“Nationwide” Injunctions Are Really “Universal” Injunctions And They Are Never Appropriate, Howard Wasserman
“Nationwide” Injunctions Are Really “Universal” Injunctions And They Are Never Appropriate, Howard Wasserman
Faculty Publications
Federal district courts are routinely issuing broad injunctions prohibiting the federal government from enforcing constitutionally invalid laws, regulations, and policies on immigration and immigration-adjacent issues. Styled “nationwide injunctions,” they prohibit enforcement of the challenges laws not only against the named plaintiffs, but against all people and entities everywhere.
The first problem with these injunctions is one of nomenclature. “Nationwide” suggests something about the “where” of the injunction, the geographic scope in which it protects. The better term is “universal injunction,” which captures the real controversy over the “who” of the injunction, as courts purport to protect the universe of all …

Since the publication of Janice Fine’s path-breaking book, Worker Centers: Communities at the Edge o f the Dream in 2006, scholars and commentators on the left and the right of the political spectrum have grappled with how to characterize these emergent worker organizations on the US labor relations scene. This chapter deepens our understanding of the nature of worker centers by examining the funding trends that underlay the wide range of experimental organizing and advocacy strategies highlighted in other chapters of this volume. Undoubtedly, to emerge and survive, these organizations need money (Bobo and Pabellon 2016). But how financially stable …

Adminization: Gatekeeping Consumer Contracts, Yonathan A. Arbel
Adminization: Gatekeeping Consumer Contracts, Yonathan A. Arbel
Vanderbilt Law Review
Large companies and debt collectors frequently file unmeritorious claims against consumers. Recent high-profile actions brought by the Consumer Financial Protection Bureau against J.P. Morgan, Citibank, and other large debt collectors illustrate the breadth and importance of this phenomenon. Due to the limited financial power of individuals, consumers often do not defend against such baseless claims, which results in the entry of millions of default judgments every year. To combat this problem, policymakers and scholars have explored a variety of court-based solutions that would make it easier for consumers to defend in court, but these prove ineffectual. To solve the problem …

Contract As Commodified Promise, Erik Encarnacion
Contract As Commodified Promise, Erik Encarnacion
Vanderbilt Law Review
Many scholars assume that lawmakers should design contract law with the goal of facilitating commercial promises. But the question of which promises count as commercial remains neglected. This Article argues that this question matters more than one might initially expect. Once we understand commerciality in terms of commodificationroughly, treating something as subject to market norms-surprising recommendations for reform follow. First, if contract law should enforce commodified promises, we should demote the consideration doctrine to a presumption of enforceability rather than a formal requirement. Second, we should adopt a rule, contrary to current doctrine in most jurisdictions in the United States, …

Active Judging And Access To Justice, Anna E. Carpenter
Active Judging And Access To Justice, Anna E. Carpenter
Notre Dame Law Review
“Being a good judge in this environment means unlearning what you learned in law school about what a judge is supposed to do. Fairness is doing things a federal judge would never do.”
Active judging, where judges step away from the traditional, passive role to assist those without counsel, is a central feature of recent proposals aimed at solving the pro se crisis in America’s state civil courts. Despite growing support for active judging as an access to justice intervention, we know little, empirically, about how judges interact with pro se parties as a general matter, and even less about …
