This Article surveys cases from the Georgia Supreme Court and the Georgia Court of Appeals from June 1, 2016 through May 31, 2017 in which principles of administrative law were a central focus of the case. The Article first discusses the exhaustion of administrative remedies, followed by decisions by state administrative agencies, then on to scope of authority, statutory construction, a review of administrative decisions, and concludes with a brief review of enactments from the 2017 regular session of the Georgia General Assembly.

Following the adjustments to Georgia's Evidence Code on January 1, 2013, Georgia courts have developed significant case law interpreting various changes from the old code. This year's survey period marks the fourth year since the landmark alterations to the Georgia Evidence Code, Official Code of Georgia Annotated (O.C.G.A.) Title 24 took effect. Addressed in this year's Article are cases spanning from June 1, 2016 to May 31, 2017. During the survey period, the Georgia Supreme Court and the Georgia Court of Appeals examined the applicability of statutory ante litem notice in the context of whistleblower actions against municipalities, while the Georgia Court of Appeals reaffirmed strict compliance in assessing the sufficiency of ante litem notice presented to departments of the state under the Georgia Tort Claims Act (GTCA).

This Article reviews notable real property issues arising from the decisions of the appellate courts of Georgia as well as legislation enacted by the Georgia General Assembly. Real property law is often thought of as stodgy, particularly with the roots of the practice arising from English common law. However, real property law is ever-changing and often touches on a myriad of issues necessitating the need for the topics reviewed in this Article. The 2016-2017 survey period was relatively quiet for workers' compensation developments, but the workers' compensation system was nonetheless impacted by appellate decisions during this period. Such decisions involve issues ranging from statutes of limitations to willful misconduct, including two decisions from the Georgia Supreme Court reversing cases featured in last year's survey.

Early Eocene hyperthermal events can be an analog for global warming. Pelagic marine barite in deep sea sediment is a proxy for marine export production of organic matter into the deep ocean. Pelagic marine barite accumulation rates (BAR) were reconstructed over the Paleocene – Eocene Thermal Maximum (PETM; ~55.5 million years ago), Eocene Thermal Maximum 2 (ETM2; ~53.7 Ma) and ETM3 (~52.4 Ma) from ODP Sites 1209, 1215 and 1263. Northern Atlantic samples (with high detrital content) were acid digested and analyzed to reconstruct biogenic Ba (Ba/Al, Ba/Ti) and compare with elemental data from high resolution X-ray fluorescence. This paper examines efficacy and limitations of time series models, namely ARIMA, GARCH, and ARMA-GARCH for stock market returns forecasting. First, the paper assesses the unique features of financial data, particularly volatility clustering and fat-tails of the return distribution, and addresses the limitations of using autoregressive integrated moving average (ARIMA) models in financial economics. Secondly, it examines the application of ARMA-GARCH models for forecasting of both conditional means as well as the conditional variance of the returns. We evaluated the effectiveness of existing turtle fences through collecting and analyzing turtle mortality data along U.S. Hwy 83, in and around Valentine National Wildlife Refuge, Nebraska, USA. We also investigated the level of connectivity for turtles provided through the culverts that were originally designed to pass water through a capture-mark-recapture experiment. While fenced valley sections had 33.1% fewer turtle observations than unfenced valley sections, the difference was not significant. However, we think that the effectiveness of the fence can be improved through fence repairs, other modifications of the fences, vegetation maintenance, and extending the length of the fences. Four …

Individual readers vary greatly in the quality of their lexical representations and consequently in how quickly and efficiently they can access orthographic and lexical knowledge. This variability may be explained, at least in part, by individual differences in exposure to printed language, as practice at reading promotes the development of stronger reading skills. The current eye-tracking experiment tests the hypothesis that the efficiency of word recognition during reading improves with increases in print exposure by determining whether the magnitude of the repetition priming effect is modulated by individual differences in scores on the Author Recognition Test (ART). The current study examined disruptive behaviors, internalizing symptoms, parental distress, and parenting practices in children with autism spectrum disorder (ASD), attention-deficit/hyperactivity disorder (ADHD), ASD+ADHD, and typically-developing (TD) children. Specifically, the current study examined how those factors differed according to diagnostic group as well as how child characteristics (i.e., disruptive behaviors and internalizing symptoms) were related to parental factors above and beyond specific symptoms of ASD and ADHD (examined dimensionally). To examine those questions, parents of 14 children with ASD, 16 children with ADHD, 13 children with ASD+ADHD, and 15 TD children participated in the current study (total N = 58). …

Nurse anesthesia programs demand time and commitment for educational requirements and success. Student Registered Nurse Anesthetists (SRNAs) are encumbered with an exponential amount of stress in these programs. Research has shown that mindful-meditation is an effective method for stress reduction and improving attention and concentration. The purpose of this Doctor of Nursing Practice project was to determine if mindful-meditation has an influence on perceived self-efficacy in SRNAs.

Breast cancer is one of the most commonly diagnosed cancers in women. A mastectomy is one of the first line treatments for breast cancer, but it is associated with considerable postoperative pain. Literature suggests current methods of pain management are ineffective and regional anesthesia can help reduce postoperative complications following a bilateral mastectomy with immediate reconstruction. Information from the literature review was used to inform five anesthesia providers at a rural hospital in Mississippi about the benefits of regional anesthesia for patients having a mastectomy. Tungsten oxide (WO3) nanostructure is an interesting material for many applications such as batteries, gas sensors, photocatalysts, display utilizing, and smart windows. In this work, we fabricated the WO3 nanoplates by sputtering, acid treatment and annealing. Firstly, a tungsten film was deposited on a silicon or glass substrate by sputtering. The film was then immersed in nitric acid (HNO3) at 80 °C. The effect of the exposure time, and annealing temperature was investigated. After the acid treatment, the tungsten oxide hydrate or tungstile (WO3•H2O) with nanoplate structure was developed. This practice-oriented article shares how one small institution on a tight budget without a fulltime archivist leveraged existing resources (human, technological, and physical) to maximize 75 years of institutional archives for a recent milestone alumni reunion. Projects included drafting an institutional history, interviewing long-time members of the institution, organizing photos for display, and providing alumni with access to yearbooks. Special attention is given to the process of creating a 20-minute institutional history video, which premiered at an alumni banquet and was shared with other constituents electronically. Type 1 Diabetics have various ways of managing their diabetes that have been studied for their effectiveness. Pregnancy in the Type 1 Diabetic has been understudied. It is known that Diabetics in general have poorer pregnancy outcomes because of poor glycemic control. This coupled with the fact that the body needs 3-4 times more insulin as pregnancy comes to an end makes managing blood glucose levels challenging for diabetics (Lowdermilk, 2016, p. 689). This study used content analysis to review the social media marketing strategies of the organic food industry. The results reveal which social media channels are being used and which social media marketing strategies are being used. Qualitative techniques were used to generate a pool of eight organic companies. The social media channels used were highlighted by Chanthinok, Ussahawanitichakit, and Jhundra-indra (2015) as those used by frequency and the ability of the application to achieve the desired marketing goal. The nationalization of the Suez Canal by the Egyptians in 1956 was an international controversy. As history, the topic has been just as controversial among scholars; however events such as: the planning of the Aswan Dam, the Protocol of Sèvres, the Bandung Conference, and the Baghdad Pact have helped crystalize the perspective and significance of the Suez Crisis.
