The End Of Bargaining In The Digital Age, Saul Levmore, Frank Fagan

Bargaining is a fundamental characteristic of many markets and legal disputes, but it can be a source of inefficiency. Buyers often waste resources by searching for information about past prices, where a seller already holds that information. A second—and novel—source of social loss is that some buyers will avoid otherwise beneficial bargains and sellers with negotiable prices because they recognize the seller’s advantage in any haggling match. They might also hide information that reveals their willingness to pay. This Article argues for mandated disclosure of past prices, and occasionally settlements, where these have been negotiable. Lawyer As Soothsayer: Exploring The Important Role Of Outcome Prediction In The Practice Of Law, Mark K. Osbeck

Outcome prediction has always been an important part of practicing aw. Clients rely heavily on their attorneys to provide accurate assessments of the potential legal consequences they face when making important decisions (such as whether to accept a plea bargain, or risk a conviction on a much more serious offense at trial). And yet, notwithstanding its enormous importance to the practice of law (and notwithstanding the handsome legal fees it commands), outcome prediction in the law remains a very imprecise endeavor.

This chapter explores the legal challenges to Chinese financial institutions in Southeast Asia against the backdrop of China’s grand ‘Belt and Road Initiative’ (BRI) and the establishment of the Association of Southeast Asian Nations (ASEAN) Economic Community. Banking and finance play important roles in promoting trade, investment and infrastructure projects. The development of ASEAN, an immense economic bloc located immediately south of China, will have an enormous effect on the BRI strategy. This chapter outlines the current development of financial integration within ASEAN with respect to the bloc’s banking and insurance sectors. It also considers the legal obstacles and potential …

In a commentary, SMU Associate Professor of Law Eugene Tan opined that even as the legal profession strives to remain relevant, it must resolve to be steadfast and true to its calling. The report of the Committee for the Professional Training Lawyers recently released urged all those seeking to read law and to practise law “[to] be frank in asking themselves why they are attracted to the profession”. Associate Prof Tan noted that with the Government accepting in principle the committee’s recommendations, the pathway to be a full-fledged lawyer is going to be more demanding and longer.

Skills-Based Volunteering As Both Work And Not Work: A Tension-Centered Examination Of Constructions Of “Volunteer”, Sarah Steimel

The Corporation for National and Community Service defines professional skills-based community service as “the practice of using work-related knowledge and expertise in a volunteer opportunity.” Traditional definitions of volunteer work in organizational communication scholarship, however, are typically based on (1) the bifurcation between work and volunteer activity; (2) low barriers to volunteer entry and exit; (3) the lack of managerial power/control over volunteers; and (4) the altruistic focus of volunteer work. An analysis of interviews with 19 skills-based volunteers highlights the identity and role tensions inherent in professional volunteering and serves as the basis for a proposal for a new …

This Comment will analyze the tobacco companies' use of the privilege doctrines to avoid litigation over the past thirty years, specifically focusing on the last fifteen years of litigation between this industry and its accusers. Part II of this Comment will discuss the pertinent discovery rules and the manner in which they are abused. Part III will examine the development, scope and limitations of the attorney-client privilege and work product doctrines, considering with particularity the corporate context and the applicability of the crime-fraud exception to these doctrines. Yearbook of Antitrust and Regulatory Studies
This contribution examines some of the consequences of the UK’s exit from the European Union for the enforcement of the competition rules. It reflects on the impact that Brexit is going to have on future transnational antitrust litigation in Britain and Europe. Thereafter it analyses the challenges that Brexit is likely to present for cooperation in public competition enforcement and suggests solutions for future development.
