Where To From Here For The Catholic Church- Recommendations 94 And 95 Of The Redress And Civil Litigation Report, Jane Power
The University of Notre Dame Australia Law Review
The Royal Commission into Institutional Responses to Child Sexual Abuse handed down its Final Report in December 2017. In 2015 it presented its interim Redress and Civil Litigation Report which contained final recommendations in relation to reform in civil litigation. Recommendations 94 and 95 of the Redress and Civil Litigation Report both directly and indirectly address the lack of legal entity for the Catholic Church in Australia and the problems this causes litigants seeking legal recompense. This paper considers the current legal status of the Catholic Church in Australia in light of the Recommendations.
Immigration And Domestic Violence Services: One Size Fits All?, Mary Kate Taggart
Immigration And Domestic Violence Services: One Size Fits All?, Mary Kate Taggart
Master’s Theses and Projects
The purpose of this study was to explore how immigration-related factors affect provision of domestic violence services. These factors include the survivors’ integration into the American society and their English language proficiency. Considering the recent dramatic rise in immigrant population in the United States, addressing the needs of foreign-born domestic violence survivors is becoming increasingly important. This thesis used secondary data from Multi-State Study of Meeting Domestic Violence Survivors' Needs Through Non-Residential Services and Supports. The data was analyzed using SPSS. After conducting Chi-square and OLS multiple regression statistical tests, some hypotheses were supported while others were not. Overall, this …

The Karamazov Murder Trial: Dostoevsky's Rejoinder To Compassionate Acquittals, Ronald D. Leblanc
The Karamazov Murder Trial: Dostoevsky's Rejoinder To Compassionate Acquittals, Ronald D. Leblanc
Languages, Literatures & Cultures
Gary Rosenshield has argued that the miscarriage of justice Dostoevsky depicts in the final book of The Brothers Karamazov, where an innocent man is wrongly convicted in a court of law for a crime he did not commit, may be read as the novelists attempt to dramatize in a work of fiction the strong misgivings about the legal reforms of 1864 that he had expressed in his Diary of a Writer during the mid-1870s. More specifically, Rosenshield argues that the Karamazov trial constitutes Dostoevsky’s novelistic reworking of his own journalistic commentary on two particular jury trials, those of Stanislav Kronenberg …

Neglect And Abuse Of Unaccompanied Immigrant Children By U.S. Customs And Border Protection, University Of Chicago Law School - Global Human Rights Clinic
Global Human Rights Clinic
According to the U.S. government, tens of thousands of Central American and Mexican children travel alone to the United States every year to escape violence and poverty in their home countries. U.S. Customs and Border Protection (CBP), a sub-agency of the Department of Homeland Security (DHS), detains many of these children when they arrive at U.S. ports of entry or cross the U.S. border. While in CBP custody, immigrant children have reported physical and psychological abuse, unsanitary and inhumane living conditions, isolation from family members, extended periods of detention, and denial of access to legal and medical services.

Rule 8.4 And The First Amendment: Distinguishing Between Discrimination And Free Speech, Rebecca Aviel
Rule 8.4 And The First Amendment: Distinguishing Between Discrimination And Free Speech, Rebecca Aviel
Sturm College of Law: Faculty Scholarship
The ABA's recent adoption of Model Rule 8.4(g), making it sanctionable for lawyers to engage in discrimination or harassment, has garnered a great deal of attention, much of it focused on whether the rule violates an attorney's right to free speech. This article attempts to bring clarity to the discussion. It emphasizes the significance of claiming, as some have done, that the rule is facially invalid because it is overbroad, and then engages in the close textual analysis necessary to evaluate claims of overbreadth. This analysis yields important insight about how the rule might be revised to better reflect the …

Defining Attorney-Client Privilege For The Independent Contractor: A Case For The Functional Equivalent Doctrine In Washington, Benjamin J. Robbins
Defining Attorney-Client Privilege For The Independent Contractor: A Case For The Functional Equivalent Doctrine In Washington, Benjamin J. Robbins
Washington Law Review Online
Corporations increasingly rely on independent contractors to fulfill basic organizational needs. This increased reliance has created a number of legal issues, one of which is the level of privilege extended to communications between contractors and legal counsel for the contracting corporation. This issue is particularly relevant for corporations in the “gig economy,” like Uber, Lyft, and Postmates, which rely on independent contractors for fundamental business functions. Washington State courts have yet to decide whether independent contractors are entitled to attorney-client privilege regarding these conversations. Generally, Washington courts follow the U.S. Supreme Court’s “Upjohn rule,” which protects communications between corporate counsel …
Big Law Dreams, Pam Jenoff
Big Law Dreams, Pam Jenoff
Florida A & M University Law Review
Upon graduation, law students continue to seek positions with large law firms in record numbers. Graduates are drawn to Big Law for the purported pluses of high compensation; interesting work; extensive training and resources; mobility and prestige. However, a closer examination of the present-day realities reveals that these beliefs may be outdated, overstated, or simply incorrect. Students who make their career choices based on such premises may find themselves trapped in ill-fitting and unsatisfying positions. Moreover, an unyielding focus on Big Law based on faulty assumptions may have costs and consequences for legal education and the provision of legal services. …

Ethics Of Using Artificial Intelligence To Augment Drafting Legal Documents, David Hricik
Ethics Of Using Artificial Intelligence To Augment Drafting Legal Documents, David Hricik
Articles
Skynet is not and may never be self-aware, but machines are al-ready doing legal research, drafting legal documents, negotiating disputes such as traffic tickets and divorce schedules, and even drafting patent applications. Machines learn from us, and each other, to augment the ability of lawyers to represent clients—and even to replace lawyers completely. While it also threatens lawyers’ jobs, the exponential increase in the capacity of machines to transmit, store, and process data presents the opportunity for lawyers to use these services to provide better, cheaper, or faster legal representation to clients. By way of familiar example, instead of determining …
