Dissolved Carbon Transport In A River-Lake Continuum: A Case Study In A Subtropical Watershed, Usa, Zhen Xu, Y. Jun Xu
Faculty Publications
Rivers and lakes have been traditionally studied as separate entities for carbon transport. However, there is a gap in our knowledge of the connectivity of dissolved carbon in a river-lake continuum. In this study, we analyzed dissolved carbon along the Little River-Catahoula Lake in subtropical Louisiana, United States to assess carbon biogeochemistry in such a river-lake continuum. Monthly in-situ measurements and water sample collections were made at four locations during April 2015 to February 2016 to determine riverine carbon transport into and out of the lake. Results show that much of the dissolved inorganic carbon (DIC) in the river-lake continuum …

Purpose: To examine data reporting characteristics in sports nutrition. Methods: We examined 236 papers from ten journals published in 2016. The primary outcome was statistical variance associated with treatment (SD (correct) vs. SEM or CI). Secondary outcomes included the reporting of: (a) effect sizes (Y/N); (b) outcome prioritization (Y/N; primary, secondary, etc.) and (c) statistical variance relative to change from baseline (CI (correct) vs. SD or SEM). As tertiary/exploratory outcome, we examined whether authors stated a directed hypothesis. Statistical evaluation was performed using chi-square analyses. Results: We observed significant trends for all analyses (p < 0.001) and between category comparisons (p < 0.002). For the primary outcome, 128 (59%) articles correctly used SD to denote treatment variance, while 79 (36%) and 11 (5%) used SEM and CI, respectively. For secondary outcomes, 63 articles (29%) reported effect sizes, while 155 (71%) did not. Additionally, 188 articles (86%) did not prioritize outcomes, 134 articles (61%) stated no hypotheses and 40 (19%, out of 100) articles used CI to denote change scores vs. SD (19%, n = 41) and SEM (n = 10, 5%). Eight articles (4%) reported no variance terms. Conclusions: Overall, there are gaps regarding reporting in sports nutrition. Editors, journal publishers, and the field of exercise science alike should consider these outcomes and provide editorial staff, reviewers and authors with more concrete guidelines.

Administrative Barriers To Compliance With The 2010 Ncaa Policy On Concussion Management, Tyler Norman
Administrative Barriers To Compliance With The 2010 Ncaa Policy On Concussion Management, Tyler Norman
Dissertations
Concussions and concussion management in sport have become a polarizing public health issue. The best concussion assessment practices and “return-to-play” guidelines have been debated in both the scientific arena and in the media. At risk is the health of the athletes when proper diagnosis and treatment are not accurate for this potentially devastating injury.
Recent research estimates that approximately 1.6 – 3.8 million sport-related concussions occur each year in the United States (Brady, 2011), which can lead to chronic disease, swelling of the brain, cognitive impairment, chronic headaches, mood disorders, depression, blurred vision, double vision, cranial hemorrhaging and death if …

Komida: Making Microfinance Digital In Indonesia, Adrian Yeow, Wee-Kiat Lim
CCX Research
This case chronicles specific background, challenges, and actions taken by an Indonesian microfinancing institution (MFI) as it was implementing a digital mobile system to replace its current manual processes used in its field office operations. From a high level perspective, it describes the challenges faced by an organization that was attempting to implement a new digital initiative but constrained by its resource-scarce, institutionally, and culturally bound environment. At the same time, it highlights that this digital initiative was a critical part of its overall plan for addressing industry demands, increasing competitive pressures, and internal process issues. The case study thus …

Intersectional Invisibilization: Black Female Movement Leaders In Mexico And Their Private Sphere Resistance, Lindsay Fasser
Undergraduate Honors Theses
International attention drew to Afro-Mexican individuals in 2015, when the Mexican inter-census survey first allowed Black Mexican people to self-identify as Afro-Mexican. The Black movement in Mexico revolving around recognition rather than liberation had been stirring in Coastal regions for decades prior, fueled by the work of incredible activists across the gender spectrum. However, the representation of such activists in public discourse is largely male. In analyzing this particular movement, the importance of intersectional theory becomes apparent, in unpacking both gendered and racialized forms of hierarchy and invisibility. By exploring the intersections between social movement and social suffering, as well …

"Hurricane" Sandy: A Case Study Of The Eastern District Of New York's Effort To Address Mass Litigation Resulting From The Effects Of Climate Change, Cheryl L. Pollak, Ramon E. Reyes Jr., Robyn Weinstein
Texas A&M Journal of Property Law
On the evening of October 29, 2012, “Hurricane” Sandy made land- fall on the New York coastline, battering the land with strong winds, torrential rain, and record-breaking storm surges. Homes and commercial structures were destroyed; roads and tunnels were flooded; and more than 23,000 people sought refuge in temporary shelters, with many others facing weeks without power and electricity. At the time, Sandy was heralded as one of the costliest hurricanes in the his- tory of the United States; the second costliest hurricane only to Katrina, which hit New Orleans in 2005. Unfortunately, recent experience with Hurricanes Florence, Maria, Harvey, …
Fixed Constitutional Meaning And Other Implausible Originalisms, Frederick M. Gedicks
Fixed Constitutional Meaning And Other Implausible Originalisms, Frederick M. Gedicks
Theses and Dissertations
Public-meaning originalists contend that judges properly interpret the Constitution only when they discover and apply its “original public meaning”—how the public understood the Constitution at the time it was adopted. Public-meaning originalism is premised on the “fixation thesis”—the meaning of any constitutional text is fixed when it is adopted. Concerns of the present, therefore, cannot affect constitutional meaning. Public meaning originalists acknowledge that the search for the fixed original meaning is not always successful, but it is always ontologically “there” to be found, even if epistemologically we sometimes fail to find it. The fixation thesis underwrites the powerful rhetoric of …

Reusable, publicly available data is a pillar of open science and rapid advancement of cancer imaging research. Sharing data from completed research studies not only saves research dollars required to collect data, but also helps insure that studies are both replicable and reproducible. The Cancer Imaging Archive (TCIA) is a global shared repository for imaging data related to cancer. Insuring the consistency, scientific utility, and anonymity of data stored in TCIA is of utmost importance. As the rate of submission to TCIA has been increasing, both in volume and complexity of DICOM objects stored, the process of curation of collections …

Clt Shearwall Dovetail Connection, Alexander Eduardo Esser, August Messano
Clt Shearwall Dovetail Connection, Alexander Eduardo Esser, August Messano
Architectural Engineering
As cross-laminated timber has become an increasingly popular construction material, its use as a shear wall element has also demanded attention. Primary obstructions to the use of CLT shear walls have been the lack of an economic connection type that does not compromise the structural integrity and has the robustness that CLT shear wall panels deserve. Dovetail connections provide a great option for the connection of CLT shear walls. With more experimentation, the optimal dovetail geometry can be further developed. The small-scale testing done in conjunction with this report proved that very deep pins and tails will result in bearing …
The Bureau Of Land Management's Infirm Compensatory Mitigation Policy, Justin Pidot
The Bureau Of Land Management's Infirm Compensatory Mitigation Policy, Justin Pidot
Fordham Environmental Law Review
Secretary of the Interior Ryan Zinke has described “compensatory mitigation” as “un-American” and “extortion.” In keeping with that view, on July 26, 2018, the Bureau of Land Management (“BLM”) adopted a radical new policy that disclaims statutory authority to impose compensatory mitigation measures.
Notwithstanding the aspersions the Secretary has cast, compensatory mitigation is a common-sense policy instrument that has been a mainstay of environmental and public lands policy for decades. It is a tool through which an agency authorizing private activities—drilling oil wells, filling wetlands—conditions its approval upon the implementation of measures to offset attendant environmental harms. Compensatory mitigation thereby …

The Act amends the statutes in the Georgia Code applicable to the University System and Board of Regents statutes in the Georgia Code. It adds new sections that place affirmative requirements on the Board of Regents to adopt and publish new policies, which aim to encourage the dissemination of free speech across university campuses. Further, the Act directs that universities must implement disciplinary sanctions for anyone subject to the jurisdiction of the University System who interferes with the free speech of invited speakers and others on campus. Finally, the Board of Regents must publish annual reports regarding any barriers to …

Geographic Discrimination: Of Place, Space, Hillbillies, And Home, William Rhee, Stephen C. Scott
West Virginia Law Review
This Essay explores the two-sided challenge of geographic discrimination, where U.S. citizens receive disparate treatment from other citizens or the government solely because of where they live or self-identify as home, through the interdisciplinary concepts of space, place, and distance; and an original examination of discrimination against Appalachians. Such disparate treatment is unavoidable and even arguably politically correct. Where we call home matters in a number of legitimate ways to include our access to jobs and services, culture, educational opportunities, and other basic human capabilities. Although technology has increased individual mobility more than ever before, a majority of Americans nevertheless …

Ending Innocence Denying, Lara Bazelon
Hofstra Law Review
Prosecutors, the most powerful actors in the criminal justice system, also have the most difficult job: they must be "ministers of justice." A prosecutor's core mission is to vindicate the truth, rather than strive to "win" by accumulating a track record of convictions. When evidence somes to light suggesting that a wrongful conviction has occurred, a prosecutor's ethical obligation requires admitting to a terrible mistake and working to undo it. Many conscientious prosecutors accept this responsibility and confess to their errors. But too many do not. They insist, in the face of overwhelming evidence to the contrary, that wrongfully convicted …

The False Hope Of Deliberate Forgetting: A Critical Response To Proponents Of Limited-Use Memory Manipulation, Peter A. Depergola Ii
Philosophy, Theology and Religious Studies Faculty Publications
The emergence of manipulation techniques that dampen, disassociate, erase, and replace unsavory episodic memories have given pause to even the most ardent proponents of the practice. Supporters of memory manipulation have since clarified that the interventions should be made available exclusively in extreme and limited-use cases. In light of the narrowing of this approach, the present essay examines the arguments in favor of limited-use memory manipulation (LUMM) for the two most commonly-cited circumstances in which the practice is claimed to be justified: post-traumatic stress disorder (PTSD) and substance addiction. After examining the neuroscience of PTSD and substance addition, the critical …

Addressing Skills In An Analytics World: Proposals For The Accounting Department At The University Of Arkansas, Michael Griffin
Accounting Undergraduate Honors Theses
Since the publication of a special report by the American Accounting Association’s (AAA) Committee on the Future Structure, Content, and Scope of Accounting education in 1986, professionals and educators alike have been calling for a change to the accounting curriculum to better prepare the accounting graduate for the professional world. There is a stark division on which skill areas should be improved. That special report predicted “an accounting profession that will provide information for economic and social decisions, using sophisticated measurement and communication technologies applied to a substantially enlarged scope of phenomena” (AAA, 1986). AAA (1986) commented on how the …

Reversing The Reliance Revolution In Contract, Eric Alden
Reversing The Reliance Revolution In Contract, Eric Alden
Washington Law Review
During the past century, leading American academics have attempted to rewrite in radically altered form the theoretical foundation of liability in contract. In derogation of the historical bases for contractual liability in Anglo-American law, namely voluntary mutual exchange and “formal” contract, these intellectual revolutionaries desire to impose strict liability in contract on the basis of unilateral, unbargained-for reliance. The centerpiece of this revisionist effort has been the novel and artificial doctrine of “promissory estoppel,” first advanced by Williston and Corbin in the Restatement of the Law of Contracts published in 1932. The invention of this doctrine has been accompanied by …

Danger Ahead: Risk Assessment And The Future Of Bail Reform, John Logan Koepke, David G. Robinson
Washington Law Review
In the last five years, legislators in all fifty states have made changes to their pretrial justice systems. Reform efforts aim to shrink jails by incarcerating fewer people—particularly poor, low-risk defendants and racial minorities. Many jurisdictions are embracing pretrial risk assessment instruments—statistical tools that use historical data to forecast which defendants can safely be released—as a centerpiece of reform. Now, many are questioning the extent to which pretrial risk assessment instruments actually serve reform goals. Existing scholarship and debate centers on how the instruments themselves may reinforce racial disparities and on how their opaque algorithms may frustrate due process interests. …
Finality, Appealability, And The Scope Of Interlocutory Review, Bryan Lammon
Finality, Appealability, And The Scope Of Interlocutory Review, Bryan Lammon
Washington Law Review
Most of the law of federal appellate jurisdiction comes from judicial interpretations of 28 U.S.C. § 1291. That statute gives the courts of appeals jurisdiction over only “final decisions” of the district courts. The federal courts have used this grant of jurisdiction to create most of the rules governing appellate jurisdiction. But those efforts have required giving many different meanings to the term “final decision.” And those many different meanings are to blame for much of the confusion, complexity, unpredictability, and inflexibility that plague this area of law. The literature has accordingly advocated reform that would base most of the …

As society evolves, so do criminals. In the early twentieth century, America embraced the automobile, passed the Volstead Act, and created a national highway program. These developments inadvertently paved the way for interstate criminal enterprise. Infamous gangsters such as Al Capone were able to operate large-scale racketeering syndicates without fear of being prosecuted for two primary reasons: (1) states lacked jurisdiction, resources, or both to go after such criminals, and (2) there was no federal criminal statute to fill the gap left by the states. But as criminals evolve, so does society. In 1961, Congress, at the urging of Attorney …
