Globalization Of Business Lawyering In Japan, Yoshimichi Makiyama
Globalization Of Business Lawyering In Japan, Yoshimichi Makiyama
UC Law SF International Law Review
The development of a legal system under globalization has impacted the legal practice of cross-border transactions. Businesses are confronted with several legal systems in foreign jurisdictions, as well as, foreign languages. On the other hand, the role of the legal system of each country becomes relatively diminished in the area of cross border transactions. The legal risk may materialize as uncertain knowledge and recognition of foreign legal systems and international law. From this perspective, it is more important to understand the roles of lawyers who support solving legal issues in transnational business. Cross-border transactions involve several different jurisdictions where the …

Mass Incarceration Of Palestinian Youth As A Potential Catalyst For Socio-Political Change: An Examination Of International Reports On The Systematic And Institutionalized Ill-Treatment Of Palestinian Youth In The Israeli Military Detention System, Hannah Marie Procell
Theses & ETDs
In this study I explore how various international non-governmental organizations (NGOs) frame the issue of, and solutions for, the incarceration of Palestinian youth. I employ a method of content analysis in combination with social movement (SM) theory and frame analysis to critically analyze these organizations’ approaches to writing reports on the systematic and institutionalized ill-treatment and torture of Palestinian youth in the Israeli military detention system. In addition to finding how social movement NGOs frame the issue, my research fills a valuable research gap through connecting the topic with U.S. based mass incarceration literature. I discuss the necessity of reforming …

Check Your Privilege: The Big Blow To Corporate Internal Investigation In The Post-Upjohn Era, 52 Uic J. Marshall L. Rev. 125 (2018), Brandon Villa
UIC Law Review
The attorney-client privilege is the oldest privilege recognized by common law. In the corporate context, the attorney-client privilege exists between control group-officers and corporate counsel. That privilege extends to communication collected from lower level employees which encourages the frank communication to gather all relevant information to adequately advise the corporate client. But does information gathered from an employee after termination enjoy that privilege? The Upjohn rationale for the attorney-client privilege erodes when the sole focus of privilege focuses on an attorney-client relationship. Specifically, the Washington Supreme Court deviated from the Upjohn rationale which corrodes the fundamental principles of the attorney-client …

Emergency Preparedness In The Legal Librarian Community In The United States – Current Culture And The Need To Expand Collaboration, Danielle Lewis
Emergency Preparedness In The Legal Librarian Community In The United States – Current Culture And The Need To Expand Collaboration, Danielle Lewis
Borgeson Paper Archive
The frequency of natural disasters hitting populated areas is increasing, and due to society’s increased dependency on modern infrastructure, the impacts of disasters have also escalated. I interviewed librarians and law librarians that work or have worked in libraries that were impacted by natural disasters, as well as experts in the disaster management field. From their comments and insights, shared in this paper, it is clear that there are lessons that can be learned from the larger community in the area of disaster management in law libraries. The law librarian community needs to expand the scope of the national discussion …

Externship Assessment Project: An Empirical Study Of Supervisor Evaluations Of Extern Work Performance, Margaret Reuter
Externship Assessment Project: An Empirical Study Of Supervisor Evaluations Of Extern Work Performance, Margaret Reuter
Faculty Works
Field supervisors’ evaluations of their student externs are packed with lively stories. They deliver a fly-on-the-wall perspective, giving us color about the work entrusted to our students, the behaviors our students exhibited, and the enjoyment the attorneys reaped. The authors decided the evaluations were so fertile that they should be systematically scrutinized to seek meaningful, reliable insights about the extern experience, especially regarding the variety, complexity, and responsibility levels of their work. We also saw a prime opportunity to assess an externship program and find ways to improve it. Thus, the Externship Assessment Project was born. We deployed qualitative data …

What Are Courts For? Have We Forsaken The Procedural Gold Standard?, Arthur R. Miller
Faculty Articles
This Article expands and updates my Alvin and Janice Rubin Lecture delivered at the Paul M. Hebert Law Center, Louisiana State University on March 8, 2017. I have tried to preserve its conversational style. At several points, however, that style did not translate to paper, but the substance of my remarks has not been changed. The citations are designed to be illustrative rather than exhaustive.
Widening The Lens: Refocusing The Litigation Cost-And-Delay Narrative, Arthur R. Miller
Widening The Lens: Refocusing The Litigation Cost-And-Delay Narrative, Arthur R. Miller
Faculty Articles
Lawyers are the focal point of the Judge’s Articles. But lawyers are not the only players on the litigation field, and I believe the dialogue should go beyond their behavior. To have a clearer picture of the cost-and-delay narrative, a wide-angle perspective rather than a telephoto view is necessary. What follows is an attempt to chronicle some of the legislative, judicial, and rulemaking procedural developments of the past half-century, as well as the influences of our complicated federalism. These are the tools that practicing lawyers use; I believe these developments are, at least in part, the by-products of the narrative …

Taxing Litigation: Federal Tax Concerns Of Personal Injury Plaintiffs And Their Lawyers, Gregg Polsky
Faculty Articles
This Article addresses the federal tax concerns of personal injury plaintiffs and the lawyers who represent them, typically on a contingency-fee basis. It explains when plaintiffs’ recoveries are taxable for income and employment tax purposes and whether and how those recoveries are required to be reported by defendants to the IRS. It also discusses whether attorney’s fees and costs are deductible by plaintiffs. In addition to these tax planning and compliance issues, the Article also considers when tax evidence might be admissible. Plaintiffs and defendants often try to introduce tax evidence in an effort to increase or decrease, respectively, the …

Learning In "Baby Jail": Lessons From Law Student Engagement In Family Detention Centers, Lindsay M. Harris
Learning In "Baby Jail": Lessons From Law Student Engagement In Family Detention Centers, Lindsay M. Harris
Journal Articles
Between 2014 and 2017, more than 40 law schools and likely well over 1000 law students engaged in learning within immigration family detention centers. The Trump Administration’s “zero tolerance” policy and implementation of wide-scale family separation in 2018 led to increased involvement by professors and students in the constantly shifting landscape of immigration detention. As the detention of immigrant families becomes increasingly entrenched, this article hits the pause button and assesses the benefits and challenges of the various approaches to, and proposes some principles for, law student engagement in this crisis lawyering in immigration detention centers, for families, and beyond.

Repealing No-Fault Divorce Would Harm Survivors Of Domestic Violence In Texas, Judge Elmo B. Hunter Legal Center For Victims Of Crimes Against Women
Repealing No-Fault Divorce Would Harm Survivors Of Domestic Violence In Texas, Judge Elmo B. Hunter Legal Center For Victims Of Crimes Against Women
Hunter Center Publications
For the past two legislative sessions, the Texas Legislature has explored the repeal of no-fault divorce in the state. This paper explains why such action would be detrimental to the more than five million survivors of domestic violence in Texas. Briefly stated, requiring proof of fault in order to obtain a divorce imposes financial burdens that trap victims in abusive relationships and increases the risk of harm and lethality.
The economic impacts of repealing unilateral no-fault divorce will adversely affect not only victims of domestic violence but also the State of Texas itself. By its nature, fault-based divorce is significantly …
