Criminal Liability Of The Supervisory Board Pursuant To Art. 296 Of The Criminal Code, Marcin Piotrowski

The present study is to analyze the constituent elements of art. 296 of the Criminal Code in the context of liability of the members of the supervisory board. For this purpose, the author attempts to synthetic approximation of the current achievements of the doctrine and jurisprudence, to define the mark, “dealing with financial affairs or business”. Analysis of the collected material reveals some discrepancies in the theory and practice. Finally, the author draws conclusions de lege ferenda aimed at developing a uniform interpretation of the concept of the mark “deals with financial affairs or business” including also supervision.

Modern universities are experiencing constant changes which are extremely meaningful nowadays. These changes reflect on the further directions of the management education development in a broad context. This paper presents the results of research on the condition of management education in the students’ perception. The methodology of this research was inspired by ethnography and based on anthropological interviews (12 conducted with first-year students and 13 with last-year students). The unconventionality of monetary policy can be considered depending on the system in which it is functioning. The aim of the article is to present the concept of competence and financial division of tasks of the local government unit into: governmental, local-governmental, and local community. The concept has been developed on the basis of a critical assessment of the adequacy of funds for own, commissioned and agreement tasks. The source data for the task-and-financial adequacy analysis were based in budget data from reports on the implementation of city budgets ,being on the poviat rights like Szczecin, Kraków and Poznań. Due to access to reports, the analysis covered the years 2011–2013.

Global tax abuse is one of the key obstacles to sustainable development. Each year more than USD one trillion are lost to cross border tax abuse and stored away in tax havens. We establish that tax abuse accumulates capital, makes tax systems more regressive and diminishes government revenues. Tax abuse consequently indirectly increases economic inequality and relative poverty and reduces social expenditure affecting both dimensions of economic and social rights fulfillment: the ability of people to claim their rights in the market place or through the provision of entitlements. Energy security concept is contextual and understood in different ways in different context. This paper examines the development of the literatures of energy security. Using chronological method of organization, this paper classifies the literatures into three different periods: 1970-1990, 2000-2010, and post-2010. From this classification, it is found that there is a proliferation of themes in the definition of energy security concept. The concept has expanded from what was initially limited to availability and affordable price, to include themes such as infrastructures, environment, social impacts, efficiency, governance and public policy. This article explains the influence of the United States of America to Indonesian counter-terrorism. Two aspects of counter-terrorism are explained: effectiveness and adherence to human rights values. It argues that America’s emphasis on the need to forge security cooperation in responding to terrorism facilitated human rights values to be adopted as justification of counter-terrorism, rather than a balancer to its effectiveness. This study examines the relationship between country’s reliance on renewable energy, energy profile, and political economy aspects using dynamic panel data models for a global panel consisting of 43 countries. The time component of our dataset is 1990-2012 inclusive. Tryptophan 7-halogenase catalyzes chlorination of free tryptophan to 7-chlorotryptophan, which is the first step in the antibiotic pyrrolnitrin biosynthesis. Many biologically and pharmaceutically active natural products contain chlorine and thus, an understanding of the mechanism of its introduction into organic molecules is important. Whilst enzyme-catalyzed chlorination is accomplished with ease, it remains a difficult task for the chemists. Therefore, utilizing enzymes in the synthesis of chlorinated organic compounds is important, and providing atomistic mechanistic insights about the reaction mechanism of tryptophan 7-halogenase is vital and timely. The purpose of the study was to increase the contextual knowledge of the impact of student loan debt on educators by examining their experiences of student loan debt during repayment, the perception of indebtedness, the altered meaning of education, and essence of student loan debt. Semi-structured, 30-60 minute, in-depth interviews were utilized to collect data with the study employing Interpretative Phenomenological Analysis to analyze the experience of repaying student loan debt. Most nursing students fear death or care of the dying and thus question their abilities to give compassionate and competent care to patients or families at end-of-life (EOL). Research has shown positive results when students have experiences with dying patients in environments where interdisciplinary palliative and end-of-life practices are delivered. The Central American and the Caribbean Courts of Justice (CACJ and CCJ) are hybrid judicial institutions. While their Member States envisioned them as "EU-style" regional economic courts, they have explored the whole extension of their formally delegated functions and have developed peculiar expertise in matters relating to freedom of movement, human and fundamental rights, and other politically fraught issues. The article explains how two International Courts (ICs) seemingly established to build common markets have come to adjudicate high-stakes political disputes, which, ostensibly, have little to do with regional economic integration. Territoriality is a foundational principle of international order, and U.S. laws have always operated on a territorial basis. However, when U.S. jurisprudence speaks of extraterritorial application of its laws, it is usually assessing whether the legislature or the court has jurisdiction over persons, properties and conducts outside of the territorial borders of the United States. This paper argues that such a conception of the extraterritoriality doctrine only reveals half of the picture, because U.S. courts may indirectly apply U.S. law beyond U.S. borders through extraterritorial court orders without relying on extraterritorial jurisdiction. Given the depth of Venezuela's economic crisis, many fear that the government and the state-owned oil company Petroleos de Venezuela, S.A. ("PDVSA") are on the brink of insolvency. In this paper, we introduce a restructuring plan that would allow Venezuela to restructure its external debt in an orderly manner. We propose that Venezuela restructure both PDVSA debt and its own external debt via Exchange Offers. To maximize the number of participating bondholders and receive sufficient debt relief, we suggest that Venezuela primarily utilize the pari passu clauses included in the vast majority of PDVSA and Venezuelan bonds, which are modified …

Fossil data provide copious evidence that anatomical (morphological) change within individual lineages is not constant: short bursts of great change commonly separate long durations of little change (1, 2). Despite this, most models of morphological change assume that probabilities of morphological character change are the same from one generation to the next: even if rates change over time—such as in “Cambrian explosion” or “early burst” models, where high disparity among anatomies evolves early—then it is still assumed that fast rates of continuous character change gave way to slow rates of continuous change (3).
