In 1988 the United States Supreme Court declared constitutional the federal government’s development plan in an area (known as the High Country) that was considered central to the religious practice of three local American Indian nations. The Court admitted that “It is undisputed that the Indian respondents’ beliefs are sincere and that the Government’s proposed actions will have severe adverse effects on the practice of their religion.” Nevertheless, because the disputed area was on public land, the Court thought that the government should be allowed to manage its property in any way it saw fit, regardless of the severe adverse …

Wood County, Ohio Service providers and volunteers came together to serve those at risk for homelessness and under-served populations at the 5th Annual Project Connect. Data were collected from guests, volunteers, and providers to capture the characteristics and satisfaction levels of those in attendance and those involved in carrying out this expansive, one-day event. The results are presented in the report.

Business Volatility And Employee Performance, Wen-Chyuan Chiang, Li Sun, Brian Walkup

This study examines the impact of business volatility on employee performance. We posit that employees work harder in a more volatile business environment as prior research links business volatility to increased use of performance-based compensation systems, which may result in better employee performance. Our results suggest that business volatility has a significant and positive impact on employee performance. Furthermore, we find that the relationship between business volatility and employee performance is stronger for larger firms and firms with higher labor intensity.

From Ainsworth to Yutan, from library systems with twelve branches (i.e., Omaha) with a legal service area population of 537,709 to single libraries serving a population of less than 1,000 (which describes 60% of all public libraries in Nebraska), the Nebraska Library Commission serves very different constituencies all with different needs and different resources. Given that diversity of librarianship, as a “Problem of Practice” (Carnegie Program for the Education Doctorate, 2014) I needed to learn how to optimize the continuing education opportunities offered by the Nebraska Library Commission to this diverse constituency. Grandparent caregiving is a widespread form of kinship care in the U.S. More than 2.7 million of grandparents in the U.S. are the primary caregivers for grandchildren without parental involvement (US Census Bureau, 2012). A particular group among grandparent caregivers often excluded in social services are those that are raising grandchildren informally without child welfare involvement. Informal grandparent caregivers (IGCs) are increasing and will continue to play significant roles in raising grandchildren for many generations (Ehrle et. al., 2001; Gibson & Singh, 2004; Goodman & Silverman, 2001). Spanish heritage speakers are a growing and heterogeneous population that shares a status of inequality within society regarding their language and culture. This study explored the language ideologies of Spanish heritage speakers and their English peers in two different settings: an urban monolingual school and a sub-urban bilingual school with a Dual-Immersion language program in Indiana.

In the wave of efforts to encourage and support more “responsible” land investments, one aspect has been largely overlooked: are governments equipped with the legal and technical support needed to effectively negotiate and conclude investment contracts that lead to responsible outcomes?

CCSI researched how host governments access legal support in the planning, negotiation, and monitoring of land investments, with a view to better understanding where legal support gaps for governments exist, and how these can be addressed by governments themselves, as well as by donors, support providers and investors.

This Article analyses the preliminary reference procedure under Article 158(3) of the Hong Kong Basic Law and its transplantation from Article 267 of the Treaty on the Functioning of the European Union. Preliminary reference procedures require courts of final appeal to refer certain questions of law to a higher legal authority for determination before they can give judgement. This Article argues that this area of Hong Kong constitutional law is underdeveloped, due in large part to the unwillingness of the Hong Kong judiciary to respect the interests of the national legislature. The Public Service Loan Forgiveness Program: The Need For Better Employment Eligibility Regulations, Gregory Crespi

A few people have now applied for and obtained tax-exempt debt forgiveness of their federal student Direct Loans under the Public Service Loan Forgiveness (PSLF) program after satisfying the requirements of 10 years of post-October 1, 2007 employment in a “public service job.” While only a relatively small number of people have received debt forgiveness to date, I estimate that as the number of persons eligible ramps up sharply in 2018 and thereafter eventually 200,000 people a year or more will obtain debt forgiveness under the PSLF program, at a total cost to the Treasury of $12 billion per year …

This report analyzes the potential economic impact of La Villa Hispana’s construction and operation proposed in the Clark‐Fulton neighborhood of Cleveland, the home to the densest population of Hispanic residents in the State of Ohio. We separately estimate the economic impact of El Mercado, one of the foundational projects of the La Villa Hispana development. The economic impacts are assessed on the City of Cleveland, Cuyahoga County, and the State of Ohio.

An Honest But Fearless Fighter: The Adversarial Ideal Of Public Defenders In 1930s And ’40s Los Angeles, Sara Mayeux

Vercoe's self-description as a courtroom "fighter" illuminates public defenders' professional identity in the United States in the decades after the criminal courts had developed into a modem bureaucracy, but before the Warren Court constitutionalized criminal procedure. Historians have characterized lawyering for the poor as outside the mainstream of adversar- ial legal culture, describing a "two-tiered legal system" in which lawyers celebrated courtroom combat on behalf of paying clients but relegated the indigent to a lesser form of advocacy that valorized "compromise." Comporting with this characterization, legal scholars have portrayed early public defenders as "assembly-line" workers who conducted little factual investigation …
