Money In Politics: Campaign Finance And Its Influence Over The Political Process And Public Policy, 52 Uic J. Marshall L. Rev. 185 (2018), Conrad Foreman
UIC Law Review
Money in politics has risen to the forefront of the public political consciousness in the decade since Citizens United v. FEC. At the root of the issue are deeply flawed Supreme Court rulings on the constitutional protection afforded to political spending and the definition of regulable "corruption," which have exacerbated issues in the American campaign finance system and effectively legalized political bribery. The purpose of this comment is to highlight the impact of campaign finance on public policy and ultimately propose that we, the American people, must amend our Constitution to restore a representative democracy.

Chasing Results From The Chasing Arrows: Strategies For The United States To Stop Wasting Time And Resources When It Comes To Recycling, 52 Uic J. Marshall L. Rev. 147 (2018), Christina Everling
UIC Law Review
The United States is a leader when it comes to creating waste, but not when it comes to disposing of that waste in environmentally conscious ways, such as through recycling. While other countries boast recycling rates over 60 percent, the United States’ recycling rate is an unimpressive 25 percent. Even amidst a “zero waste” movement, there are few national efforts to increase our recycling rate. Some state and local communities have picked up the slack, implementing a variety of strategies to boost their recycling output and reduce waste. These initiatives, such as automatic curbside recycling, landfill bans, mandatory recycling, container …

Rec-Overing Body Heat: How Awarding Renewable Energy Credits To Crematoria Can Encourage The Development Of Renewable Electricity, Adriana K. Michalska
Connecticut Law Review
Despite the current political climate, enterprising developers have been driving the renewable energy market in the United States for decades now. But even though solar-, wind-, and hydro-power developments have been efficient alternatives to coal power plants and helped foster a cleaner environment, even the most agile renewable energy technologies can fail, hindered by their technical requirements. With wind and solar farms showing characteristics of being inefficient and unreliable, there is a pressing need for increased reliance on novel, even shocking, sources of energy. Because types of materials that can be combusted are abundant, if not unlimited, greater focus on …
Do Courts Engage In A Sufficiency Analysis When Making Daubert Rulings In Toxic Tort Cases?, Joseph Sanders, Michael D. Green
Do Courts Engage In A Sufficiency Analysis When Making Daubert Rulings In Toxic Tort Cases?, Joseph Sanders, Michael D. Green
Connecticut Law Review
Courts and commentators continue to wrestle with how questions concerning the admissibility of expert testimony relate to questions of sufficiency of the evidence. In an earlier article, we explained that many courts determine the admissibility of an expert opinion based on whether the scientific evidence proffered by the expert supports a reasonable inference of causation. What’s more, we claimed that this is not a bad thing and better than using inappropriate Daubert factors to decide admissibility. A key distinction to appreciate is that between global sufficiency and local sufficiency. Just as courts may take a case from the jury if …
Implied Consent To Religious Institutions: A Primer And A Defense, Michael A. Helfand
Implied Consent To Religious Institutions: A Primer And A Defense, Michael A. Helfand
Connecticut Law Review
One of the recent fault lines over religious liberty is the scope of protections afforded religiously motivated institutions and corporations. Courts and scholars all seem to agree that such religious institutions deserve some degree of protection. But there remains significant debate over the principles that should guide judicial decisions addressing the circumstances in which religiously motivated institutions should, and in which circumstances they should not, receive the law’s protection.
In this Article, I expound, and defend, my proposed “implied consent” framework for addressing religious institutional claims. Such a framework grounds the authority of religious institutions not in a degree of …
Connecticut’S Food Waste Problem: Innovation, Anaerobic Digestion, And The Dormant Commerce Clause, Kara A. Zarchin
Connecticut’S Food Waste Problem: Innovation, Anaerobic Digestion, And The Dormant Commerce Clause, Kara A. Zarchin
Connecticut Law Review
Connecticut has a food waste problem. Much of its food waste ends up in landfills where it rots and produces methane gas that contributes to global warming. This Note examines Connecticut’s efforts to address its food waste problem through a waste flow control law, Public Act 13-285. With this law, Connecticut became the first state to pass legislation to reduce food waste through state-mandated diversion. This Note frames its discussion of Public Act 13-285 in terms of federal initiatives to cut food waste and the growing national consensus on the important role for anaerobic digestion in reducing food waste. This …
What Is Race?: The New Constitutional Politics Of Affirmative Action, Mary Ziegler
What Is Race?: The New Constitutional Politics Of Affirmative Action, Mary Ziegler
Connecticut Law Review
The Supreme Court’s recent decision in Fisher v. University of Texas II defied expectations, upholding an affirmative-action program and opening the door for universities to adopt similar policies. Using original historical research, this Article contends that Fisher II matters just as much because of the new challenges it reveals for proponents of affirmative action. Read together with the Court’s recent decision in Schuette v. Coalition to Defend Affirmative Action, the dissents in Fisher II lay bare profound dangers confronting proponents of affirmative action, regardless of the outcome in Fisher II. In addition to praising colorblindness, the Court has cast doubt …
Constitutional Rights As Bribes, Rosalind Dixon
Constitutional Rights As Bribes, Rosalind Dixon
Connecticut Law Review
Constitutions worldwide protect an increasingly long list of rights. Constitutional scholars point to a variety of top-down and bottom-up explanations for this pattern of rights expansion. This Article, however, identifies an additional, underexplored dynamic underpinning this pattern in certain countries: the pairing of constitutional rights with various forms of structural constitutional change as part of a trade between civil society and dominant political actors in their aspirations, or support, for constitutional change. This form of trade, the Article further suggests, has potential troubling consequences for democracy: it can pave the way for the consolidation of dominant-party or presidential rule in …

Patent Infringement As Trespass, Adam J. Macleod
Patent Infringement As Trespass, Adam J. Macleod
Scholarly Articles
The now-conventional account of patent law holds that infringement is a strict liability offense, meaning that intent is not an element of an infringement claim. This account heightens the apparent injustice of patent law’s special knowledge problem, that as ambiguous descriptions of intangible resources, patent claims do not sufficiently make potential infringers aware of a patentee’s right to exclude. Particularly in the age of so-called “patent thickets,” clusters of patents of variable merit which are indistinguishable from each other and from prior art, strict liability for infringement seems rather hard. These problems reflect a conceptual misunderstanding. When infringement is understood …

Claw Morphometrics In Monitor Lizards: Variable Substrate And Habitat Use Correlate To Shape Diversity Within A Predator Guild, Domenic C. D'Amore, Simon Clulow, J. Sean Doody, David Rhind, Colin R. Mchenry
USF St. Petersburg Campus Faculty Publications
Numerous studies investigate morphology in the context of habitat, and lizards have received particular attention. Substrate usage is often reflected in the morphology of characters associated with locomotion, and, as a result, claws have become well-studied ecomorphological traits linking the two. The Kimberley predator guild of Western Australia consists of 10 sympatric varanid species. The purpose of this study was to quantify claw size and shape in the guild using geometric morphometrics, and determine whether these features correlated with substrate use and habitat. Each species was assigned a Habitat/substrate group based on the substrate their claws interact with in their …
Of Trade And Beer: Nafta, The Comeau Case And Regulatory Cooperation, Maureen Irish
Of Trade And Beer: Nafta, The Comeau Case And Regulatory Cooperation, Maureen Irish
Canada-United States Law Journal
This article is adapted from the 11th Canada-United States Law Institute Distinguished Lecture given by Professor Maureen Irish at Western University Faculty of Law on October 2, 2017. The Supreme Court of Canada is hearing a case that deals with the nature of the internal market in Canada. This paper discusses trade law relating to regulatory cooperation in NAFTA, the European Union, the Canadian Free Trade Agreement and other recent Canadian international initiatives. It examines the ways in which these treaties and other arrangements respond to regulatory differences between importing and exporting jurisdictions. The challenge of how to deal with …
Women’S Rights In The Dprk: Discrepancies Between International And Domestic Legal Instruments In Promoting Women’S Rights And The Reality Reflected By North Korean Defectors, Jina Yang
Cornell International Law Journal
It is commendable that the DPRK has ratified the CEDAW and has established legislative measures to protect women from violence and guarantee equal protection. However short of internationally accepted human rights standard the DPRK may fall, such actions show that the DPRK is nonetheless trying to be a responsible member of the international community. However, many findings show that women’s rights are far from reaching the international standards, because of patriarchal traditions that are entrenched to the North Korean society and the national institutions related to women’s rights, which are used to mobilize women to work for the state, rather …
