Alchemistic Metaphors In Comparative Law: Mixed Legal Systems, Reception Of Laws And Legal Transplants, Andreas Rahmatian Dec 2018

Alchemistic Metaphors In Comparative Law: Mixed Legal Systems, Reception Of Laws And Legal Transplants, Andreas Rahmatian

Journal of Civil Law Studies

The terms “mixed legal systems” and “legal transplants” are used frequently in comparative law. What they denote exactly, is difficult to ascertain: what does the mixité consist of, what are its ingredients or building blocks; which types of mixité exist, how are legal transplants transformed in the receiving legal system? Comparative lawyers often resort to metaphors when they try to describe and explain these complex phenomena: metaphors from cooking, music, horticulture or biology. Whenever there are mixtures, trans-formations, or transmutations, metaphors from the philosophical concepts of alchemy are at least equally illuminating. This article discusses the different problems of conceptualising …

Orbital Angular Momentum Generation Using Composite Quasi-Continuous Metasurfaces With Perfect Efficiency, Menglin L.N. Chen, Li (Lijun) Jun Jiang

Electrical and Computer Engineering Faculty Research & Creative Works

A composite perfect electric conductor (PEC)-perfect magnetic conductor (PMC) metasurface is proposed for orbital angular momentum (OAM) generation. Each scatterer on the metasurface consists of an anisotropic PEC layer and an isotropic PMC layer. Unlike conventional metasurfaces that composed of discrete scatterers, the scatterers on the proposed metasurface form a quasi-continuous pattern. Therefore, negative consequences of periodicity breaking from the patterned scatterers with varying sizes or orientations and their mutual coupling are avoided. We model the scatterer using Jones matrix. Its design is based on the features of PEC and PMC, which abandons complicated optimization process. The patterning of scatterers …

Journal of Cybersecurity Education, Research and Practice

This paper introduces a holistic and case-analysis teaching model by integrating case studies into cybersecurity courses. The proposed model starts by analyzing real-world cyber breaches. Students look into the details of these attacks and learn how these attacks took place from the beginning to the end. During the process of case analysis, a list of security topics reflecting different aspects of these breaches is introduced. Through guided in-class discussion and hands-on lab assignments, student learning in lecture will be reinforced. Overall, the entire cybersecurity course is driven by case studies. The proposed model is great for teaching cybersecurity. First, the …

Legal Status Of Virtual Currency In Indonesia In The Absence Of Specific Regulations, Soonpeel Chang Dec 2018

Legal Status Of Virtual Currency In Indonesia In The Absence Of Specific Regulations, Soonpeel Chang

Indonesia Law Review

Given Indonesia’s recent legal policy developments regarding cryptocurrency, it is pertinent to ask whether this new investment market, by its overall structural formation, holds any further risks to Indonesia beyond those to individual parties. This paper contends that any effective regulation of this new ecosystem requires adoption of the machinery of more fundamental concepts and a clear direction. Even if the Government’s skepticism about soundness of the cryptocurrency markets is fully justified, how best to protect the various parties in the market is a different issue, one which calls for urgent attention from policy makers, legal practitioners, the judiciary and …

Indonesia’S Upstream Petroleum Governance Reform: Which Model Is Constitutional Enough?, Afghania Dwiesta Dec 2018

Indonesia’S Upstream Petroleum Governance Reform: Which Model Is Constitutional Enough?, Afghania Dwiesta

Indonesia Law Review

The Indonesian Constitutional Court abruptly annulled provisions regarding the function of BP Migas as state representative in managing upstream oil and gas operations in Indonesia, declaring it unconstitutional. Apparently, the Court was convinced that exercising absolute state control over hydrocarbon operations would give the utmost benefit to the people. This research argues that in achieving such goals, a state must be able to create strong administrative infrastructure and regulatory regime capable of controlling and supervising hydrocarbon operations in accordance with both national and international oil fields. Using a comparative study method with secondary data collection, this research observes Norway’s, Mexico’s, …

Creating Pedagogy To Integrate Sustainability And The Arts, Nancy Bertaux, Kaleel Skeirik Dec 2018

Creating Pedagogy To Integrate Sustainability And The Arts, Nancy Bertaux, Kaleel Skeirik

Journal of Management for Global Sustainability

The creation of a sustainable world urgently requires managers of organizations to consider large-scale changes in the practices and policies of social and economic institutions. Compelling scientific and economic information on the environment, while the basis of much dialogue in higher education and in the public sphere, has failed to motivate adequate progress to date. In this article, therefore, we present an original theoretical model for a pedagogy that brings together the arts and sustainability. We postulate that motivation or “heart” to initiate such actions for the environment and persist in the face of societal and institutional inertia can come …

Chancing The Arm To Save The Face: The Fight For Irish Gaelic Recognition And Ending The Stormont Deadlock, Samantha F. Sigelakis-Minski

Brooklyn Journal of International Law

Since January 2017, the Northern Irish government has been shut down, with both the Executive and Assembly collapsed and the two major political coalitions deadlocked. Since then, civil servants with no major decision-making power have largely run the government. One of the deadlock’s major battlegrounds is whether there should be legislation in Northern Ireland mandating that Gaeilge, or Irish Gaelic, be treated as a language of equal status to that of English. This Note explores this issue and argues that the right to equal language protections is founded in the right to one’s cultural identity, and as such should be …

Resistance To Neocolonialism In Contemporary Chinese Literary Theory, Zeng Jun Dec 2018

Resistance To Neocolonialism In Contemporary Chinese Literary Theory, Zeng Jun

CLCWeb: Comparative Literature and Culture

In his article "Resistance to Neocolonialism in Contemporary Chinese Literary Theory" Jun ZENG claims that the introduction of Western Literary Theory in the past forty years of China's reform and opening up was carried out under the background of neo-colonialism. "Western imagination" in the discourse of contemporary Chinese literary theory was an important aspect of the strategy of cultural resistance under the overwhelming influence of Western neocolonialism. Contemporary Chinese literary theory no longer simply regards Western literary theory in the twentieth century as a bourgeois literary ideology; instead, it adopts a "de-ideological" attitude to return to the issues of literature, …

The End Of The Nobel Era And The Reconstruction Of The World Republic Of Letters, Guohua Zhu, Yonghua Tang

CLCWeb: Comparative Literature and Culture

In their article "The End of the Nobel Era and the Reconstruction of the World Republic of Letters" Guohua Zhu and Yonghua Tang critically examine mechanisms of cultural hegemony associated with the Nobel Prize in Literature from a neocolonial lens. Borrowing from Casanova's idea of the "World Republic of Letters" and its attentiveness to geopolitics, the essay proceeds to reconstruct the dialectical relations between the nation and the world. It does so, in the first place, by documenting and analyzing the process of negotiation and bargaining entailed in the construction of global cultural hegemony and thereby examine the functions and …
