On Canon, Craig Deksen, Darren Hudson Hick
Contemporary Aesthetics (Journal Archive)
Canon is a concept from aesthetics that has become a regular subject of commonplace discussions. The nature of canon, especially as it is used in these commonplace discussions, has not been subject to adequate philosophical scrutiny. We attempt to remedy that by placing canon in its historical and philosophical context, exploring and rejecting several common accounts, and presenting some basics of how canon works. We reject the accounts that place control with the author or the legal property holder, which appear to be the most commonly held accounts.
Assessment As Critical Programmatic Reflection, Vicki Reitenauer, Rowanna L. Carpenter
Assessment As Critical Programmatic Reflection, Vicki Reitenauer, Rowanna L. Carpenter
Women, Gender, and Sexuality Studies Faculty Publications and Presentations
This article argues that general education assessment is an opportunity for engaging faculty and the general education program as a whole in critical reflection on the practices and pedagogies that affect the entire undergraduate body. Through intentional assessment practices tied to learning outcomes, pedagogical expectations, and faculty and student classroom experience, an assessment program can meet accreditation expectations while serving as a rich location for critical reflection and continuous improvement. To illustrate, this article takes the reader through a year in the life of University Studies' assessment at Portland State University. It provides details about the individual elements of our …

Women, Gender, and Sexuality Studies Faculty Publications and Presentations
This retrospective on service learning in the development of University Studies Capstones, the senior-level requirement in the University Studies general education program at Portland State University, explores how the original framers of University Studies anticipated the pitfalls of "pedagogies of whiteness" in deploying service learning as the hallmark pedagogical feature of the program; includes a case study of a Capstone course that centers on Indigenous ways of knowing, learning, and teaching through its pedagogy; and identifies the formative presence of Capstone faculty committed to anti-racist and anti-imperialist pedagogies. From a variety of institutional and disciplinary standpoints and through long association …

Digital Problem Solving: The Literacies Of Navigating Life In The Digital Age, Gloria Jacobs, Jill Castek
Presentations and Publications
Digital problem solving reflects an individual’s ability to navigate and use multiple digital resources in order to accomplish goals across domains including work, personal interests, educational pursuits, social or professional networking, civic participation, and for future uses not yet conceptualized. To accomplish these goals, individuals need to enact everyday literacies (Knobel, 1999) that include: “asking questions, constructing meaning from [information and] data, generating [and sharing] creative solutions, and reflecting on how to improve these solutions for different contexts” (Manderino & Castek, 2016, p. 79). As individuals move through daily lives, they are constantly traversing disciplines as they collect information and …

Digital Problem Solving Toolkit
This document introduces the definition of digital problem solving that emerged from a three year long research project. Digital problem solving is described as being related to, but unique from, digital literacies and basic digital skills. Specifically, digital problem solving involves the use of the skills, strategies, and approaches (including mindsets) needed to navigate online in everyday contexts, including the library, and use novel resources, tools, and interfaces in efficient and flexible ways to accomplish personal and professional goals. Authors describe how the definition of digital problem solving was developed and applications within libraries, Adult Education, and Lifelong Learning.

Counselor Education Faculty Publications and Presentations
Multiculturalism and social justice are considered major forces in the counseling profession, revolutionizing the complexity of social identity, cultural identity, and diversity. Although these major forces have influenced the profession, many challenges exist with their implementation within counselor education curriculum and pedagogy. A major challenge is the complex dynamics of privilege and oppression that both counselor educators and counseling students face. This article discusses the use of intersectionality to approach counselor education pedagogy and practice.

Counselor Education Faculty Publications and Presentations
Background: Tinnitus (ie, ear or head noises not caused by external sounds) is common among the general population and is the most prevalent service-connected disability in the United States’ Department of Veterans Affairs system. While numerous clinical interventions have been created to systematically address the range of issues caused by tinnitus, only a few tinnitus interventions have focused on both teaching and assessing coping strategies. The present pilot study involved a randomized clinical trial comparing 3 brief group interventions to a usual-care (UC) group (ie, a wait-list control group): the first intervention based on acceptance and commitment therapy (ACT), a …

Our personal data is everywhere and anywhere, moving across national borders in ways that defy normal expectations of how things and people travel from Point A to Point B. Yet, whereas data transits the globe without any intrinsic ties to territory, the governments that seek to access or regulate this data operate with territorial-based limits. This Article tackles the inherent tension between how governments and data operate, the jurisdictional conflicts that have emerged, and the power that has been delegated to the multinational corporations that manage our data across borders as a result. It does so through the lens of …

The New Writs Of Assistance, Ian Samuel
Articles by Maurer Faculty
The providers of network services (and the makers of network devices) know an enormous amount about our lives. Because they do, these network intermediaries are being asked with increasing frequency to assist the government in solving crimes or gathering intelligence. Given how much they know about us, if the government can secure the assistance of these intermediaries, it will enjoy a huge increase in its theoretical capacity for surveillance—the ability to learn, in principle, almost anything about anyone. That has the potential to create serious social harm, even assuming that the government continues to adhere to ordinary democratic norms and …

With more than 61 million individuals receiving Social Security benefits, one out of every four families in America receives monthly cash payments from the Social Security Administration (SSA). These monthly payments directly benefit 48.5 million retired workers, their current and former spouses, 10 million disabled adults, and include more than 3 million children. Several million more children and adults in the increasing number of multi-generational households in America benefit indirectly from Social Security retirement payments.
In addition to the broad reach of monthly Social Security retirement benefits these payments have ensured the financial well-being of millions of American families for …

Climate Change Challenges For Land Conservation: Rethinking Conservation Easements, Strategies, And Tools, W. William Weeks, Jessica Owley, Federico Cheever, Adena R. Rissman, M. Rebecca Shaw, Barton H. Thompson
Articles by Maurer Faculty
Climate change has significant consequences for land conservation. Government agencies and nonprofit land trusts heavily rely on perpetual conservation easements. However, climate change and other dynamic landscape changes raise questions about the effectiveness and adaptability of permanent conservation instruments like conservation easements. Building upon a study of 269 conservation easements and interviews with seventy conservation-easement professionals in six different states, we examine the adaptability of conservation easements to climate change. We outline four potential approaches to enhance conservation outcomes under climate change: (1) shift land-acquisition priorities to account for potential climate-change impacts; (2) consider conservation tools other than perpetual conservation …
Legitimate Yet Manipulative: The Conundrum Of Open-Market Manipulation, Gina-Gail S. Fletcher
Legitimate Yet Manipulative: The Conundrum Of Open-Market Manipulation, Gina-Gail S. Fletcher
Articles by Maurer Faculty
Is manipulation possible in the absence of misconduct? This is the foundational inquiry at the heart of open-market manipulation. Open-market manipulation captures the attention of lawmakers and courts because it is market manipulation effected entirely through facially legitimate transactions. Whereas traditional, well-accepted forms of market manipulation involve deception, fraud, and monopolistic prices, open-market manipulation involves no objectively bad acts and, instead, is accomplished through permissible transactions executed on the open market. As enforcement of this form of manipulation increases, the question arises—when, if ever, is a legitimate transaction manipulative?
To the Securities Exchange Commission and the Commodity Futures Trading Commission …

Clinical Relevance Of Μ-Opioid Receptor A118g Polymorphism In Demographically Variant Populations, Iryna Pokotylyuk, Srishti Kulshrestha, Zvi G. Loewy, Priyank Kumar
Touro College of Pharmacy (New York) Publications and Research
Use of opioids is essential in providing a broad and effective analgesic effect. Opioid dosing has to be monitored and controlled in order to manage pain and the corresponding side effects due to opioid treatment. A very common single nucleotide polymorphism (SNP) associated with the µ opioid receptor is A118G. A118G, located on exon 1 of the µ-opioid receptor gene (OPRM1), may alter how patients respond to opioid treatment. This polymorphism results in an exchange of adenine for guanine, which in turn leads to substitution of asparagine for the aspartic acid. In order to understand how individuals with the G …
Some Themes In Suárez’S Account Of The Separated Soul, James B. South
Some Themes In Suárez’S Account Of The Separated Soul, James B. South
Philosophy Faculty Research and Publications
In this article, I focus on three issues in Francisco Suárez’s account of the separated soul: the status of the separated soul as a person, the separated soul’s knowledge of itself, and the question of the soul’s nature both as form of the body and as existing outside the body. I place his discussion in dialogue with St. Thomas Aquinas and Cajetan (Thomas de Vio) and show the ways he departs from those two thinkers. Finally, I show that his account of these problems makes for a philosophically probable account of the resurrection of the body.

Abstract: Mind as Spirit in the World of Culture. Philosophy of Culture, "Naturalistic" Transcendental Philosophy and the Question of the Space of Culture. In this essay I present Cassirer's philosophy of culture as a special application of Kant's transcendental philosophy. I then compare and contrast it to another tradition, namely the Pittsburgh School, especially McDowell. The starting point here is the Sellarsian concept of the 'Space of reasons', which McDowell expands through his Aristotelian-inspired concept of 'Second nature'. By way of a rather peculiar interpretation of an early interpreter of Cassirer -Howe- I will attempt to bring 'Marburg' and 'Pittsburgh' …

Toward Universal Deportation Defense: An Optimistic View, Michael Kagan
Toward Universal Deportation Defense: An Optimistic View, Michael Kagan
Scholarly Works
One of the most positive responses to heightened federal enforcement of immigration laws has been increasing local and philanthropic interest in supporting immigrant legal defense. These measures are tentative and may be fleeting, and for the time being are not a substitute for federal support for an immigration public defender system. Nevertheless, it is now possible to envision many more immigrants in deportation having access to counsel, maybe even a situation in which the majority do. In this paper, Professor Michael Kagan makes no real predictions. Instead, he offers a deliberately-perhaps even blindly optimistic assessment of how concrete steps that …
Remorse Bias, M. Eve Hanan
Remorse Bias, M. Eve Hanan
Scholarly Works
In this article, Professor M. Eve Hanan addresses how implicit cognitive biases may affect judges when they decide whether to credit defendants' displays of remorse and how we can lessen the effects of that bias. Part I of this article introduces the main ideas to be discussed. Part II establishes the salience of remorse to punishment decisions and then demonstrates the ambiguity involved in assessing the sincerity of remorse. Part III examines existing research on implicit biases associating African Americans with criminality to consider whether judges are likely to view African American defendants' expressions of remorse as insincere and, thus, …

The Public Defender's Pin: Untangling Free Speech Regulation In The Courtroom, Michael Kagan
Scholarly Works
Recent disputes in Ohio and Nevada about whether lawyers should be allowed to wear “Black Lives Matter” pins in open court expose a fault line in First Amendment law. Lower courts have generally been unsympathetic to lawyers who display political symbols in court. But it would go too far suggest that free speech has no relevance in courtrooms. This Essay argues for a way to strike a balance.

A Framework For Social Media Use In Project Management, Muralitheran V. Kanagarajoo
Theses: Doctorates and Masters
There has been rapid adoption of social media (SM) in business functions such as marketing and advertising. This being primarily due to its capability to communicate information. There has been less widespread adoption of SM for other business functions and the potential of SM is not comprehensively understood. The purpose of this thesis is to explore the potential of SM for project management and to understand some of the difficulties that arise from SM use. The research specifically investigated how SM is being used for project activities and the maturity of the management processes that govern SM use. Implications for …

Selling The Modern Day Tribe: The Commodification Of Rave Culture, Duncan Martin Barnes
Theses: Doctorates and Masters
This thesis examines youth and rave culture from the late 1980s to the present. It considers the history as well as the global and local impact of rave. I provide a visual ethnographic study from 1999-2014, based on my work as a commercial photographer of the Perth, Western Australian scene. While critically reflecting on existing subcultural research this thesis adds another dimension – the effect that global corporations have had in reshaping subcultural practices, specifically the commodification of rave culture in the form of the contemporary electronic dance festival.
The research incorporates both qualitative and quantitative data to interrogate media …

Does Facial Physiognomy In The Context Of Anoccupational Safety And Health Message Predict Outcomes?, Ian Parker
Theses: Doctorates and Masters
Physiognomy, the practice of looking to another person’s outward facial appearance to unmask the inner character of that person, has had a diverse historical impact within art, medicine, theology, anthropology, law, criminology, political history, psychology, psychiatry, and popular culture, since it was conceptualised in Greece during the 5th and 4th centuries B.C (Physiognomy, 1999-2009, 2009a). Aristotle, the prominent Greek philosopher, penned many chapters on physiognomic properties and touched upon strength/weakness, genius/stupidity, and other trait characteristics and their opposites in so far as such characteristics were associated with facial form (Physiognomy, 2006, 2009b).
In more modern times, facial recognition and evaluation …
