Although it had been mentioned in other disciplines, the term “private environmental governance” entered the legal literature in 2007. In the first paragraph of the article that imported the term, Professor Michael Vandenbergh wrote, “Nongovernmental organizations (NGOs), rather than lobbying national and international governmental bodies to generate public requirements, are using consumer pressure to demand that corporations engage in . . . private regulation.” Thus, from its very beginning, the legal scholarship on private environmental governance has explicitly acknowledged the role of NGOs. This article examines the surface damage agreement as an instrument of private governance. Part I describes split-estate ownership of oil and gas and the historic dominant-servient ordering of the mineral and surface estates. Part II explores the rebalancing of power effectuated by split estate acts and statutory requirements to contract for surface damages in both state and federal law. Part III examines the surface damage agreement and provides a catalog of common environmental provisions and covenants within those agreements. President Barack Obama’s farewell address serves as a symbolic end to an eight-year tenure as president of the United States. The standard themes in Obama’s public addresses have been hope and change, and the president continues to elaborate on those here. While describing accomplishments of his administration and thanking important people, Obama uses his last address as president to craft a narrative in three strands—past, present, and future—meant to inspire civic engagement in his audience. I use Burke’s dramatistic pentad to discover how Obama rhetorically motivates his listeners towards this end. President Obama creates a sense of empowerment and audience …

This critique of three films of The Island of Dr. Moreau, a classic story that keeps resurfacing in popular culture, aims to shed light on the geologic era in which we live, the Anthropocene. What do these films reveal about the Western conceptualization of the differences between “human” and “animal,” and what does this conceptualization reveal about the Anthropocene? The post-human analysis primarily employs concepts from Lacan, Derrida, and Eagleton, and includes a detailed look at the role of language. A growing literature on the archaeology of farmsteads and rural domestic sites has examined commodity consumption as the means by which rural families created and maintained social networks and identities. During the nineteenth century, rural areas were increasingly influenced by the practices and values of the urban middle classes, although not every farmstead would, or could, participate in the same way. This paper examines a matching teacup and saucer recovered from the Spring House, a former commercial farmstead and hotel located southeastern Monroe County, Western New York State. The Polycomb repressive complexes play diverse and essential roles in cell fate decisions, embryonic development, stem cell pluripotency, and gene regulation. There are two main Polycomb complexes in mammalian cells, Polycomb Repressive Complex 1 and 2 (PRC1 and PRC2). PRC1 can be further subdivided into canonical and non-canonical complexes depending on its composition (cPRC1 and ncPRC1). Historically, Polycomb complexes have been mostly associated with maintaining gene repression carried out by its histone-modifying and chromatin-remodeling capabilities. Specifically, PRC1 can catalyze mono-ubiquitination of histone H2A on lysine 119 while PRC2 trimethylates histone H3 on lysine 27. Both these histone marks are associated …

Climatic elasticity is a crucial metric to assess the hydrological influence of climate change. Based on the Budyko equation, this study performed an analytical derivation of the climatic elasticity of evapotranspiration (ET). With this derived elasticity, it is possible to quantitatively separate the impacts of precipitation, air temperature, net radiation, relative humidity, and wind speed on ET in a watershed. This method was applied in the Wuding River Watershed (WRW), located in the center of the Yellow River Watershed of China. The estimated rate of change in ET caused by climatic variables is −10.69 mm/decade, which is close to the …

The threatened eastern wolf is found predominantly in protected areas of central Ontario and has an evolutionary history obscured by interbreeding with coyotes and gray wolves, which challenges its conservation status and subsequent management. Here, we used a population genomics approach to uncover spatial patterns of variation in 281 canids in central Ontario and the Great Lakes region. This represents the first genome-wide single nucleotide polymorphism (SNP) dataset with substantial sample sizes of representative populations. Although they comprise their own genetic cluster, we found evidence of eastern wolf dispersal outside of the boundaries of protected areas, in that the frequency …

This is a poster presentation demonstrating the project our group has been working on. We hypothesize that the stomatal conductance of mulefat will decrease as soil salinity increases in both pre-rain and post-rain conditions because the plant tries to absorb salt water. However, the salt water cannot pass through plant tissue and draws water out of the plant. Since plant requires water for photosynthesis, water being drawn out means less water is available for the plant to do photosynthesis. We have tested our hypothesis by collecting soil samples in Legacy park, and recorded stomatal conductance by using a leaf porometer

Current solutions of coral restoration rely mainly on fragmentation. Though a reliable technique, this asexual form of reproduction does not benefit the genetic diversity of the coral reef. With many global and local stressors threatening corals’ existence, the resiliency of corals to future ocean conditions depends highly on sexual reproduction to produce new genotypes. New technology allows coral spawning/larval release, larval settlement and rearing to be carried out in an aquarium system. Introduction: Vestibular schwannomas (VS) are the most common benign neoplasms of a cerebellopontine angle (CPA), which arise from the Schwann cells of the vestibulocochlear nerve. Eighty percent of CPA tumors are VS followed by meningioma as the second common mass lesion in this critical potential space. Treatment options range from watchful waiting with serial imaging studies to radiosurgery or a microsurgical excision or a combination of surgery and radiation therapy. The primary objective of the study was to assess hearing and facial nerve status before and after the surgery via the retrosigmoid approach.

Some norms are bad. Norms of revenge, female genital mutilation, honor killings, and other norms strike us as destructive, cruel, and wasteful. The puzzle is why so many people see these norms as authoritative and why these norms often resist change. To answer these questions, we need to look at what “bad” norms are and how we can evaluate them. Here I develop an integrative analysis of norms that aims to avoid parochialism in norm evaluation. After examining and rejecting several evaluative standards, I propose what I call a comparative-functional analysis of norms that is both operationalizable/testable and nonparochial, and …

A method of treating cancerous tumors is presented herein. The method includes injecting an effective dose of a plasmid encoded for IL-12, B7-1 or IL-15 into a cancerous tumor and subsequently administering at least one high voltage, short duration pulse to the tumor. The electroporation pulses may be administered at at least 700V/cm for a duration of less than 1 millisecond. The intratumor treatments with electroporation may be administered in at least a two-treatment protocol with the time between treatments being about 7 days. Background
Understanding the factors shaping population genetic structure is important for evolutionary considerations as well as for management and conservation. While studies have revealed the importance of palaeogeographic changes in shaping phylogeographic patterns in multiple marine fauna, the role of reproductive behaviour is rarely considered in reef fishes. We investigated the population genetics of three commercially important aggregating grouper species in the Indo-West Pacific, namely the camouflage grouper Epinephelus polyphekadion, the squaretail coral grouper Plectropomus areolatus, and the common coral trout P. leopardus, with similar life histories but distinct spatio-temporal characteristics in their patterns of forming spawning aggregations. …

Triple negative breast cancer (TNBC) patients have high risk of recurrence and metastasis, and current treatment options remain limited. Cancer stem-like cells (CSCs) have been linked to cancer initiation, progression and chemotherapy resistance. Notch signaling is a key pathway regulating TNBC CSC survival. Treatment of TNBC with PI3K or mTORC1/2 inhibitors results in drug-resistant, Notch-dependent CSC. However, downstream mechanisms and potentially druggable Notch effectors in TNBC CSCs are largely unknown. In a four-session Summer Bridge programme, we experimented with new curricular and pedagogical ideas with a group of incoming freshmen. We developed the Comics-Questions Curriculum (CQC), which melds students’ question asking with a focus on comics. The purpose of this paper is to describe the rationale for and ongoing development of the CQC as well as the ways the CQC fosters engagement of students and librarians, builds upon students’ existing skills but propels them forward toward college-level work, and positions librarians as partners in students’ college work.
