All For Copyright Stand Up And Holler! Three Cheers For Star Athletica And The U.S. Supreme Court’S Perceived And Imagined Separately Test, David E. Shipley

In March 2017 the United States Supreme Court held in Star Athletica L.L.C. v. Varsity Brands Inc. that an artistic feature incorporated into the design of a useful article could be protected by copyright when that feature could be perceived as a two- or three-dimensional work of art separate from the useful article, and imagined separately as a protectable pictorial, graphic, or sculptural work. This two-part test replaces a variety of tests which courts and commentators proposed and applied during the last 40 years. In 1926 John Maurice Clark published a seminal text in institutionalist economics, Social Control of Business, surveying the ways in which business was subject to control by a variety of formal and informal constraints. 1 The text rejected mainstream ideas in neoclassical political economy by explaining how individual self-interest and competition could be manipulated not only through legal rules but also by custom, habit, codes of ethics, and morals. Representative of the institutionalist movement, Clark discarded presumptions of an individualistic economy based on market competition. The purpose of this study is to empirically explore the effect of rice for the poor (Raskin) or subsidized rice consumption on the food demands elasticity of poor households. The study utilizes the primary data collected in 2015 based on the purposive sampling method for establishing the homogeneity characteristics of Raskin beneficiary’s households. An Almost Ideal Demand System approach is adopted to measure the proportion of food commodities expenditure of the poor and the demand elasticity as well as their responses to the income elasticity. Public Health Theses
Cigarette smoking and hypertension are well known risk factors for cardiovascular disease, but the association between cigarette smoking and blood pressure/hypertension remains controversial. Although several existing studies have examined this association, their results are inconsistent. Therefore, this study is intended to examine the association between smoking and blood pressure/hypertension. This cross-sectional study was conducted in rural China. The study subjects were 575 volunteers with a mean age of 48.3 ± 5.6 years. They were divided into smokers and non-smokers. The effects of smoking on blood pressure and the prevalence of hypertension were examined. The results show that current smoking is …

Large Palaeophiid And Nigerophiid Snakes From Paleogene Trans-Saharan Seaway Deposits Of Mali, Jacob A. Mccartney, Eric M. Roberts, Leif Tapanila, Maureen A. O'Leary

The Paleogene was a time of high diversity for snakes, and was characterized by some of the largest species known to have existed. Among these snakes were pan-Tethyan marine species of Nigerophiidae and Palaeophiidae. The latter family included the largest sea snake, Palaeophis colossaeus, known from the Trans-Saharan Seaway of Mali during the Eocene. This paper describes new material collected from Malian Trans-Saharan Seaway deposits, including additional material of Palaeophis colossaeus, a new, large species of nigerophiid, Amananulam sanogoi gen. et sp. nov., and a medium-sized snake of indeterminate affinities. Stimulating the brain with a low current that is focused on specific regions of the brain has been shown to modify brain function and treat various neurological diseases. Transcranial direct current stimulation (TDCS) has been an effective and life changing alternative treatment for a vast range of neurological conditions including depression, epilepsy, stroke rehabilitation, addiction and chronic pain but only if it is administered correctly. During TDCS, a weak constant current is applied to precise locations on the scalp to modulate brain activity. Those locations can be determined by the cumbersome 10-20 EEG measurement system, transcranial magnetic stimulation or neuronavigation. …

Thymic epithelial cells (TEC) are essential for a proper adaptive immune response by regulating thymocyte development and establishing central tolerance. In the thymus, TECs differentially express Wnt proteins, which activate canonical and non-canonical Wnt signaling pathways. Wnt signaling is thought to regulate cell survival, proliferation, and development although the direct molecular mechanisms in TECs have yet to be elucidated. The inducible inhibition of canonical Wnt signaling with Dkk1 leads to a rapid loss of TEC progenitors as well as a decline in mature Aire-expressing mTECs. This thesis looks at Nineteenth Century American adventure narratives to examine the role of the wilderness. This thesis centers on a motif of isolated characters in the wilderness and analyzes the various techniques nineteenth-century authors use to project the psyche of their characters. The selected Nineteenth Century authors: Washington Irving, Charles Brockden Brown, Edgar Alan Poe, Harriet Spofford, Nathaniel Hawthorne, and Herman Melville root America’s identity in the wilderness. The thesis of this paper is that cross-cultural writing can be done with the right methods of communication, such as engaging narrator and education—or simply sensitive, imaginative writing. Herman Melville and Joseph Conrad’s five books set in the Polynesian and Malay Archipelagos—Typee and Omoo and the Malay Trilogy (Almayer’s Folly, An Outcast of the Islands, and The Rescue)— are used as master models of how to write indigenous characters with rich characterization in pivotal roles, even circa 1846 and 1896. This thesis examines the social and political relationships between indigenous communities within the Nigerian Delta region and the Federal government regarding the management of petroleum resources and its implication for the general socioeconomic development of the Nigerian State. It investigates the correlation between the broader issues of sociocultural sovereignty, representation of ethnic minorities in the body politic and infrastructural development of the country. The role of heterogeneous nuclear ribonucleoproteins (hnRNP) in cellular senescence is yet to be defined. Cellular senescence is a terminal growth arrest in somatic cells. It is thought to be the consequence of telomeric shortening that acts as a DNA damage signal. Conversely, cells induced into premature senescence (SIPS) by oxidative stress, is independent of telomere attrition. Premature senescence has been proposed to be physiologically relevant as it can be induced by treatment with chemotherapeutic agents. Atherosclerotic plaque localizes in predictable areas such as arches and bifurcations which are characterized by disturbed flow patterns and the resulting damage and dysfunction to the endothelium. Endothelial cells (ECs) under sustained laminar flow align in the direction of flow; however, under disturbed flow conditions, ECs sustain damage to their glycocalyx (GCX) which results in unaligned and rounder cells. More than 172 million people are influenced by a retinal disorder that stems from either age-related or developmental causes. Of those, 1.5 million people endure a developmental retinal disorder. In the developing retina, neural cells undergo a series of highly complicated differentiation and migration process. A main cause of these diseases is abnormal collective migration of neural progenitors hindering the retinogenesis process. However, our grasp of collective migration and signaling molecules, critical to the developing retina, is incompletely understood. Nature’s Prototypes is an ongoing narrative series that blends realism and fiction to create both dialectic plot structures and image sets. For substance, the series utilizes biological inquiries into fields, like ecology, pathology, and bioengineering, to imagine action-centric vignettes, where animalistic to monstrous characters become the predominant actors in a post-dystopian worldscape. Throughout these vignettes, these characters are subjected to the trials and tribulations of the catalysts and flux that are imposed upon them. The federal government currently publishes 195,245 searchable databases online, a number of which include information about private parties that is negative or unflattering in some way. Federal agencies increasingly publish adverse data not just to inform the public or promote transparency, but to pursue regulatory ends ⎯ to change the underlying behavior being reported. Such "regulation by database" has become a preferred method of regulation in recent years, despite scant attention from policymakers, courts, or scholars on its appropriate uses and safeguards.
This Article, then, evaluates the aspirations and burdens of regulation by database. Based on case studies of six …
