The Foreign Emoluments Clause, Erik M. Jensen Jan 2018

The Foreign Emoluments Clause, Erik M. Jensen

Faculty Publications

Because of the foreign business dealings of President Donald Trump and his family, interpreting the Foreign Emoluments Clause has become a nearly fulltime job for political pundits, with stories about the clause appearing in every conceivable media outlet. The clause provides that “no Person holding any Office of Profit or Trust under [the United States] shall, without the Consent of Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.” If the president is benefitting economically from business dealings with foreign governments (or organizations that might be treated as agencies …

Department of Supply Chain Management and Analytics: Faculty Publications

Background: Childhood obesity rates have been rising rapidly in developing countries. A better understanding of the risk factors and social context is necessary to inform public health interventions and policies. This paper describes the validation of several measurement scales for use in Turkey, which relate to child and parent perceptions of physical activity (PA) and enablers and barriers of physical activity in the home environment.

Method: The aim of this study was to assess the validity and reliability of several measurement scales in Turkey using a population sample across three socio-economic strata in the Turkish capital, Ankara. Surveys were conducted …

Mark’S Young Man And Homer’S Elpenor: Mark 14:51-52, 16:1-8 And Odyssey 10-12, Sungchan Moon Jan 2018

Mark’S Young Man And Homer’S Elpenor: Mark 14:51-52, 16:1-8 And Odyssey 10-12, Sungchan Moon

CGU Theses & Dissertations

Mark obviously says that all of the disciples of Jesus desert him and flee (Mark 14:50). Mark, however, introduces a young man as a new character who was following Jesus like other disciples and fled naked before Jesus’s suffering. This young man is the most enigmatic character in Mark. In particular, the young man never appears in other Gospels. For this reason, the young man’s identity and his conduct has been a topic of longstanding dispute among scholars.

Some regard him as historical figures, one of Jesus’ own disciples like John the son of Zebedee, James the Lord’s brother, or …

The Role Of Brand Name Fluency: A Pharmaceutical Marketing Perspective, David Wamble Jan 2018

The Role Of Brand Name Fluency: A Pharmaceutical Marketing Perspective, David Wamble

Electronic Theses and Dissertations

Background: consumers are exposed to thousands of advertisements, most all of which are designed to promote a particular brand and accompanying brand name. The selection of a brand name is a critical strategic decision and is an important means to building brand equity. The importance of branding elements, specifically brand names, has led pharmaceutical manufacturers to become more creative and open the possibilities of language in brand name development. Given the complexities associated with brand name development in the U.S. pharmaceutical industry and the trends observed in recent pharmaceutical brand names, advancing the understanding of how brand name selection can …

Japanese-English Bilinguals’ Competence Of Speech Acts In Politeness, Chikako Takehara Jan 2018

Japanese-English Bilinguals’ Competence Of Speech Acts In Politeness, Chikako Takehara

Electronic Theses and Dissertations

The perceptions and norms of speech acts vary depending on the actor’s culture and language (Blum-Kulka, House, & Kasper, 1989; Rinnert & Kobayashi, 1999). Politeness also has diverse benchmarks depending on culture and language, as noted by Ide et al. (1992) who argue that the concept of politeness is different in Japanese and English. When considering the fact that it is challenging to possess bicultural competence and equal proficiency in both languages (Baker, 2011), how one retains this competence becomes a noteworthy question. Thus, this study investigated whether bilinguals who move to a L2 dominant country retain their communicative competence …

African American And First-Generation Students’ Perceptions Of And Experiences With An Academic Cohort, Kim Barnes Jan 2018

African American And First-Generation Students’ Perceptions Of And Experiences With An Academic Cohort, Kim Barnes

Electronic Theses and Dissertations

Underrepresented student populations are faced with numerous barriers and are often overlooked on many college campuses. The aim of this research was to better understand academic cohorts and if they help reduce some of the barriers faced by African American and first-generation students which can ultimately affect retention and persistence to graduation. In order to gather this information, interviews and surveys were conducted with students once enrolled in the foundations for academic success track (Fastrack) program at the University of Mississippi. Results from the interviews and surveys indicate that while the Fastrack program seemed to support successful social transitions for …

Acquisition Of Chinese Wh-Questions By English L2 Learners, Linfei Yi Jan 2018

Acquisition Of Chinese Wh-Questions By English L2 Learners, Linfei Yi

Electronic Theses and Dissertations

The current thesis investigates the acquisition of Chinese wh-questions by English l2 learners based on the syntactic differences between the two languages. I seek to find out how well do the l2 learners acquire the wh-questions, as measured by a grammaticality judgment task; what wh-words tend to pose difficulties for the acceptability of l2 learners; if l2 learners able to acquire the native-like word order of wh-questions in Chinese; if the results of the initial l2 learners in line with any hypotheses of the initial state. Through the analysis of the results, I will conclude that l1 English learners of …

The Law Of Nations And The Constitution: An Early Modern Perspective, David Golove, Daniel J. Hulsebosch Jan 2018

The Law Of Nations And The Constitution: An Early Modern Perspective, David Golove, Daniel J. Hulsebosch

Faculty Articles

For political and cultural reasons that go beyond the boundaries of this forum, many American scholars, lawyers, and judges born in the latter half of the twentieth century have found it difficult to comprehend, or even recognize, the Founding generation’s commitment to the law of nations as a system of law, jurisprudence, and morality. Perhaps for similar reasons, that commitment tends to get lost in much modern historical writing. So, too, with respect to a related, but, from a legal perspective, more conse-quential aspect of the Founding: the prominent place of the law of nations in the constitutional reform project …

Gender, Parasocial Interaction, And Nonverbal Communication: Testing The Visual Effect Of Sports Magazine Cover Models, Ben Wasike Jan 2018

Gender, Parasocial Interaction, And Nonverbal Communication: Testing The Visual Effect Of Sports Magazine Cover Models, Ben Wasike

Communication Faculty Publications

An experiment examined gender, parasocial interaction, and nonverbal communication regarding sports magazine cover models. Results indicate that a correlation exists among parasocial interaction, nonverbal communication, and gender, with female cover models eliciting larger effects on test subjects. However, gender did not correlate with parasocial interaction or nonverbal communication among the test subjects, contradicting extant literature. Also, the parasocial interaction and nonverbal communication measurement scales positively correlated. In conclusion, static images are reliable experimental stimuli for parasocial interaction studies and nonverbal measurement scales, and sports magazines are better served by featuring more women.

A Review Of Conceding Composition: A Crooked History Of Composition's Institutional Fortunes, Andrew Hollinger Jan 2018

A Review Of Conceding Composition: A Crooked History Of Composition's Institutional Fortunes, Andrew Hollinger

Writing and Language Studies Faculty Publications

Compositionists (a community in which I include myself) often work with a chip on our shoulders. Perhaps we find the chip during grad school or when we are asked to teach an overload or when a literature professor’s summer course does not make and they demand a section of first year writing instead or because so many of us remain contingent faculty. Whenever and however the chip appeared, many of us have felt or discussed its presence: we, and our courses, are the misunderstood and much maligned. In fact, this is “the field’s conventional historical narrative, [that] composition is marginalized …

The Ethics Of Dying : An Exploration Of The Right To Suicide And Clinician Response To Self-Determination And Suicidal Ideation Among Adults Who Struggle With Mental Illness, Shelley Bair Jan 2018

The Ethics Of Dying : An Exploration Of The Right To Suicide And Clinician Response To Self-Determination And Suicidal Ideation Among Adults Who Struggle With Mental Illness, Shelley Bair

Theses, Dissertations, and Projects

This paper explores the question: What beliefs, values and assumptions do social workers hold when assessing whether or not a person who is a mental health client has the right to suicide? The current literature reveals that individuals struggling with physical disorders deemed extreme and untreatable are likely to be accepted as rational grounds for suicide. Underrepresented in extant research is the critical examination of the desire to die as a rational versus pathological and treatable response to mental health concerns. The study question is examined, in part, through the lens of the Code of Ethics presented by the National …

The Differences Between And Within Beg And Bag: Phonological, Morphological, And Lexical Effects In Prevelar Raising, Joseph A. Stanley Jan 2018

The Differences Between And Within Beg And Bag: Phonological, Morphological, And Lexical Effects In Prevelar Raising, Joseph A. Stanley

Faculty Publications

Hypotheses

  1. Based on my exceptions, BEG-raising is less common when it is followed by a sonorant.
  2. BEG- and BAG-raising have different patterns.

Phonological Effects

  • No difference between intervocalic /ɡ/ and word-final /ɡ/.
  • For BEG only, significantly less raising before sonorants, particularly liquids.

Morphological Effects

  • Adding –s was had a negligible effect for both vowels.
  • There was more raising reported after adding –ing.
  • For BAG only, there was more raising in words with –ed.

Conclusions

Many language-internal factors:

  • Despite relatively few words with BEG and BAG, there are phonological, morphological, and lexical effects.
  • A small word list may not have captured …

The Consensus Myth In Criminal Justice Reform, Benjamin Levin Jan 2018

The Consensus Myth In Criminal Justice Reform, Benjamin Levin

Michigan Law Review

It has become popular to identify a “consensus” on criminal justice reform, but how deep is that consensus, actually? This Article argues that the purported consensus is much more limited than it initially appears. Despite shared reformist vocabulary, the consensus rests on distinct critiques that identify different flaws and justify distinct policy solutions. The underlying disagreements transcend traditional left/right political divides and speak to deeper disputes about the state and the role of criminal law in society.

The Article maps two prevailing, but fundamentally distinct, critiques of criminal law: (1) the quantitative approach (what I call the “over” frame); and …

The Unifying And Divisive Effects Of Social Identities: Religious And Ethnopolitical Identities Among Mindanao Muslims In The Philippines, Ma. Elizabeth J. Macapagal, Jose Jowel P. Canuday, Cristina J. Montiel Jan 2018

The Unifying And Divisive Effects Of Social Identities: Religious And Ethnopolitical Identities Among Mindanao Muslims In The Philippines, Ma. Elizabeth J. Macapagal, Jose Jowel P. Canuday, Cristina J. Montiel

Psychology Department Faculty Publications

The present study looks into the unifying and divisive effects of ethnopolitical and religious social identities, and an emerging superordinate Bangsamoro identity of Muslims in the southern region of the Philippines. We surveyed 394 Muslims with a mean age of 32.6 and standard deviation of 13.3 from the Tausug, Maranao, and Maguindanaoan ethnopolitical affiliations using various measures of social identities. Findings showed that the Muslims in our sample identify themselves more strongly with their religious identity over their ethnopolitical affiliations. Religious identity may thus be a unifying element in the conflict-ridden context of Mindanao, as a significant correlation was also …

Article Ii And Antidiscrimination Norms, Aziz Z. Huq Jan 2018

Article Ii And Antidiscrimination Norms, Aziz Z. Huq

Public Law and Legal Theory Working Papers

The Supreme Court’s judgment in Trump v. Hawai’i validated a prohibition on entry to the United States from several largely Muslim-majority countries, and at the same time repudiated a longstanding precedent associated with the Japanese-American internment of World War II. This Article closely analyzes the relationship of these twin holdings. It uses their dichotomous valances as a lens onto the legal scope for discriminatory action by the federal executive. Parsing the various ways in which the internment of the 1940s and the 2017 exclusion order can be reconciled, the Article identifies a generative tension between the two holdings. Contrary to …

Legal Or Political Checks On Apex Criminality: An Essay On Constitutional Design, Aziz Z. Huq Jan 2018

Legal Or Political Checks On Apex Criminality: An Essay On Constitutional Design, Aziz Z. Huq

Public Law and Legal Theory Working Papers

How should constitutional designers address the problem of apex criminality, or criminal actions by those elected or appointed to high positions in a national government? I offer three general observations about this difficult question of constitutional design. First, it is not at all clear that a constitutional designer ought to expend effort on creating accountability mechanisms to address apex criminality. Second, if a designer does choose to address the question, she must opt between two highly imperfect options—a ‘legal’ mechanism embedded in a nonpartisan body such as a prosecutor’s office, or a ‘political’ mechanism, which runs through an elected body …

How War Makes (And Unmakes) The Democratic State: Reading The Reluctant Fundamentalist And Exit West In A Populism Age, Aziz Z. Huq Jan 2018

How War Makes (And Unmakes) The Democratic State: Reading The Reluctant Fundamentalist And Exit West In A Populism Age, Aziz Z. Huq

Public Law and Legal Theory Working Papers

War makes the state, and war makes the state democratic—or so the conventional wisdom holds. But the wars of the twenty-first century will have a distinct complexion from wars of the century just passed. As war and democracy alike change, their relationship alters. This book chapter examines that relationship through the lens of two recent novels by Mohsin Hamid, The Reluctant Fundamentalist and Exit West. The protagonists of these novels stand in some fashion for the two main vectors by which war is perceived to, and indeed does, work a change to the democratic state—the terrorist and the migrant. The …

Statutory Interpretation On The Bench: A Survey Of Forty-Two Judges On The Federal Courts Of Appeals, Abbe R. Gluck, Richard A. Posner Jan 2018

Statutory Interpretation On The Bench: A Survey Of Forty-Two Judges On The Federal Courts Of Appeals, Abbe R. Gluck, Richard A. Posner

Public Law and Legal Theory Working Papers

This Article reports the results of a survey of a diverse group of forty-two federal appellate judges concerning their approaches to statutory interpretation. The study reveals important differences between their approaches and the approach that the Supreme Court purports to take. It also helps to substantiate the irrelevance of the enduring, but now-boring, textualism-versus-purposivism debate. None of the judges we interviewed was willing to associate himself or herself with “textualism” without qualification. All consult legislative history. Most eschew dictionaries. All utilize at least some canons of construction, but for reasons that range from “window dressing,” to the use of canons …

Measurement Equivalence Of English Versus Native Language Versions Of The Kessler 6 (K6) Scale: An Examination In Three Asian American Groups, Yuri Jang, Daniel A. Powers, Hyunwoo Yoon, Min-Kyoung Rhee, Nan Sook Park, David A. Chiriboga Jan 2018

Chiriboga

Social Work Faculty Publications

The use of languages other than English in population-based surveys is necessitated by the linguistic diversities in the United States. However, inclusion of multiple languages in survey data collection raises concerns about whether an instrument administered in different languages functions equivalently across groups. Using the Kessler Psychological Distress Scale 6 (K6), the present study examined differential item functioning (DIF) between surveys conducted either in English or the native language of the groups of Chinese Americans (n = 622), Korean Americans (n = 471), and Vietnamese Americans (n = 513). DIF analyses using a series of multiple-indicator multiple-cause models showed that …

Applications Of French Phonetics To Flute Playing: A Historical Perspective, Mary Margaret Zrull Jan 2018

Applications Of French Phonetics To Flute Playing: A Historical Perspective, Mary Margaret Zrull

Libraries Award for Undergraduate Scholarship

When people speak, they shape their mouths differently for different languages. It follows, then, that there are inherent differences in flutists’ playing based on their native language. In the case of teaching syllables—syllables that the flutist “says” while playing in order to achieve a certain articulation or embouchure formation, such as “tu”—this can become confusing. Therefore, it is important for flutists to study the pronunciation systems of foreign languages, in order to know how to correctly produce teaching syllables used by flutists and teachers of other cultures. Flute pedagogy has a strong French tradition, and many modern day, American, English-speaking …

Memory And The Realization Of The Nothingness. On A Letter Of Vittorio Sereni To Giuseppe Ungaretti, Stefano Giannini Jan 2018

Memory And The Realization Of The Nothingness. On A Letter Of Vittorio Sereni To Giuseppe Ungaretti, Stefano Giannini

Languages, Literatures, and Linguistics - All Scholarship

The problematic relationship of Giuseppe Ungaretti (1888-1970) with Alexandria of Egypt – his city of birth – sheds light on the interplay between memory and oblivion in his poetry and prose. The shuttling back and forth between these poles marks the nature of his unfulfilled desire to recreate a lost Alexandrian atmosphere. In Ungaretti’s works, language opacity is coupled with his attempts to represent a city—as he writes—that is suffocated by the sun and whose hidden ancient port is submerged in the depth of the sea. Blinding light and the darkness of the deep waters make the understanding of Ungaretti’s …
