How Asian Should Asian Law Be? – An Outsider’S View, Ralf Michaels Jan 2018

How Asian Should Asian Law Be? – An Outsider’S View, Ralf Michaels

Faculty Scholarship

Is there an Asian identity of Asian law, comparable to European identity and therefore similarly useful as a justification for unification projects? If so, what does it look like? And if so, does this make Asia more like Europe, or less so? Or is this question itself already a mere European projection?

This chapter tries to address such questions. In particular, I look at a concrete project of Asian law unification—the Principles of Asian Comparative Law—and connect discussions about its Asian identity with four concepts of Asia. The first such concept is a European idea of Asia and Asian law, …

“Once A Scientist…”: Disciplinary Approaches And Intellectual Dexterity In Educational Development, Katherine Kearns, Molly Hatcher, Mara Bollard, Michele Dipietro, Devon Donohue-Bergeler, Leslie E. Drane, Elizabeth Luoma, Andrew E. Phuong, Laura Thain, Mary C. Wright

To Improve the Academy: A Journal of Educational Development

The authors claim that disciplinary epistemologies—disciplinary habits of mind and ways of thinking—offer productive lenses for observing teaching practices. Furthermore, they argue that educational developers who draw from multiple epistemologies in combination provide rich evidence with regard to teaching and learning and can speak to academic colleagues from an array of disciplines. Clarity is provided for career paths in educational development for colleagues from academic disciplines who are contemplating part- or full-time work in a teaching center. The authors hope that this opening collection develops into a toolkit and area of inquiry about disciplinary approaches to the practice of educational …

Affective Tensions In Response, Nicole I. Caswell Jan 2018

Affective Tensions In Response, Nicole I. Caswell

Journal of Response to Writing

This article reports on a study focused on understanding the relationship between teachers’ emotional responses and the larger contextual factors that shape response practices. Drawing from response and emotion scholarship, this article proposes affective tensions as a way for understanding the tug and pull that teachers experience between what they feel they should do (mostly driven from a pedagogical perspective) and what they are expected to do (mostly driven by an institutional perspective) in a contextual moment. The case study of Kim, a community college instructor, offers an analysis of two affective tensions that emerged from her think-aloud protocol (TAP): …

Leviathan: Ontogeny Of Salvation, Faren L. Lejeune Jan 2018

Leviathan: Ontogeny Of Salvation, Faren L. Lejeune

Honors Undergraduate Theses

Wrought from clay and hardened by fire, the narrative sculptures which comprise this body of work are dualistic symbols of life’s brutality and nobility. The philosophical import of the opus is manifested through the convergence of material, process, and form—to instantiate truth and initiate analysis. In my interdisciplinary research, I have come to understand leviathan as an exceptional, universalizing symbol of life's duality and the locus of Man's potential for honorable distinction. I invoke the name in order to instigate reflection upon the concept of the world serpent as a symbolic representation of existential nuance.

Confucius Institutes: Expelling A Trojan Horse Or Looking A Gift Horse In The Mouth?, Michael J. Swain Jan 2018

Confucius Institutes: Expelling A Trojan Horse Or Looking A Gift Horse In The Mouth?, Michael J. Swain

BYU Asian Studies Student Journal

During the past ten years, China has actively promoted its Confucius Institute (CI), a program of instruction in Chinese language and culture for college students outside of China. The program’s stated purpose is to meet an existing demand for education in Chinese language and culture, with the intent of strengthening relationships between China and other countries in order to promote a more harmonious world. However, many have viewed the CI program as nothing more than an expansion of Beijing’s soft power. Some Western institutions have even expelled CIs from their campuses. The growing concern suggests that China’s offering of what …

A Review Of Taiwanese Trust In The Police With Alternative Interpretations., Shun-Yung Kevin Wang Jan 2018

A Review Of Taiwanese Trust In The Police With Alternative Interpretations., Shun-Yung Kevin Wang

USF St. Petersburg Campus Faculty Publications

This study aims to review and reinterpret Taiwanese citizens’ trust in the police, with a focus on taking its social changes, political transitions, and historical background into consideration. Modern Taiwan inherits both Chinese and Japanese cultures, and the urbanization on the island has generated substantial differences between rural areas and metropolitans. The political system has also successfully transformed from authoritarianism to democracy since late 1980s and subsequently leads to paradigm shift in policing. All of the contemporary empirical studies regarding public assessments of the police are based on survey data, however, they either poorly measure the multi-dimensional nature of trust …

“They Do Evil Because Of Fear”: Anti-Heroism And American Anxieties In Fear The Walking Dead, Rachael A. Murphy Jan 2018

“They Do Evil Because Of Fear”: Anti-Heroism And American Anxieties In Fear The Walking Dead, Rachael A. Murphy

Theses & ETDs

This thesis explores the current state of the anti-hero in American television. Several popular anti-hero series have recently ended, begging the question of what comes next for the genre. This thesis uses a popular anti-hero TV show, Fear the Walking Dead, as a case study to address the issue. It relies on Joseph Campbell’s conception of the traditional hero in order to trace the development of the anti-hero in twenty-first century American television. Psychoanalyst Carl Jung’s concept of the Shadow is also used to explore the ways in which three anti-heroes in Fear the Walking Dead interact with their own …

Predictive Analytics In The Criminal Justice System: Media Depictions And Framing, Kar Mun Cheng Jan 2018

Predictive Analytics In The Criminal Justice System: Media Depictions And Framing, Kar Mun Cheng

Honors Program Theses

Artificial intelligence and algorithms are increasingly becoming commonplace in crime-fighting efforts. For instance, predictive policing uses software to predetermine criminals and areas where crime is most likely to happen. Risk assessment software are employed in sentence determination and other courtroom decisions, and they are also being applied towards prison overpopulation by assessing which inmates can be released. Public opinion on the use of predictive software is divided: many police and state officials support it, crediting it with lowering crime rates and improving public safety. Others, however, have questioned its effectiveness, citing civil liberties concerns as well as the possibility of …

Impact Of Rapid Meca Polymerase Chain Reaction Rapid Diagnostic Testing For Staphylococcus Aureus In A Pediatric Setting, Emily Drwiega Jan 2018

Impact Of Rapid Meca Polymerase Chain Reaction Rapid Diagnostic Testing For Staphylococcus Aureus In A Pediatric Setting, Emily Drwiega

Undergraduate Honors Thesis Collection

Rapid molecular technology can detect the mecA resistance gene in Staphylococcus aureus (SA), predicting methicillin susceptibility in under one hour. In combination with antimicrobial stewardship program interventions in adults with SA bacteremia, rapid mecA testing decreases time to targeted therapy. This intervention has not yet been shown effective in pediatric patients or in the absence of real-time stewardship interventions. The objective of this study was to determine if time to optimal therapy decreased following implementation of GeneXpert rapid diagnostic testing (RDT) in a pediatric institution without a formal antimicrobial stewardship protocol for response. The primary outcome was time to optimal …

Single Or Taken: The Effect Of Relationship Status, Gender, And Interaction With The Opposite Sex On Arousal And Spatial Ability, Kylie Mcgee

Undergraduate Honors Theses

The purpose of this project is to examine the effect that relationship status, gender, and interaction with the opposite sex has on nervous system arousal and spatial ability. In the first experiment, 20 female participants were selected, 10 being in a committed relationship and 10 being single. Spatial ability and heart rate was measured for each participant before and after mixed-sex dyadic interactions. Results showed that a person’s relationship status does indeed have an effect on nervous system arousal after a mixed-sex dyadic interaction. In experiment two, 25 participants were studied, 13 participants were male and 12 were female. 7 …

The Place Of Culture In Psychology: A Social Constructionist Standpoint, Kenneth J. Gergen Jan 2018

The Place Of Culture In Psychology: A Social Constructionist Standpoint, Kenneth J. Gergen

Psychology Faculty Works

Tensions between various approaches to culture in psychology have been intense. Critique across the various approaches has led to alienation and isolation. As I propose, by removing the vision of “truth making” in psychology we also remove the barriers to mutual understanding and appreciation. If we understand accounts of culture as social constructions, themselves wedded to their cultures of origin, we realize the advantages of multiple perspectives. We solve previously insoluble dilemmas, sharpen our critical perspectives, and open up new potentials for interpretation and action.

Social Psychology And Social Justice: Dilemmas, Dynamics, And Destinies, Kenneth J. Gergen Jan 2018

Social Psychology And Social Justice: Dilemmas, Dynamics, And Destinies, Kenneth J. Gergen

Psychology Faculty Works

The emergence of this handbook on social justice represents a groundbreaking event in the history of social psychology. In this summary discussion, I outline significant limits to social justice work embedded in the empiricist tradition of inquiry and point to ways in which the current work transcends these limits. However, I also view the present endeavors as in a fledgling state. In the service of enriching and rendering these pursuits more effective, I discuss five domains in which tensions currently prevail and suggest directions for future undertakings. Challenges are discussed in terms of epistemological schisms, presumed ontologies, value pluralism, explanatory …

A Genealogy Of Programmatic Stop And Frisk: A Discourse-To-Practice-Circuit, Frank Rudy Cooper Jan 2018

A Genealogy Of Programmatic Stop And Frisk: A Discourse-To-Practice-Circuit, Frank Rudy Cooper

Scholarly Works

President Trump has called for increased use of the recently predominant policing methodology known as programmatic stop and frisk. This Article contributes to the field by identifying, defining, and discussing five key components of the practice: (1) administratively dictated (2) pervasive Terry v. Ohio stops and frisks (3) aimed at crime prevention by means of (4) data-enhanced profiles of suspects that (5) target young racial minority men. Whereas some scholars see programmatic stop and frisk as solely the product of individual police officer bias, this Article argues for understanding how we arrived at specific police practices by analyzing three levels …

Hacks, Hackers And The Expansive Boundaries Of Journalism., Nik Usher Jan 2018

Hacks, Hackers And The Expansive Boundaries Of Journalism., Nik Usher

Communication: Faculty Scholarship

This chapter begins with an examination of some of the complexities and opportunities afforded by the rise of these computationally minded journalists, collectively discussed here as 'interactive journalists' – an umbrella term that delineates this fusion of programming, data, and journalism from other points in journalism's long entanglement with computation. Newsrooms have had internal and externally focused hackathons to drive innovation, taking cues from the Hacks/Hackers group's role as a conveyor and culture-bridger for technologists and journalists. The boundaries of journalism are increasingly blurred as new entrants from people to new forms of news expand the field. However, the terms …

Culture And Time Perception: Implications For Mental Representation And Decisions, Siew Hong Tan Jan 2018

Culture And Time Perception: Implications For Mental Representation And Decisions, Siew Hong Tan

School of Psychology Theses

This thesis examines cultural variations in time perception, as well as the possible influences on mental representation and decisions. Building on prior research on cultural differences in time-related perceptions, two main time perceptions were identified and focused on, namely temporal orientation and the use of time metaphor. The temporal orientation line of investigation explores the implications of a stronger future versus past orientation among English and Mandarin-speakers respectively. Based on Construal Level Theory, temporal orientation is expected to be related to psychological distance, which in turn affects the mental representations individuals form. The findings supported a stronger future orientation among …

Organized Gaming And Its Effect On Collegiate Academics, Mark Cochran Jan 2018

Organized Gaming And Its Effect On Collegiate Academics, Mark Cochran

Honors Program Theses

With the emergence of gaming as an ever more popular pass time, and professional level eSports gaining steam, collegiate student organizations are beginning to reflect this change as well. This study of 166 college students from across the United States addresses the rise of gaming organizations and their subsequent effects of collegiate academics, namely grade point averages (GPA). The results suggest that participation in an organization dedicated to gaming results in a slightly lower GPA than those involved in other organizations, but still higher than average pointing towards factors of involvement still benefiting students. An important factor to note is …

Microfluidic Device For Decellularization Of Murine Brain Slices, Christian Morrill, Adam Talbot, Ian Wadsworth, Melena Garrett, Elaine Castro, Holly Saatzer, Yu Huang

Biological Engineering

In the body, nearly all cells in tissues reside in an extracellular matrix (ECM) consisting of a complex three-dimensional (3D) microenvironment created through cell-cell and cell-ECM interactions that maintain specificity and homeostasis of the tissue. Accurate representation of microenvironments is pivotal in furthering our understanding of several fields, including disease mechanisms, drug discovery, tissue engineering, and regenerative medicine. Current 3D tissue models are limited in their ability to reproduce tissue-specific biochemical and mechanical cues present in vivo1.

Decellularization is the chemical, physical, or enzymatic means of stripping cells from a tissue, producing a bare 3D ECM that is …

The Psychology Of Morality, Diane Sunar Jan 2018

The Psychology Of Morality, Diane Sunar

Online Readings in Psychology and Culture

Five questions regarding the nature of the moral sense, the origin of conscience, the development of morality, variability in the moral sense, and the relation of morality to behavior are examined from the point of view of four theoretical approaches (psychoanalytic theory, social learning theory, cognitive-developmental theory, and evolutionary psychology). In addition, some concepts and findings from outside the four approaches are also touched upon. The moral sense is shown to be complex, comprising cognitions, feelings, and behaviors. The theoretical approaches disagree regarding the issues of whether conscience directly reflects social teaching, or is constructed by the developing individual. They …

Making Implicit Methods Explicit: Trade Press Analysis In The Political Economy Of Communication, Thomas F. Corrigan Jan 2018

Making Implicit Methods Explicit: Trade Press Analysis In The Political Economy Of Communication, Thomas F. Corrigan

Communication Studies Faculty Publications

The political economy of communication (PEC) situates media systems and practices in their structural and historical contexts; however, PEC scholars rarely articulate or justify their research methods. To address this oversight, this article explains how PEC scholars use trade publications to study media industries, practices, policy making, and discourses thereof. Following a critical realist approach, PEC researchers “burrow down” in trade press advertisements and reports and “listen in” to the frank, insider discussions therein. This article evaluates the trade press against Scott’s four “quality control criteria” for documentary sources—authenticity, credibility, representativeness, and meaning. Trade publications employ daunting industry jargon, and …

‘The Show Must Go On’: Amateur Musical Theatre As A Community Of Practice, Kevin Walsh Jan 2018

‘The Show Must Go On’: Amateur Musical Theatre As A Community Of Practice, Kevin Walsh

Theses

Amateur musical theatre has its roots in long-standing theatre traditions that include both professional and amateur production. Apart from the performance, which is the over-arching goal, participation in amateur musical theatre yields many other personal and social benefits in areas of learning, community and identity, aligning with Wenger’s concept of a ‘Community of Practice’.

Using an analytical framework based on previous studies in this area, this research investigates how amateur musical theatre functions as a ‘Community of Practice’. The research was conducted using an ethnographic case study of two contrasting local amateur productions. Experiential data and details regarding participant interactions …
