of control net of these other components of SES. Findings also indicate higher SES adolescents feel more internal locus of control in largest part because their parents …

Mitigating Early Loss Of Community Participation In Early Psychosis Services: State Of The Science, Tamara G. Sale, Dora M. Raymaker, Mariam Rija, Veronica Gould, Christina Wall, Ryan P. Melton

School of Social Work Faculty Publications and Presentations

In the early stages of treatment for psychosis, community engagement and social networks are threatened through a combination of symptomology and negative messages and reactions from the environment which may result in internalized stigma, disempowerment, and prolonged isolation. While treatment programs attempt to mitigate these factors, ambivalence toward treatment and the basic concept of psychosis, along with difficulty engaging in conversation, make initial engagement more difficult. Self-determination theory and growing recovery literature point to the importance of maintaining a sense of community relatedness and connection, and developing a sense of agency and competence as important to active recovery and retention …

Cascadia Connect: Car-Free Access To The Outdoors, Kara Boden, Brandon Crawford, Matt Gray, Tony Lamb, Maricelith Valencia, John Whitman

Master of Urban and Regional Planning Workshop Projects

As outdoor recreation areas in Oregon become more popular, increased auto-related congestion results in strained resources, environmental degradation, and diminished visitors’ experiences. This project proposes policies, strategies, and a variety of approaches to help transportation agencies and land managers facilitate car-free access to outdoor recreation areas. The plan also proposes approaches to increase access to recreation areas for transit-dependent visitors and under-represented communities who face significant barriers to access today. The Background Report includes data; interview, survey and focus group themes; site visit findings; and personal travel anecdotes.
