Originalist Theory And Precedent: A Public Meaning Approach, Lawrence B. Solum Oct 2018

Originalist Theory And Precedent: A Public Meaning Approach, Lawrence B. Solum

Faculty Scholarship

This Article provides some introductory thoughts about the relationship between originalist constitutional theory and the proper role of precedent in the American judicial system. The development of these thoughts begins in Part I, which provides a brief introduction to originalism and its principle rival, which is sometimes called “living constitutionalism.” Part II describes the problem of precedent for originalism, emphasizing that the nature of the problem depends in part on our understanding of precedent. Part III offers some reflections on the question as to the constitutional status of the doctrine of horizontal stare decisis in the United States Supreme Court. …

Predicting Visual Context For Unsupervised Event Segmentation In Continuous Photo-Streams, Ana García Del Molino, Joo-Hwee Lim, Ah-Hwee Tan

Research Collection School Of Computing and Information Systems

Segmenting video content into events provides semantic structures for indexing, retrieval, and summarization. Since motion cues are not available in continuous photo-streams, and annotations in lifelogging are scarce and costly, the frames are usually clustered into events by comparing the visual features between them in an unsupervised way. However, such methodologies are ineffective to deal with heterogeneous events, e.g. taking a walk, and temporary changes in the sight direction, e.g. at a meeting. To address these limitations, we propose Contextual Event Segmentation (CES), a novel segmentation paradigm that uses an LSTM-based generative network to model the photo-stream sequences, predict their …

How Does The Language Used In Literacy Coaching Conversations Impact Teacher Self-Efficacy?, Nicole Cahill

School of Education and Leadership Student Capstone Theses and Dissertations

This action research study explored the language used by the researcher during literacy coaching sessions with six elementary school teachers. The research question addressed in this capstone is, how does the language used in literacy coaching conversations impact teacher self-efficacy? The author reviewed relevant research regarding self-efficacy, the components of effective coaching conversations, and a social constructivist view of language. Key findings from the literature review were used to develop a list of language prompts in order to increase teacher self-efficacy during coaching dialogues. Each research participant engaged in an individual coaching cycle that included a modeling session, two sessions …

A Study On The Use Of Rubrics To Guide Writing And Self-Assessment In The L2 Elementary Classroom, Matthew Hoerr

School of Education and Leadership Student Capstone Theses and Dissertations

The use of rubrics in the classroom to guide writing or as a means of self-assessment are not new concepts but ones that have received little study at the primary level. This study took the

form of a classroom-based action research project, over a seven-week period, in a fourth- grade elementary school classroom, at an international school in Ecuador. Data was collected

through responses to narrative writing prompts scored by the teacher and self-assessed by the students using the 6-Traits Writing Rubric. The students received direct instruction on writing traits as well as training on how to use the rubric. …

About this Project

In the fall of 2018, 14 of the families and 32 students from two first-year seminars, Crossing Borders: Immigration, Identity, and Development and Immigrant Stories, worked together to create this cookbook. Families submitted their favorite dishes and then invited students to their homes to demonstrate the preparation. As they cooked and ate together, students recorded the steps to make the recipe and listened as connections between food, memory, family, migration, traditions, and religion emerged.

Harvesting Memory, Preserving Home: A Cookbook of the Painted Turtle Farm is the product of this undertaking. In it, we offer the …

Mathematical Literacy And The Secondary Student, Adam Poyner Oct 2018

Mathematical Literacy And The Secondary Student, Adam Poyner

Senior Honors Theses

Public education is a continually evolving field, with new research, policies, and practices explored by professionals who are driven to provide America’s youth with high-quality education. Research literature since 2000 has highlighted the importance of disciplinary literacy and its unfortunate neglect in a majority of secondary classrooms (Shanahan & Shanahan, 2008). Students who are literate in a particular discipline, such as math, view themselves as fluent in the language of mathematics, comfortable with reading, discussing, and practicing complex mathematical concepts while using appropriate vocabulary (Buehl, 2017). As seasoned professionals and novice educators consider the role of disciplinary literacy in their …

Are Beach Boundaries Enforceable? Real-Time Locational Uncertainty And The Right To Exclude, Josh Eagle Oct 2018

Are Beach Boundaries Enforceable? Real-Time Locational Uncertainty And The Right To Exclude, Josh Eagle

Faculty Publications

Over the past few decades, landowners have tried to use the First, Fourth, and Fifth Amendments to fully privatize the upper, dry-sand part of the beach. If these efforts were to succeed, there would be a host of negative consequences, and not just for surfers. In most of the states in which beaches are economically important, including California, Florida, New Jersey and Texas, privatized dry sand would mean little to no public access at times when the public, wet-sand part of the beach is submerged, that is, in the hours immediately before and after high tides. Decreased beach use would …

When Courts Should Ignore Statutory Text, Jesse M. Cross Oct 2018

When Courts Should Ignore Statutory Text, Jesse M. Cross

Faculty Publications

Statutory interpreters often rely upon a fundamental assumption: namely, that every word of a statute is meant to be read — and given legal force — by the courts. This assumption unites both textualists and intentionalists, and it has been invoked by Justices as diverse as Chief Justice Marshall, Justice Stevens, and Justice Scalia — the last of whom called it a “cardinal rule of statutory interpretation.” It underpins at least nine separate canons of statutory interpretation, and it even shapes how courts interpret legislative documents beyond statutes. It is difficult to imagine a more central assumption in statutory interpretation. …

The Constitutionality Of Classification: Indigenous Overrepresentation And Security Policy In Canadian Federal Penitentiaries, D'Arcy Leitch Oct 2018

The Constitutionality Of Classification: Indigenous Overrepresentation And Security Policy In Canadian Federal Penitentiaries, D'Arcy Leitch

Dalhousie Law Journal

This article examines one component of the Correctional Service of Canada's (CSC) risk classification scheme. The CSC uses the Custody Rating Scale (CRS), a 12-item actuarial instrument, to measure risk and to provide security classification recommendations. Empirical data shows that while CRS recommendations may have some predictive validity, certain of the 12 items the CRS includes do not, particularly for Indigenous prisoners. This article makes the case that the inclusion ofsuch items in the CRS violates prisoner's rights under section 7 of the Charter by depriving them of liberty in a manner that is arbitrary and overbroad. Habeas corpus is …

Integrating Student Development Theory Into Education Abroad Advising, Amanda Lentz Oct 2018

Integrating Student Development Theory Into Education Abroad Advising, Amanda Lentz

Capstone Collection

In higher education there is an emphasis on promoting the development of students. As research has found, this is equally important to employers. Theorists like Linda Riessler and Arthur Chickering have designated tasks that students must complete to develop into competent human beings. This has been recognized and valued by higher educational institutions and employers. There is an emphasis on the importance for students to have a global perspective and to be fully developed adults upon completion of their degree. As a means to meet this objective, students and administrators are looking to study abroad.

This research aims to support …

Architectural Evangelism: Examination Of Place Constructs Held By Churched And Unchurched Individuals, Matthew Niermann Oct 2018

Architectural Evangelism: Examination Of Place Constructs Held By Churched And Unchurched Individuals, Matthew Niermann

Great Commission Research Journal

In recent decades, the exterior design of Protestant churches has undergone radical reformulation under the influence of the church growth architectural design theory known as architectural evangelism. Presupposing that churched and unchurched individuals hold differing place constructs, architectural evangelism seeks to attract unchurched individuals to the church by changing the exterior design from church typologies to secular typologies. In doing so, as the theory proposes, when an unchurched individual is exposed to a typology they are more familiar with, a different place construct formulation occurs—a place construct rooted in conceptions of comfort and the perception of community-based activities. Noting the …

Proposing A Transactional Model Of Ehealth Literacy: Concept Analysis, Samantha R. Paige, Michael Stellefson, Janice L. Krieger, Charkarra Anderson-Lewis, Jeewon Cheong, Christine Stopka Oct 2018

Proposing A Transactional Model Of Ehealth Literacy: Concept Analysis, Samantha R. Paige, Michael Stellefson, Janice L. Krieger, Charkarra Anderson-Lewis, Jeewon Cheong, Christine Stopka

Faculty Publications

Background: Electronic health (eHealth) literacy was conceptualized in 2006 as the ability of internet users to locate, evaluate, and act upon web-based health information. Now, advances in eHealth technology have cultivated transactional opportunities for patients to access, share, and monitor health information. However, empirical evidence shows that existing models and measures of eHealth literacy have limited theoretical underpinnings that reflect the transactional capabilities of eHealth. This paper describes a conceptual model based on the Transactional Model of Communication (TMC), in which eHealth literacy is described as an intrapersonal skillset hypothesized as being dynamic; reciprocal; and shaped by social, relational, and …

Collaborative Curricular Initiatives: Linking Language And Literature Courses For Critical And Cultural Literacies, Yuri Kumagai, Kimberly Kono

East Asian Languages & Cultures: Faculty Publications

This article introduces a curricular initiative linking language and literature courses at a liberal arts college in the northeastern United States. In the spring 2013 and fall 2014 semesters, we concurrently taught an advanced-level Japanese language course and a literature seminar, both of which focused on ethnic “minorities” in Japan. This arrangement allowed students to utilize their linguistic and literary analytical skills and integrated their learning in both Japanese and English. By reading the same texts and discussing surrounding issues in both languages, students began to see how the cultural context of language shapes different approaches to a topic. Based …

Fully Convolutional Neural Networks For Pixel Classification In Historical Document Images, Seth Andrew Stewart Oct 2018

Fully Convolutional Neural Networks For Pixel Classification In Historical Document Images, Seth Andrew Stewart

Theses and Dissertations

We use a Fully Convolutional Neural Network (FCNN) to classify pixels in historical document images, enabling the extraction of high-quality, pixel-precise and semantically consistent layers of masked content. We also analyze a dataset of hand-labeled historical form images of unprecedented detail and complexity. The semantic categories we consider in this new dataset include handwriting, machine-printed text, dotted and solid lines, and stamps. Segmentation of document images into distinct layers allows handwriting, machine print, and other content to be processed and recognized discriminatively, and therefore more intelligently than might be possible with content-unaware methods. We show that an efficient FCNN with …

Acoustic Correlates Of Aging And Familial Relationship, Samantha Michelle Taylor

Theses and Dissertations

The purpose of this study was to examine the potential differences in selected acoustic measures of speech as a function of age, across sexes, and between families. The data used in this study were previously collected for a larger project on voice production at the University of Utah. Participants included 169 individuals, 79 men and 90 women, from 18 Utah families, ranging in age from 17 to 87 years. All participants had no history of articulation disorders, stroke or active neurologic disease, or severe-profound hearing loss. Participants were recorded reading two passages aloud in a sound booth. These two passages …
